kennedy. it's been a day of intense rhetoric and mudsling. but an unmade truck advise years calling it a massive success. trump signed the executive order friday night. it indefinitely bands syrian refugees from entering the u.s. halts the refugee program for four months and bans travelers from predominantly muslim nations for four days. that led to protests all weekend long. more than 100 travelers were reportedly prevented from entering the united states. trump this morning defended his order, tweeting of course, quote, there is nothing nice will searching for terrorists before they can enter our country. this was a big part of my campaign. study the world.
8:02 pm
sean spicer came out swinging as well. >> i know everyone likes to get to where they want to get to as quick as possible. i think the government did a phenomenal job of making sure we processed people through. but we've did so knowing so the people who were coming in hadn't done anything seeking to do is harm. when you actually look at perspective of what's going on and you note the polls going up this morning. a majority of the americans aggrieve with the president. the steps he has taken were to keep this country safe. dagen: donald trump's immigration ban is turning republicans against him. several gop leaders have spoke out against the ban, including a joint statement from in the ordinary course of business john mccain and lindsey graham. it reads in part our most important allies in the fight against isil are muslims who reject their ideology.
8:03 pm
we fear this will become a self-infliskted wound in the fight against terrorism. let's ask chris stirewalt. senators graham and mccain come out and are warning about what trump's doing. i say surprise, surprise, surprise. >> just because they disagree with him. they aren't the only ones. there is a lot of the concern about how this lands. and the what it was executed didn't add confidence to those people who were sceptical this was going to be pulled off the right way. especially the two-step they have did on green cards. the 7 countries on this list produced half a million green cardholder's in this country in the last decades.
8:04 pm
so that add to the discomfort. every year the united states tieks i --takes in' 10,000 refu. so there are big broader yous here. there are good defenses that the trump administration can make, and there are bad develops. the whole issue comes down to will it make people feel safer. dagen: they have came out over the weekends and said there is an exemption for green cardholders. but in the order having read it, there wasn't an exemption for individuals who had fought along sides the united states. it was slip shot it was like a rusty chainsaw in terms of precision. but do you think people can get past that? the people in the trump administration think we said at
8:05 pm
the top. massive success. >> banning refugees from entering the united states for four months is a massive departure in policy. you can mounts serious develops and say it's crucially important. all of that can be done. the question is, can you do it so -- will people get over the execution? if what happens next is smooth and snoang a clear voice, then, yes, if there are more problems and more confusion and mixed messages, then no. you saw it today, the administration effectively pushed out a new narrative that was clear and lucid. dagen: does trump lose political capital? being on the business network i think about all the thing that need to get done to jump start an economy that's still not growing at 2%.
8:06 pm
you talk about corporate tax cuts and reforms. and even greater rollback in regulation. and there is some concern among investors that that's going to get pushed out because there is this distraction in d.c. over just this travel ban. >> this that. there is also obamacare is first in the hopper. there is a growing understanding in washington. the trump folks don't have a lot of experience. that's the selling points, right? fresh voice, drain the swamp. but it also means there is a steep learning curve. the question is can they learn tto martial their forces. as president obama learned you

can get bogged down. so it's good to be fresh and good to be a candidate of change. but you can get swamped. dagen: you did realize i was doing goar --doing gomer pyle. chris stirewalt, always great to see you. bye. let's welcome the panel. kat timpf. gregg smith, comedian and host of part of the problem podcast. and chris barron part of lgbt for trump. >> there is some legitimate cause for concern. i think this executive ordinary letter be effective in keeping people safe. it will cost money and there will be individual liberties violated in the process. that being said, what trump is
8:08 pm
able to do throughout the entire trump moment is expose the hypocrisy of all of his enemies. liberals love the cia and knee so cons are worry about blowback from the muslim world over violating iraqi civil liberties. it's insane and i don't know what to say. dagen: the rollout went poorly over the weekend. there were big holes in it, kat timpf. as the day wore on today i found myself thinking why am i shocked at how the trump administration is handling this? they did not back down and are calling it a success and not even admitting anything went badly. >> the rollout is disgusting. i had legal permanent status and i was trying to come back here base had something to do and i was stuck at the airport, that's
8:09 pm
very serious implications for people with green cards. that's not refugees. people have a right to stay mad about that. i understand as a libertarian i'm more liberal on foreign policy. so i think that, you know, trying to be logical, calm and balanced. if you are someone at the airport oral life our country -- >> the whole reaction was so over the top with chuck schumer. the fake tear from chuck schumer. i don't want to sound crass. but i thought, nobody died. where are the tears for terror victims or people who lost their lives in our military? >> the tears were for television. all of this is a democratic stunt for attention.
8:10 pm
they suck at wing elections. apparently they are trying to master political kabuki theater. i loved president trump's executive action here. guess what? there was problems in this rollout. but trump said he will change the way things are done. he's not going to play this bureaucrat i can game all the time. there will be mistakes that are made. but nobody died in this process. i look at that executive order and talks about how we should not be importing people into this country who preach bigotry and hatred towards gay people and women. let's stop the ones coming here who are doing that. you don't have a right to come to this country.
8:11 pm
particularly people saying i think gay people ought to be death. >> kat was talking about green card holders to people who hate gay people. we are putting a temporary pause on 6 to 7 countries that don't have functional governments. >> someone like chuck schumer, i would much whether see those tears for the 22 soldiers a day committing suicide. the moral outrage is not on a level it should be. if you are a green cardholder waiting at an airport, of course you should be outraged. dagen: i admit it was a foul-up. you don't hear that from the trump administration. i said to chris, the customs

8:14 pm
emotions take over on either side. >> i get. i get. fine. i still had my starbucks this morning. it was a little burnt. dagen: why do they do it? it does seep like in silicon valley the c kerk os there were very angry that trump wouldn't elect. you are getting more and more of this. you had bank executives communicating with their employees who might have been impacted by this. >> i think you should send your coffee back. trump probably won't appreciate the nuance kat just put forward. but i find it -- the interesting layers to all of this. but what's driving the vast majority.
8:15 pm
if we could harvest virtue and turn it into energy we could pay off the debt obama left us. dagen: what do they get in return tore this? >> what liberals do unlike other groups is they praise people for virtues. you do this and you will be worshiped by everyone else. dagen: worshiped doesn't do it for me. kat, people worship the weird things about you. >> they do. dagen: the and will return later. we'll talk about the shrill noises coming out of hollywood about president obama. he's set to name his supreme court tomorrow. will it smashing. >> the confirmation battle on capitol hill?

8:21 pm
hardiman. judge gorsuch disagreed with judge scalia's tendency to defer to the federal bureaucratic agencies. the judge is known for having a more stringent view of the constitution. that would probably be a gain for individual liberty. dagen: how big of a fight will this be for the trump administration to get this nominee approved? >> th if they chees choose one of these three names i don't think there will be a fight. this was the main reason why a lot of republicans held their those and voted for trump. and the senators are going to want to fill that seat with
8:22 pm
somebody who has the vetting of respected d.v. area conservatives. and all three of those judges do. if president trump sticks to that script i don't think there will be a problem. there will be opposition and fireworks but no real problem in the end. if on the other hand president trump goes rogue and ignores the experts, choose somebody on the basis of that person's likelihood to sustain his things like the travel ban order and things like that. that could be a lot more controversy. dagen: there is a report out that $10 million are ready tore trump conservative groups to run ads against senators who vote against this. >> there is a at stake on personal liberty, sexual freedom. i think that's one reason i
8:23 pm
suspect pryor will not be the choice. june priesh is a respect attorney and judge. business also rather controversial. he has a lot of social conservative views. following the nomination of sessions which was so controversial over those very same issues already, i would suspect the smart money would be they don't want to bring down another fight like that. but this administration is so unpredictable it's hard to say. dagen: they are all under the age of 55, with neil gorsuch 45. so they will be there for a long time. thank you so much. coming up. a chinese military official says war with america is getting less hypothetical more practical. should we be worried hey, searching for a great used car?

after trump spoke with vladimir putin. a call in which the two leaders talked about working together to defeat isis. some big-time geopolitical issues, no worries. joining me now is fox news strategic analyst lieutenant colonel ralph peters. should we be worried about this believating coming out of china? >> you pay attention to everything. but there is no need tore excessive alarm about china at this point. i always tell people, china is a rival, and sometimes it's an antagonist. but rishes an enemy. what we are hearing from china
8:29 pm
is war-like receipt flick response to donald trump's rhetoric. especially to rex tillerson's comment during his confirmation hearings that he basically foresees a military option with the south china sea. the chinese don't want to fight us and we don't want to fight the chinese. the problem is by attacking china publicly,. same with mexico. attacking china publicly, they can't back down without losing an enormous amount of faith. so you have two super powers acting like schoolyard kids yelling at each other. but the trouble is both those kids -- dagen: don't expect trump to stop with the rhetoric. just when people think he's going to behave in a different way, he doesn't, then they act as if they are shocked.
8:30 pm
but what about this travel ban over the weekends. doesn't that's send a message to the leaders of china or mexico. that trump walks the talk and makes good on his word and they need to pay attention to it. >> i think they are trying to figure him out. but i have to say, the -- whenever you have thrift contents of the travel ban, the sheer incompetence with which it was rolled out did not do us any favors in the world. it made a lot of people angry. europeans went into their normal mode. it gives you have the impressions americans are anti-islam after all. we need dramatic immigration reform on many front. but you have got to talk to the experts. you can't have a bunch of
