about this. fred, first to you. since the 9th circuit essentially sort of read into their decision things that weren't even in the law itself, some of which were actually wrong. they said no terrorists had been arrested from those seven countries in the united states. the trump administration came out with a long list of people who had been arrests from those 7 countries. isn't it just as likely no matter how this new act is different, they will knock it down as well? >> that's a possibility. the lower court judge in the state of washington and the 9th circuit looked at this thing not on the question they should have looked at whether the president's order was constitutional and didn't violate any statutory law, which of course it didn't.

but it its something they were anticipating. right behind me is lake oroville. over the weekend crews were able to lower the water levels just enough in anticipation of this storm that is arriving, and more rain is expected through the middle of the week. they were able to get it low enough to make room for that additional fresh rain water. and they did that by releasing a lot of water through the damanged spillways. they continued to work on the spillways, the mess eroding down. they have been dropping slurry and cement. but the helicopter pilots decided there is no way they can work in this situation because it's too dangerous. we have some video we want to show you of the damage on that's emergency spillway. you will see this gray area. that's the seem slurry they have been dropping on to shore up
