travel ban it's only going to create more litigation over what a relationship is. kennedy: the judicial branch cannot write law. is the executive order the same thingness as a legislative law in that case? judge napolitano: yes. they can't rewrite the order for him. but that's effective live what they did. this is classic chief justice john roberts. finds some way to bring everybody together, tamper with this just enough so ruth bader ginsburg and agree on the same thing and it will look good and authoritative and everybody will accept it because it's unanimous. but in the process of doing this they created for themselves the ability to rewrite presidential

executive orders. kennedy: it sounds like a huge precedent. judge napolitano: it is. we don't know what the decision will be in december when the decision comes down. because it applies to most people from those countries, the president has crowing rights and he should be happy as he's analyzing it. kennedy: let's say we do have more retirements and vacancies on the court, and 6-3 conservative leaning and eventually you have a democratic president. will that court be able to rewrite executive orders from a president who has arguably a different leaning? judge napolitano: yes. do we want the supreme court rewriting executive order particularly in the area of foreign policy which this very court said is exclusively the president's. if it's exclusively the

president's, then why are you rewriting the executive order? i don't want to be the scum at the garden party. this all preliminary. after they rule in december, there have to be trials on the executive order. this will go on and on probably for the duration of his term. december is more than 90 days from today. what's the significance of that? the executive order only lasts for 90 days. the court could decide in december it doesn't exist anymore. kennedy: trinity lutheran church of columbia versus comber. judge napolitano: state of missouri says we have x dollars to repave the parking lots and playgrounds of schools if you want to apply.

50 schools applied. five religious and 45 public. the supreme court said you either gift to everybody who qualifies or nobody. you can't draw that line on the basis of religion. that's a victory for keeping the government out of the business of deciding whether to give benefits to religious schools. they either give it to everyone or no one. kennedy: is there a correlation between this and hobby lobby. judge napolitano: yes, and it could be along the lines of the colorado baker case. can your religious views exclude you from complying with the laws that apply to everybody else. that's what they will answer in october. kennedy: judge, thank you so much. always great to see you. coming up.

reading materials out of carry-on luggage because stacks of paper could prevent other items from being screened. is the tsa going too far or is it the legitimate safety issue that warrants them degrading travelers yet again? so books and food. just a couple of things we may have to take out of our carry-on luggage this summer. what's going wouldn't tsa. what's the rationale? >> they argue bags are getting more and more densely packed because people are doing more carry-ons. but tsa should be the ones making the case. they should do the public rule making and establish in a written record that this is a good security measure.

they have been able to do just about anything they want from way back from the strip search machines. they are talking about people coming in from europe. this is a trial balloon to see if they can get a look at our books. kennedy: is this a violation of the first amendment? >> the whole thing is unless they can show it's truly justified, a reasonable search of our persons and papers, i don't think that's well made. it has been challenged in one court. so the ruling wasn't good. this needs to be unpacked. years and years after the 9/11 attacks we still have courts deferring to the tsa and it's not working for the american traveler. kennedy: what is the solution? we talked about privatizing airport security. what do you think the ultimate execution is?

>> restoring responsibility for security to the airlines and the airports is the right way to go. in the meantime if a federal agency is going to be doing this stuff, they have to make rules. as to the establish what the rules are going to be and hear from the public. they didn't do that when they created the strip search machine rule. they are doing anything they want raising political trial balloons rather than doing authoritative risk based assessments of what the rules should be at the airport. kennedy: not only is it invasive and feels unconstitutional and unjust. it will create longer lines at the airport during the height of the travel season. >> a lot of the negative experience you get at the airport is because of tsa. they mess with the airports, the

way the airports are configured. they mess with what the airlines can allow from us. the identification requirements. those are things that don't have to be in place. there are lots of ways to do security. if you were to restore responsibility for security to airports and airlines they could experiment what works best. balancing security interest, costs, nice things like saying please and thank you when you are getting your security checked at the airport by private actors not government inspectors. kennedy: some of those tsa agents are lovely people especially my friend paulette at lax, you know who you are, girl. ivanka trump, she is lovely. the daughter of the president of the united states. she has an office in the white house and hold the official role of special assistant to the president. she sat down with "fox and

showed a 23% drop in hospitalization rates for people suffering from pain killer and opioid abuse in states where there was medical marijuana. so there seems to be a direct correlation between drug correlation and healthier living society. >> one of the things we have seen is there is a correlation between you're socioeconomic status. this is tending to hit hardest in the rural towns of the america where economic opportunity is not as high as it is in other parts of the country. so they turn to these drugs as the escape from the reality they are not happy with. so there is that part of the he quition as well. >> that means you have to deal with it as a public health crisis. >> the opioid epidemic is a public health crisis. kennedy: and not a criminal justice issue.
