persuasive and i have more members, specially those undecided now saying absolutely. this is the most conservative bill that's going to pass the house or the senate and so, look, we have work to do but the momentum is on our direction. nicole: conservative caucus still has enough votes to defeat the bill. congressman jim jordan on the first one hundred days last night. >> let's be honest does this bill repeal obamacare, no, it doesn't. it's obamacare like, does this bill bring down premiums, no, it doesn't. does this bill unit republicans, obviously it doesn't. you have lots of conservatives in the house and senate oppose to this legislation. nicole: bill will be taken up by the house rules committee and for more on this jim will be joining us in just a few minutes. lauren: supreme court nominee

neil gorsuch said to return to the senate this morning for his confirmation hearing, this comes after 12 hours of tough questioning from democrats yesterday. >> how do we have confidence in you that you won't just be for the big corporations? that you will be for the little man. >> i participated in 2,700 opinions in 10 and a half years, if you want cases where i've ruled for the little guy as well as the big guy, there are plenty of them, senator. lauren: during yesterday's hearing he also pushed back against the idea of political motivated judges. >> i have no difficulty ruling against or for any party other than based on what the law and the facts and the particular case require. and i'm heartened by the support i have received from people who recognized that there's no such

time on the one case where we found for the employer. look, it was those facts and circumstances. what about the 2500 of the cases where i favored the plaintiff. nicole: he clearly has made that evident that he's not doing that. where does he fit with the justices over all? >> he's definitely constructionist. he says he's a constitutionalist, he looks at the four corners of the constitution but he's exactly as justice scalia would, i wouldn't say exactly, certainly similar to justice scalia. it's not going to change the balance of the court. it's going to be the next nominee that would because he's going to step in to just scalia's shoes. lauren: he was pressed yesterday about president trump's criticism of judges calling that thorough judge who is opposed travel judge. neil gorsuch couldn't have been

more clear that he thought it was demoralizing and wrong. >> it will depend on the cases, i will look at the facts. i just wanting to through the facts and they kept throwing all the hypotheticals. what if this case started to manifest itself? no, no, i need to look at the facts and the laws. i'm not a legislator. nicole: muslim ban. what if a muslim. first of all, i'm not going to answer the question, he held strong. >> very strong. it's someone who is impervios. lauren: really quickly, still senate minority schumer is still trying to delay confirmation. >> ultimately they may have to go nuclear and say we are not even going to entertain having any vote.

road in order to get their votes. nicole: the market was spooked yesterday that this may not go through and what happens to tax changes and reforms and if you can't get support for this maybe he doesn't get supports for tax cuts, your thoughts. >> absolutely. this is really -- this is an argument that speaker ryan has made and the president has made that this is the first part of the agenda. if you can't get a repeal and replace of the affordable care act, you will have a lot of trouble getting to the budget reform and other parts in the agenda. this is critical for house republicans and for republicans in the white house. president trump just generally speaking their entire agenda in washington this year is critical to this vote and whether or not they can move this forward. lauren: they're already calling calling in the wall street journal a great piece tax reform like that the plan that we do eventually get, the tax cuts, it's going to be smaller and lighter than a lot of people had hoped and that's what nicole

pointed out. that's what took stock down yesterday. >> yeah. tax reform, this is really interesting because the affordable care act repeal and replace is probably an easier effort in the house than tax reform is going to be and probably an easy effort in the senate so if they can't get this done, i don't know how they're going to be able to get tax reform done by tend of the summer which is the goal that they set out. nicole: do you think it happens tomorrow or no? >> i still think better odds than not that it passes. everyone ran on repealing and replacing the affordable care act. it's pretty difficult if someone comes to you while the vote is open and says this is your chance to do it and still be casting the vote no. nicole: we have obviously the elections for the congressional seats so they have to get it done. thank you for joining us. >> thank you. lauren: holding off to optimism there. toronto raptors beating chicago bulls but not without throwing

lauren: good morning, we have had at least 12 hours of testimony yesterday grilling on the hill. again today, how will today be different? and when can we expect a gorsuch confirmation? >> thisfirst day. i have a hundred letters say that say you shouldn't be on the supreme court. we are going see more of that. it's going to be more explosive. judge gorsuch did a great job yesterday. he was on, he was clear, he pushed back when he needed to push back. lobbied by senators but a tomorrow is going to be it. tomorrow will be likely the vote. i'm sure it's going to be nuclear unfortunately. we started start to see the democrats we are not going to be able to vote him in. we saw chuck schumer say repeatedly through the process that they will not be supportive

of the canned day. this is very unfortunate. it's not going to change the balance of the court. it's the next nominee. nicole: you believe she will be confirmed and the political theater continues. as that continues today, what do you expect. what do you think highlights might be today? >> they are going to go back to big corporation versus little guy. nicole: you think he's a good choice, right? >> excellent choice. if you look at some of his decisions, i read his decisions when he was nominated. he's straight down the middle. i can see the logic behind his rulings, it's not something they could say it's politically motivated. he was cler on the facts and the issue that kept coming up as truck driver, it was clear, this is an employee, you were an employee and if you don't follow direction and do do what you're supposed to do you're going to lose the job. lauren: the truck driver on the freezing cold left the car on the side and neil gorsuch said i probably would have done the

same thing but i'm a judge and looking at the legality of the case i have to rule in favor of the company. how exactly are democrats going to try to ding him today? >> probably a lot more of the support and they allege that there's controversy surrounding the judge and more lefts to come in. let's say he's the worst judge and procorporation, that these are the decisions he should highlight. there's going to be more of that today just to change. yesterday judge gorsuch did a good job and today all the unsettling letter that is will come in. nicole: we will come in. when is the next judge lined up? >> good question. nicole: he gets confirmed this week and then what? >> weare looking at judge ginsburg. she's going to hold on till she possibly could and then justice kennedy.

>> that's a really important question and i don't know the answer to it at this point. right now they have seen enough momentum towards the bill. they have seen some conservative members from the committee. even if we don't have enough votes, let's put this to a vote on the floor and challenge the numbers on the floor and say are you willing to derail our chance to repeal obamacare. right now during this vote, i think that will be a pressured situation for some of the members who are voting no. i think there's a reason that they might put this bill on the floor even if it doesn't have the votes, if it's pretty clear that it's not going to pass, then it might be the smart move for them to pull the bill and restart negotiations and try again because this will be a huge embarrassment for the white house and for speaker paul ryan if this thing doesn't pass. nicole: that would be pretty tough on them as well. who are the hold-outs and what does it take to change their

minds? >> you're seeing some members of the ultra conservative house freedom caucus saying this is obamacare like, this isn't what we promised when we said we were going to repeal and replace the affordable care act. basically a wholesale change so what the legislation is doing. some of the voters -- members on the conservative side are probably not going to vote for it no matter what they to to change it. and then you see moderate who is are worried about what the cbo said in terms of the loss of coverage and so they want a little bit more help with elderly people and the poor being able to get tax credits to help them pay for healthcare. they are really worried about people in their district who is are going to lose health care over this legislation based on what the cbo said. so some minor tweaks and changes could bring some of the moderates on board but i think the conservatives are pretty firm of the opposition. lauren: they, but they are
