how the agency failed to act on multiple warnings about the florida high school shooting suspect and the president's claim that the russia investigation got in the way. plus, justice for innocent lives taken way too soon. nikolas cruz appearing in court this afternoon, the latest on where the investigation stands right now. >> but president trump is getting ready to depart palm beach florida en route back to washington d.c. as blame is mounting on the fbi after multiple signals were missed ahead of the deadly florida shooting. blake burman live in d.c. with the very latest from the president, hi, blake. >> hi lauren and president trump over the weekend did not specifically mention christopher wray by name instead he talked about the institution as a whole , about this missed phone call from last month questioning why it was not forwarded along. the president tweeting over the weekend "very sad that the fbi missed all of the many signals sent out by the florida school

shooter. this is not acceptable. they are spending too much time trying to prove russia collusion with the trump campaign and there is no collusion get back to the basics and make us all proud." here at the white house today they were asked a spokesperson was and would not say whether or not they feel wray should resign which the florida governor rick scott has called for but the white house saying president trump at this point is supportive at looking into sur ing up the federal background check system. >> you have the phone call to the fbi and so when you're looking at ways to fix this system you want to look at measures like fixing the background check system and also want to understand what broke down and allowed for this individual to go on unattended while other people were raising red flags? >> you saw in that tweet how the president brought up russian meddling there were multiple tweets over the weekend from the president about this in fact he just sent out another one in which he wrote "obama was president up to and beyond the 2016 election so why didn't he

do something about russian meddling"? there are of course questions and criticisms about this president and how much he wants to do with the intelligence chief testified up on capitol hill last week they have not yet received a direct command from the president to look into russian meddling. david, lauren back to you. >> so much to look into blake at the white house thank you so much. >> deirdre: here to react to the fbi fallout, bill gavin, a former fbi assistant director. bill it was friday we got that bombshell statement from the head of the miami unit of the fbi. let's just listen to that and get your reaction. >> the fbi released a statement regarding information provided to our public access line on january 5 of this year. the caller provided information about nikolas cruz, the potential of him becoming a school shooter. under protocol this information should have been provided to the miami field office.

there appropriate steps would have been taken. the fbi has determined that protocol was not followed. >> deirdre: bill when you heard that, your heart must have sunk. >> it sure did, david, i was embarrassed, the fbi itself was embarrass, and there is no way to make up for that with the horror that occurred as a result of this young man killing all these people. >> deirdre: well bill specifically, if the call had been made to the miami bureau and if they had gone to investigate all this what would have happened? could the shooting have been avoided? >> that's very difficult to say, david. i don't know if it could have been avoided certainly if the lead went into the sic in miami and he sent agents out at least to talk to this individual to see what the problem was, go to the school talk to the school do they have a problem there talk to students that would have been done, but could they have obtained any kind of a search

warrant? that would all be subject to vague ares of the united states attorney office down there to determine whether or not they had probable cause to look at his computers but the bottom line is it was a horrible event not to have been picked up by whoever is responsible at the center for receiving these tips, and not analyzing it and sending it out immediately to the fbi in miami. that was will be forever a sorrowfull for that and it's out in the open we were transparent about it but that doesn't satisfy anything. >> well governor scott says of course nothing will satisfy a horror like this but governor scott says the director of the fbi wray should be fired as a result of this, what do you think of that? >> i think that's probably a little bit over-the-top. i understand the emotional aspect david but firing director wray over something that happened probably without i know without his knowledge and he's

done everything to rectify it, i'm sure the appropriate measure s are in place and it doesn't happen again, they probably changed some of the protocol, but fire director wray just doesn't make sense to me. >> now the president spoke to this and he kind of linked the shooting to the mueller investigation. i just want to put up a tweet that he put out this weekend ong many oerth he said "very sad ttha the fbi misse all of the many signals st out by the florid shooter. this is not acceptable. they are spending too much time trying to prove russian collusion with the trump campaign. there is no collusion." are they distracted? is the fbi distracted by the russia investigation? >> i'm sure that the president of the united states fully understands that the 3700 or 37,000, a whole bunch of people in the fbi, i'm sure that he also realizes that there is no distraction from doing of the

all of our investigations, all of the investigations in the fbi , it doesn't doing what they're doing in conjunction with the collusion and with the robert mueller is not detracting from what they do on an every day basis but i fully understand what he has to say and why he said it. >> we always try to mention this , the fact that he got a bad shake over the past seven or eight years, it's time that we stood up for leland despite these awful mistakes that were made that are in excusable i think somebody should pay overall the agency still does a good job. it's not an agency without any direction right now is it? >> thanks, david i appreciate that kind and you're right it isn't. 99.99% of the people are doing an outstanding job. when you have a horrible event like this, and somebody doesn't do the right job, it just

exacerbates and magnifies the horror of the whole thing and there is no excuse. we often, i don't think the bureau is offering any excuse to a tone for this. it happened and it was wrong to happen and they've been transparent about it and they're doing everything to remedy it but what i think what we have to do as a country is determine how do we address this whole problem of mental instability among our citizens of this country. we have to do something. you're so good you agreed to stick around we appreciate you being hearings bill, lauren? >> well the tech titans are in focus the special counsel investigation into the russian meddling 2016 presidential election shedding light on the role of the biggest names in social media, hillary vaughn live in los angeles following that story for us, hi hillary so what is the latest? >> hey lauren, well facebook was mentioned 41 times in this indictment but they weren't the only tech company called out, twitter, youtube even pay pal listed in the 37-page document

so now social media companies are making changes to prep for the midterm election in 2017. secretaries of states across the nation gathered in d.c. this weekend for their winter meeting to talk election security along with facebook, secretary of state dennis miller, denise merr il was the president during the 2016 election and she says voter fraud and hackers aren't the biggest threat to election security. >> but its come through to me also that the biggest threat is not from any of this election process or cybersecurity issues. the biggest threat seems to be from the american public believ ing the many false stories that were told out there during the last elections. >> facebook director policy also attended that meeting telling election officials that facebook is cracking down on political ad buyers to make sure they're living in the u.s. and at the heart of this big strategy, any ad buyer who wants to advertise

in a federal rate will be mailed a postcard with a code they need to enter in order to make an ad buy and now while facebook is making changes their vice president of ads pushing back on the idea that russian ads were a big player during the 2016 election goldman tweeting most of the coverage of russian meddling involves their attempt to affect the outcome of the 2016 election i've seen all the russian ads and i can say that swaying the election was not the main goal. he continues to say that the majority of russian ad spend happened after the election saying we shared that but very few outlets have covered it because it doesn't align with the main media narrative of trump at the election now twitter saying the fight against election-focused propaganda is a shared responsibility and they think law enforcement needs to lead that charge. lauren? >> hillary vaughn thank you so much you've teed me up perfectly for bill gavin, who has been sticking around. bill you just heard hillary's report. what can we done to make sure

there is a strong likelihood that the russians meddling again in the midterms and of course 2020. what did law enforcement do? >> lauren it's a complex problem with a complex solution. first of all when mr. goldman says it wasn't the main goal of the russians to interfere with an election, i guess you can see that it was a goal. when did he determine that it was a goal and what did he do about it? that's a question that's still up in the air. and what can be done in the future, i think more attention from the social media, for social media itself for the leaders of the organization bringing those things that disturb them to the attention. send them postcards everything, that's it is what it is but i'm not too sure it's going to be totally effective to stop some perpetrator from doing what they want to do with ads still. they may say one thing and do another as many people do. >> it's an old school way to deal with a modern problem in

essence and you can always get, you know, a fake local address anyhow. to get back to the point, i understand and i think the american people understand that any other country meddling in our political system to create discord is wrong and bad and a big deal, but if you can just perhaps quantify how big of a deal this is, and i'm asking in light of a couple of things. if you look at how much money these russian-paid actors spent on social media advertisements, we're talking about thousands of dollars a month, where the campaigns whether it be the clinton or the trump campaign they spent almost $2.5 billion, so how big of a deal is this in influencing our politics? >> you know, i think it's very difficult to measure it. i don't know what the yardstick is that you'd use to measure the influence that it has because it's so subjective when it goes out over-the-air and when it gets americans to participate in

an ad campaign that they think originates in america, it's very deceitful at worst and how much it influences i don't know but what i can say is that the investigation being conducted by mueller and the committee, it just goes to show what is being done, is the right thing to be done because they have issued subpoenas convened a grand jury and indicted a whole bunch of people in three corporations. if this had been done in other cases in particularly the server case with hillary clinton and it was left to agents to bring it before a grand jury convened by the united states attorney and subpoenas issued r for people to come and tell the truth, tell a lie or take the fifth we wouldn't be in the situation we are in today in terms of this whole with hillary's server so it just shows that when the right thing is done the right results will take effect. >> noted.

noted and just going back to the social media companies for a moment here. do you think educating the citizens will help in making sure that misinformation isn't spread so easily? >> i don't know how we would do that, you know, it would take one heck of an educational endeavor and i really don't know who would start there, where it would come from, who gets to be gored out of that kind of an educational process. >> bill, thank you so much. my pleasure lauren thank you so much. >> and as ku see from that shot, that's from palm beach, they are preparing air force one for the president i believe one of those cars with the flags in the front has the president inside and he is embarking for a trip to washington d.c. back to the white house. cameras are kept a little further away than usual during this particular trip back home for the president.

whole investigation by claiming victory here because what if down the road there is another indictment or a series of indictments that do name trump or do name the russians and trump campaign colluding because that's what this is about. this is about getting trump, chris. this whole thing is about setting trump up for impeachment if the democrats win in 2018, this donald trump remains in the crosshairs. he is the target and there is no letup in that. david: a lot to unpack in that statement rush limbaugh warning president trump not to claim victory offer special counsel robert mueller's indictment of 13 russians released friday his indictment stated that there was and i'm quoting him now, mueller now, "no allegation in this indictment that any american had any knowledge of russian election meddling." here is john decker fox news radio white house correspondent thanks for joining us on this holiday john. what do you think of rush

limbaugh's warning? >> well he raises a really good point. the risk for the president, the risk for anybody on his team claiming that this mueller indictment which was announced on friday is a vindication of the entire investigation. i think puts the president and his team on a slippery slope, because as rush limbaugh points out in that sound bite that you just played it's down the road. mueller decides based upon evidence to indict the president or anybody close to the president on his team here at the white house. they already have the president on record saying that robert mueller as it relates to this indictment of these 13 russian nationals is doing a very good job. david: yeah, but you know, what about the other point that rush makes that the brass ring for democrats is impeachment if they take over the house, of course the house can impeach it's the senate that has to try and it's a tougher road for democrats to take over the senate but if they take over the house there's going to be an impeachment what do you think? >> i have no doubt there are

some members of the house even the senate that would very much like to bring articles of impeachment against this president, but you need something there. the constitution talks about high crimes and misdemeanors. have we seen anything like that related to the president yet? no, we haven't, but mr. mueller continues his investigation. remember, with bill clinton back in the 90s when the house brought articles of impeachment against bill clinton they had something to go on with the star investigation. there was some wrongdoing that mr. star alleged took place on the part of the then president, namely lying under oath. nothing like that has been brought by robert mueller yet against this president. david: you know there was something else in the mueller indictment on friday that was kind of interesting it showed how deeply our investigative units whether it was the c cia or fbi we're not sure a combination were investigating these russians long before the election itself. that led donald trump to tweet this out this afternoon.

he said obama was president up to and beyond the 2016 election, so why didn't he do something about russian meddling? he's got a point doesn't he? >> he does have a point you're already seeing some democrats raise exactly the same issue the president raised in this tweet including adam schiff whose the ranking member of the house intelligence committee. president obama perhaps should have done more, but i think he was ultimately very confident that hillary clinton was going to win the 2016 election, no need to go down that road and of course it was after the election that president obama imposed those tough sanctions on the russian government. david: john very quickly one interesting thing is that more activity russian activity took place after the election, including by the way of protest at which michael moore was attending, so i'm wondering if michael moore is part of the russian collusion here? >> well i don't know about that. i know you're making a joke. david: i'm joking i'm joking. >> but as they point out in this

lauren: florida school shooting suspect nikolas cruz appearing in court this afternoon there he is there. the judge ordering cruz to be present at the hearing to decide how much of his case should be sealed to the public. joining us now with the very latest, outside the courthouse in parkland, florida fox news correspondent steve harrigan. steve what is the latest on the situation? >> reporter: this is really the first look that we got at the shooter live in court, 19-year-old nikolas cruz, five foot seven just 130 pounds, he looks in the red jump suit

reserved for the most violent offenders, his arms and ankles were shackled but this is the man suspected of firing off more than 100 rounds on wednesday in less than three minutes killing 17 people, 14 students three administrators and wounding more than a dozen. he has been in solitary confinement and also been on suicide watch according to the sheriff here. they have is on him at all times so far, his public defender says he is likely to plead guilty to 17 counts of first degree murder this the attorney says would be an attempt to try and avoid the death penalty. as far as the mood and the situation on the streets, it is really a mix. on the one hand there is funeral after funeral. four yesterday, three today, two more tomorrow, and around those are often viewings or wakes, so some students are simply too stunned by what has happened to really make sense of it but others are moving forward and moving forward politically trying to harness or channel some of that anger and grief. there have been a number of anti -gun rallies over the

>> good to be here. >> thank you so much. lauren: robin is this a good strategy to basically weaponize nancy pelosi? >> if i were a republican strategist i think it's the best strategy. her name is basically enough to the right and even to some moderates like myself and you know the republicans have really effectively used her name right here i'm from atlanta, georgia and we sunk the campaign by linking him to pelosi they were never even in the same room together but commercial after commercial after commercial calling him a pelosi democrat and that worked. lauren: what do you think kristin? >> well, i mean i tend to agree with robin. that's fascinating. lauren: wow. >> but it was really a serious miss calculation on the part of the democratic party as well as nancy pelosi to do that eight hour speech and then even previous to be apart of shutting down the government. whenever the government shuts down even though it was not for a very long time still the party to blame very much was perceived

throughout the media as the democrats fault and obviously she is the leader of the of opposition party. the interesting thing her favorability ratings are relatively low but really what matters more when you come to the president the midterms are the presidential approval ratings and we've seen those continue to go up but i will say final word here is that a lot can happen between now and november, but especially in this cycle. lauren: the president has anyway indicative of the future this will continue. and a lot of folks on both sides of the aisle say she's so disconnected, i mean if you think of all of the crumbs comments that she made about the tax cuts and bonuses, saying oh, just crumbs, you know, donald trump tweeted this one of his many tweets. great polster, now has the gop up in the generic congressional ballot. big gain over last four weeks. i guess people are loving the big tax cuts giving them by the republicans, the cuts, the dems

want to takeaway, we need more republicans, so robin if you're a democrat and the tax cut and the stimulus is getting more popular, how do you campaign against that? >> it's a tough one, the only thing that i can say is that democrats are pointing out the disparity that of course the bulk of the tax cuts went to the upper brackets and you saw paul ryan recently brag about the lady who was saving $1.50 a week on her paycheck, so you know, we'll try and nuance that and point out the disparity there but the point is that people like nancy pelosi you know her net worth is somewhere around $29.3 million, so for her to call that crumbs, she's just the wrong messenger for that and you mentioned that she's maybe out of touch. well she's from california. she's a liberal from california so i tend to agree with you. lauren: i want to get this in too, senate majority leader mitch mcconnell told the new york times somewhat of a change of heart and he was more

optimistic earlier this year he now expects republicans to lose seats in the house and senate. why do you think that is? >> well historically every single midterm election the party in power will lose seats so it's just a function of politics and also he's probably being cautious because being the senate majority leader understanding his very public position he has to obviously set lower expectations so that when they do come out and possibly gain seats he can celebrate. lauren: just to be fair here he did point out the fundraising obstacle that the gop senate candidates in key states where they're up against democratic incumbents the gop candidates are struggling look at the difference in the numbers over 2 million to 700,000. kristin, robin thank you so much , good to see both of you and for a long day kristin you were on with us earlier this morning. >> thanks lauren. david: good people there and while some business networks are taking the day off did you notice if you did notice and you're watching the wrong channel because fox business is open for business all day. by the way last week the market

david: a nuclear armed brawl, the website is reporting that a u.s. military aid carrying the nuclear codes was being blocked from following president trump into china's great hall during the president's trip there in november when chief of staff kelly heard about it he approached the chinese guard in a shoving match ensued leading to the usa being allowed into the great hall. the secret service trying to soften the incident tweeted out fact check reports about secret service agents tackling a host nation official during the president's trip to china in november 2017 are false. here now is lieutenant general thomas mcinerney, general you ever heard about anything like this happening before? >> i have not, david, so it surprised me a great deal. david: well as you heard, the secret service is suggesting that general kelly didn't tackle anybody but the story didn't say

that he tackled anybody. i think they're trying to make the best of a bad situation here >> they are. what he did according to the reports i read was he moved out when he heard they were being held up this particular group of aids and assistants was being held up. he immediately went out, went to where he was being held up, told the whole group to move through, and the chinese guard didn't want that to happen and he put his hand up on general kelly who nicely removed it. there are words that secret service then got in a wrestling match but in any case general kelly was on the scene, he was proactive. david: well he's a marine general. he's not air force but he's a marine he doesn't take it but just one quick question. i mean, we make light of it, but it does show perhaps a vulnerability of having all those nuclear codes in one bag

lauren? >> laura: lauren: that would be like one day, a family of four, $530 not including parking i digress let's bring in back conservative comentator and robin former obama campaign regional field director. what do you guys think of universal basic income, good idea kristin? >> well actually, on the broader scale universal basic income is something that conservative economists have also proposed but the concept being when you give universal basic income from the federal government, it's something that eliminates all other welfare programs so all other entitlement programs so you're just giving people that u bi, so it is something that people have proposed with increasing automation and globalization and lower wages people working multiple jobs a way to actually sustain the economy and also enforce another conservative principle which we leave spending time with family building communities that time

can be better spent instead of making minimum wage it can be better invested in family and communities so this is actually something on a broader scale might 10-15 years down the road that we discuss but in this experiment $500 a month extra is not enough to get any real results and as you saw there it's not going to incentive incentivize people to save this money or invest it in a way to help their career. lauren: i like the spin silicon valley puts on this robin, mark zuckerberg has been on the record and said this is a way that you chase your dreams, you'll have a cushion so you can go about and do whatever it is you really want to do. do you buy that or do you think that's a little bit of guilt for the people who create the robots an the artificial intelligence and everything else that basically still are human jobs? >> you know i see exactly where you're going and i came out in full disclosure against this policy when mark zuckerberg did put this out as a nationwide program potentially and he was fielding a potential 2020 run

himself when he was dog the 50 state tour, so i came out against that but i want to say that a study was just released yesterday which i found fascinating because we already sort of have this in alaska with the alaska permanent fund it's a $61 billion program that's funded from oil money and so alaska residents all of them get some form of a basic income off of that and i want to point out that the study released yesterday showed employment went up by 17% and that people actually took on additional employment so i'm curious to see how this experiment goes. lauren: that is a very good point because the way our welfare system works now, if you make too much money, they pullback what you get. if there's no strings attached here, this cohen courage people to work even more and increase employment. >> it absolutely could but at the end of the day it's going to sound like free money to a lot of people. you have to have the personal responsibility, there are skills that have you to have as a person to be able to use that money wisely so it doesn't
