in syria john kerry's diplomacy has failed totally. the russian military has won. aleppo falls, assad wins and president obama clearly lost. and monica crowley joins the national security team and our own judge napolitano says there will be a supreme court pick before the inauguration, he spent an hour at trump tower. this program had a lot to to with who will be running the country, ain't that right? wednesday we were only 34 points away. we're a lot-- still about 100 away. right now though i'm going to tell you this, stocks will open higher this morning. 20, 30 points up. we're on 20,000 watch again, and look who is here this morning. scott shellady, complete with cow jacket, bow tie to boot, i might add. >> holiday season. stuart: no, merry christmas, come on! all right, all right, all right. 20,000 today, monday, when? >> it looks like it would happen before christmas. i was hoping it would be when i was in studio. stuart: need luck. >> we're going to need a boost, but a slow march higher and looks like that will be the case the rest of the year. stuart: we've got momentum. >> yes, we do. stuart: have you ever seen an explosion in stocks like this? for a generation. >> money policy we've tried and going to try fiscal policy and i'm introducing a third tenet, mental policy.

we've got a new sort of mental policy eking. ashley: optimism is a wonderful thing and it's contagious. liz: it's true. home builder confidence, small business confidence, consumer sentiment is going up. liberating capital across all economic sectors, there's the fly in the ointment though. stuart: oh, lizzie, what? [laughter] >> what? well, when the fed raises rates three times, maybe next year, and ash talked about it yesterday, the dollar's spiking to a 14-year high. you're not going to like it. the president could inherit a debt crisis in emerging market like the latin american debt crisis or asian flu. and each time it spiked, a crisis occurred. ashley: is doing is a little lower. >> there's a fly in that ointment. stuart: what's that? >> she believes what the fed has to say. liz: who is she? >> liz believes. liz: thanks. >> and apparently three more between now and the-- >> when you have inflation

[laughter] now, look, next case, the economy, the chair of president obama's team, top guy on the economy for the team, he sounds pretty upbeat about the economy. watch this. >> the economy, i think it's almost all the way healed from the great recession. stuart: okay. it was short, but very much to the point. almost healed from the great recession. look at this. new fox poll tells a completely different story. only one in three say they're

better off financially since president obama took office. that's the reality on the ground. and look at this, look into the future. 56% said the economy will be better in one year's time. charles, that's what this rally is all about, isn't it? >> yes. stuart: looking to growth in the future, right? >> i always say no matter what the economic team is, if people don't buy into it, it's not going to work. a lot of it is self-fulfilling and that's what the fed tried to do, spark the so-called cycle, make us feel richer that we would spend money and make investments and ultimately would make us successful. 56% is a good starting point. stuart: if we get tax cuts and government spending on the military and on infrastructure, do we get 4% growth? i'm not asking when, but do we hit 4% growth? >> definitely, that's definitely the foundation for 4% growth. stuart: scott shellady 4% growth if we get-- >> absolutely.

10-year treasury yield at 6%, some are calling for. stuart: liz, you've got the point. liz: no, you don't, i keep talking about it and you keep jumping around to the other guys. you can't dismiss that, when they talk about higher interest rates and. stuart: i would never dismiss you. and thank you, charles. and the 10-year-- >> i'm not going up against stuart varney. stuart: and during his thank you tour, talking about boeing, watch this. >> where we get more equipment for less money, i don't want a plane to fly around that costs 4.2 billion dollars, believe me. 4.2. not going to happen. but we're going to work with

boeing. stuart: that's interesting. doing more with less. getting more out of the bucks you spend. look, it sounds wonderful, no question about it, but, scott, how many times have i heard that from previous presidents, it never happens. >>, but i think that he's given a little more lip service to this than everybody else and to liz's comment earlier, the next person i would anoint as a common senseocrat. if somebody gets in there and puts a foot in the door, it might make a difference. stuart: he's not cutting spending, talking spending the same amount and getting more for it. liz: hallelujah. stuart: what's wrong with that. ashley: as you say it sounds great in theory, if anyone can do it probably donald trump, let's hope. stuart: okay, charles. >> yeah, i like after the air force one thing, the next day boeing talked about the planes to iran.

the tactic, they were on the offensive, immediately before it became a news headline they said, listen, we're going to keep 100,000 jobs because of this deal and next day raised the dividend and buyback, essentially saying to donald trump we're going to be on the offensive from now on with you, if you question what we do, we're going to tell the american people before you start we're keeping american jobs and we're rewarding shareholders in a capitalistic society so game on. stuart: all right. 21 minutes away to the opening of the market. we are watching for dow 20,000, but i can't resist bringing you this particular news item. this is from "the washington post" and i've got the headline for you. it's the article is totalled, trump considers financial pundit larry kudlow for council of economic advisors. larry kudlow i've known for generations, a good friend of mine and a great guy. the article goes on to say this, kudlow lacks a graduate or undergraduate degree for economics and hasn't written

scholarly papers. >> and i also read that rick per perry failed science in college. >> and president obama and community activism? no, drop it. >> you've got a degree in-- >> i would say this, apparently you don't have to have a job to be a president, right? so who cares if he doesn't have a degree. [laughter] >> he went to harvard. stuart: i want to move on to individual corporate stories here and i'm going to start with mcdonald's. they're talking, i believe, they're planning, what, delivery, home delivery? >> yes. >> i'd like a big mac, brought to my door, large fries and maybe an apple pie. you can do that starting in january, they're going to test it out in florida, tampa, orlando, miami. you can order off the menu and use uber eats app.

now, uber eats is in about 50 cities around the world and literally much like uber cars, you can track your delivery and mcdonald's is like one of the first fast food restaurants to sign up for uber eats. they're going to test it and feedback. stuart: you've got to pay, pay uber, right. ashley: yes. stuart: for $6, fries, shake, big mac, whatever it is, you're going to be paying double. ashley: they haven't given the pricing, but someone is going to get commission off of that. stuart: scott shellady, mcdonald's here in the news, you want to talk. >> i knew you were going to look at me with mcdonald's. if they test piloted where i live, it would be a-- >> and you trade the beef that they put in the burgers. you've got on a cow jacket. the stock will be, not sure where it's going to open. the price of gold is down big after the fed raised rates and the dollar strengthened. five bucks higher, 1134 is your bullion price. the president-elect's pick ryan zinke for interior secretary. i think he wants-- the man a guest on the program, there he is going into the trump tower. a friend of the program. do you think that he is going to push for drilling for oil on federal lands and/or in the arctic national wildlife preserve? >> he may, but it's going to be a difficult road to hoe. think about it, we have opec and tried to manufacture a higher price and been struggling. i think the fly in the ointment. we slowly, but surely are starting to see that oil price melt lower and the decision will be made for everybody, it will be financial will i seizable-- >> you can't drill in the, a

particular without huge production costs. liz: the president just signed an executive order protecting alaska's bering sea and removing it from drilling and so trump would have to reverse that executive order and put more lands in the west under executive order, meaning federally protected. stuart: charles, i guess this, the aappointment of ryan zinke sends a signal we're going to produce our own energy, but that means lower prices for energy. >> that's the conundrum. stuart: across the board. >> that's the conundrum. if demand doesn't pick up around the world to scott's point, the more we drill we reach that point. we want oil, i think to be around 60 or more because we want the capital spending. a lot of folks don't get that at the pump. that's where the big money came in, we're talking 50, $100 billion a year, welders and construction, that's the stuff that gets us going. i would pay an extra 20 cents at the pump or 50 cents in the pump to get that america. stuart: that big yank tank

that-- >> i'll be honest, i hardly look at the price anyway. stuart: so wealthy, is that it? the bottom line is we're going gung-ho to produce the energy within our boundaries and the price will-- >> perry, yeah, i've got to-- funny feeling we'll be focused on energy independence. stuart: i'm looking forward to energy independence. i'd love to see it. i've got to get this in. facebook says they're trying to tackle the fake news issue. all right, lizzie, spell out, what are they doing? >> basically they're going to put a new button that says, on facebook, you see fake news, report it to us and we'll send it to political fact or checking with abc news to see if it's a fake story. stuart: check with abc news? >> yes, exactly. and then a warning sign pops up, this is in dispute and they'll bury it in the news feed. stuart: and somebody else will decide what it fake news or not

earnest, i don't know if he's talking to president obamament you know, having the right press secretary is so important because he is so bad the way he delivers a message. he can deliver a positive message and it sounds bad. he could say, ladies and gentlemen, today we have totally defeated isis and it wouldn't sound good. stuart: have you ever seen a president-elect, have you ever seen anybody talk like that. ashley: no. stuart: no, you have not. come on in, please, fox news digital editor chris stirewalt. the thing about the russians and hacking is extremely complex, i want to bring it down to one question. why can't we see the evidence? why can't we have it made public so we can all decide? why not? >> well, and good morning to you, dr. varney. the issue here is probably partisan in the sense that there is a misapplication of

appropriate definitions of the english language. we have on one side, or american english anyway. we have on one side the word election and on the other side the word campaign. it is obvious to all, of course, that the return r russians had an influence on the campaign, the way it was conducted. the hacking informed hacks that resulted in damage to the dnc, that through wikileaks and john podesta and affected the discussion. what no one has alleged not even the staunchest supporter of hillary clinton that the rushes shuns had anything to do with hacking the elections, the outcomes, the votes. democrats don't like how much or the way in which the things discussed in the election, but no one says the election is void or invalid in any way. stuart: why can't we see the evidence that the russians tilted the election towards donald trump. that's what the democrats allege and why can't we see the

evidence? >> president obama finds himself in an interesting pickle and starts out, his administration is advancing the argument and advancing the case the part that's obvious and the part that is not obvious about the russians involvement in the 2016 campaign. and then all roads lead back to who? who president obama as americans say, why didn't you prevent it and now we find the news reported by nbc yesterday that in fact the white house thought that hillary clinton was going to win anyway, so they sat on the ball. they sat on the ball and did not respond to russia. it's astonishing. stuart: there's a totally different spin on the story and i think the democrats played defense on this and it's back fired against them. chris, thank you for jumping in, and thanks for your clarity. >> anytime, glad to help. stuart: i want everybody to check this out. 11:08 eastern time on our show. the dow was just 49 points away from 20,000 at that time. there it is right there. it actually went a little higher from there. so, what happened to the rally?

[laughter] >> is there something about 20,000-- >> that's a psychological number and we are making a huge, huge deal about it. stuart: of course i am. >> we should be because it does mark something, you know? we've come a long way, but from a fundamental thing and all that we know it doesn't matter. i believe once we get over that hurdle, once we get over that hurdle, a sense that the train is leaving the station then a lot of naysayers are going to have to chase the rally and

that's where the ignition comes in, once we close above 20,000. stuart: jeff sica, do you agree with that? if we cross 20,000 we get some momentum and a lot of people jump in? do you agree with na? >> yeah, this rally are full of people afraid of missing out on 20,000. this is a momentum driven rally and this rally has been highly focused on the financials and the utilities that are going to benefit from deregulation, and i think there will be people jumping in, but keep in mind, this is not uncommon for a new president coming into office for markets to rally and then selloffs happen shortly after. >> may want to go to the rest of the panel, but let's acknowledge this is the best post-election rally. mckinley, put out one of the longest lasting tariffs and by the way he sparked an economic

revival in the late 1800's and won the 1900 reelection in landslides. the bottom line though did $the reason i'm putting these things out is because people are afraid of protectionism, but we've seen it in the past where it helped the economy. people are afraid of this market. we've seen in the past where it worked. by the way, five times since we've had this kind of a rally in a post election rally it's gone on four times and goes up another 10% at least in the next six months. if it starts out this way it normally has legs. >> thank you for that, our star historian, charles payne. >> i thought you were going to get excited about mckinley. stuart: i was there. [laughter] . ashley: cub reporter. stuart: can i move on to amazon? the story of the day, by the way they're down 3% since the election. that's interesting. well, they're up 3 bucks this morning, but down 3% since the election and 10 days until christmas or a bit less than that. what's going on with amazon, jeff sicca?

>> the sentiment is against the technology stocks. a lot of people have bought into this, this mantra that trump is bad for tech. and one thing, and you know, i have a negative bias on the market at this level, but technology should be participating. especially amazon, because amazon is not only a technology company, it's an e-commerce company and it's firing on all cylinders, right now, and i think the sent mentd -- sentiment against it is probably providing an opportunity down the line. i don't think it's warranted that this is happening. >> i've got a news item about amazon, they're working on an uber for truck drivers? >> they are, it's an app that they hope to debut in the summer of next year and what it basically do does is connect the truck drivers with the shippers, taking out the middle person, the brokers that charge a 15% commission. now, this is a huge industry.

800 billion dollars by some estimates, 84% of all freight shipped is done by truck. what amazon wants to be is a full-scale logistics company. they want to take on the entire delivery cycle, another example of that. it's remarkable. stuart: you're shaking your head, what's up? >> that's a slippery slope because then we'll go to the driverless trucks and you have to realize that 29 states in america truck driving is one of their top economic engines. stuart: yeah, so that's a problem for employment in that industry, but you're looking way down the road. >> that's going to be something that's going to be disruptive and another hurdle to get over what you do with all of those people. stuart: i've got to go to facebook taking objection to stop the fake news. two lines. liz: and mark zuckerberg said that pretty crazy to say that fake news impacted the election. and now they're going to 0 use fact checkers.

stuart: the story has no impact on the stock. look, facebook is often touted as the next big tech company that's really going to have a surge. i think we've heard this from you, jeff sicca, haven't we? >> yeah, and i think it's going to continue to have a surge. i personally think that facebook should-- they're putting themselves, in a slippery slope with this and they should back out of it, out of the news business as much as they possibly can, so they don't get any negativity over anything that could go wrong. but as far as everything else, i mean, they're opening up a litany of revenue streams for themselves in the future and if they focus, if they stay in their lane, i really think they're going to have another surge beyond what they've already seen. but they could get a lot of negative publicity if they hold onto becoming the thought police or the news police. that's a very dangerous place to be. stuart: all right. now, check that big board. we're six and a half minutes

into the trading session on a friday morning, we're up 30 points. they have been up 60 and now we're up 29. so we're slowing down the rate of rise. put it like that. we've got another car company talking about self-driving cars. they're all at it. and now it's general motors. testing self-driving vehicles on public roads in michigan. the stock is up 6% this year, unchanged right now. software maker, oracle, shift to the cloud taking longer than wall street thought. the stock is up 10% this year. down 3% this morning. chipotle, they say they've got an agreement with bill ackman's pershing square operation. four new directors going on the board at chipotle. the market kind of likes it, up $8, 2% higher. trying for that turn around. adam shapiro at the new york stock exchange, give us the stocks leading the dow right now. >> and stuart, there are big names leading right now. take a look at ge, united

health, verizon, they're all up as we start the trading session. one stock you'll want to keep your eye on, and this is up flat, they want a 2.5 billion dollar victory over gilliard in a patent lawsuit. and gilead is-- >> i think that applause was for you. >> it was for the men and women of air force who are visiting today. stuart: get them back for the applause, we like that. verizon is pushing yahoo! change the terms of the merger deal, please. liz: we hear they're threatening to go to court to lower the 4.8 billion -- 4.8 million deal. and verizon could walk away. when yahoo! said to users you've got to change your passwords. they could say we're not going to use yahoo!.

>> it's friday morning and the trump rally is rolling on. it is the best rally to greet an incoming president in the history of the united states. i'm trying to do the math and i think we're up about 1600 points since election day. 1500, 1600, very roughly in that neighborhood and we're up 42 points right now. and an item of news from apple. they've hired a race car engineer from porsche. what's that. ashley: they have and his name is alexander hipsinger, you know the lamans races, he was part of building a hybrid car that was successful in those races and he says he wants to contribute in a way that will benefit society.

so, obviously, a top mechanic or engineer, more than a mechanic, he's an engineer, joining apple shows their commitment to their car program. it's interesting. stuart: and the car program entails the driverless car. ashley: the driverless car. stuart: becomes a computer essentially. ashley: exactly. stuart: they're all doing it, i don't know any car company that doesn't have a plan of some sorts. ashley: google is doing it, they say they're making the software other cars can use. they're smart people and won't be long before we see them all over the place. stuart: of course that commercial, any day now. you remember that one. [laughter] let's bring in kellyanne conway, let me set this up. she is the first lady in history to run a successful presidential campaign and now, kelly anne conway is getting attacked by feminists, why? because she wants to spend time with her family. and kellyanne is with us, joining us from trump tower.

you're a star and thank you for being with us. >> it's my pleasure, stuart, thank you for having me. stuart: let me see if i've got it right. you say you might not take a top job in the investigation because you've got four young children underage of 12 and you might want to spend more time with them so the feminists are attacking you and saying, you're wrong. what kind of woman does this? do you want to respond to that? >> sure, i can respond to them. i thought that women were a product of their choices and that's what i'm trying to do here, quietly and privately, find the best balance for my family and stuart, maybe i will go into the administration because i know donald trump and my husband are very supportive of that choice as well. the president-elect and the vice-president elect are creating a very family friendly environment in the white house and in this administration. donald trump has never been anything, but gracious and gentlemanly to me and respectful of the fact that i'm a mom of young children and actually thinks it's pretty cool. he obviously has a fabulous relationship with his five children and five grandchildren tan their spouses.

so the issue is just a very personal one, but i can't help, but think that people are really judging my politics and not my motherhood. i will just note to you that some people who attacked me are moms. and some who have attacked me are childless interns born in the 1990's or women who have cats as twitter pictures. i'm not going to lose my mind over people attacking me in 140 characters. stuart: kelly anne, i never want to cross you, i would be shredded. that would not be enjoyable. a wonderful response. president-elect trump has been tweeting again this morning and talking about the russian hack. the quotes, are we talking about the same cyber attack that revealed that hillary clinton was given questions to the debate? i've been asking this all morning, why can't we see the

evidence, if there is evidence, that the russians influenced the election in favor of mr. trump, can we see it? and why not? >> well, that's part of the point here is all we have are unsourced, unnamed folks leaking to the lead ye media, coming out of house intelligence closed doors meetings and arguing in the press usually unnamed sources arguing how important it is. and most have their hair on fire about interference in the election, which is unproven, his point is, hey, didn't hillary clinton get this party started when she set up an illegal server that put her e-mails at risk and frankly put us all at risk. for selfish, peevish reasons to do that and dogged her to the point people didn't think she was honest and trustworthy, obviously. look, i think what people are trying to do is conflate so

folks out there get confused and certain that russia hacked into the e-mails of the dnc and then affected the election. stuart, roll the tape. who on the left, who in the democratic party, who in hillary clinton's campaign, 1.2 billion, who was talking about this as a deal breaker as a way they were going to lose the election? answer, no one. why? because they thought they were going to win the election. and so, there's either it's jim comey's fault, bernie sanders's fault. the alt-right movement we have nothing to do with here. and now it's the russian hacking interference. it's hillary clinton and the fact that she had no message for most of america. stuart: would you stay there for a moment? i've got to do a brief market update and a commercial break and bring you right back again. >> absolutely. stuart: thanks, check the market. we're up 41 points and a lot of green on the left-hand side of your screen and a lot of stocks are going up among the dow 30. we've got an opinion article in "the washington post" and it's
