up all for school choice. but i can't figure out what devos' qualifications are. i like her music for the brady bunch but i don't see it. i guess is all i'm supposed to care about is i sort of agree with her on something in i think you can find another person who is more pro school choice. kennedy: we talked about michellmichelle wiegen. i know a hot parent who spend their children to those schools and they love them. man she would rather run these schools and make a difference that way as opposed to being swallowed up by one of the lesser bureaucracies. but i think it's not necessarily about betsy devos. it's not necessarily about her position as secretary of education.

yelling allahu akbar, those kinds of attacks, and there have been attacks like that and the press plays this game. kennedy: particularly ohio state. i was with pete hegseth. i said what do you think this is? he said it's obviously a jihadist. he's using a car. >> a couple days after the san bernardino attic was on cnn and they brought on a law enforcement analyst and i was former cia guy, and they said are we sure this is a terrorist attack? and i said yes i'm 99.9% sure. this was a few days afterwards. they were saying, well, the other analyst said we can't be sure at this point. it may have been workplace violence.

this was received by the anchors with some knowing nods. the way that this is reported it seems like it's politicized. and they try to make it about everything other than a jihadist attack. kennedy: that's a really good points. and the politicalization can be dangerous. but also it's interesting because you are right the reactions specially from the former administration, if there was a gun involved, don't make it about terror or motivation, make it about guns. and you see a rush to pin it on hate crimes. >> you can go through various mass casualty attacks like forward hood which was workplace violence according to the obama administration. san bernardino workplace violence.

orlando nightclub massacre was a hate crime. it was gun violence. the way this always plays out, it's so predictable and it under mines the confidence in the media overall. every time one of these attacks happens, and they go, let's not jump to conclusion, they wait a few days and the story drops off. kennedy: the president can't tell the press how to do its job, and the press is trying to cover the president as he's doing this job. how do we function going forward? i think there will be more roll for bless to say, an apparent jihadist attack or likely jihadist attack instead always hedging in the opposite direction. i think this is a deep-seated thing at this point with the trump administration, there are concerns among the press and the media. is this going in the opposite direction? so we'll have to see.

kennedy: hello. democratic senators will barely catch their breath from the confirmation of betsy devos before jumping back into the confirmation battle over neil gorsuch. who is this judge, what are the objections against him and would he be a good replacement for judge antonin scalia. judge andrew napolitano joins us. i have been waiting to talk with you about this nomination. philosophic a, for people who embrace liberty and freedom, what does this judge mean? he's a worthy successor to justice scalia. he's a small government person.

is he a libertarian? no. but he's refreshingly sceptical of the government. if the epa wants to regulate a mud puddle in your backyard under the present state of the law, you have to demonstrate to the court why they abused their discretion to get on your property and to regulate the mud puddle. under judge gorsuch's version of the law and justice scalia agreed with this. the epa has to justify what they are doing on your property and woo where their authority comes from to regulate the mud puddle. this is not an academic argument. because with the deference that the e.p.a. gets, they almost always win. we read about the supreme court opinions when the epa is thrown out. but it's rare. they win 98% of the time.

under judge gorsuch's version, the epa will be equal. kennedy: he has to go to capitol hill and senators to unanimously voted for him to sit on the federal bench. why case dose have to make to some of these democratic senators in red states voting for donald trump? >> that they would be unwise in terms of their reelection if they were 20 to frustrate president trump's choice of a conservative troo diggallist for the court because that's what president obama promised he would nominate, and the people of their state went for president trump and in some cases by huge numbers, even though there are still sitting democrats in the state. west virginia is an example. trump one west virginia by 43 point. joe manchin is up for reelection
