we know one tricky provision in the two 2008 fisa law. all right, rand paul will explain. >> the way that it works is that the fisa court wiretaps warners and the listens to americans. because they have so much data they can type donald trump into their vast resources and get records of phone calls. kennedy: that's not right, but the result is the same thing as having them install a series of transmitters. it would be bad for any government agency to warrantless do such a thing. and so it's like crab fishermen

that are not necessarily crabbing. they just like taking their car out for a stroll. they sometimes just wander in. you weren't crab fishing you were just carp walking. that is the justification for them listening in on telephone calls. and let's just face it, spy agencies have been endless appetite for drama. and taken it from both sides on the hill in today's hearing before congress. >> the president accused mr. obama and presumably the fbi of engaging in mccarthyism. >> i very much try not to engage in any "isms" of any kind.

kennedy: let's talk about this. as you know, there are some unforeseen things on both sides of the equation and i want to start with democrats on getting fixated on the term wiretapping. they are using a very specific and narrow version of the word to dismiss it. and aren't they doing a great disservice to civil liberties about privacy in this country by being dismissive so early? >> i think it's true that the conversation has been too narrowly focused on this tweet. no president can legally order the wiretapping of any american to this and am. but, they had said that they had obtained and examined from an aide's e-mails or phone calls, we would be having a different phone call right now. the surveillan this country gives the government

many legal ways to access americans communications and in some cases without a warrant or any evidence of criminal activity. kennedy: if you have someone who was a target for a number of reasons, this is somewhat vague. the people that can be targeted and the reason for which they are targeted in the first place. >> this traces back to a law that was passed in 2008. it is called texas 702 of the foreign intelligence act. it will expire at the end of this year unless congress reauthorize event. it allows them to elect communications between foreign targets and americans without getting a warrant from a fisa

court which is what was previously required. you are correct that the foreign target has no target of being suspected of wrongdoing. the. kennedy: hopefully we'll come back and join me. you have written and talked extensively about this. i look forward to another conversation. >> thank you. kennedy: in the meantime james comey had a rough day on capitol hill. republicans trying to pin him down on whether the feds are investigating white house leaks. and democrats got him to admit a little bit of a political bombshell. >> in unusual circumstances where it is in the public interest, it could be appropriate to do so. i have been authorized to confirm that the fbi is part of the counterintelligence mission is investigating the russian government's efforts to interfere in the 2016 presidential election.

that includes investigating the nature of any links between individuals associated with the trump campaign and the russian government. kennedy: what about links between the clinton campaign and the russian government. hillary clinton was the presumed winner from all sides. and the white house are the ones in power. they have been pushing back on that today claiming that there is no evidence of a link. so it's the usual capitol hill sideshow or is it a legitimate turning point in the russian election investigation. chris stirewalt joins us. welcome back. >> thank you. kennedy: what are the main takeaways from his testimony today before the house? >> well, one main take away was there was a criminal investigation going on in both campaigns relating to both candidates during the 2016 election. congratulations, america. and looking forward we are all

just in spin mode and political posturing until the fbi finishes its work. i highly doubt democrats would be satisfied with any result that the fbi brings forward other than an indictment of the president's top campaign aide. anything short they would probably say they aren't good enough. for people who are not partisans here, we have the possibility for closure that we could get to see a moment in the coming weeks when the fbi does with hillary clinton last year which is to come out and say okay, here is what we found in this is basically what it is and they need to make a recommendation for criminal charges against somebody or say that we are done. >> i would be surprised. i'm curious to see how you would feel if james comey came out and laid out a case for how the trump campaign was careless but then did not recommend charges. it could happen. don't you think that that would be politicalpolitical ly

suicidal for him? >> when you are the fbi director, and i know that there are criticisms from both sides, when you are the fbi director you have to know where the facts are and lay out what you got. if there is some evidence that there was collusion or extended contact between donald trump's advisers or the russians as it related to hack material and the release there a period you have to go with it. and if you don't have it, you have to say it's not there and were done. kennedy: what do you think we got today? >> i think that today we got hope that there might be a conclusion. and again, it is never going to satisfy the most partisan democrats. but we have hope that we might get to a point where the fbi can finally say one way or the other whether or not there is any evidence that the donald trump campaign had an inappropriate relationship that they were trying to influence the election. >> basically you just had both parties writing their own headlines. you had republicans saying that james clapper, the former

individual saying that there was no collusion and then you have democrats saying that there was no wiretapping. so i think that the fbi has to find a middle ground. also james comey has to keep himself on firm political ground. did disarm him politically? >> i don't think so. the political harm was argued on with the flip flopper he at the end of the 2016 election. and the key word is evidence. there is no evidence of collusion. no one has seen any evidence of collusion and nobody has seen any evidence of barack obama ordering wiretapping on donald trump. so we are doing a lot with these claims that both sides, as you said, are competing. but what we are talking about is there is no evidence. what we can hope to get to is a finish line or we can stay here is the evidence. kennedy: thank god for

congressman adam schiff. we now know that the director of the fbi is not mccarthyism. [laughter] >> that's right. the. kennedy: and coming up next, comedian joe de vito. he has a mind for business and a body for pilates. [laughter] and peter suderman is also here. i want to welcome you guys and talk about the other big story of the day. and federal judge neil gorsuch. by most accounts he's pretty qualified for the job. that is putting a lot of democrats in a sticky position. on one hand they want to give the appearance that they are putting up a fight. on the other hand they vowed it out to take down any democratic lawmaker that votes yes on neil gorsuch. will he seals sail through the

process or will he battled the nomination. i will turn to you first because democrats do not seem to be as vocally opposed to neil gorsuch as they would be for other nominees simply because of the timing and the fact that there will probably be another vacancy on the court. >> this guy is someone who is really difficult to oppose reasonably. he is a genial guy that is levelheaded, he has a long history of supporting even by democrats, he was up approved in 2006. they didn't even bother to count the votes because he was such an obvious shoo-in. you cannot stick your neck out to oppose him. >> could you make the case that he is an ideologue? >> he has a judicial philosophy. this guy is an originalist and basically aiming is a mainstream

conservatives conservative. and they really want to take a hard stand against the sky and the reality of who the judges. the. kennedy: the reality is that most people do not pay attention to federal judges until their names pop up for confirmation on the highest court. having said that, you are a bit of a judicial fetish. >> you know, i think that there's not a lot to get excited about with him. so they are trying to drum it up. and it's like oh, no, you are returning us to the dark ages when he was still alive. if you are going to freak out about this, you are going to run through it pretty early in the administration. to say that democrats that support him have to pay a price, just as we hold hillary clinton accountable, you know, i don't think it's going to be a

problem. kennedy: let's talk about garland. a lot of them are saying that he wasn't given his time in the sun and merrick garland was a moderate jurist that would probably have been confirmable in much the same way that neil gorsuch was or will. >> i always thought that was interesting because it seemed like hillary was going to win. and she wasn't going to maintain that nomination. >> i actually thought that it was incredibly smart president obama to nominate someone more middle of the road. i understand that there were objections and second amendment rights. but we have countless republicans saying that merrick garland was a great guy. and i think that president obama was actually trying to make sure that this happened in time in case there was an anyone there. but also a nod to the other side is a that there were a couple of

pics going down the middle. and i think that actually in honoring the legacy she would've kept merrick garland. >> i understand that and you know, it was a curious political thing. the republicans ended up winning. at one point, will they give of the argument and the let us move forward in the present? >> i really hope quickly. when i hear things from clair mccaskill or others, we are not going to take back the senate in 2018 and if we are losing. people have an incredibly difficult job right now. >> listen, his approval is living in everything. he has not had a great first two months in office. kennedy: but again, it's only been two months. >> they were designed to have nine.

we don't want to go through this. there is precedence for it. we can go for a long time like this. john mccain and ted cruz talked about it saying that we don't have to confirm anyone. and now it's like oh, we better get him in tomorrow. >> it's absolutely true, but there's nothing saying that there has to be nine supreme court justices. the court has actually been functioning. and not every decision has been like this. >> the lower courts are more liberal. kennedy: you are telling me. that hawaii ninth circuit loosey-goosey business. first up, liberals are hoping that elizabeth warren has what it takes to challenge the president in 2022 an arm wrestling match. he says bring her on. but should he be careful? i will explain. he is coming up next.

[inaudible] >> guess, her mentor. although there's rumors that she and hillary clinton do not get along. he says that elizabeth warren really hurt hillary in the backstretch because she comes off mean. i think that people misunderstand. they say that arnold schwarzenegger gets under his skin. no, they don't. it's okay when they play this game because they usually second now. elizabeth warren would be a gift to him. she is a high-profile name but she only has so big of an audience. in fact, she is going to struggle. >> what happens is with an excited and loud audience, the people tend to think that that is bigger than it actually is. and they look at the success of bernie sanders and they think

elizabeth warren is a few years younger than the senator from vermont. she has a way of explaining things that she sort of disavows times.ores facts and logic but it is still very plain for people to grasp onto who want to share her ideology. and because she is able to explain things and she is a firebrand, in many ways she's a natural. >> do you think that she will get beyond these very liberal based red states back to blue again? what she's talking about these things? kennedy: the only power that she has, i believe that the populist ideas that she tapped into along with this president is if the economy improves or the ideas hold, i think she can do well. if the economy improves but people still have things like health care bringing them down personally home, i think that that is a failing argument.

>> i think that it's an interesting combination of world events. when donald trump says that i'm against free trade, that is pretty much what the democrats say. there goes one issue away than the economy begins to grow. he can say look at the changes i may, look at the growth that we had. just because he tweets in a way in which john adams would not approve and maybe james polk would not like, he's a little different and he might say that we are getting used to him. not that he's ready to be president, not that he wants to be, but somebody that can straddle both lines and say yes, i see that because we could not get any more divided. >> i think that those two names pose a bigger threat to donald trump then elizabeth warren. i think when you talk about populist blue-collar and normal democrats to appeal to people beyond the progressive base, i

philosophical issues of whether health care is right and whether it is the governments job to provide it for everyone? doctor ron paul is here host of the ron paul liberty report. welcome back. >> thank you, it's nice to be with you. >> in a recent article you said that you addressed the fictitious right to health care. there are people that say that if you in any way question whether or not it is a right that the government bestows upon you, you are a heartless person and therefore do not deserve to live in a free society. what do you say about that remapped. >> i think that they are wrong and i think that i am right. if you've legislate a new right to something but they failed to ask, whose rights do you violate? someone else's rights have to be violated to give somebody something that they call a right. so it's impossible but the whole

world sort of has a miss believe on what the rights are and most of the world is a mess. medical care in this country is messed up because it is mixed up with a lot of corporations and special interests and that is where the real problem is. then they come up and they misunderstand what insurance is all about. they talk about insurance all the time and there's no such thing. it is so far removed from what insurance is supposed to be. that is why it is not going to be solved in the next week or two for sure is. >> and there are two things that i want to bring up. number one, there's a reason that the health care industry is so screwed up. that is because there's already too much government involvement. that insurance companies essentially run like the government runs medicare. and that is how they bill physicians and that is how the list of services is predetermined. so we are already -- i guess

that we are operating under a government and the and this bureaucratic projection -- there is no way to reverse the damage that the government has already done to health care. did you find that as a doctor? >> yes, this is absolutely true. and that is why the patients get messed up because they don't have a doctor patient relationship and they frequently point out the uniqueness of patients going to get plastic surgery or eye surgery that is not covered by insurance or by government. and believe me, the prices keep going down and there's competition under the circumstances. there is no competition. the insurance companies endorsed obamacare and now they are crying because it didn't work out so well. it is not socialized medicine but it is every bit as bad and ruthless because some people get

wealthy off of corporatism. so they are in their battling this in the same way. they do well and they protected their monopoly. the patients are the ones that suffer the most and as you pointed out if you don't have a right to health care you or some sort of a person that doesn't care. and yet those of us that understand how the market does, i believe that we really do care because we understand how the system is making it difficult for the average person to get good health care and to blame one group isn't right because i think that republicans and democrats have messed this up for so many years that it's going to be very hard to reverse. i don't think the reversal will come until you just legalize freedom of choice and let people get out of the system. the republican version of this certainly isn't allowing people in this. >> you are absolutely right. if there were a way for people to opt out from any sort of government intrusion when it came to health care, you would

see that system alone would operate much, much better. and unfortunately you are right with corporations and both parties and this massive medical establishment that we have created together -- and we will never fully see the effects of the free-market. >> i think that this is absolutely true. what it is is -- any money that he's been under medical care, either get a total tax credit from it, or you get a deduction. just forget about all this other stuff. that would be the transition that you could have without messing ar stuff. that would be the transition that you could have without messing around. and there's a lot of people that would like to just opt out. that is what we have legalized. we have the right to opt out in the government school education called private schools and homeschooling and it's growing by leaps and bounds. and so as bad as it is if you

the grave as well. at. kennedy: the segment centered on h1b visas. but now there are questions about whether some u.s. companies are abusing the program to get cheaper foreign labor. an issue that president trump has, promised to fix. what are some of the consequences so let's talk about this. the h1b program. has it been hijacked? >> it has been abused from the start, there should eat no h1b program. there should be no restriction on hiring foreigners for any u.s. company. and you know, there's no such thing as an american job or your right to a job where your right to an american job. you cannot force other people to hire you. so i think that there should be

no restrictions on hiring foreigners. and you know, overall in the long run they are much better as a result. >> you could argue that if a company is using cheaper labor, they could use the money they are saving to create more jobs. is that being too optimistic? >> that is how it works. people think that because they have the right to just do that due to a relative. but you need to improve your skills. the fact of the matter is that just as you said a company can hire a cheaper employee and that just doesn't sit correctly somewhere. it's an easier job for someone that was our inherent. >> do you think that 60 minutes was appealing to a part of the population that the mainstream media has completely ignored? >> i think that there is

unfortunately some xena phobia. or some media outlets that are cashing in on that. immigration improves the economy and people should know that. and you know, think about it. you can get a job in america to be a doctor at the american girl store. only in a wealthy country where jobs can be distorted can you have a kind of wealth creation and job creation as well. >> are you subjective to the whims of obamacare? >> i don't know that. i would have to imagine. >> there really is a free market and it is a merit-based hiring system and i would make an amazing bet on that. >> in a free society there's a negative number of jobs. and so to get rid of all the regulations from obamacare down to the minimum wage, you will see an explosion of wealth. it can happen again today.
