"time" magazine has declared done very person of the year. last year the donald was simply a dark horse candidate, a rabble rouser in a crowded field who didn't have a shot at wing the white house. "time" snubbed him in 2015 and the soon-to will be nominee was not happy tweeting back, they picked a person who is ruining germany. last year the "time"'s person of the year was david hasselhoff. adolph hitler was the man of the year in 1938. the distinction is not necessarily a positive one. it goes to quote person who had the greatest influence for bert or worse on the events of the

year. last year donald lands in third place. the two who sit on very opposite ends of the burka issue. hillary clinton came in second. at least that's what time says now. but here is a look at the cover. as they mop up their liberal tears with the dying pages of a magazine forced to put president lightning rod on its cover. internet users tickling keys. the first time al gore ran for president, and the mag crowned the computer king of the hill in 1982, pick a human. this time they did with a resigned see you.

welcome back. this is quite an honor for you. so "time" magazine's person of the year, you are a limited government libertarian leaning republican. what does donald trump have to do in your minds to earn that distinction. >> at the heart of libertarian principles is a non-aggression policy. you don't attack someone if they don't attack you. one of the things i'm most optimistic about is we are not going to war with russia. whether it's ukraine or syria or georgia, donald trump has not expressed a willingness to agitate russia. i think that's a good move. i'm optimistic about some of these cabinet appointments. i wouldn't call any of them libertarian yet. but on the spectrum of smaller government or bigger government, and i know some of them and they

are small government type people. trump's promise to roll back regulations. when i saw you at the rnc. i was there on the floor listening to it. he took a swipe at the world trade organization which sort of warmed my heart. libertarians are for sovereignty and sovereign nations. we don't think we should subject u.s. citizens to a world government. kennedy: "reason" is reporting you are being considered for two posts, including energy secretary. what do you think about that. >> i haven't been contacted about that. but if i were contacted about that, i would consider it seriously. i think they need some common

sense in the white house as well as in congress. i think i can provide that. kennedy: i think you could, too. i would love to see a voice like yours in that administration. they are filling some of those posts rapidly. and one of the things that is something we are all going to be watching is the meeting next week with tech titans invited to trump tower for a meeting with the president-elect. what would you tell donald trump to ask some of the people from silicon valley who were pretty much disinterested in a successful campaign of his? >> i don't know what he needs to ask them. i think they are sort of coming hat in hand. none of them were for him. some of them worked on hillary's campaign. there is more to effect than just silicon valley. there is a lot of tech in manufacturing. a lot of tech in a bunch of

different sectors. the presumption in the previous white house is as long as you had google people around you, that you were tech, and that's not necessarily true. there is a lot more to technology than just a few companies on the west coast. kennedy: where do you stand? should the government force tech companies to comply with some of the orders when it comes to certain types of speech on social media platforms? >> the government shouldn't be forcing anybody to do anything. we are getting back to libertarian principles. one issue that has couple in congress is the subject of intellectual property. whether there should be patents or not. i hold 29 patents and i'm a libertarian who says patents are property rights. we honor property rights. you have got some companies on the west coast that aren't keen on patents.

i think that will be interesting to see where donald trump comes down on that. kennedy: we'll be keeping an eye on you and see if you get the nod to go to trump tower. if you do, wing by here first. >> i want to personally invite out inauguration. i have a ticket with your name on it. >> i'm going to start dress shopping tomorrow. let me welcome the party panel into this discussion. tonight's dagen mcdowell from th dave smith, host of "part of the problem" podcast. and tom shillue host of "red eye." so we just heard congressman massey talk about donald trump, person of the year. and i want to talk about the titans of tech and this upcoming meeting at trump tower.

what do you think the conversation is going to go like? a lot of people who emerge from those meetings are star struck bialek and they have nothing but glowing thing to say? >> everybody is turning back. the people who were talking about ar arm ar arm. we should stop talking about everybody in northern california as being the tech industry. this is a smart guy. i loved listening to that interview. kennedy: he's really bright, and he's have much -- his heart is in the right place when it comes to limited government and i hope there are people like that who are welcomed into the administration.

but i do have concerns and i shared the same concerns over hillary clinton is a do with the trump administration. what is the government going to do in terms of these big tech companies and our privacy. >> trump hasn't from our perspective been on the right side of that issue. i don't know, i do think it's interesting. we don't know what trump is going to do. trump is like door number three president. do you want hillary clinton or what's behind door number three. we all looked at hillary clinton and we said we'll take that door. i am a little bit concerned about privacy issues. i don't think sessions is a friend of civil liberties. kennedy: it's the apple case. we are talking about the government trying to force apple to open that iphone under the san bernardino terrorists. i think tim cook, he was right about that. protecting the companies.

>> silicon valley hates donald trump. so it will be hard for them to mask their loathing of him. you think new york city is progressive and left wing and liberal and crying over hillary? silicon valley is a cauldron of anti-trump sentiment. i had people on my facebook wall saying you are killing my children in you vote for trump. he will destroy the future of america. so they have been living in this bubble. the irony of ironies is the tech companies make money by disrupting the future. house the greatest disrupter of all, donald trump. what's interesting is google put out a want ad look for someone to do conservative outreach in washington, d.c., the job title is conservative outreach and public policy partnerships

because these technology companies have had a free ride and open door policy to the white house for 8 years and they got whatever they wanted. kennedy: they are all part of the same bubble. and they don't realize there are a lot of people who think differently and they are no longer able to share their frustrations and day to day concerns. >> uber now tracking you five minutes after you get out of the car. after a right. speaking of privacy. >> that's just when i get into trouble. five minutes. kennedy: it's that five-minute window. kennedy: the house homeland security committee released a terror threat snap shot. according to the report the united states facing its highest threat from islamic terrorists since 9/11 stemming from radicalization within the country. meanwhile the president is downplaying the threat.

>> w we awe attacked isil's financial pipeline and we are eak the back of isil. kennedy: if the back is broken, why is the terror threat so high. he has done nothing to fight isil. he has done something. he is doing something. he's droning people and killing people. but i think he's not doing enough or i don't kn wt his approach is. i don't know what to do to deal with isis. i don't know if trump's idea, the "mad dog" will have an idea. but i think obviously -- the thing where obama is wrong is he's saying obama -- we are breaking their back, they are on the run. they are not. you can't say they are not metastasizing and growing very well in many countries. >> he's also just protecting

himself and his legacy. all he's hoping to do is say a bunch of stuff to keep people distracted so there is not a terrorist attack on his watch before donald trump takes the oath of office. >> he's concerned about his legacy which he is lying through his teeth about. i think a lot of republicans give obama cover for this. the truth is obama expand the war on terror and expand the drone program. this is what is amazing the trump moment. you have an opportunity for conservatives to return to where they have always been. the conservative wing of the republican party advocated for a non-interventionist policy. we dismissed pat buchanan and russell kirk who warned us not to pursue. look what we have to show for this war on terror. it's the most failed policy in modern american history. maybe we can look at this.

where is the one victory in this war on terror? kennedy: you are creating environments where terrorists flourish. >> there is a blindness and deafness on the part of president obama to the ideological threat. one of the quotes was over the last 8 years no terrorist organization has successfully planned or executed an attack on our homeland. what about the 18 emails between anwar al awlaki and the fort hood shooting. but that was workplace violence. i always look back to -- he's always been so concerned about optics and how things look. you have a nato ally, belgium, being attacked by radical jihadist terrorists and he's at a baseball game in cuba doing the wave and giving the thumbs up to castro.

kennedy: they have gone rogue. some of them, very few of them. but let the legal battle over the presidency begin. two electors have filed a federal lawsuit challenging the state's law requiring them to vote for the winner of the state's popular vote as illegal. hillary won colorado. but the plan is to undermine laws in other states to free up electors. two republican electors in texas said they will not cast their vote for donald trump when the electors meet up in two weeks. with us now is one of those texas electors. how are you, chris? so, chris, let's talk about some of the issues you have with donald trump personally and politically.

i know you have some objections. is that what's driving your defection? >> well, they are not personal issues or professional or political. they are constitutional. during the campaign we had 50 republicans who are experts in foreign policy and national defense say that donald trump would be dangerous if he were president. and we have seen his foreign policy acumen tested already by his acceptance or making a call to taiwan. kennedy: how is a call to taiwan unconstitutional. i understand divesting from his businesses and the opinion of certain people. i don't think personal opinion necessarily disqualifies somebody from the presidency. certainly not constitutionally. but you have a lot of people on both sides of the aisle saying breaking protocol with taiwan not a bad thing when you are talking about a democratically elected president.

>> i'm opposed to someone not capable of executing that correctly in office. kennedy: donald trump won enough votes to win the presidency. the electoral college gave him 306 electoral votes? do you think we should disband the electoral college and amended the constitution? >> no, i do not. but i think it was not devised under any circumstance to be a rubber stamp. alexander hamilton is clear that it should be empowered to stop people they feel are dangerous. you and i both know that alexander hamilton would be disgusted at the kind of chaos that would follow from a presidency being overturned by rogge collectors.

he would not approve of this system. >> i'm not sure that that would be his position. kennedy: i contacted a hamiltonian scholar on his issue and i was assured by someone who spent their life's work learning from alexander hamilton that he was all in favorites of a stable government. >> i'm all in favorites of a stable government. but our constitution is clear that the presidential election happens through the electoral college december 19. if one of the two persons in our system don't get 270 votes, the top three voters are considered by the house of representatives. i'm not sure why it's quite so scary for all of the people out there screaming. but there is a system in place and it's still a smooth transition. kennedy: to what? you are trying to get enough electors to lose their fai as

you have to overturn the results of the election? then what? you are hoping it go to the house of representatives and the house votes for john kasich? >> the ultimate outcome for me is to vote for someone with whom i'm comfortable who doesn't demagogue racial groups and doesn't have a conflict of tints across the board. kennedy: i didn't vote for donald trump and that may be worth nothing and that's fine. but next week he's holding a press conference talking about divesting himself of his business. but the last questions you raised are questions that should have been sold more forcefully to voters and they are not necessarily a question of constitutionality or whether this person is qualified for the

presidency. qualification an incredibly subjective thing and treating it likes it's an objective criteria is doing a disservice to the tradition you have sworn to uphold and the vote horse placed a faith in the system. too we are going to disagree on that part. i'm going for the deliberative process. if you look at backlash i received, no one would walk into that willingly if their convictions weren't strong. kennedy: if it's hamilton you are following, buy a couple tickets to the musical. it might help. kimberly gill spoil joins me in moments.

but that doesn't mean the two-party system should continue to dominate. according to a gallup poll americans believe a third party system is need by 57%. only 37% want two-party system. you laid out t various branches of the two parties. in the republican party you say there are wall street, social cons, neocons, and white nationalist alt-right he's not a party person. it's hard to position him any place in the republican party. that's why a lot of republicans have problems with him. they don't know what he is.

kennedy: so you consider yourself to be libertarian democrat. there are new and interesting distinctions now. the last time we talked about a post idea lodge cal world donald trump is creating for himself. couldn't you argue he is in essence the first third party president we have had? >> he cannot be positioned on an ideological continuum. he's independent. but he doesn't have a core of beliefs. you can't position him any place. kennedy: is that proper mat pick? do you have to have a corset of beliefs? is that necessary for having a viable third party? >> i think those are separate questions. to have a third party there has to be a reason for the third party to exist. it has to elect people to various offices. i don't think he's interested in being a third party.

kennedy: you sliced and diced the two main parties we have. you were a former democratic party spokesperson. what do you think a third party looks like? is it lire libertarian or a mashup where the parties meet? >> i think it's much more libertarian. right now the democratic party is 2/3 of the way there. they are left on foreign policy issues. but very retro on economic issues. the republican party is conservative on social issues, conservative on foreign policy, at least the neocons are. and they talk a good game on free markets but are crony capitalists. neither party is a good fit for

people with libertarian ideas. but i think the upcoming generation that will decide the balance of power in politics, millennials, want choices. kennedy: that may be one of the best legacies we have from millennials. but you had a high profile libertarian person running for president who only got 3% of the vote. he tried to position himself and his ticket asking about the most enticing option of all the people running for president and it didn't get any traction. what does a libertarian third party have to look like to attract moreeople? >> first all it has to be looked at. the american people have to see the third party and our mainstream media didn't allow that. i want to insinuate a libertarian ideas into the democratic party because it's

hard for a third party to be hed in o media politics. kennedy: i don't see the mocratic party being as libertarian as you do. i think a lot of people in power right now, particularly in the senate, the senate democrats, are incredibly pro-government and controlling and they would do whatever they can to increase the size and scope of government and control our lives. but it's worth continuing this discussion to see how we can end up with more choices in this country.
