>> here comes the closing bell. david and lauren simonetti at headquarters to pick it up on after the bell. lauren: merry christmas and happy hand -- hanukkah and a few catholics in ireland. lauren: stocks fighting for any gains, climbing in the final minutes of trading before the long holiday weekend. major averages ending higher for the week. the dow higher every day of the week since election. i'm in for melissa francis. david: just barely. a lot of other news going around the world. here is what we have for you this hour. the terrorist behind the berlin christmas market attack is dead after a shootout with police in
4:01 pm
milan, italy. details on who he was and how he crossed over to european borders. isis issues a new threat against thousands of churches here in the u.s. during christmas. the critical united nations pinning president obama and president-elect trump against each other with one of our closest allies, israel caught right in the middle. speaker paul ryan calling the actions of the white house shameful and donald trump has just weighed in. we will give you the details. lauren: let's go back to the markets, dow is struggling for gains but finishing at the high of the session, up 145 point. 9,333, longest winning streak in two years, how about that? oil hitting a high for the year. trader is at the cme in chicago to tell us why and adam shapiro on the floor of the new york stock exchange. adam, we were so close to dow
4:02 pm
20k this week and we lost momentum and started resistance. who were the biggest names holding us back from the milestone? adam: you want to play the blame game? blame canada first. let's get right into it and not because canada is going to buy from boeing an not lockheed. one of the biggest as far as losers for the week. at the end they were down but you can adjust a bit. wal-mart was down 2.1%, pfizer was a drag 1.2% and united health group 4.7%, united health group we want to change that 4.7%. but there were winners and losers. mycon up. bed, bath and beyond. lauren: thanks so much adam,
4:03 pm
right back at you. oil hitting new high and gold is tumbling in the first time in a row. the question s what's the driving force behind both of these, hey, scott? >> well, the three numbers i have for you, we have been in dow and oil and we are not moving far from those numbers because the tenure is also sitting where it was. there's just not going a lot going on right now. we can't read too much into it. we have to take stock in effect that's there's not a lot of folks playing the market. there are a few things that are winding their way through. at the end of the day, say, for gold we are not recognizing inflation, have really not fallen through the market, the week hand in gold is sill long and getting out probably 11th hundred level. market has been pretty frustrated right now.
4:04 pm
we have been talking about dow 20,000, the market is so frustrating it could drive a wooden man nuts. we will wait and see what we get next week. lauren: happy holidays, thank you. david: major indices sliding lower. has the trump rally stolen all of the steam here steve cortez. steve, first to you, i'm just wondering how long this market will be on pause. my suspicion is it will wait until inauguration date, finally when it sees something happening. so far they've seen a lot of talk but not much action, is it going the wait until inauguration day before it gets going again this rally? >> you know, david, that could be be or at least until the new year. let's remember the markets boring today. it's a little frustrating this week for people that wanted the 20,000. let's shown how far we have come
4:05 pm
in the last few weeks. unbelievable rally and even for the small cap which i'm heartened by as a trump guy, someone who participated in the campaign. dow is doing great, s&p doing great, the russell is doing even better. david: right. >> main street is growing and should be by the end of the year. david: focus on deregulation to help smaller companies in america, that's great if it works out, but is the market waiting to see how he works out as president? >> no, it's not waiting at all. you guys are watching the average and there's not much action in the averages. if you're index spun investor, it's not very exciting, but look underneath the hood. there's been a tremendous change in leadership. i'm seeing gains all over the place among -- david: still even in the past week you're talking about? >> yeah, i was looking at stocks that are expected to benefit from infrastructure, that have
4:06 pm
high tax rates here in the u.s. and who are expected to benefit from reflation in particularly. david: why? >> i still see stocks moving. this trump bump is not fully played out in some of the names, but, you know, the value managers are stoked right now. the index indicate vestors are not going to see much action. david: jack, your publisher is pleased. >> i get ten cents for every plug. david: lauren. lauren: donald trump fighting in an effort to slash government spending, fighter jets, based on tremendous cost and cost overruns, i've asked bow to go price out comparable f-15 super hornet, all right, let's talk about it.
4:07 pm
hi, guys, good to see both of you. is this a good move, he's asking like the ceo of our country, a business leader trying to save us money or is he trying to deincentivize business right now? >> if you're asking me, i think anthony weiner was less controversial on twitter to be honest with you. -a reason we don't handle weapons procurement and bidding on formats like twitter. i understand what he's trying to do. the good is that people discount some of this flamboyant language. i always look first at the stock prices. is lockheed plunging, no, is boeing soring, no. people are taking this with a grain of salt. lauren: go ahead. >> i think it's more substantive than that. i think that both of these companies are going to do very well and we need to build defenses and trump ran on that largely but he was elected in part at least because he is a deal-maker and because he convinced the people that we need to bring some of that
4:08 pm
business knowledge and no how to washington dc for far too long giant multinational corporations via their case of loyalists, lobbyists and lawyers have gotten just about what they want and that includes defense contractors. i think he has put them on force one, fighter jet projects, he's put them on notice that trump -- donald trump has first and foremost the back of the taxpayer and that they're going to have to compete for tax dollars in the way that they never did before, whether it's defense contracting or government contracting. i think this populist message is important, it's part of why he won. >> there's also a competitive bid, of course. i'm just not sure how twitter plays into it. david: okay, by the way, there doesn't have to be a competitive bid. that's part of the problem. it's nice to see competition in this area. the meanwhile business cabinet fighting conflicts of interest, actually traded $300,000 worth of stock in health-related
4:09 pm
stocks while pushing legislation that was affecting the same companies. meanwhile, carl icahn, special adviser to president elect, may also benefit privately from what he will be doing, cutting red tape. jack, does any of this bother you? [laughter] >> i mean, what were the appointee, secretary of talking his own book. that refiner that he has in portfolio went up 10%. he goes on television, of course, he's talking about a need of less regulation, we have to help them to earn better prits. it's dicey. not official enough to require senate confirmation or divest any holdings, it somehow is official enough for him to go on television and talk about where we need regulation most, which happens to be in his book. i think it's problematic. david: steve, americans voted overwhelming at least in the states that counted in this election for a president that has business experience and, of course, he was going to appoint people who have business
4:10 pm
experience to help him out to get this country move again. of course, there are going to be conflicts of interest. >> exactly. i will be the first to concede, this is a unique situation. we've never elected a citizen president before, someone who didn't come from government or the military and not just a citizen but a mogul who has enormous private holdings. as i would say as trump baker, at tend of the day, if you believe he's doing for the bottom line, i think it's i logical. he spends $66 million of cash, he ignored businesses largely for a year and a half so he can take on this campaign. he's doing this, i believe, as the closing chapter of amazing life. he wants to do for america what he did for himself and for his employees. this is not about his bottom line. he's already rich. he's fine. it's about allowing america to get rich and if not allow to get rich to pay bills. so the idea that he's in for self-dealing, doesn't make sense on its face. having said that too, we have to be careful, team trump has to be
4:11 pm
careful about the appearance even of impropriety. lauren: this one has to do with charity and government colliding, trump taking yet again to twitter to voice frustration over the fact that son eric will be stepping down from his charity. this is the tweet, my wonderful son eric will no longer be allow today raise money for children with cancer because of a possible conflict of interest with my presidency. isn't this a ridiculous shame? he loves these kids, has raised millions of dollars for him and now must stop, wrong answer. jack, now -- [laughter] >> throw me in front of the train. [laughter] lauren: come on. >> look, i'm for kids with cancer getting better and for people helping them but you can't -- you run against someone who has a charitable foundation and you accuse them of, you know, influence peddling and here you have charitable
4:12 pm
foundation, they're not just influence peddling, they are influence auctioning and you get a better problem. they're making the right move. hopefully they can find another way to help. lauren: auction with ivanka trump for coffee topped $70,000 and they had to kill it. steve, donald trump went after the clinton foundation and arguably hillary clinton got the negative line up against her for her inability to separate herself and distance herself from the foundation, so shouldn't the president elect donald trump realize the same thing with regard to this? >> i agree. appearances do matter here. by the way, i think that's why they are making the right call here. it is ashame. i agree with the president elect, it's ashame that eric won't be able to raise money for the cause that's so near and dear to his heart. right now what's most important is to totality of america and what we need to do to get growth
4:13 pm
and security back for the great country, part of the way to do that is to remove even the appearances of impropriety. this was the right call by team trump. these are issues and we are going to in a smart and deliberate way team trump work through them which is why they delayed the process on how he's going to handle private interest, a lot of answers forthcoming for the american people. lauren: jack, steve, happy holidays, thank you. >> thank you. david: hundreds of flight delays and cancellations bringing the holiday travel rush to a grinding halt for thousands of travelers all over the country. what you have to know before you head out to the airport. lauren: critical united nations vote hitting president obama and president-elect trump against one another when it comes to supporting one of our closest allies, israel. why netanyahu, the prime minister has now turned to trump for help. david: germans breathing a sigh of relief after the suspect of berlin christmas attack is shot
4:14 pm
dead but they are not so sure of how they hear the details on how far he got and the ties to isis. >> it's a relief because there's no more danger but i don't think it stops there. >> i can't say it in english. [speaking in native tongue] >> justice, yes.

4:18 pm
anís amiri shot and killed in milan, italy overnight. amiri has been on the run since he was the only suspect in the berlin christmas market attack that killed 142 -- 12 and injured dozens more. here is a series of events that led to killing according to italian authorities. in the overnight hours, amiri was stopped by a couple of police officers for what officers viewed as suspicious activity and shortly after he was stopped, they said amiri reached for a gun and began firing. that is when the officers returned fire and amiri was killed. we are learning more about the potential motive behind the attack. a video shows that amiri had pledged loyalty to isis. now, that video does nod have a date on it, so it remains unclear whether it's new or old, somebody where in the middle but the video was indeed posted to isis' website. lauren, david, back to you.
4:19 pm
lauren: thanks, blake. the police officers stopped him simply because he looked suspicious, for no other reason. thank you, blake. david: andrew mccarthy pinned an article that islamic enclaves in europe are even bigger problem than trained jihadists entering nations. he joins us now. andy, good to see you, you're not diminishing in any way, shape or form the threat of refugees who might have been recruited by isis but suggesting that the islamic enclaves are a bigger problem, why? >> i think, david, what i'm saying that the problem is much bigger than what we acknowledge it to be if we focus only on the jihadists because the enclaves in which is islamic supremacist, that's where the recruiting happens, that's where the
4:20 pm
recruit asking arranged and plots are hatched. david: right. it's like an evil version of the underground railroad, the point is they can get around in all of these neighborhoods, there's one in particular that we remember in brussels, it's not just in germany, that's called molibek, i believe, one of the terrorist responsible for the perisian bombing hid in plain sight. >> there are dozens of neighborhoods in germany that fit that description and i point out that just listening to the report that you just had, one of the things we haven't heard is how did he get out of germany. the fact is he was killed in milan, he's obviously heading south, probably in the hope of getting back to tunis or some place in north africa that's an

isis stronghold, but the point is he was able to make his way out of germany notwithstanding that he was supposedly, you know, the most wanted man in all of europe. david: out of germany and crossed two frontiers, france and italy from there. muslim leaders in the united states say that couldn't happen here, muslims who come here even from areas where there's civil wars and where isis is active, muslims here assimilate in a way that they don't in europe to which you say what? >> so faruslims assimilate here, if we are going talk about it at the 50,000 level better than done in europe simply because we don't have the problem they have of proximity to the particular islamist strongholds. nevertheless, what happened in europe can happen here which is as the numbers get greater and they reach a critical mass, you do find this resistance to assimilation which is why it's simply insane that we would
4:22 pm
allow a mass crossing into our country of migrant. david: yeah; you do have a growing number of individuals in the website, you can find a list of individuals who have been spending money, sending money over to isis who have been arrested for it but you do have a growing problem in the united states as well. >> you sure do. you know, part of the reason that we have it is because we won't face to some of the things that we proved in court, for example, that in radical areas the mosques and islamic community center is actually a hub of conspiratorial activity. i hate to say that but it's been proven in court. david: this is the guy who got the blind shake, remember his involvement in the first world trade center involvement. good to see you, thank you for being there. have a merry christmas. thank you. lauren: u.s. allowing antiisrael measure to pass by sitting out in a crucial united nations
