hall.com president katie pavlich. within congress there are members from both parties frying to put legislation together to protect mueller from firing by the president. but you have a big and growing group of republicans who say this investigation is completely compromised. where is the truth in all of this? >> the senate judiciary chairman chuck grassley has asked for some explanation how they are handling bias at the fbi, making sure agents are doing their job without political input. but is anybody going to believe the outcome of the special counsel? there are two sides to that. if the special counsel can prove in a court of law to a judge that these crimes have been committed. on the side of public opinion, i

think that it's over. we had a crisis of confidence in our public agencies before the special counsel was appointed. but as we continue to see the biased letters and emails, people are looking at it and going, it looks pretty bad. kennedy: it doesn't help the special counsel claims of objectivity. you have the fact that christopher steele had some interaction, perhaps some employment with the fbi, he's the guy who put the dossier together. but long before the investigation was complete or she was even interviewed by the same agent or the agent who oversaw that was also the one as i said, he signed the man for the search warrant. he launched the russia investigation. >> if you go back to when the

special counsel was put in place by deputy general rod rosenstein. rob mule per was praised as an excellent choice for the special counsel. a man of integrity and character. that still might be true, but the people around him who have the conflicts of interest, we have evidence of him having clear political anti-trump pro-hilly bias. they are starting to make his investigation and his credibility look bad. kennedy: and he's the one who staffed this investigation team. it's curious, because i almost think it's not so much about people who are pro hillary. i think they are have much anti-trump. he's someone who has directly called out these intel agencies and the highest law enforcement agency in the land as being so self-protected that they are

essentially beyond reproach. >> we are seeing calls for more transparency and more information on this. judicial watch filed a lawsuit to get some of the text messages that were sent by strzok to his alleged mistress being pro hillary. kennedy: how did we get wind of this in the first place. is this the cia spying on a lead investigator at the fbi? or was this a love gone sour. >> that's a good question. i'm not sure where we found these messages, but i know they are being turned over to the house intelligence committee as part of their investigation. but the department of justice itself has an obligation to look at the fbi which they oversee and make sure their investigations are being conducted in a fair, honest, and non-political way.

it's hard to do in washington, d.c. because everybody is tied to politics? some way. but it really matters when it comes to our institutions. the most of powerful law enforcement agency. that people can have confidence in their decision making. it isn't a decision like the irs where certain people are held to a higher standard than others. it should give more confidence to the american people about the justice department. kennedy: if we do make it necessary changes so they can police themselves so they don't have to keep appointing special counsel. the one good thing about the legislation would make it hard to fire special counsel. the next time around, whoever is appointed will have to be careful about the person they put in there. >> i don't think that the white house has had any indication at all at least recently that they

dagen: absolutely. is, mueller too conflicted to be running to be the special counsel? part of the issue is the fbi, what happened with jim comey and the fbi and the handling of the clinton investigation. the "wall street journal" editorial page called for robert mueller's resignation. mueller made it clear that he's not going to sit here while they disparage the fbi. and the agent who got caught sending anti-trump text messages to his mistress. he did interview cheryl mills

and huma abedin who lied. why weren't they charged. kennedy: what does mueller do? he's so dug in, and this is playing out exactly as james comey wanted. pete: i don't see him stepping down. if you look at the facts of the matter and what we reported at fox fuse channel. you see how biased it's been, the way politics has been weaponnized. but if you were to turn on other networks and watch other morning shows, everyone is going to be thrown in jail soon, the noose is tightening. kennedy: how many times have they claimed, this is it. this is the thing that will bring the president down. pete: every single time. it's offensive to nothing

burgers to call it a nothing burger. i think it amounts to a whimper. kennedy: as civil libertarians what we have to look at is the abuse of power and the amount of power concentrated at the fbi. so much of this is about maintaining and protecting that power and punishing the person going after it, namely the president. i'm not a fan of everything the president does, but i'm dubious about the fbi's role in the hillary clinton investigation on the server and their response to it. how do you see it? kat: the more that comes out about how biased this was. i understand why hillary clinton did what she did. i would have totally been a criminal, too, if i knew everything i did would be written off as no big deal. kennedy: if you win the presidency you put in a new fbi director.

if you lose you are not going to be charged because you plate victim. kat: she knew these people were her buddies. she didn't have to be as careful. i wouldn't call the russia investigation a nothing burger because we had four indictments. but you have to be an idiot to say that the treatment has been the same. kennedy: there is a double standard. pete: there are so many great agents that do great work. kennedy: will robert mueller ever indict or investigating head of the fbi? dagen: he believes it is above board all the time. that's the argument from the "wall street journal" editorial board. kennedy: there is a degree of sanctimony there. they are doing such good work by virtue of their goodness, they cannot be investigated in the same way. dagen: one issue that needs to

kennedy: president trump and the republican national committee are all in supporting roy moore. but last night steve bannon took the fight to republicans who have been keeping their distance from the controversial candidate. >> they want to destroy judge roy moore because they want to take your voice away. if they can destroy roy moore, they can destroy you. kennedy: latest polling data shows victory is well within moore's reach. but there is fear in the party that it could pose trouble for other candidates.

could a roy moore victory be more costly to the gop than a defeat? joining me, jason chaffetz. so do you support roy moore? >> it's not up to me. it's up to the people of alabama. let them decide. kennedy: i'm not asking about the people of alabama. i'm asking you, do you support roy moore. >> i'm not getting into that fight. i am not endorsing it. i haven't donated money. the people of alabama have to make a difficult choice. it's not somebody in utah or california or anywhere else. i wish we had done with donald trump wanted to do and that's was to stick with luther strange. that battle didn't go the president's way, otherwise we would have avoided all these

problems. kennedy: i wish ma don and sean penn had -- madonna and sean penn had stayed married. >> i want to support the republican. but in the case of this, it's a very, very difficult -- these women are coming across as very credible. the nation is wake up to a problem that's been there for decades. people who are highlighting this, the person of the year, i think that was a brilliant choice. kennedy: do you believe the women in alabama who have come out against judge moore? >> i think they have credibility. and i heard from the spokesperson yesterday that was disgusting. i think we need to look hard at what these people are saying.

and like i said, the people in alabama have a tough choice. but if your number one issue is abortion, i'm not going to blame somebody for saying look i'm not going to elect a democrat who is pro abortion when that's the number one issue. kennedy: jeff flake and ben sasse have been forceful in their condemnation of roy moore. but sas, e says it's -- sasse says it's possible to be pro-life and anti-child molestation. >> there should be for people who engage in this.

if they are guilty, there should be a political death penalty. i don't think we should put up with people who engage in this type of behavier at the highest levels of government. we shouldn't have to accept them. kennedy: this will be so problematic for the republicans endorsing them. i think they are being short-sighted. as the mother of girls, i'm so disgusted by the pattern displayed by roy moore, the fact he was band from a mall for being creepy to teenaged girls. i think the man is absolutely disgusting, i feel bad for the people of alabama for having to make this choice. i think it's gross, anybody coming to his political rescue for short-term gains, it will cause long-term problems. >> again, if we had done what

kennedy: president trump announcing a huge foreign policy shift declaring the u.s. will recognize jerusalem as israel's official capital. president trump: it's time to officially recognize jerusalem as the capital of israel. we want an agreement that is a great deal for the israelis, and a great deal for the palestinians. we are not taking a position of any final status issues. kennedy: israel and palestine claim jerusalem as their capital. and most of countries have kept

which institutionally is opposed to this. and they hear a lot from theologians in the arab world and europe who adhere to a long out of date idea that somehow jerusalem is different from the rest of the former palestinian mandate. i think what trump has done has popped some bubbles and breaks some delusions. but fundamentally he recognized reality. consider this outlandish proposition. our embassy ought to be in the capital city. this is important for american foreign policy. it will make it more effective and efficient. you have had an illusion that israel is a temporary problem without a capital city. suddenly america found out where that capital city is and it will put its embassy there. kennedy: it defines our

intentions and policy. its there an argument to be made that this bolsters and enhances the peace process? western europe and pretty much all muslim nations are freaking. >> the trump announcement knead clear that we are not going to put the embassy in east jerusalem. the embassy will be in west jerusalem which no one mass ever argued will come under palestinian control under any conceivable scenario ask except the elimination of israel. this dates back to the 1940s. by because tonight reality it says to everybody in the peace process. if you want to secure a lasting, equitable peace agreement, that will have to be based on reality, too. kennedy: will our embassy actually ever move to jerusalem?
