want to be told what to think. this new healthcare bill is an example of fat, ugly spending. gallup has been tracking political affiliation for a dozen years. 35% of respondents claimed to be independent, but this year 44% made the same determination. this president is unrestrained by traditional party protocol. and people like being on the winning side out of fear or hope. it's always good to be in the winner's good grailss. the country was founded to exist without this two-party tyranny. john adams says there is nothing

do you think john kasich wants to bring people together? julie: i love john kasich. he thinks everybody should be come buaccumulation buykumbayai. better late than never, welcome to the kumbaya era. kennedy: bipartisan essentially means spend more money. i don't know if bipartisanship is the greatest thing in the world. >> i think bipartisanship has been that where citizens don't

feel it's helping them. we want to see bipartisanship that achiefs results people can feel. kenned i don't know how point is to pass something both sides like when one side likes the something that's so controlling and statist and wrong. >> if we give them a couple years and lock them in a room, i think we'll find some common ground. kennedy: what do you think, dave? dave: why is bipartisanship necessarily good? all the unnecessary wars. the mass incarceration is all achieved through bipartisanship. they act like they are such a divided congress. but when the patriot act expired they got together real quick to

write up another version of it. this idea people are turned off by the squabbling? they are turned off by the massive failures of government. that's what trump ran against. kennedy: that's what forces people into independent thinking. he's more an independent, whether you like his position, they don't belong to just one team. dave: he doesn't have the answers but he was right about they failed on the economy and the wars. evan: if you look at the way we reacted to the brands of politics. it was a way the people could feel powerful and say we can give a middle finger to you guys and say this isn't working. if you are not careful, we are going to go after you.

julie: the problem for him is he owns a party. the republican party isn't the party of george bush or john mccain. it's the party of donald trump. but the problem for the republicans is you can't say you are anti-establishment when you are the establishment. they are in charge of the whole thing. david: we have a more divided government than we have had in my lifetime. donald trump, i'm not a fan. he's not a democrat or republican. kennedy: president obama holding his first cabinet meeting since becoming president. we are told a lot of subcabinet position are vacant as well as hundreds if not thousands of supporting staff jobs. the white house claims democrats are obstructing appointments,

and the president says he doesn't plan to fill a lot of jobs. is the new administration lagging behind or ahead of the curve? dave: i think they are ahead. when you look at rex tillerson he wanted his own deputy secretary of state. then we found out the deputy candidate had said bad things about the candidate during the campaign but was willing to work with him. if the president trusts someone enough to run a government agency, he should trust them to appoint their own deputy. kennedy: do we need all the federal jobs? dave: i don't know. maybe they would appoint someone who would shrink the agency. but the oh-eds they are calling

journalism are saying these position are crucial or vital. i don't know. we spent $4 trillion a year, we could cut half of it and have the same government we had under george w. bush. the idea that this is a disaster because he hasn't filled these bs. kennedy: we just got a phenomenal jobs reports and there are other economic indicators. julie: that jobs report, he hasn't passed health reform or a budget. that's left over from the previous guy. those jobs are leading indicators. but i will say if you are rex tillerson you can't run the entire state department by yourself. claiming democrats for not getting through nominees who haven't been nominated yet. that's magical thinking.

julie: every cabinet secretary is confirmed who has been nominated. republicans control everything. you can't keep blaming barack obama. kennedy: what about chuck schumer who says we'll slow walk this. they can't filibuster anymore. harry reid did it. pottery barn, you break it, you own it. the trump administration this past weekend continuing to shake up the system. asking for the resignation of 46 federal prosecutors. new presidents do this all the time. but this was notable for preet bharara. >> you are no longer with us. you are fired. kennedy: the prosecutor of the southern district of new york

claims he was fired after refusing to resign. he says president trump told him he would be allowed to keep his job. others are saying bharara is making a self-serving spectae in order to forward his agenda. let's ask judge andrew napolitano. judge napolitano: this is the district of most new york city. they serve at the pleasure of the president. if the president says you should resign, you should resign. unless you want to turn that resignation into a political spring board like running for u.s. attorney in new york state where donald trump isn't that popular. it might be a political sort of

gambit he could take. but in terms of coulds a could t could a president have whatever federal prosecutors he wants? certainly. it's been the law since 1989. kennedy. i don't know what evidence he has. no one outside the justice department knows what evidence he has. but an investigation once commenced would be continued by the acting u.s. attorney, then eventually the person who will be appointed, nominated and confirmed to the u.s. attorney. just because the u.s. on is gone doesn't mean cases go away. it's theoretic all possible for a for a u.s. attorney to say i'm

not going there. bharara is no friend of the first amendment. you remember what he did to some good friends of yours and mine at "reason" magazine. he out source -- he sought sourd got a gag order. you are in the media. you post something on your website. the government want to know who this person was who got on to your website and you can't talk about it. it's one thing for prosecutors to push the envelope. it's another thing for them to act like the first amendment doesn't exist. but donald trump. fill in the blank. the president of the youth is entitled to have his own sheriff of wall street which is what this job is sometime called because wall street is in it district. kennedy: what do you say to people who are outraged. >> george bush did it twice.

this is standard operating procedure. kennedy: you would think from the reaction this is a draconian exercise where sessions -- judge napolitano: i know some of theme people and i feel sorry for them that they are out of jobs. but they knew this was probable at the time donald trump defeated hillary clinton, and they knew it was possible at any time. barack obama could have said to preet bharara a year ago, to years ago, five years ago, it's time for somebody else to have your job and you are gone. kennedy: loretta lynch once had a job in new york city. judge napolitano: she was the u.s. attorney for the eastern district of new york. which is brooklyn and long island. kennedy: maybe preet thought he would be sitting tweet with fancy pants motion in d.c.

judge napolitano: i think he thought he could continue to pursue political corruption. this is the job once held by tom dewey who ran for president. by jim comey before he became directorf the f.b. by rudolf giuliani before he became mayor. this office is known to be a political spring board it's also an office known for rooting out political corruption. kennedy: thank you very much for your insight. coming up, president trump's upcoming budget proposal set to slash federal jobs by historic proportions. is that good tore republicans to is that good tore republicans to ways wins.

this is recent stuff. these aren't embedded in our history and constitution. i give donald trump full credit for taking a step that could be beneficial for the economy and our country. kennedy: we see fruit bearing from these position. ben carson and rick perry in charge agencies they despise. do you think their placement was intentional? jonathan: i wish this administration could make a bigger more principled argument about why it's important to cut government. i don't know if it's dr. carson or rick perry speaking in the president's ear. but i did like the president in so many ways, but i have to give him full credit. governments are like aircraft carriers, they don't necessarily turn on a dime.

even if you have cut the epa, it will have wealth creation positive effects for decades to come. new innovation and job creation. kennedy: job creation is one of the things that leftists tend to boo-hoo is the number of jobs that might go away if these agencies are less than you are n surgically culled. jonathan: jobs in government is necessarily destructive. this idea destroying government jobs. we are going to put people out of work. we are liberating them to work in real economy, the productive economy. kennedy: that's one of the boast phrases i have ever heard.
