question, i won't answer that question, sure one who is merely presiding. >> certainly the way that the special counsel investigation that we have came to be was an instance of him being passive in what his duty was. which was to set parameters around that investigation. but i think two things this i come away with from the testimony today are the idea that a justice department inspector general investigation, which is narrow, particularly compared to a regular investigation, is not supposed to be a substitute or a productsy in anyway -- proxy in anyway for congress to do oversight and get answers to these important questions on behalf of the people they represent. that is the way our government is supposed to work. second thing that precious

reliance on regulations about you know, whether people can give political contributions, look. i was a prosecutor, very opinionated prosecutor, i gave donations from time to time too. usually, it does not make a difference. and in most cases the regulations make perfect sense. but you are always supposed to have an independent obligation to avoid appearance of impropriety. if you know you are going to a investigation, that is pull of politics, if you are partisan, that does not make you a bad person, but you should stay out of it, if you don't have sense to stay out of it, they should not recruit you in the first place. lou: why would you not choose a prosecutor who was not so fraught with partisanship. >> all people from outside, mueller came from outside, there are people like me, i am not

this conversation. and when folks say that this is new and we don't have full disclosure. look, we had working committees. i was part of -- i chaired one of the working committees. but we were able to get some legislation, actually, out of that. so we've been talking about this for a long time. this is not anything new. it's just a matter of -- lou: doing it is what's new, though. y'all have been talking for a long time. >> that's right. i'm so proud of the fact that we are at this point in time where we're actually going to show the american people that we can get this done. lou: and i'm proud of the fact that this president is the one talking about politicians in washington who do all talking and now showing them how to get things done, and i think it's a wonderful moment for all americans. i also want to turn to what could be coming our way. thank you very much to the dems, and that is a government shut down. where do you stand and are you confident that you can avoid it? where do we stand? >> well, right now, we're going to be doing another continuing resolution, which we want to keep the government open until we can get the bca

cap taken care of. but, look, it doesn't do the american people any good to shut down the government. we really don't want to do that. i've been here when we did that previously. and, look, we've got so many good things going on, lou. we want to keep the government open. we want to work with democrats. lou: just like you say, congresswoman, i can't think of a reason to shut it down. where is the freedom caucus? where are the conservatives? and where is the leadership and where are the dems? >> well, i know that the speaker is working with across the aisle and trying to get the democrats to come where we can have an agreement on a bca cap. and that is really important that we get that agreement because unlike the reconciliation where we could do that simply with our own members, that's not something we can do with our own members. we do have to have the bipartisan support on getting that bca cap done. so, look, if we had all of our

members and our house vote on it, we would do it here. but you can't because you need 60 votes. look, we need to work together on this. lou: let mitch mcconnell worry about that part of it. >> we will. don't worry about it. lou: what do you think? what are the odds right now? >> i think the odds are looking better day by day, and there's a lot of conversation going on. and i will tell you as a fiscal hawk. you know how i am, and i did this in my budget are i just say you have got to watch those dollars. and even when we see the economy getting better, lou, we have got to be careful that we don't spend more than what we bring in. and we start using some of those dollars to pay down our debt. lou: when have you ever seen that be the case? i mean, you had a republican administration for eight years. you watched the obama years drive it crazy, almost doubling it. but when -- i mean, you have to go back to the early clinton years,ed mid-clinton years to see a balanced

budget. come on, congresswoman. you don't want to slow this economy down. >> no. i don't want to slow this economy down. i want this economy to grow, and i want those dollars to come in, and then i want us to be responsible when the dollars come in. and with our budget, this is the first time in 20 years that we produced the conservative budget where we actually had some mandatory spending. now, the senate didn't take it. but this is changing the culture around here. there's a lot of people that are a lot more aware of what we need to do because of what we did on the budget, and i'm very proud of that. lou: yeah, i'm very proud of the fact that you guys are close to getting the economy where it needs to be, and that is 4% plus growth and starting to build prosperity for every american. and i don't want some -- nobody's more conservative than me on a fiscal policy. i think you know that. but i've got to tell you. the idea of slowing down this economy with a government shut down is absolute nuts.
