air force drills. our top story, more trouble for the special counsel robert mueller, a man who is in significant trouble for his conflicts of interest and his actions as special counsel reveal a pro-clinton, anti-trump attitude so strong that it influenced the hiring of prosecutors and influenced the investigative assignment of top fbi officials. we know the special counsel removed peter strop from the mueller team. we know yes was removed and we have a clear picture of his previous assignments and why mueller did everything he could to avoid the reasons for

professor, jonathan turley, one of the nation's leading experts on constitutional law. we have a large menu from which to draw. these latest developments, we are finds that strzok was involved in nearly every facet of the fbi investigations and that of robert mueller's special counsel. this is an extraordinarily active fellow with an anti-trump bias that apparently was being played out at the top of the f.b.i. as well as the special counsel. >> one of the things the justice department looks at when someone has a problematic or tainted history is how to control the damage. how far did this person go? this individual seems to have been everywhere at every time throughout the investigation. so the idea of controlling the

damage, it could be difficult. the other thing is at this point i said for some time that regardless upon he which side you are on, the russian investigation, the clinton investigation, the public as a whole has very little respect for the prospect. when you reach that point. it's a time to have all of these investigations go forward and be as transparent as possible. it supports those who want answers on why changes were made. the thing that catches my eye the most of is this idea that he was a key player in changing that language. the extreme carelessness when it was first uttered by comey, moment us reacted immediately and said what's that? that's not a legal standard. it seemed to come out of the

head of zeus. if it came out of this guy's head and nobody else was supporting it, that's a matter of concern. it didn't make a lot of experience at the time. lou: rhetorical equivalency was used by fbi director james comey to avoid gross negligence, but they mean precisely the same thing, do they not? >> they really do. the problem with the cling on investigation is obviously there was gross negligence answer false statements that were made. at the time i wrote columns saying i was surprised at the agreements the clinton people were able to forge. the clinton team refused to speak. hillary clinton refused to speak with the state department that was investigating whether security had been breached. that alone was astonishing. then to find out that the

department of justice cut these immunity deals and had agreement to the get rid of certain evidence like laptops, i thought was quite breathtaking. i have been a criminal defense attorney for some time, and those seemed to be to be rather odd for the justice department investigating a major case. lou: i have literally talked to not a single attorney who can find a single example in which key witnesses and possibly subjects of an investigation have been granted immunity wholesale to this extreme on the part of the clinton staffers and top officials of the campaign. it stands alone. >> i thought that was a legitimate issue of that hasn't been fully answered. i thought it was particularly odd to read accounts that some of the clinton people said they weren't going to turn torch

computers until they had certain assurances. that was government material. they didn't have to strike a deal in wasn't a judge in the country that wouldn't have ordered them to be turned over. it doesn't mean it would have resulted in prosecution, but these are legitimate concerns. lou: the destruction of devices. the list goes on. when we look to strzok. his involvement in such a product range of issues that involve hillary clinton and every one of them was decided in favor of clinton and against what i think it's fair to say obvious crimes that were committed, whether it be putting a server and conducting state business on it with classified information. it was as if they introduced concepts of intent and the idea material was not compromised

when we had full straightforward statements that we expect there were come prove miced classified documents as a result of her placing that private email server in her home. and with this -- with such a range of charges against strzok and the the charges against james comey, the fired fbi director. do you think we'll see the hillary clinton seem case and as well the clinton foundation case reopened? >> i'm not too sure. i think the department of justice is going to allow the inspector general to finish his investigation. he has a great ability to dig on something like this. and my understanding is it i.g. is communicating with leadership in the house about that investigation. i have a feeling they will let

that run to its conclusion. but i do think there will be a lot of people who want some answers. we talked about regular order. there was nothing regular about how the clinton investigation was handled. that dponts mean there were crimes. but the public does have a legitimate interest in learning exactly what happened at this point. because it's too much, i think, concern among citizens that their government is a series of partisan spirs on both sides. -- partisan conspiracies on both sides. lou: john northern, i believe there are so many questions now the about the lack of ethics, the lack of ethical concerns about obvious conflicts of interest and assignments that were so critical for the republican, if you will, i don't believe the american people

lou: a few thoughts on the special counsel and the lead investigator who appears to have been an anti-trumper. robert mueller and peter strzok thought they were under no come:punks to be -- compunction to be honest and decent. congress is making it clear they will have to answer. the devout anti-trumper was chosen to lead the email investigation in 2016. strzok was asked to work on

comey's draft statement, the purpose of which was to exonerate clinton. rock is responsible as well for changing the language from grossly negligent. had that expression been used there would have been no choice but to prosecute. instead he came up with the words "extremely careless." strzok was assigned to obstruct russian efforts in the dnc hack. rock agreed with the dny that they would take somebody's word that the rugs were involved in their servers at the dnc. strzok become one of a dozen officials who actually received

the trump dossier. then strzok was assigned to oversee interviews of general michael flynn. are you starting to see a massive contamination of the entire process? the inspector general's office is investigating strzok's role in sensitive cases. in fact 9 of the 17 attorneys who served on the mueller team special counsel contribute to democrats, more than half of those, and five of those donated individually to hillary clinton. all of which means a call for the firing of robert mueller no longer satisfies any call for accountability. rock and mueller and comey in my judgment should be the subject of criminal investigation and be held accountable for crimes
