open-door meeting the president had yesterday when he seemed to take various position and caught everyone off guard because they are not used having discussions like that in front of tv cameras. >> he took every position possible. conservatives are worried about it. but he also took other position. i wouldn't read too much into it other than a kumbaya moment. the president has a long career in business. he's not one of the free traders that think every side has a wish. he has written that deals have winners and lose ishes. he has written the best way to achieve a deal is to force him to the table.

kennedy: i think what he was trying to do is catch some of those people off guard and on the record. even though he may have given some headway on his own positions. what are those positions now that steve bannon is no longer in his orbit. >> trump has been talking about the united states getting a bum deal on trade since the 70s and 80s and 90s. when he said i'm goinged to build trump tower. steve bannon's problem was he believed his own press. trumpism will long survive steve bannon's influence on the president. kennedy: steve bannon has had an epic meltdown. it's interesting to watch a figure like that that so many

he's running for jeff flake's seat. he's gunning for the retiring senator's chair. the president pardoning the sheriff for congressional contempt last year. he says he's going to run to support the agenda and policies of president donald trump. flake is one of three republican senator hospital will not be seeking reelection. and darrell issa, just announced he also will not be seeking reelection in 2018. he's joined by 31 other republicans in the house who won't be running. will the mid-terms cause a major shift in the gop? does that make it problematic and more an uphill battle for republicans? >> mid-terms are always

difficult for the party in power. we have thanked 32 retirements with darrell issa. it's not like everybody is fleeing for the gates. i will say this idea that somehow if the republican majority in the house is smaller that means we'll have a more moderate congress, you are on. the republicans who are safe are conservatives. a smaller republican majority in the house means a more conservative republican caucus. kennedy: they tend to be much more pro liberty and they are also cost cutters. so i appreciate that. the president might be the gift that keeps on giving. we are hearing that oprah in a pendulum move might run against the president in 2020 and that's a revenge fantasy. and you also have sheriff joe.

to this country and take away our freedom. i think we can agree those people have to be targeted. but you are saying there are innocent americans warrantlessly spied upon and oftentimes unmasked by intelligence agencies privy to that information. >> we are asking for two things. this massive amount of data, you can't look at it without a judge's warrant. it was collected with a less than constitutional standard or no constitutional standard. that information shouldn't be used against americans. because the constitution wasn't obeyed to collect information. even if you look at it you can't say we are going to prosecute medical marijuana in colorado by searching his illegal data we collected on foreigners. kennedy: what is there to prevent that from happening?

>> nothing. they will not give us information. they could be searching the data base and not presenting it in court. this is called parallel construction. they get the information you are involved in the medical marijuana base. then they tell the police who get a parallel investigation and don't use the secret data. it can be used in a nefarious way to get domestic officials snooping in your business. but the 4th amendment says the government is not allowed to look at any of your stuff, papers, invade your house without probable cause that you committed a crime. this is a bedrock constitutional principle. i will do everything i can to fight to make sure it does not pass unless we get our reformed attached to the bill.

kennedy: the freedom caucus has issues with the permanent allowing of fisa to go on and on endlessly. but also there is the amendment put forth by representative justin amash that curtails some of this power. what do you think the chances are of that passing the house? >> representative amash's amendment is identical to senator wyden and myself's bill. we are excited that this is really a bipartisan. we have right and left. there will be over 100 democrats in the house and may well be over 100 republicans. this is a chance for the liberty movement to have a victory. the liberty folks who watch your program, you need to call your

congressman. this is a big fight. kennedy: if there is going to be bipartisanship in congress, this is where it should rest. it's not on infrastructure and immigration it's right here where we have to be so mindful of our civil liberties. what concerns me is devin nunes is trying to find a middle ground. but my worry is it becomes a creep toward eroding our rights. >> what they are calling middle ground is worse than the existing law. it says explicitly you can use information from this foreign data to convict americans domestically for domestic crime. it specifically allows what we are trying to prevent. there is no warrant requirement. there is a little bit of a tweak of a reform. but be wary when the
