12:00 am
gail trotter, mark simone. we thank you for being with us. tonight i'm appearing with sean hannity on his show at 10:00 p.m. on the fox news channel. please join us. be back here tomorrow. we'll be be. good night from new york. [♪] kennedy: donald trump putting your money where his mouth is when it comes to foreign policy. iran officially on notice. what does that mean? ambassador john bolton is here to explain. riots at berkeley after a controversial right-wing speaker showed up for a speech on campus. what happened to free speech in do you remember the 80s? i don't either. but legendary new order basist peter hook is here to fill us in. grab your amp, time to plug in. it's february 2. remember the movie groundhog day? >> i wake up every day right
12:01 am
here in punxsutawney and it's always february 2, and there is nothing i can do about it. kennedy: it is groundhog day. instead of six more weeks of winter, we'll have four more years of protest. the left has decided to throw a poopy attack. >> in my lifetime i have never seen as many people on the streets. kennedy: diane, that's because you were born before there were streets. the protesters are mad. they are confused. and they aapparently keep putting the wrong addresses in the wave. because they are showing up to the yong senators houses. 3,000 unwashed showed up at
12:02 am
humanners house. and 250 stragglers showed up at feinstein's palatial crypt. shouldn't you be wining the jeff sessions and pulling down a statue of jesse helms? this is what the left is doing to itself. pretend can the man with the hat is elizabeth warren. >> he says -- don't get me wrong. i love nibbles. and chaos and gridlock. especially if it means lawmakers get so distracted thwi beads to the mardi gras boobs. they forget to spends money. this is exhausting and annoying. it's like quitting drinking because of a migraine. it's shouting count opposition. the left is in a tailspin
12:03 am
because they can't force their form oppressive government to control every aspect of your life. if they can't impose their government, they will settle for anarchy, which has its own strange appeal. like a bourbon street parade. until you have step in a puddle of hobo puke. schumer and elizabeth warren tends to coddle these fools. but little piece of advice. these cooks are fascists and you will never make them happy. it's like thinking squats will shrink kim kardashians bootie. as long as they are apeeftds, we'll wage to the same loud day the next four years. i prefer getting bit in the face by a giant rat. but what do i know? let me put you in bondsage. i'm -- in bondage. i'm kennedy.
12:04 am
president trump is putting iran on in the for firing a ballistic missile in violation of the nuclear agreement. tweeting, iran was on its last legs ready to collapse until the u.s. came along and gave it a lifeline in the form of $150 billion. iran has been formally put on notice for firing a ballistic missile. should have been part of the deal the u.s. made with them. ' australia planned to send some of their refugees to the u.s. the president apparently mexico to send troops across the u.s. border to take care of the cartels. the leaders of australia and
12:05 am
mexico deny these reports. rex tillerson is walking into some interesting times in american foreign policy. what effect will the latest reports have on our global relations? but guess who is here. former u.n. ambassador, fox news contributor, john bolton. welcome back. what does it mean to put iran on notice. what does that mean? >> i think it's the first time in 8 years any leader in this country told iranians we know exact lire what they are up to. this ballistic missile launch clearly violated the spirit of the u.s. security council resolution, even thoat weasley words of the resolution and the underlying so-called agreement make it hard to pin it down. these missiles are intended to be delivery vehicles for nuclear weapons. by saying you are on notice, that's pretty close to the point where you have say this agreement doesn't exist anymore which is something i hope we do
12:06 am
soon were rather than later. kennedy: is that a prediscussor to war? >> of course not. the iranians took us to the cleaners in this agreement. they got everything they wanted in exchange for next to nothing. and so the issue here is whether we are going to acknowledge that the obama nuclear deal was a strategic mistake for the united states and its friends in the region like israel and the arab states or whether we different and move on to something that might be effective in preventing the ayatollahs from getting nuclear weapons. kennedy: we might be on the brink of war with iran. are we all so going to war with australia? >> you are big on words today. number of one, presidential conversations with other northern leaders get very limited distribution. you have might get a readout of
12:07 am
something directly pertinent to what your responsibilities are. very, very few copies are circulated anywhere. and so to the extent there is anybody talking about what purportedly happened in this conversation, it's obviously somebody who doesn't have the president's best interests at heart. kennedy: will there be a cottage industry of people who are essentially selling or trading these stories for some sort of favor? will people be betraying these kftions to advance their own agendas? >> absolutely. it goes on in the got all the time. this is the early indication of these kinds of leaks. kennedy: do you think they are fabricated? do you think the president said he was going to send troops into mexico? >> it could have been lost in translation. i could say that with the australians, too. just to take australia as an exam 3e8.
12:08 am
australians are plain speakers like americans are. they are not afraid to tell us exactly what they think. i think in america it used to be and still is that plain speak is a virtue, and it's a virtue in communication between leaders. we'll see. i think this is more a mountain being made out of a molehill and i think in six months everybody will forget it. kennedy: thank you for your time as always. democratic senators are lining up in opposition to donald trump's supreme court pick judge neil gorsuch and using obstructionist across particulars they criticized republicans for doing. if democrats filibuster it could take up to a year for republicans to push the novel nation through. president trump is urging them to pursue a filibuster and allow
12:09 am
a simple majority vote. when last in power, the democrats used that nuclear option. before it has never been used on a supreme court novel nation. -- nomination. matt welch is here, and fox news anchor julie banderas. welcome, everyone. let's talk about the nuclear option. do you have think democrats -- do you have think republicans will employ this on an all-important supreme court pick? it's very, very dicey. >> if it got to that i think they would use that. at some point during his presidency i think they will use that if necessary. kennedy: what's going to happen. >> there are 8 democratic senators who have gone on the record saying either they are
12:10 am
going to push for a full vote and not use the filibuster or wavering and thinking about it. that's awful close to get to the 60. there are some democrats serious about process and did believe it was what terrible violation what the republicans did with merrick garland. other people have different views on that. but they want a discussion. gorsuch is a pretty good pick from a democratic point of view. you are not seeing think argument made because democrats aren't made right now. heas a view ecutive and regulatory power that may thwart pump. kennedy: he's opposed to chevron defendefenddeference.
12:11 am
>> democrats will try to block anybody at this point. they know there is a little bit of infighting within the republican party. but the obama administration did the same thing. all they need is 8 democrats to come out in favor of this. i don't believe the filibuster will be necessary. and i don't think they will have to impose this nuclear option. the question is how much will he let his other advisors know what he's up to. a lot of the planning has been behind closed doors. though the leaks are suspect. kennedy: i have was talking to michael malice last night who thick it's a ducky idea. but i think -- >> the way thing are shaping up, not surprising at all. president trump will do anything to get his nominee confirmed. i don't think he should have answered the nuclear option question the way he did.
12:12 am
he should have shown more confidence in his 23407 nation s nomination and his party. kennedy: you are saying he should have gone on the offensive and say i know some of these people are confident, and they don't want this gridlock the to go on and on. we'll see. one of president trump's cabinet confirmations may be deadlocked and vice president pence may have to do something that has never happened before in the history of this great nation. he would have to step in and break a senatoal tie. senator susan collins and senator lisa murkowski says they cannot vote for betsy devos because of her views on charter
12:13 am
schools. are they beholding to teachers union? >> they got too many phone calls in the wrong direction on betsy devos. betsy devos has become the locust point of democratic disaffection with trump's cabinet. the charter school advocate, my god, burn her at the stake, and she has been a big donor to conservative causes. she is the opposite of a democrat going against the teachers unions. the reporting on them doing this, they knew this would get the 50-50 and the 50-50 would be a tie broken. if there is going to be another republican to peel off. they might reconsider their votes. whatever republicans causes this thing to go south will be under intense pressure going forward. kennedy: mnuchin, sessions,
12:14 am
tillerson, those are going to go forward. is there sksism playing? betsy devos is a lady. >> of course that's going to be the argument. if for some reason -- kennedy: hillary clinton is the sexism police. >> i honestly think it does come down to the democrats want to go a for every person being nominated. at this point i don't think it will hold. i think she'll end up getting confirmed. i just think anybody they bring rward at this point -- >> everyone is getting confirmed. >> thank you for that confidence. >> unlike gorsuch, devos is a different ball of wax. her lack of experience is the
12:15 am
biggest issue with her. it has a lot to do with her poor performance during her confirmation hearing and makes her and easy target. she may not be the most powerful person in the cabinet, but she is easy to nitpick at because of the simple mistakes she made. kennedy: the party panel returns in just a bit. cal berkeley the self-proclaimed bastion of free speech burst into riots over a controversial conservative speaker. lady gaga is going to sing at the super bowl halftime show. and she is featured in a commercial for the big game.

kennedy: controversial bright part editor milo yiannopoulos was scheduled to speak at u.c. berkeley. boy, did they roll out the welcome mat. they had a bonfire. they shot fireworks at buildings, smashed windows and lit a gasoline fire in the
12:20 am
speech. milo yiannopoulos said riots are evidence of the left's intense opposition to free speech. president trump tweeted if u.c. berkeley doesn't allow free speech, no federal fund. who is in the wrong. milo, berkeley, trump. who is wrong here? >> why do they get federal fund any ware? john: that's what college is all about, the federal government shouldn't be subsidizing these rich universities anyway. kennedy: it's a big chunk of
12:21 am
change they endow on these universities. john: for an advanced degree. kennedy: i got a plain old masters. i loved it there, though. i understand the arguments. but i don't know that's the argument the president is making. when milo goes to these campuses and gets shut down and cause this kerfuffle, it only enhances his brand. john: i don't get what's so horrible that he sets them off like that. i was looking for some of his offensive comments. can we do them here? >> birth control makes women unattractive and crazy. i don't agree. but it's humerus. he's kind of a standup counsel. fat shaming works. science profits. so what? they are rioting over this guy because he has the wrong opinions and they have been told this is hurtful to the weaker class and we have to protect
12:22 am
them. kennedy: he's basically going into the hornet's nest with a poker and no one is surprised when the bees come out. john: i'm surprised the bees are so arrogant that they think they have the right to shut down free speech. the berk live response was timid so they are at fault, too. kennedy: if they are putting lives at risk and destroying other people's property. wh if you sttepushing peop and breaking windows. john: they would put me in jail. berkeley said it was a mostly peaceful protest. kennedy: having been to these protests at the inauguration and
12:23 am
the wto in 1999 and the two big conventions it doesn't take 150 of them. 150 of them probably live in the bay area and they descended on the madness to make it pen more -- make it even more. john: milo has been blocked from twitter. ken there are free speeches specially on college campuses. you can't hurt people, you can't destroy their stuff. john: they say words are like bullets. words are words and business are bullets, let's keep them apart. words are free. kennedy: donald trump just felt the true weight of the office. and it involves a fallen navy
12:24 am
12:25 am
12:26 am
12:27 am
kennedy: president trump tend to one of the most somber duties of his presidency, honoring the remains of a navy seal who was killed in action. he's the first known casualty of the trump administration. >> i just returned from an amazing visit with a great,
12:28 am
great family. at dover. it was something very sad, very beautiful. ryan, a great man. kennedy: joining me to discuss the *'s heavy responsibilities as the commander of our military. pete hegseth, a veteran of iraq and afghanistan. let's talk about this. tell me how the weight of a meeting like this influences the president's military policy. >> because we are all human. the first time you meet with a soldier or send a soldier into battle and you meet the family of the fallen, or a gold star mother or gold star wife. it's going to leave an i am print on your heart. you can talk on the campaign trail by the. but when you see that family where you ordered that mission where their son is never coming home. it will reminds you of the
12:29 am
consequence of this job. i think donald trump already knew that. but as a human you are going to feel that realization and it will be part of your calculation going forward. kennedy: the president talked about anti-interventionism on the campaign trail. and he talked about getting tough on isis. can you be an anti-interventionist at heart? can that be your governing principle while at the same time being tough and doing what some of your generals think is necessary in order to defeat isis? >> if you fight isis by untying your hands and fighting ruthlessly, this particular mission didn't geese well as some had planned. a couple other guys were injured. there were some civilian casualties. but you are not hearing donald ump apologizing for the casualties. you hear him lauding the hero we lost and saying it was an important mission.
12:30 am
but with barack obama you would probably have seen a drone strike. i think you can focus on isis, there is radical islamic hell hole without having to tint screen everywhere in the middle east which is a lesson donald trump learned. kennedy: last night wee spoke about drone strikes versus gathering human intelligence which is obviously much tougher. does it make -- does it make the world safer faster to have incursions like this? >> yes, intelligence is king. when i was on the ground in iraq. if you don't know who that enemy is, if you don't have digital and human information and intelligence, then you can't finds them and it does take longer and you have more civilian casualties. so i think it focus on human intelligence on the willingness to go in when necessary, not recklessly, but when necessary will lead to the unraveling of networks.
12:31 am
that's how we got so much of the intelligence that led to the disman manying of al qaeda cells. i think it does make us safer but the lead off raters are at the tip of the spear. they want their hands untide. they want a commander in chief who will have their back and go to dover and pay their respects. that's different than what we've had with barack obama. he respected the troops, but pulled the rug out from under them in so many theaters by telling the enemy when we were going to leave. these fighters have seen them, they know how vicious they are and they want the defeat them. kennedy: there are many lessons to learn what happened in yemen and it will focus actions going forward.

i'm going right to the source. the commercial's bad. >> that's a great commercial. i just like the fact that we are making commercial for stoners. jack in the box broke through the fifth wall explicitly appealing to stoners. kennedy: who knew there needed to be a commercial for avocados? if you haven't bought them already for super bowl they are going to be bad on monday. next up, lady gaga rolling around on the floor and a.m.erring about pretentiousness and black and white. seemingly for tiffany jewelry. >> i love to change.

12:45 am
memoir called "inside new order." today peter cook joins me. it's a sad story. admittedly. because the band kind of fell apart. and it's an interesting journey. but you said the saddest part is the fact there is no happy ending. >> i wrote three books now and none of them have had a happy ending. we are -- we split up in 2007. and we started fighting. and then they reformed in 2011 without me under murky circstans. so i started a long legal battle it's still going on and we are still fighting away. i think the lawyers are delighted paying for their mercedes and holidays in the bahamas while we fight it through. i met burn when i was 11. it's amazing how you can spend

so much time with someone and it goes so wrong in the end. kennedy: you have said you were more analog and he was more digital. >> the interesting thing is it did work. because after george vision which was purely rock, we went into new order and started using the technology avail, mainly american in 80-81. they wanted to go electronic and i pulled them back to rock. and not' the accepted medium for almost he group. kennedy: you have played the foundation so that sound is implicit. >> it was an english revolution. new order, it was very important to the world of music. kennedy: is it true that bernard tried to lessen your bass sound? >> yes, it is true it was a

america. the truth is his illness was progressive. he was such a nice guy, he would never let you know he was suffering. because contradiction is, you are watching him really suffer and you would say what can i do to help. he would go, no, i'm fine. he didn't want you to saw in the way that he suffered. ultimately he paid the price for that. and we were so young. we didn't know what to do. but i must say there were older people around who didn't know what to do either. the interesting thing about new order is when george vision finished we put it away in a box. music, everything, we put it away it was a hard struggle. one of the great things about america was that the americans tuned into our music immediately as we started. kennedy: they embraced that at that time.
