question, sure one who is merely presiding. >> certainly the way that the special counsel investigation that we have came to be was an instance of him being passive in what his duty was. which was to set parameters around that investigation. but i think two things this i come away with from the testimony today are the idea that a justice department inspector general investigation, which is narrow, particularly compared to a regular investigation, is not supposed to be a substitute or a productsy in anyway -- proxy in anyway for congress to do oversight and get answers to these important questions on behalf of the people they represent. that is the way our government is supposed to work. second thing that precious reliance on regulations about

you know, whether people can give political contributions, look. i was a prosecutor, very opinionated prosecutor, i gave donations from time to time too. usually, it does not make a difference. and in most cases the regulations make perfect sense. but you are always supposed to have an independent obligation to avoid appearance of impropriety. if you know you are going to a investigation, that is pull of politics, if you are partisan, that does not make you a bad person, but you should stay out of it, if you don't have sense to stay out of it, they should not recruit you in the first place. lou: why would you not choose a prosecutor who was not so fraught with partisanship. >> all people from outside, mueller came from outside, there are people like me, i am not volunteers, but people who are

their tax burden is and also on the amount of jobs. 18,000 new jobs in tennessee are supposed to be created and that means an additional almost 2,000 in people's pockets. lou: when i think the projections about that. i've heard them throughout my career. what i do know is that once you change direction in an economy, open it up, get rid of regulation, open up the pathways for animal spirits in a capitalist economy like ours, free enterprise kicks in and nothing but good things happen. so i can only imagine what would happen to this economy if republicans fail to deliver. i don't think you. i don't think mitch mcconnell. i don't think speaker ryan would want to contemplate would that would do. so it seems to me that those choices are simple for you all. >> yeah. not at all. because we've been talking about this for the seven years that i've been here. you know, chairman camp began this conversation.

and when folks say that this is new and we don't have full disclosure. look, we had working committees. i was part of -- i chaired one of the working committees. but we were able to get some legislation, actually, out of that. so we've been talking about this for a long time. this is not anything new. it's just a matter of -- lou: doing it is what's new, though. y'all have been talking for a long time. >> that's right. i'm so proud of the fact that we are at this point in time where we're actually going to show the american people that we can get this done. lou: and i'm proud of the fact that this president is the one talking about politicians in washington who do all talking and now showing them how to get things done, and i think it's a wonderful moment for all americans. i also want to turn to what could be coming our way. thank you very much to the dems, and that is a government shut down. where do you stand and are you confident that you can avoid it? where do we stand? >> well, right now, we're going to be doing another continuing resolution, which we want to keep the government open until we can get the bca

cap taken care of. but, look, it doesn't do the american people any good to shut down the government. we really don't want to do that. i've been here when we did that previously. and, look, we've got so many good things going on, lou. we want to keep the government open. we want to work with democrats. lou: just like you say, congresswoman, i can't think of a reason to shut it down. where is the freedom caucus? where are the conservatives? and where is the leadership and where are the dems? >> well, i know that the speaker is working with across the aisle and trying to get the democrats to come where we can have an agreement on a bca cap. and that is really important that we get that agreement because unlike the reconciliation where we could do that simply with our own members, that's not something we can do with our own members. we do have to have the bipartisan support on getting that bca cap done. so, look, if we had all of our

members and our house vote on it, we would do it here. but you can't because you need 60 votes. look, we need to work together on this. lou: let mitch mcconnell worry about that part of it. >> we will. don't worry about it. lou: what do you think? what are the odds right now? >> i think the odds are looking better day by day, and there's a lot of conversation going on. and i will tell you as a fiscal hawk. you know how i am, and i did this in my budget are i just say you have got to watch those dollars. and even when we see the economy getting better, lou, we have got to be careful that we don't spend more than what we bring in. and we start using some of those dollars to pay down our debt. lou: when have you ever seen that be the case? i mean, you had a republican administration for eight years. you watched the obama years drive it crazy, almost doubling it. but when -- i mean, you have to go back to the early clinton years,ed mid-clinton years to see a balanced

budget. come on, congresswoman. you don't want to slow this economy down. >> no. i don't want to slow this economy down. i want this economy to grow, and i want those dollars to come in, and then i want us to be responsible when the dollars come in. and with our budget, this is the first time in 20 years that we produced the conservative budget where we actually had some mandatory spending. now, the senate didn't take it. but this is changing the culture around here. there's a lot of people that are a lot more aware of what we need to do because of what we did on the budget, and i'm very proud of that. lou: yeah, i'm very proud of the fact that you guys are close to getting the economy where it needs to be, and that is 4% plus growth and starting to build prosperity for every american. and i don't want some -- nobody's more conservative than me on a fiscal policy. i think you know that. but i've got to tell you. the idea of slowing down this economy with a government shut down is absolute nuts. and with that, congresswoman,

lou: in our online poll we asked last night, do you think a second counsel is the only way to root out the justice department? 84% of you said "yes." now, i think that should have been higher, personally. joining me now, ed rollins, michael goodwin. columnist for the new york post. both fox business contributors and have accolades and plotted horrific beyond all the time we have left. good to have you both here. >> thank you. lou: let's start with -- to me, it's ancient history. roy moore in alabama. gone. >> gone. he's a lousy candidate and ran a lousy campaign. and the other side who ran the democrat campaign, the traditional campaign, and they got the african-american vote

out. lou: so got lucky? >> well, he knew what -- lou: joe trippy is an old friend. and a great strategist. >> he knew he was going to do it and i said on this show, they have to get 95% of the african-american vote out, and they did. >> did you tell him to do that? >> i didn't tell him to do that. i didn't think he could do it. and christian wright didn't turn out the normal numbers. and the candidate didn't campaign the last couple of weeks there. didn't have the money or the resources and washington was against them. >> mitch mcconnell, the establishment. >> and shelby. >> he can look up every day for the next three years and when he cast his vote, he can know that his vote is being offset by a nondistinguished candidate that got elected yesterday. lou: i don't think it bothers him a bet. >> the history of roy moore in alabama is even when he has

won two statewide races, it has been by close margin. >> won by a landslide. >> all the attacks from the media and then the right in look about the same size as the margin. so it was just a bridge too far. too many things and on one level, you can see mcconnell was right about this. luther strange would have been a far superior to what alabama got and what the president gets as a result. the president was right. he also backed luther strange. but the real answer is that strange was the wrong guy and mo brooks was the right guy and why in the heck they didn't get behind him. i mean, this is like people didn't do any thinking here. they just kept reacting. >> the final story is sessions would be the worst pick sessions has made to be attorney general. lou: that's a great point. rod rosenstein defending

corruption in his own organization and the appearance of conflicts of interest and activists working in the special counsel against the sitting president. this is as ugly as it gets. >> i thought rosenstein today often looked like the deer caught in headlights. he seemed not to be prepared for these questions about did you pay steal. was the steal dossier -- lou: oh, he was never going to answer the question. >> but all of these things about the contributors on mueller's team, the two democrats. his answer is more like, you know, 2000. trust us. we have procedures. we will take care of these things. did he not see what happened in this country in 2016? we're past that now. we don't trust the government. lou: andy mccarthy said a terrific thing. a terrific attorney and writer. but he said all president trump has to do here is tell

the justice department to release the documents and give it to the oversight committee because it's ignorant what's being done here by -- >> could not agree more and the president is in a real fight. if he doesn't do that and make some other changes. he's going to have a real long hard fought battle here because they're against him. >> yeah. he has to get ahold of the justice department. i mean, with sessions out of there and rosenstein sort of going by the book, and you see the deep state that's there. he has to figure this out. >> and somebody has to go into that justice department. not saying this moment but rip out the fools who think it's a candy rock mountain for people who would support the constitution of the united states. and a president. gentlemen, it is always good to see you. >> thank you. lou: why don't we go have dinner. >> why don't we do that?
