country reportedly and here is the image spotted illegally selling oil to north korea obviously in defiance of un sanctions against the north, trump spoke to new york times, he says his position on trade with china has been soft and hopes the country would help end north koreans nuclear program but now trump says, quote, oil going into north korea, that wasn't my deal. and he tweeted yesterday, caught red-handed very disappointed that china is allowing oil to go into north korea, they'll never be a friendly solution to the north korea problem if this continues to happen. as for china, they say they have been strictly enforcing the un sanctions. separately president trump told "the new york times" that he thinks special counsel robert mueller will be fair in investigation of possible collusion between trump's team and russia. lea: joining us leet colonel danny davis, senior fellow for defense priorities, nice to see you, danny.

>> appreciate it. it's a rare sampling of what u.s. spy satellites have seen. can you think we will see more of this? >> i don't know if we will see more. that certainly is enough. whole red-handed information there. it's not a minor issue. certainly useful, i think, for diplomatic pressure. lea: how else can the u.s. motivate china to do more, this is sort of public shaming. >> here is what we have to recognize. china has their self-interest, russia that is self-interest and very often they diverge from ours and any time that happens, we need to put pressure back in specially on public record saying they will take certain actions, but what it does in my view highlight that is we can take care of this on our own, we can't rely on other people, deterrence is what we have in our hand with our military and our diplomacy that we can work as much as we can with the

nations. our deterrence is what's going to really keep news driver seat here. lea: you make such a good point. keep the nuclear triad strong and continue to work military. what about economic restrictions and further sanctions against chinese companies? >> you know, i think that's a bit of a slippery slope because we don't want to do anything that will damage our own economy and our own relations with them but you certainly can't let it go by without any actions, when you have something like that you have to be firm in response and something measured an commensurate with our own interest. lea: president trump told new york times that the mueller information into collusion, quote, makes the country looks very bad and puts the country in a very bad position and for russia discrediting the u.s. is the name of the game, do you think that it's time to move on from this? >> you know, i think it is, if there's something there, if they have information, by all means

present it, but if they don't, nothing after a full year, you have to stay, it's time to move on and take care of issues that really do matter to our relations with russia. lea: thank you, nice to be with you this morning. >> thank you. lauren: more attacks against the justice department, house intelligence committee devin nunes slamming doj as well as the fbi saying they failed to produce documents relating to dossier, subpoenaed information relating to dossier in august but hasn't received it yet, house majority leader kevin mccarthy says he understands the frustration. >> when you sit back and you look at what has happened, the lack of response, congress has responsibility of oversight, they have been ignored, they have been delayed, they have been refused to send people in to have hearings, to be questioned. lauren: congressman nunes is demanding that all records be

provided to the committee by wednesday. lea: apple is making amends for admitting to purposely slowing phones. lauren: i bet they wish they didn't admit to that. tracee: following eight class actions and backlash from many apple users, apple finally apologizing for controversial move to slow down older phones saying it would not internationally shorten the life of any apple product or degrade the user experience to bring customer upgrades, apple said it's taking $50 off the out of warrantly replacement for the next year bringing the cost to $29 for anyone with an iphone 6 starting in late january. a new software update will also hit early next year. that should help with battery life but not everyone is satisfied with apple's apology, a group in france latest to file

begins weeks after the prior new years, begins after action reports, it begins with an analysis of some people who were arrested that you never saw last year with intelligence information-gathering over the past year, so the things you will not see are all those things such as the intelligence and information gathering, there are tremendous amount, probably over a thousand undercover agents, undercovered detectives that will be on the streets. obviously you will see uniform personnel that will act as deterrence but the key here is what you don't see is what is really important and the most, what's very, very important, if you see something, say something. we have said that over and over again and i've also added something else to that, if you send something, send, let someone know. lea: you mentioned new york will

be the safest place on earth and clearly such security presence, if you see something, say something, there will be celebrations around the country in smaller cities that are softer targets because they will not have as much as law enforcement presence. are you concerned at all about the smaller cities being better targets? >> well, i could tell you that the -- since we've had the creation of joint terrific task force in every state and in every county in many states, all of that intelligence information is being widely shared. i'm not too concerned about the smaller towns as i used to be because i know now that the fbi, the greatest law enforcement agency on the surface of this planet. i mean, they work very hard in sharing a lot of information at times like this, so i think we could rest easy knowing that we are in good hands. lea: you mentioned jttf, can you help us understand the role of the jttf and helps protect the

smaller cities? >> sure, i was one of the first military intelligent officers that was assigned to the joint terrific task force in fbi headquarters and there was little information sharing, cia, fbi, now with the creation of the national joint terrific task force in early 2000's jttf have grown all over the country and information and intelligence, that, for example, a police department may get in los angeles will go to new york, new york will send it to every police agency in that state no matter how big or how small. so this is very important that -- it actually keeps us safe. lea: real quick, we have about 10 second, i want to ask you, that keeps us safe when we have the intelligence, what about the lone wolf, the ones who aren't connected necessarily that we wouldn't have intelligence on? >> we will never be able to paren everything, there's always a crack that somebody might go

hey, griff. >> good morning, lauren, lea, this wouldn't be the first strongly-worded letter around washington but it is telling, may make for fireworks in the new year, chairman nunes is slamming the department of justice and fbi for failing to produce documents for subpoenas issued four months ago concerning the so-called trump dossier. at this point, it seems the doj and fbi need to be investigating themselves. nunes is demanding those documents now by january 3rd next week along with witness lists, he's clearly frustrated with the agencies stalls or slow-walking his request and sentiment shared on capitol hill, kevin mccarthy weighing in. >> there are a number of informations going on here but the lack of cooperation, the questions raised by individuals in the doj and also within the fbi and inspector general doing the own investigations with the

emails came out forward, i think we will have to clean some areas up and i think you have to have transparency. >> this comes as president trump sat down with new york times reporter who asked about the mueller investigation, the president telling him that he has confidence in mueller saying, quote, i hope that he will be fair, i think he's going to be fair and based on that there's been in collusion. it follows change, guys, fbi and doj where we have seen former deputy general bruce ohr remoted and peter strok removed and baker reassigned and deputy andrew mccabe expect today retire early next year. my hats off to our colleague john roberts who obtained this letter exclusively yesterday. it's going to make for a very busy perhaps next week, lauren, lea. lauren: what a mess tat justice

department. griff, thank you. lea: winning bid to buy a stake in uber. lauren: tracee carrasco joins us on that and other headlines making news this morning. for uber this significantly devalue it is company from a prior valuation in tracee: this is about a 30% decrease, the deal values uber at $48 billion, that is less than what it was previously valued at $68 billion, but soft bank did win bid to buy major stake in uber at steep discount. own about 15% of uber and other members of soft bank's bidding group, they'll own about 3% of uber, as part of the deal soft bank plans to invest $1.25 billion into uber. lea: let's talk about amazon. amazon has been killing it this year, there's something big going on today. >> the holiday deals aren't not just day, today is digital day on amazon.

2017, how do you top that, melissa, arian at mv financial join us now to look into their cristal balls, good morning, melissa, we will start with you? >> good morning, what a year it was this year for the market, the market is the winner this year, let me tell you. some kind of catalyst for the market to have pullback and there could be some type of geopolitical event but right now smooth sailing, the market had the best year that it has ever had and everyone has been talking about it all year, i'm telling you the market had the best year it ever had this year. here is why, it made more brand-new all-time highs than it ever has, it had more follow through, bearish stock was quickly brought up. two pullbacks on march and

august that could have technically bought the market into pullback or rally, i don't know what today brings, we won't know until 4:00 o'clock, the market might close and make another brand-new all-time high today and that would be more confirmation that in 2018 we will move higher. lauren: which would be for the dow 72 record highs and we are about 163 points away from 25,000, light volume, we will see some wind dressing, but anyway, it could, let me bring you in, besides geopolitics, could something like messing up some trade deals or what are the catalyst that you see that could pull down this market? >> sure, well, we are overdue for a direction no doubt about that, but black swan is really

the only thing i could see derailing or a grate change in the fundamental picture as long as earnings continue to stay strong, i think the money will continue to fly in from the sidelines, we are at the late stages of bull market, i don't see anything changing in the fundamental all picture. we have shrugged every worry and we will continue to see that happen. it's been a strong economic picture or stronger one, so more of the same. lauren: earnings are expected to grow 12% next year. if you take a look at the dow and the winners and losers this year, a lot of folks are saying, if you look at the beaten-down stocks, ge being down sharply two years in a row, that for instance is a stock to buy in 2018? >> i would not buy ge right now, i'm sorry to say it. it's a lovely company, however, the fact the stock is in down trend, technically speaking you don't buy stocks that are in down trend, you buy stocks that are strong, one of the biggest

winners is facebook, facebook flows at 115 and brand-new all-time highs, facebook moved 50%. the market moved over 20%. facebook moved 50% in a year, facebook is a good buy. lauren: isn't it expensive? i will add microsoft to that, four tech funds in the s&p 500. this is what a lot of people own. you keep buying or do you say, all right, they pulled up recently, minus amazon, maybe we sell them in the new year? >> i would hold. it's always a good strategy, right, to buy the losers and sell the winners but at this point the companies will remain strong, there's no reason to sell. generally, you want to have a good ray of different sectors and stocks in your portfolio, you want to remain discipline, now is not the time to make

fundamental changes like we talked about, things are looking good and remain the same. is there place for ge and companies that are in a downward trend or doing poorly, sure, when you buy them, that's anyone's bet. lauren: you guys are optimistic for me. i'm trying to play devil's advocate. is this a sector beaten up in close to buy in the new year, melissa? >> well, i would say that anything it's in the down trend and you're talking an the cheap. the problem is that when something cheap, it could keep going down, down until it rides back up again. so you don't want to buy something and then go down before it goes up. the idea to buy something and then go up right away, different oil stocks have been doing better than others, you have to pick and choose, i think, which

ones you go for. i think the tech stocks are the ones that you want to focus on. you better to have less size and quantity if you're a long-term investor, it really shouldn't matter because you're driving it out for the long haul, if you're a trader, you're in a day or two, that's up to you, depends what your time horizon is. lauren: what about bitcoin, arian, that's a good way we can all make money in the new year, right? [laughter] >> you keep hearing about it, don't you? >> we are not recommending to our clients to buy bitcoin. we have a lot of questions on it. i'm personally saying away from it. everything looks rosy and you hear about success stories, again, we are here for the long-term growth and participating in market growth and bitcoin is just a little too speculative and too much crazy about it. lauren: we hear about all the hackings and everything else, governments around the world are warning against in crypto currency market. all right, melissa, arian, good

lauren: all right, good morning, let's get you caught up on what's happening now. rose marie, the actress made famous in show, has died at age 94, film and broadway actress had running career in entertainment. passed away at her home yesterday afternoon. well, the trump administration has struck down rules proposed by the obama administration that limits fracking and other oil and gas drilling practices on government land. companies would have had to disclose the chemicals used in

property taxes that have not been assessed prior to 2018 are not deductible in 2017, translation there, if your municipality hasn't put forward your 2018 tax bill, you could be out of luck. the tax foundation thinks this is outstanding issue and could be headed toward litigation, if you happen to end up on the wrong side of prepayment, it's not like you're losing money. >> at worst if they didn't make the payment, they simply provided interest-free loan. this is a one-by-one situation where tax adviser is best advice. blake: potentially this could bring amt into play for some people, there are, though, potentially big tax savings for those who decide to load up their deductions in 2017, the bottom line from everyone we have talk today from the irs on down, if you are considering making these prepayments, either talk to your local tax official and in many cases as well as
