more take-home pay. it will be a christmas gift for hard-working americans. i wanted it done before christmas and we got it done. kennedy: it is not perfect, it was rushed. but if the best parts are ex tranltsed it's not hard to see the benefits. the left has been pushing a justification for resistance. apparently democrats hate when they make money. the only kind they like is the kind they steal from you have by force and they get to redistribute. there has bean lot of whimpering about the corporate tax rate. the cut is a great thing because businesses small and large will owe less to the federal robber barrons and will be able to do more with their newfound

uncle sam. there is no one better to ask than republican congressman from the great state of kentucky, thomas massie. >> almost all americans will see a tax cut under this program, as long as they pay taxes. it's hard to give you a tax cut if you don't pay taxes. kennedy: ask your friend marco rubio with the child tax credit. that's essentially a subsidy. they will get money back from the government for the bold step of having children. >> some of these tax credits should have been reduced and weren't. there is a lot of tax cuts and not as much reform it started out with. but the tax cuts are the main thing. most of americans will see a tax cut from this. kennedy: let's talk about the corporate tax rate.
12:04 am
many economists say there is no guarantee lowering the corporate tax rate will do anything for working americans. >> it's called capitalism. when you let the companies keep more their money they will reinvest that money. but people are asking, what if they just give dividends to their share hoarlingsd or buy back stock. if they do, their competitors will invest in training their employees and those who sit on their cash will fall behind. kennedy: you make such a good point about distribution. they should be the ones to choose where that revenue goats. if they just -- where that revenue goes. if they just sit on it or reward
12:05 am
their shareholders, that's their right. the bernie sanders of the world want to turn the u.s. into venezuela. >> lowering the corporate rate to 21% means we won't be punishing companies for doing business in the united states. you will have companies that were moving offshore that decide to stay here or companies that did move offshore that will come back because of this lower rate. kennedy: we are always vigilant about civil liberties on this show. it's been tough to talk about because we have spent so much time talking about the russia investigation and the tax plan. but there is a deadline looming for the fisa act. >> it allows our government to spy on foreigners.
12:06 am
the problem is the fbi has been using this as a back door to spy on americans. this program expires december 31. we have an opportunity to refine it. some civil libertarians on the democrat side of the aisle are pushing hard to get an amendment in there that i have offered in previous years and it passed in previous years but never made it into final law. it would require a warrant if you want to go into this spy data base and surveil americans. that's all we are asking for, get a warrant. kennedy: that's constitutional and that's how it should happen. you can still catch bad guys. most of rational people aren't against that. but we agreed to play by the wool book that is the u.s. constitution, and you have to
12:07 am
abide by that no matter where you sit in the federal government or law enforcement. what are the chances of an amendment like that making it into law. >> one of three things will happen. either it's going to expire. or we get an amendment that's there and we change the. or as congress wants to do, they may just punt this a month then we bring up the argument in january. but we can keep them from reauthorizing them for four or 8 years without any changes. we made a play to do that and they shut it down. kennedy: where is the freedom caucus on fisa. >> i met with the freedom caucus last night. they are strong on this issue. they are ready to fight on this. not only do we stand up for the tenth amendment, this is a 4th
12:08 am
amendment issue. if the government wants to surveil people, the constitution requires they get a warrant and have probable cause and name the things and people to be seized. have a beautiful christmas, congressman. kennedy: critics say the tax plan unfairly benefits the wealthy and corporations. supporters say that's not such a bad thing because it will spur higher wages and growth. jessica tarlov is here, along with a legend in the liberty movement, matt welch, and former new york congresswoman nan hayward returns. nan, of all of us here, you are the only one who sat in congress. what do you think of the tax
12:09 am
plan? >> i think it's a tremendous step forward. can it be improved upon? sure. but it represents a real return of resources, capital and control to the american citizens. that's what we need. when i was in congress i saw the way government squanders your money because government is political. everything government does is done with cronies. kennedy: what do libertarians get out of this bill? what is the libertarian perspective. >> the best thing you get is a lower tax rate exceptn if you live in new york and work in the media. but the vast majority of americans you pay federal income tax plus kerp raitions. the flip side of that is we are
12:10 am
getting to a stage now where the committee for responsible budget says we'll get to the trillion dollar deficit as soon as next year. increasing the deficit by $1.5 trillion. that has an impact on economic growth. what i worry about is we'll get a lot of good stuff happening in the economy and because of the regulatory activity the trump administration has done. but if we have 120% debt to gdp ratio -- kennedy: it's like having a great body and an ugly face. there are a lot of people on the left who say nancy pelosi used the words armageddon.
12:11 am
why do you hate money? geoff i love money and i will have a little bit more of it, i have to check. that's the talking point donald trump used when he said i'm going to make helping funders really pay. trish regan said it's not way it's suppose to be, the private equity guys aren't supposed to be this well off. but they are the ones who pay the most of taxes. if you are so concerned making sure middle and lower income americans got a break, why didn't they go higher with the individual cut. i get the corporate cuts. but this is something that even

republicans were saying why aren't we cutting the individual rate which reconciliation. >> jessica, you are an outstanding democrat, you are a rational smart democrat. but democrats in the senate refused to get on board with any of this. kennedy: there are some that would benefit if they brought this message back to their states. >> because they wouldn't, the republicans tried to pass a bill with only 50 votes. so they chose reconciliation. reconciliation says pay for it with limitations. and that's why we couldn't lower rate more. kennedy: zero democrats voted for this one. and the reason might include gloom and doom hyperbole from
12:13 am
party leaders. >> the republican thanks bill is like pouring gasoline on a ranging fire. >> this gop tax scam is simply theft. monumental brazen theft from the american middle class. it does violence to the vision of our founders. disrespects the sacrifices of our men and women in uniform. kennedy: what the hell is she talking about? why did democrats say they hate it so much? joining me is robert wolf. what is so hateful about this bill that it causes nancy pelosi to reach into her deadly thesaurus? >> i wouldn't say i agree with the rhetoric and use the word "hateful." i'm for corporate and individual tax reform.
12:14 am
this bill is not simpler. kennedy: i think it is problematic. but i don't think the problems were fatal. >> i don't either. we have a difficult tax bill going to another difficult thanks bill. where i have the biggest problems is something like the individual mandate. i don't understand why they couldn't attach something like the alexander murray bill to it. we know 13% of those people who need understand get understand. so that premiums don't rise. kennedy: why should the government force them to get understand? >> that wasn't what i said. what i said is if you are going to get rid of the individual mandate, attach the other bill that keeps the exchanges and premiums. when you do something that grand and that large, it should be an interim process. i think if they took that as a
12:15 am
starting point and would have continued to make changes continually i think we would be better off today. but i think we are bert off with than without it. kennedy: i would disagree especially for people paying double the premiums. they have higher deductibles. you have a third of counties in the country down to one choice. >> but i can tell you how many people are paying less and how many people are with insurance who wouldn't have. kennedy: we are talking about people not on medicaid and don't get subjects does and they have to provide their own understand. if you look at the failure of obamacare why wouldn't the answer be more insurance? a lot of these things have great intentions. >> i'm not for the single payer. i'm for an interim process that

12:23 am
when you have a multi-sided civil war fought largely in urban areas, things get pretty confusing. so what you have to do, instead of trying to make this a scandal when it's not one, look at the end result. we had a modestly equipped program to give weapons to sir ran rebel troops. the result is the islamic state caliphate is gone, dead. i am sure the people that started this program, they knew from the start that some weapons would fall into the hand of bad guys. because on battlefields, your guys get killed to and the weapons get surrendered and stolen. kennedy: when you say the battlefield is messy and we
