at&t will build a help consumers and allow them to compete with amazon and netflix. the government says at&t will have too much control over distribution and higher fees leading to higher cable bills. there's a lot more at stake in this case. unlike upon the outcome of good morning. it's been a good morning. cheryl: let's talk about the doj's challenge to the deal. they say this with say this to be anticompetitive, would raise prices on consumers. it would consolidate the entertainment market in general. do you agree with that assertion from the tmj? >> at&t makes a lot of good arguments against it. number one, they argue this is a digital merger. because they don't own tv content businesses attract and the competitor from the marketplace, said they argue it passes regulatory muster and they also argue that the flaw in the doj argument is that it's

hard economic base. they say would be an economically viable business model to blackout tv channels. that would drive up prices. instead they argue we raise competition. at&t keeps saying a real competition is facebook, amazon, netflix and google. they're merging with time warner it enables us to be more competitive. two main reasons for merging aside from the competitive edge with verizon. number one, to develop the online video factory to become more competitive, which david allen. secondly, mary and the consumer data with time warner's content and that would enable them to make profit by targeted advertising. cheryl: that's interesting. on the other side of at&t has

made several arguments as to why this would not affect the consumer. you have to get a little credence to the doj argument because their point is if at&t controls not only devices commit bandwidth coming number x, whether 5g or less, that they've got the power to slow down your phone, slowdown phone, slowdown or service from his load on your internet comes loaded on your device and if you want to watch netflix or a time warner programmer cable channel on your phone, they've got the power to basically make you pay more for that type of service. which side is the industry we are in right now. do you think the doj will hang themselves on that argument? i don't mean hang themselves, the focus on that argument or will they go another route, maybe with the fact cnn has been critical of time warner. does that come up? >> right, that will come up slightly. they will emphasize your prior point they are.

>> you would think so. this is the third time since january that congress is contemplated shutting the government down in the reality is they will have to come up with some sort of compromise to have a spending bill in place because congress knows the government can't stay shutdown. we've seen them come to the compromise in regarding immigration, the issue is something the democrats are crying wolf. because they have had since january to approach the table in good faith. they haven't done that and if they were honest, they would recognize that really what they are asking for is to legalize millions and millions of votes to keep the republican party in the minority permanently and that is something the gop isn't willing to do. regarding immigration, they have to approach the table in good faith and come up with something with a spending bill that would get us into long-term planning. cheryl: i want to go through for

viewers and for us, the things that issue underneath this do you need a scorecard here. gateway telephone into your city tunnel. gun violence, security funding for elections, harassment on online sales tax and abortion restrictions and affordable care act. all of that is in here. the most polarizing piece of this will be daca. i want you to listen to what senator durbin said on "fox news sunday" about the particular part of the spending bill. >> we are not going to have a shutdown. i'm urging the leaders to come together and understand there is an emergency at hand here. 780,000 young people have their lives hanging in the balance because president trump killed the daca program. we have to move on a bipartisan basis to put it back in business. cheryl: daca not going away?

>> not going away. a judge is taking some of the pressure off on the issue. i don't think that's going to be a problem in this round of debates. the problem is we continue to see republicans won't allow a shutdown because they are to democrats on board. durbin pretty much set up pretty much said it. they got the deal they wanted the last time around and though cobbled through the additional spending they want to satisfy democrats to disenfranchise in the way a fiscal conservative republicans and find all the votes they need to pass the bill. it is frustrating, but that's what's going to happen. >> they've given them a six-month window for the dreamers and congress failed to act. the other thing that could happen, especially in the senate, there is opportunity for some of the senators, like rand

paul for instance who are very against the high spending levels with the budget, deficit spending, whatever you want to call it, to delay proceedings to purchase up to the deadline. did you see that happen? >> there may be. this is car sharing on both sides understand this happened three times since january, but they come out to the very last minute and have to push something through that as a stopgap rather than genuinely looking forward saying what extents of the spending bill. also congressman massey as well from kentucky says that the government shouldn't be spending this much money and figure out what makes sense. if congress would you recommend they can truly have a bipartisan. cheryl: 2011 spending were republicans that wanted this at the time. thank you so much for your time this morning. thanks for chiming in this morning. >> thank you, cheryl.

they are facing a major backlash over one firm that exploited access to facebook personal profiles. lauren: hillary bond filling in for tracee carrasco. she joins us i'm not. >> good morning, ladies. 50 million people's personal information on facebook is apparently exploited by the data analytics firm that worked on president trump's campaign and now facebook is in a lot of hot water over this. they deny any wrongdoing saying this firm exploited one of the features to get access to the data. facebook in response has suspended the firm, but lawmakers in congress from senator marco rubio to senator jeff flake have all spoken out against the issue saying that this may call for a little bit more oversight over the tech company. lauren: can face the police itself? it's no secret apple is working on something secret cared what

>> in a sense commend the u.s. administration has made it very clear. do you want to move on this or not? it's an comment really upon the rest of the world as to how they respond, whether mnuchin is defending the position. the e.u., for example has higher tariffs than the united state and many products and it would be for both sides to sit down around the table with an arrangement whereby the e.u. would refuse without the u.s. raising its own. in a sense, that would be a win-win situation. i think the u.s. is in a pretty strong place. he doesn't necessarily have to be on the defensive. cheryl: the federal reserve this week, widely expected to hike interest rates. this is the meeting we will get the press conference with jay powell. first off, would you expect from the fed and number two, what you
