>> at this point you filibuster better than most my colleagues so i'll move on to another question. >> can you give me a yes or no answer? >> it's not a short answer. >> yes, it is. >> what you feel is irrelevant, admiral. kennedy: if his 7-page written statement is any indication, expect more heat as the former f.b.i. director will be pounded on statements he head on the record about a loyalty pledge, and asking for nor investigative resource. he's no longer a government employee and can spill for thrills at will. in his testimony he didn't say the president obstructed justice. if it seems like the grandstaingiraffe is protecting president trump,
12:02 am
expect senators to come unhinged. the vultures will want comey to admit he made sessions to never leave him after he lone with trump. this is the only shot the senators have to put the grill mark in comey's bony backside. and slim jim says this public appearance is one time only. that means they have one afternoon to find out exactly what the president asked him, if it was so egregious, how about make an issue of it before he was canned. the president will be live tweeting which i wholeheartedly endorsed.
12:03 am
he's nominating chris christie's former attorney to be the f.b.i. director. if we are not going to get out of comey's heart of stone, at least the president will make it entertaining for the rest of us. i'm kennedy. part of james comey's statement released earlier refer to michael flynn. he says he's a good guy and has been through a lot. i hope you can see your way clear to let him go. i reply only that he is a good guy. i did not say i would let this go. heavy stuff. tim carney joins me tonight.
12:04 am
joining me, tim carney. there is one thing i know about james comey. he has enemies on both sides of the aisle. it seems the intel committee was in a kerfuffle as they grilled the members of the administration. so now what should we expect? is there more animus in store for comey's testimony? >> the tension today is they were refusing to answer questions about conversations they had with the president or comey had with the president. and they were giving what i thought and the democratic senators thought were bogus, thin reasons for not doing it. none of those were good reasons. so what we wanted from comey, what the democrats and media granted comey is for him to relay every detail of every conversation he had with trump.
12:05 am
kennedy: what does his opening testimony tell you about how forthcoming he's going to be on the hill tomorrow? i was surprised. we were writing off a serious editorial saying james comey needs to tell us every detail, and he did it. i also think this might be the entirety of what he's going to say. it's mostly facts. it's a little bit of speculation, and anything beyond that, they will say it's not my business. if he's smart he will say you have to ask the president. when he said that about mike flynn, was he doing x, y and z. comey does a good job in his testimony saying this is what he said, this is how i took it. democrats will be pissed that he
12:06 am
didn't take it further. kennedy: will he have access to that memo and will they force comey to cough up any other conversations that he wrote down? >> that's the next question. what we have now is his rewriting of his contemporaneous notes or editing down of his contemporaneous notes. to see the actual notes would be the hard proof and that's what you would ask for if you thought he was leaving things out. does he have the right to with hold that? i don't think he does. when he was the f.b.i. director, he's creating a public record. the argument today that we can't do this because the investigation under way. those i think were shot down pretty well. to actually see the notes, i think would be the last remaining step and full transparency from comey. kennedy: what about his relationship with robert mueller.
12:07 am
do we know of conversations they have had prior to the testimony comey is supposed to give tomorrow, and will that in any way influence what he says since he is a private citizen? >> so on mueller there will be doubt object both sides. is he going -- is he somehow going to be too soft on trump gun for trump? is it approach great's in this role at all? if mueller is investigating the obstruction of justice, that's the reason he would have talked to comey. can comey talk about whether he talked to mueller without giving away something he might not want to give away? that's the cleverness of these questions. kennedy: also tell us if this special counsel is in any way compromised by a previous relationship.
12:08 am
the two are very fond of each other. i'm wondering that fondness provides a questionable shield. we'll find out tomorrow. thank you so much, tim carney. the bombshells dropping right before comey's testimony, the "new york times" reporting the comey asked jeff sessions to never be left alone with president trump again. the wall street journal said sessions offered to resign as attorney general just in the last few weeks. can the president escape this week unscathed and keep his administration intact? let's bring in the party panel. kat timpf and author of the brand-new book "mean dads for a better america," tom shillue.
12:09 am
and chart hurt. welcome -- charles hurt. charles, i officially accept jeff sessions resignation. charles: that's pretty interesting there. it makes sense he would have offered it given the fact that president trump has to be very upset with him with his decision to recuse himself. but the reason jeff sessions recused himself -- and i always those should not have recused himself. the reason he recused himself is because he wasr was part of the -- he was part of the trump campaign. and that's an entirely different things. if you are donald trump you don't have any political background to begin with, and i come into this town and your mind is blown. you think everybody is out to get me.
12:10 am
kennedy: let's talk about jeff sessions. in regards to whether or not the f.b.i. director -- the former f.b.i. director asked him to never leave him alone in the room with the president tom: why is he such a scaredy cat. what's the problems being alone with the president. he seems to be afraid to answer him. all he has to say is that line of inquiry is making me uncomfortable. i am the director of the f.b.i., i say what i think. spank, say what you are feeling. kennedy: kat, how would you feel if someone was going behind your back?
12:11 am
kat: i would not appreciate that. there have been a lot of people in the past who decided they don't want to be alone with me anymore. but at least they told me to my face instead of telling jeff sessions about it. this way i can say it didn't work out. kennedy: one thing we are not considering, the president's feeling. how do you think he feels. kat: he probably wishes he could have approached him directly. now everybody knows how he feels. he says i don't want to be left alone to jeff sessions? that's tough on an ego. kennedy: democratic senators were tough on the four panelists they were interrogating at the committee hearing. who is going to be heard on james comey? republicans or democrats? charles: i would have earlier said i would have thought the republicans would be.
12:12 am
but reading through the testimony he's going to give. there is n all of it is already leaked out. and based on the fact he didn't pursue charges of obstruction of justice obviously -- these are the smartest prosecutors we have in the country. and they all heard hip talking about this and none of them thought there were charges. i think he will get a lot more from democrats. kennedy: do you think they will ask how the memo got to the "new york times"? charle he line it has en leaked out. i'm not saying it was comey with a napkin over the phone leaking it out. kat: people are calling the leaks fake news. does this mean they are not fake news?
12:13 am
kennedy: even if the president disputes the account that comey is going to give tomorrow -- charles: i have never doubt -- i'm sure the president did say, mike is a good guy. it's the kind of thing he tweets out. why wouldn't he say it in private. kennedy: guess what we are doing? a whole lot of nothing with congress. we are nearly five months into his presidency. the freedom caucus is calling on congress to skip the summer break and get down to work. i think the freedom caucus are the on people who want to be re-elected. kat: republicans always say during elections, healthcare and tax reform is too important and you can only vote for me. the on way they can show they mean that is to get it done
12:14 am
rather than taking a month off. i haven't taken a month off ever. kennedy: who take a month off. if you had those dead lines and that impending doom hanging over your head, even if it's just a campaign gimmick. it's a smart one to say we are one of the serious ones in the room. how do you like that, paul ryan? tom: they will say i don't take vacations like that. i want to get back to work. kennedy: that's what most americans do. we work until we die, then when we are dead, we work some more. kennedy: i mean that as a compliment. the party panel is returning a little bit later. and we have some stuff to chew over. president trump wants toed a accessories to his border wall.
