connection now? catherine: there is litigation over a house intelligence committee subpoena issued to t.d. bank, this is the bank fusion gps does their banking with. we are right up against an emergency deadline for the judge to decide. so it was a court action that forced the disclosure that it was the dnc and the clinton campaign that was bankrolling this dossier through the research firm fusion gps. the thing to pay attention to now is whether a deal is struck not to release the records, and my suspicion based on reporting on this issue is there may be more damaging information in the actual financial records themselves, and whether there was some kind of foreign money at play either funding the research or paying the sources who provided the intelligence to

the british spy, christopher steel. kennedy: all sides do this in these high stakes political races. when a two-term president is leaving and another one is going to be christened. and both sides are getting information from curious sources. that doesn't seem to be illegal. so why is this so controversial? catherine: the one issue that may trip up fusion gps is whether it was acting at the direction or on behalf of a foreign government, in this case russia, in a separate business contract they have. fusion gps may have some liability here on that point. what makes this so controversial is that fusion gps, these guys used to work at the "wall street journal." they have deep contacts within the reporting circles in washington. they got the spy to brief reporters on the dossier in september and october right before the election.

the "new york times," "the washington post." the new yorker. and others. they didn't bite on the story then. but ultimately the information started leaking out. when you look at the dossier, it was an information plant by a company being paid on behalf of the democrats. that's not how it was portrayed in the reporting at the time. kennedy: how are the "new york times" and the post and yahoo feeling now that they were essentially duped when they were sold this line about the information? catherine: the post did a straight report last night when they broke the story about who paid for the dossier, and it was about a 6-8 month period from april and october of last year, and how much money the campaign gave the law firm. they didn't comment on their own reporting related to the dossier. the "new york times" has been

more on the record saying they have been chasing this story for some time and i think they said the clinton campaign for the dnc lied to them about their involvement. i mean, when you think about over the last year what we have now is we have a dossier at the heart of the collusion allegations funded by one of the political parties. but the big question here if is close out on his idea, to what extent did the fbi know this was a politically funded piece of research and to what extent did they rely on that document when they opened their counter-intelligence investigation to russia and to what extent did they use this information to get surveillance warrants on the trump campaign? i think the fbi's resistance from my experience tells me they relied on it more than they want to admit now. that's where the resistance comes from. kennedy: we have an fbi connects

kennedy: the house is voting for a budget tomorrow which will may for tax reform. last hour the president told lou dobbs why tax cuts are so important. watch. president trump: we are bringing the corporate rate down to 20% from 35%. this will be the biggest tax cut in history in the history of our country and that's great. and we need it. our country is one of the

highest taxed in the world. and we can't have that. kennedy: cut tax, cut spending. if the house doesened up passing the budget tomorrow and the president makes the biggest tax cut in history, then house republicans will have to come together on a couple divisive issues. one debate is overstate and local deductions. it will allow people to deduct their state taxes from the amount they pay feds. there is talk of limiting the amount people can put into their 401ks. kevin brady said there will be a change. how will this go down. warren davidson is with me. welcome to the show.

what is it? are we keeping the deductions on state and local taxes that have been around since 1913? >> paid fors you do on spending. taxes you need to get the policy right. state and local tax debate is an interesting one. i think everyone will have to get a reform that will grow our economy. the most of important thing, your segment what the president highlighted, how important it is to goat the economy growing. kennedy: everyone agrees on that point. what they can't agree on are some of the particulars. that's why you are hearing different things from the ways and means committee chair and the president of the united states. where do you think it's going to fall as far as state and local deductions. >> when you look at the savings rates people have for retirement, far too many people are dependent on social security.

we really have that deduction on the tax system as it is today to encourage people to save for retirement. i expect it will survive. kennedy: here is the president talking about 401ks. president trump: 401ks to me are very important, it's one of the great benefits to the middle class. >> but kevin brady said this morning it could be on the table. president trump: maybe it is and maybe we'll it's as negotiating. kennedy: so you are a small business owner. you understand how many small business owners are hamstrung in this country because of high taxes and limited available capital. so what will this tax plan do for small business owners and for the economy? >> i think it will be tremendous. one of the secret sauce pieces is expensing.

there is bonus depreciation that help businesses accelerate the payback of their expensing. but when you do full and immediate expensing that will be tremendous for our country. a big portion of that given the tight job market for skilled labor, the most of skilled people will see their wages go up. kennedy: there are a lot of high school people who have been in lower skilled jobs for years since the 2008 great recession. hopefully this will allow the free market to shine so better jobs can get created in this country. that is the evolution our economy. what do you think of jeff flake resigning. do you any that's a bad idea or do you think he's a quitter? >> i think he's a smart guy to resign. from what little i know of arizona politics i don't think

his possible expects were looking very good. kennedy: were you sad? >> i was not. i agree with him on free trade. he's a republican and i am sure there are a lot of issues we would agree. but there are more things that unite us as republicans than divide us. i didn't here him as a vocal critic of president obama or hillary clinton. so to be actively engaged in this civil war is distracting from our party and distracting from the momentum we have. we do have a play book. people say, is there a plan? we do have a plan. and we have to get back on track with tax reform. things are getting a lot of traction. get back on the play book. call the plays that are winning. we know they are winning because they won. kennedy: this is a gimme from me

magnets together west coast, they repel each other. one unifying force is the differences they feel about president obama. it was fascinating to see depending on how conservative you are, 93% are happy with donald trump and only 10 were * of democrats are. it's the inverse of where we are going. but in terms of immigration and taxes, the view of the global economy, there is some diversity on both sides. we are tearing at each other. within the party they are disagreeing. kennedy: the party is way too limited in this post modern day and age. i want to ask you about old hickory. andrew jackson had one of the bs political nicknames ever. will donald trump have as good a nickname? brian: i believe donald trump all across the country everyone has i different name for him.

little bit. i have friends who can't stand hillary clinton. they are huge rabid bernie sanders supporters. every time another story like this comes out, she say see, an honorable man was tanked. you have having to defend her again and it's exhausting. juan: i don't think the democrats are trying to defend her. i think they are tired of the children tons and all of their scandals, and tired of the idea that they are earn titled. that they think they are the king and queen of the democratic party even when barack obama was there. they are look for new energy, new faces and new ideas that can drive the party. so far we are not seeing it. they are still skating by there and whistling by the graveyard halloween-type talk. because they don't.

all these months we are almost a year past these 2016 elections. wouldn't you think at this juncture even if hillary clinton had something some say, she would say it in such a way that it would galvanize the ranks of the democratic voters. trump's numbers are not particularly good. kennedy: there are passions to be stoked. there are people who still feel economically displaced. it's the perfect time for someone to come in and offer more than resistance. it's surprising you don't have a 3-point plan from democrats. i think you have got people leading the party who are looking backwards. i think they are caught up in hating on trump. i think there is lots to hate on trump, but it's not persuasive in terms of saying vote democratic. unless they come up with something in terms of the economic issues and the social
