what is this about? >> fundamentally it's about politic. she is from michigan, i'm from michigan. i grew up knowing all about the devos family and their generosity. michigan was a state donald trump won. and he's trying to give back. but democrats are signaling to their base. they have to respond to it group pressure putting the pressure on to make sure they block donald trump at he turn. this is a way they are trying to do this as well. donald trump i wasn't a big fan of donald trump. but he has the right to appoint cabinet members who reflect his views and philosophies and that's what he did with her. >> the word generosity i don't think i would use for this. donald trump said he was going to drain the swamp.

also the pushback with bill o'reilly. it shocked everyone on both sides. >> this trump-putin romance, it's been fun -- a lot of people pushing themselves as conservatives. they are sort of now out there defending trump on putin and i think by that process sort of defending putin. and it make it clear to me they were never in favor of limited government. but what they have in trump is an her to tearian daddy figure to make them feel safe and tuck them in 59 night. kennedy: this is something president trump ran on and it gave the right fifth. i think in that regard president trump is saying you could be a extract the same thing. we are going to have a pra pragc relationship with russia because we'll need them at some point to fight isis. a lot of people can take issue.

a lot of people take issue with the fact that he has business ties and people he worked with in the past and presently who have some ties to russia. but valerie jarrett never came under the same microscope with regard to iran. it was fine and even couraged that we made this horrible deal with iran. and now the country has to break up the relationship with iran and russia. >> the smirk was i was considering how much better off president trump would be if he took a moment and thought about it and spoke about it the way you did. there usually is a kernel of something in what he says that has merit. kennedy: there are people who have to make excuses. >> basically we are back to the reset button. kennedy: i don't think we are back at the reset button.

want to report it or is the president overplaying his hand? let me ask buck sexton, a former cia officer. it's tricky how you report them. the first question is, do you as someone who has seen this intelligence and acted on a lot of it, do you think it's under reported? >> some of the attacks i think are under reported. but really what the president is refering are to and this ways resonates with people. this is not word for word what he said, the way that press covers a lot of these attacks, it's intentionally done so there will be a heat taken out of it. they will wait a few days they will not jump to the obvious conclusion about what is the motive here. when someone is running around

yelling allahu akbar, those kinds of attacks, and there have been attacks like that and the press plays this game. kennedy: particularly ohio state. i was with pete hegseth. i said what do you think this is? he said it's obviously a jihadist. he's using a car. >> a couple days after the san bernardino attic was on cnn and they brought on a law enforcement analyst and i was former cia guy, and they said are we sure this is a terrorist attack? and i said yes i'm 99.9% sure. this was a few days afterwards. they were saying, well, the other analyst said we can't be sure at this point. it may have been workplace violence.

this was received by the anchors with some knowing nods. the way that this is reported it seems like it's politicized. and they try to make it about everything other than a jihadist attack. kennedy: that's a really good points. and the politicalization can be dangerous. but also it's interesting because you are right the reactions specially from the former administration, if there was a gun involved, don't make it about terror or motivation, make it about guns. and you see a rush to pin it on hate crimes. >> you can go through various mass casualty attacks like forward hood which was workplace violence according to the obama administration. san bernardino workplace violence.

orlando nightclub massacre was a hate crime. it was gun violence. the way this always plays out, it's so predictable and it under mines the confidence in the media overall. every time one of these attacks happens, and they go, let's not jump to conclusion, they wait a few days and the story drops off. kennedy: the president can't tell the press how to do its job, and the press is trying to cover the president as he's doing this job. how do we function going forward? i think there will be more roll for bless to say, an apparent jihadist attack or likely jihadist attack instead always hedging in the opposite direction. i think this is a deep-seated thing at this point with the trump administration, there are concerns among the press and the media. is this going in the opposite direction? so we'll have to see.

kennedy: hello. democratic senators will barely catch their breath from the confirmation of betsy devos before jumping back into the confirmation battle over neil gorsuch. who is this judge, what are the objections against him and would he be a good replacement for judge antonin scalia. judge andrew napolitano joins us. i have been waiting to talk with you about this nomination. philosophic a, for people who embrace liberty and freedom, what does this judge mean? he's a worthy successor to justice scalia. he's a small government person.

is he a libertarian? no. but he's refreshingly sceptical of the government. if the epa wants to regulate a mud puddle in your backyard under the present state of the law, you have to demonstrate to the court why they abused their discretion to get on your property and to regulate the mud puddle. under judge gorsuch's version of the law and justice scalia agreed with this. the epa has to justify what they are doing on your property and woo where their authority comes from to regulate the mud puddle. this is not an academic argument. because with the deference that the e.p.a. gets, they almost always win. we read about the supreme court opinions when the epa is thrown out. but it's rare. they win 98% of the time.
