not quite as robust as economists were hoping for. still enough to keep the markets afloat. apple's blowout earnings this time yesterday, continue to fuel technology. the s&p, nasdaq, also closing at records today. the big story of course, the apple iphone x, released today. huge demand for this, with the market cap of the company approaching now $900 billion. it is staggering. apple continuing feigns from earnings charged yesterday. look at ge. finally relief for ge shareholders. snapping a nine-day losing streak, the longest in something like eight years. ge shares dropped below 20 bucks yesterday. they're barely broaching $20. enough to snap scary losing streak for general electric. deal in the chip industry. broadcom is looking to buy qualcomm. qualcomm got a huge boost on the news. shares up almost 13%.

best day for qualcomm in nine years. if this happens, it would be the biggest chipmaker acquisition ever. we'll keep our eye on it. melissa: lori, thank you for that. david: a tax bill in hand, but little time to sell it. president trump aiming to sign the bill into law by the end of the year. so can republican leaders get it done? chad pergram, fox news capital hill senior producer. i'm told on monday, it goes into mark-up. what is mark of up? what is is entailed in the process? >> this is the first step of the process, go through the bill line by line and make legislative changes. we expect it to start noon on monday t could go well into the night. maybe go several days, tuesday, wednesday, especially on piece of legislation on this import. you get something sometimes called the chairman's mark, official reporting out of committee what the bill looks like. you also sometimes get a manager's amendment. i remember when i was a little

kid, on christmas morning i thought i should have a manager's amendment, that is all the things santa didn't bring. so what kevin brady, chair of ways and means committee might be see what gets the votes. one of the issues may be revenue, if they eliminate the individual mandate of obamacare. that ising is out there, when i asked kevin brady anything related to the bill, he said no, not at this point. not at this point. the manager's amendment -- david: forgive me, chad, one of the other things they're having trouble with, the folks in high-taxed state, afraid of losing deduction of state and local taxes, where does that stand now? >> if you get the manager's amendment, that repeals individual mandate, that might take care of salt, state and local tax deductions to give people happy. i will give you three canaries in the coal mine to look for. lee stefanik, claudia tenney

from upstate new york. they voted against the budget framework for tax reform. it was a tight vote. lose two votes it, would have been done. if they are yeses on, very likely they could pass this bill. david: great. we have canary notice coal mine. there is another big coal mine to talk about, the u.s. senate. they are the ones that hung up reform in the health care, are they going to do the same for taxes? >> people think is it may may not be the coal mine but a bottomless pit. keep in mind how fast they want to do this they want to get it by november 8th. maybe not putting daca on government funding bill. i bring that up why? because democrats won't side with them on government funding bill. could they pass tax reform and get it through the house and senate amid a government shutdown at holidays? that would be absolutely epic. it would probably kill tax reform right there, david. david: chad pergram, who could

write a novel of everything happening over past several months. melissa. melissa: unemployment dropping to 4.1%, the lowest level in 17 years, adding 261,000 jobs. here is jack, "barron's" senior editor and michelle gerard. thanks for joining us. what do you think of the number? >> there is so much noise in the number. look at trends, year-to-date job growth, 170,000. it is same the last six or 12 months away from the noise of the hurricane. we have a strong job market. unemployment rate moving lower. this month is moved down for the wrong reasons. people left labor force after blowout number last month. the bottom line, economy is healthy. job market is healthy. we have upward momentum heading

into 2018. melissa: jack, do you agree with that? >> for the most part. i would like a continuation of wage growth. we haven't seen that. this is more of what we've seen a long, slow economic recovery. that is enough to keep the stock market moving. >> michelle, how do we get upward pressure on wages now? seems like all excess is wrung out of the jobs market. that is the next spot that has got to kind of move? >> the important point, key is productivity growth. i think companies are moving loathe to hire workers that aren't going to add a lot to revenues or the bottom line. and productivity growth, through 2015 was very soft. the good news is, we have data on this week, productivity has been picking up. this year we've seen companies back investing in equipment and productivity is rising. i think that bodes very well for the wage picture going forward. melissa: i mean, jack that is a great point especially now if you see the tax code changes, they bring more money back from overseas. there is the opportunity to invest that in equipment and

other enhancements that might increase productivity? >> perhaps. look. on the tax code, on the tax reform, we're a long way from seeing what we're going to get. the chances of it passing in its current form i think are very small. it is really early in the conversation. melissa: okay, all right. guys, thanks. >> thanks. >> trying to deliver great tax reform to the american public. we can't get it retroactive to this year. we're trying to do a tax plan that tarts january 1st next year. david: doesn't sound good. white house economic advisor gary cohn, telling fox business that he doesn't think the tax cuts will cover your 2017 tax bill. here is republican congressman, dave reichert, tax writing house ways and means committee member. they are the guys who are getting the jobs done, but will americans, congressman, have to wait until april 2018, until they see their taxes go down in.

>> this is the first step in the process. as of now that the is language in the by we have to go through a markup next week. senate has to look at the bill. the white house is engaged. a lot of things could change. right now january 18 would be beginning of the bill. david: that would mean april 2018, that is year-and-a-half away. if it isn't active for 2018, won't we see a dip in the economy, that could affect the 2018 midterm elections? >> i think people are excited we have a product and we're moving forward, they see the future of this tax relief especially when you take a look at lowering middle income workers tax liability, lowering corporate rate, creating jobs. david: congressman, i hate to interrupt. >> yep. david: these are promises. americans are so fed up with promises. if you look at history, history shows that when you delay things

on taxes, businesses and individuals don't make a move until the taxes are installed. until they see it in their receipts every week, their sal ray receipts. >> you will begin to see those tax relief, that tax relief with your first paycheck. david: hold on. that is not until january 2018, right? >> so next year, you get first paycheck. get paid by the week, the first paycheck you will see reduction in your withholding taxes. you will see reduction there. so that will be a immediate. but when you file your taxes, you will file for 2017. again, that hasn't been decided the important piece to point out this is not just tax cuts this is tax law. this is very, very different. i think has created energy not

only amongst the middle class workers but across the board when it comes to businesses. david: we understand. the difficulties are enormous. it's a huge economy. taxation is how we fund the government. that is a huge process. but there are some glitches in a way. we're wondering, we're talking a lot about state and local tax deductions. whether and how that might be part of this tax bill. what is the very latest on that? >> you know, washington state is it one of those seven states with a sales tax. the effort here in the committee, over the last few years, and working on this ththat's been to create equality across the country for all states, we treat everyone somewhat fairly. that will not make everyone happy. the effort here is to create revenue spread out amongst the taxpayers across the country and lower everybody's rate. david: bottom line, i'm hearing you may be able to deduct your

happened, when you go by brazile's explanation how it worked there may be campaign finance violation, pardon me, they were directing money into the dnc earmarked for hillary clinton, and maybe by finance laws couldn't have gone directly to her campaign, but instead going to the dnc covers, with the idea it was for her and not for bernie sanders? >> absolutely right. we won't know the answers to that until further investigation is launched to determined because if money from her campaign is going into the dnc, we know, one were those dollars super-pac funds? were they individual fund? melissa: right. >> it makes a difference. you're right, there could be campaign finance laws violated in that whole process. we don't know the answers to that until later. melissa: we all knew, that both

the clintons and democrats would not let him anywhere near the hoop at that point. i guess he wasn't a democrat before that anyway. so maybe it is fair but who knows. herman, while we have you here what is your take on the republican tax plan? >> i think it's a good start. it's a good start. now we know that it still has to go through the legislative process, but to be honest with you, i was pleasantly pleased it retained a small business tax rate of 25%. it retained the top corporate rate of 20%. and one of the big things was, it allowed for expensing, full expensing of capital equipment in the year that it is spent. do you know how much cash i would be able to invest head of godfathers for everyone that i bought? that is sig is cans of that. it's a good start. let's hope they don't water it down so much it doesn't give the american people what we were hoping for. melissa: yeah. herman explain to the audience

numbers. how do they look, lori? >> a little bit of a disappointment but the company blaming it on the weather disasters, hurricanes and weather in mexico. after hours, shares are down 1 1/2 of 1%, first blush reaction there. the adjusted earnings per share for third quarter, 2094. each share is very expensive. the earnings per share estimate was $2402 and change. i'm reading this directly from the press release, as you know, berkshire, huge conglomerate, many, many businesses but zeroing in on insurance companies, geico, general re, owned by berkshire. pre-tax underwriting loss of approximately $3 billion, attributable to hurricanes harvey, irma, maria, earthquake in mexico. david: tough time to be in the insurance business. melissa. melissa: the house tax plan is out. what will end up staying in the bill, once the senate gets hands

the white house this morning. former cia covert operations officer mike baker joins us now. it was striking when he said that. that is not something we heard them in the past from other commanders in chief. do you think there is really that direct correlation between something happens and he goes and does something else? >> well, i mean, i think that he is serious, and, but i think always been a policy if we suffer an attack or even our allies suffer an attack we struck back and we done it with as much force as we can possibly muster and operational conditions that exist. i'm more of a speak softly, big stick person. as far as commander-in-chief, you know, a less tweeting might be gooding you know what? we are doing what we're doing. we're averaging, we're averaging a dozen airstrikes a day against isis targets in syria and iraq. we have been operating in, in africa, in east africa, somalia,

yemen, for quite a long time, actually, about 10 years against these targets. just recently, past day or so we had a couple airstrikes against isis targets in somalia. we've been going after al-shabaab there, which is a very dangerous al qaeda affiliate. but the airstrikes against isis targets is something new. that is a direct result of what the president was talking about in this truck attack. melissa: in some ways though, i mean americans, i think have been feeling very beaten down by the number of attacks that have gone on by the sense of vulnerability. by the fact you see jihadis targeting regular people, civilians, in a sense hearing something like that when americans are feeling vulnerable and, we have been through so much, and we have watched so much happen overseas, don't think it could do something to bolster the american spirit a bit, especially after we've seen the terrible pictures?

or does it sow more anger on sop of anger? >> well, i don't know. this is a really, really good question. that is well above my pay grade. actions are more important sometimes than words. we tend to, we have a great deal of success we don't publicize. maybe in a sense it's a good thing because i think you're absolutely correct. people are feeling somewhat beat down after the spate of attacks in europe and now this attack in new york city. but they shouldn't have any doubt we have a personnel and resources, devoted against this fight, with the war on terrorism. the general public is tired. we're all fatigued from it after all these years. but the terrorists aren't. they're still energized. of the good news, military, intel community, never taken the eye off the ball. they continue to do everything possible to dismantle terrorist operations, whether al qaeda affiliates or boko haram or isis

around the world. melissa: okay. >> and africa is a very good example. we've been operating in africa ever since 2001. it's a little bit disingenuous for folks on capitol hill to say how surprised we have troops in africa. i don't know what they have been doing. melissa: talk about the president's trip. he is expected to land in ha next couple hours to start off the 12-day trip through asia. tonight he will talk about the nuclear threat of north korea. a pacific governor's meeting. what is the significance of that you think? >> this shows that the administration is very, very focused on this region. and the fact that secretary mattis has been overto the dmz, into japan twice now, just during the course of this early days of this administration shows how serious they are about this. you know, the big question that hangs over this trip is, setting aside all the other issues, trade issues, the alliances what will kim jong-un do? will he do anything during the

course of this trip out to this part of the world? and, you know, even money is that he may well fly a missile, just to demonstrate the fact that he is out there and you know, put up a finger to the united states and to the president. so, yeah, the question then becomes what do we do in response? of course again, i think we're doing everything we can to -- this administration, to their credit, has changed the dialogue, they have changed the mind-set i think of china and others out there, to understand that we're not going to continue this useless diplomatic talk. melissa: definitely time for a change. >> we have military option. but we have to exert. melissa: we have to go. thank you so much. we appreciate your time. david: we also changed the dialogue as you mentioned on terrorism. instead of saying oh, it is just something we have to get used to we heard a lot of in the last administration. melissa: we're not understanding them or they need better jobs. david: we'll hit them 10 times harder. very simple and direct. gives us some hope for the

david: let the real debate begin. gop tax plan goes to mark up on monday in the house. what will it look like when it comes up for vote? who better to ask who has spent much of his life studying taxes and their effect on economy. steve forbes, fox media chairman and former presidential candidate and campaigned on flat tax. this is pretty far away from the deaths tax. >> junking up the code. phasing in death tax over six years. no one will count on that. david: facing in has never worked, has it? >> it is always counterproductive. having expensing of investments

out in five years. oh, congress will surely approve it f you're a business person, you can't count on that. on and on it goes. why would they politically do things like taking away medical deductions, student loan deduction, things that people think, why are you doing this to us if you're trying to help us out? david: "wall street journal" had a very critical piece in the editorial page today. half a tax reform, a pro-growth business plan but no growth on individual side. would i ask, isn't half a tax reform better than none? >> it is better than none but, even on the business side, they have got a little sneaker in there, we're examining it now, maybe a mini vat. this kind of thing, make it a simple cut? on the individual side, make it simple cut? reduce social security taxes we did temporarily a few years ago, so everyone get as tax cut? david: editorial in the journal harkened back to the reagan administration. i went back to the 198s, found

out what the original reagan tax plan in 1981 was. they had phases in. it was a disaster. took three years. it wasn't until it phased in, when you look at gdp numbers. had to go through recession, maybe wouldn't be as bad or wouldn't have happened at all if we did the cuts immediately. the reagan bill, reading from "the wall street journal," the reagan bill would leave intact 50% top rate on salary income. even ronald reagan had to give into pressure to leave the top rate very high. it wasn't until a few years later that he brought it down to 28%. >> but he did get the top rate of 70 down to 50. then in 1986, got it down miraculously to 28. david: the 70% was on earned, unearned income, money you get from stocks and everything. on salaried income it was at 50%. that didn't change into no. but what it did, it cut other brackets. so, you ended up even, if you're in the 50% bracket, you ended up

melissa: breaking news the nypd is building a rape case against harvey weinstein. the police believe a 2010 allegation against the movie mogul is get credible. they're gathering evidence to get a arrest warrant according to the associated press. here is harvey levin, "tmz" founder, objectified host on fox news channel. all the news seems to happen in your neck of the woods. what do you think of this idea they're trying to put together evidence to actually arrest him now? >> well again, this is new york. there are multiple criminal investigations going on. there is one going on in beverly hills. there is one going on in, in london. another at lapd. so the new york one is closest we've seen yet. this has to do with actress paz de la huerta, in 2010. she says harvey weinstein raped her twice.

the first time at her apartment, when he gave her a ride home. a detective involved in the case told "vanity fair" they have about enough evidence to make the arrest. now, you have to understand, that ultimately this comes down to what prosecutors think is prosecutable and they will have to prove guilt beyond a reasonable doubt. we have not heard from prosecutors what they plan on doing, but they are the ones who would file charges or declining. melissa: do we know where he is right now? with all this stuff piling on, i wonter if he would leave the country? i know you guys have a photo where you spot him with a wig? >> if this were weren't such a horrible case, it would be comical. he was in phoenix at a restaurant, wearing ridiculous blonde wig and orange makeup, orange make up. he thought that he was incognito. so he asked for a private room, and they gave him one. the problem was, that it was, it
