but the stock market tanked on the news, down more than 500 points. former u.s. trade representative rob portman is concerned that the president announced tariffs before the final details for finalized. >> it depends which countries might be exempted, which products. we don't know the details yet. i understand that was coming out next week and the president preempted it with his comments today. >> the tariffs are needed to protect certain steel companies and products sensitive to national security. but pat toomy of opinion said we should use existing laws to combat dumping in a statement saying changing course from this approach by invoking national security as a means of imposing huge tariffs on all kinds of imported steel is a big mistake that will increase cost ps on american consumer consumers witr country jobs and invite retaliation from other countries. the action is aimed at china which has been dumping cheap steel products into the u.s. for

nunes today wrote a letter to sessions. it says, in part, quote, the accuracy of information contained within fisa applications is of utmost importance. only documented and verified information may be used to support fbi application to the fisa court. congressman nunes is giving the justice department until march 8 to explain whether any criminal statutes were violated or whether the rules have been changed. speaking of the beleaguered and beseized attorney general, reports now surfacing that president trump has been referring to jeff sessions as mr. ma goo, a reference to the bumbling cartoon character and speculation of course rising as well about this photo, the three highest ranking officials in the justice department were dining out in washington last night as they show solidarity. sessions breaking bread with

deposit any attorney general rod rosenstein and solicitor general noel francisco in an upscale restaurant across the street from the trump hotel. a little trolling it appears. joining me now, fox news legal analyst greg jarrett. great to see you. >> great to see you, lou. lou: let's start with the nunes letter. that's tough stuff demanding answers and it seems appropriate. >> it is. and one must remember that sessions can't simply say i don't know anything about it. it was the obama administration. no, rod rosenstein, who also ought to be hauled in front of the intelligence committee, signed one of the applications for the warrant to spy on carter page, a trump campaign adviser. so the doj currently has a lot to answer for. sessions will, in typical form as he often does during his con confirmation, appearances, you

know, seems befuddled. he does seem like mr. ma goo. doesn't seem like what's going on. says i'll have to get back to you on that or i don't know anything about it. the guy, as i mentioned, that nunes ought to haul in front of the committee is rod rosenstein. he was in on this and we now know through a couple of committees that the fisa court judgeses were deceived and evidence was concealed. and that's a violation by my count of six felonies. lou: you know, all of that is outrageous, compelling and yet we know that right now the justice department has -- its leadership has a culture of delay delay delay. we never seem to get closure or resolution on any of their investigations, whether by the fbi, the inspector general, it just goes on endlessly. and we've got to find a way to break that. the fbi seemingly no longer knows how to conduct an

investigation. the effect, it seems to me, greg, has been to give everyone in the justice department leadership, who seems extraordinarily guilty of all sorts of infractions, time to cover their trail, to hide evidence. i mean, there's no urgency to that institution. it is utterly mind-boggling. >> which is why it was such a dumb an announcement by sessiono say i'll have the inspector general look at that. the ig investigates misconduct, not crime. there's plenty of compelling evidence of crimes here. the ig doesn't have grand jury subpoena power. can't compel witnesses. the ig has complained to congress that every time he tries to talk to the fbi and the department of justice they dummy up or deflect or they provide him with documents that appear to have been altered or redacted. so you have to have a second

special counsel who has the power to compel. lou: and the fbi has demonstrated its leadership, that it is, in fact now, a state police, a national state police, a secret organization that has been able to push away oversight, whether it's by the president of the united states, they are unresponsive to the u.s. congress, to the senate, both houses of course with oversight responsibility. >> yeah. constitutional authority of oversight. and yet the fbi, for years -- and it became acute during the obama administration -- thumbed their noses at efforts by congress to oversee them. this is what happens when absolute power corrupts and the doj and the fbi have had for too long absolute power. lou: and this mad nonsense that

has been perpetrated by the left, the department of justice is an independent department of the executive branch, the fbi is an independent police state unto itself. i mean, this is ignorance. by the way, this ignorance is supported by speaker ryan, senator mitch mcconnell, the leaders of the house and the senate, because they are part of a massive problem that is threatening this presidency. >> the doj, fbi, independence is one of the great canards perpetrated by those institutions on congress and the american public. it doesn't exist. it was fabricated so they could get away with abuses of power. lou: very quickly, clapper, comey and brennan. >> yeah. lou: the top three former heads of the top three intelligence agencies and the head of the

why is there any question about it? >> there should not been an outside question. people in the white house and the administration are supposed to give the president the best counsel he can. once he makes u makes up his mi, they're not to go out and say i wasn't for it. they ought to keep their mouth shut. lou: once the decision is made by the president of the united states, that should settle it. >> the discussion of the decision ought to be shut down and made internal. i think the thing that amazes me about this white house, 13, 14 months now, how much -- it's like general kelly. you know, it's the president's prerogative whether he wants general kelly or not. if i was the chief of staff and being bad mouthed by my staff, i would kick their ass out of that building. the idea that people aren't happy with general kelly that work for him, that's tough. the only guy he has to please is the president of the united states. when the president isn't happy with the staff you ought to get rid of them. that's the bottom line.

lou: it's amazing his patience with some of these folks, the president. and i suppose without certain knowledge, also general kelly is being very patient. kelly's future, h.r. mcmaster again being rumored to be leaving, hope hicks is leaving. >> again, these rumors are not rumors by the president. they're rumors by the staff. lou: i don't know who they're from. >> we're picking things up and it doesn't do any good. the most absurd thing today was for huckabee to say there are no shake jums iups in the white ho. lou: we elected this man to run the country and get us off of the path of devastation and destruction that we've been on for four decades, to end foreign wars, to end stupid open borders, to actually focus on trade policies that benefit the

we can tell, doesn't yet fly. >> that's true. but in fairness to putin, he has been refreshing his entire nuclear arsenal over the last five to six years, rather healthily. and what we're talking about icbms, long range bombers and submarine delivered missiles. and our systems have been atrophying. the trump budget for fy18 and fy19 begin to do the same thing. in other words upgrade our nuclear capability. the other thing is that putin is developing small yield tactical nuclear equips. we got rid of that as a result of the inf treaty. secretary mcmaster proposed to the president to do much of the same. what we've found out is that as long as we hold the same weapons that our adversaries hold, we're likely never going to use them and that's the policy we're moving towards. we're moving in the right direction here.

lou: that is toward expanding and creating new tactical weapons, nuclear weapons. >> and upgrading all of our strategic weapons. every single one of them. lou: you talked about four to five years on the part of russia. how quickly do you believe the united states can catch up with the russian advance? >> it will take us at least five or six years of full throated budgets on a scale that we have right now. and we just got to make the commitment to that. if we don't do that, we're going to have problems. because we're still the dominant military in the world, lou, we have eroded and our adversaries have caught up to us in a lot of our technology advantage and in certain cases they've gone ahead of us. they actually have a better tank than we have. we've been paying for 16 years of 9/11 wars and we haven't been able to capitalize on investment

accounts to get the kind of technological edge capabilities that we used to. lou: you know the president has made it clear -- he made it clear beginning in his campaign, his impatience with those who carry on unending wars, the cost of those wars and thousands of american lives, and more than $6 trillion i and the conflicts still go on. immigration policies that are not merit-based but create greater burdens rather than deal with the needs of this advanced technological service-driven economy of ours. it is stunning that we have such, such needs now in 2018 that we have to start funding to get our military into a position to basically just to protect the nation, let alone deal with foreign threats. >> and we have to do it in deficit spending as well, which

you could go to china during those booming years the last couple of decades and you would look out your hotel window. everywhere you see cranes building skyscrapers. at one time they said every crane they could get their hand on they had building in china. and then they had that paris accord -- lou: i'm sorry. without any reciprocity, there was no quid pro quo. that was a gift from the american people and the american economy to the chinese who are now dumping steel, aluminum and many other products on our country. it is -- and this is the only president who's had the guts to say it ends now. >> yep. the clintons helped it along. the bushes helped it along. obama did nothing during that period. now we have a president who says wait a second.

we keep kicking the can down the road whether it's korea, illegal immigration or gun control, here's a president knocking heads saying, okay, what's the solution. let's do it. it's got some people in washington panicked. lou: it's interesting. people do not want to accept that the man the american people sent to serve as our president is doing exactly what those voters wanted. he is disrupting the swamp, the nation's capital that is brimming with corruption, the power of special interest rather than the national interest is first in the minds and the wallets of so many of those serving as senators and congressmen. it's appalling. i mean it's hard to imagine where we would be, where we would be headed if president trump had not been the man chosen to be in the oval office. >> you're absolutely right. you know, the last two years we
