own making and perhaps encounter disaster in the midterms. the man responsible for stopping leaks from the white house is angry over leaks at the white house. chief of staff john kelly said to be infuriated with national security advisers after one or more of them leaked that they recommend the president not congratulate vladimir putin during a phone call yesterday. no no one seems to care. not even the attorney general. and facebook's mark zuckerberg is still in hiding. a real leader. finally putting out a statement today five days after the news broke that facebook has broken trust with its users and apparently leaderless. zuckerberg, simply a mess. our guest tonight, congressman matt gates on the government shutdown battle, the $1.3 trillion spending, written by the dems.

elections. it's ugly tonight in the house and it's not likely to get any better with the midnight friday deadline looming. fox news chief congressional correspondent mike emanuel on capitol hill. reporter: president trump signed often. press secretary sara sanders saying that the president supported the bill because it contains more funds to rebuild the military, such as the large ers raise for our troops in a decade and other can dmeek domec priorities. congress didn't have time for a snow day with the deadline approaches. >> i'm proud to announce it will will reach vital objectives. >> $2 billion in new money for school safety measures, a bipartisan proposal tightening up background checks for firearm purchases and $1.6 billion for

the president's border wall. $4.7 billions to address the opioid epidemic. they kept obama staicialization money out of the deal and president trump gets a deal by keeping the gateway fro being passed. saying, i think the whole process sucks. whoever designed this isn't qualified to run a food truck and he' not alone. >> when you have four people deciding. it's not a good way to do business and i hope we can do it better in the future because this is designed -- it's not very transparent. >> a former house budgeter blasted the senate for creating a mess. >> we passed what budget and appropriation bills. it is the senate who can't get their act together. we come to a place where we do a huge spending bill that has not been negotiated between the house members and the senate

members, but just a small group of people. >> signaling some relief that in the final hours the impasse seemed to have broken. >> i don't believe there will be a shutdown, if nes, god forbid a continuing resolution. >> there are leadership on both sides hoping deadline pressure and the president's endorsement will produce a result. but we've heard conservative frustration with the house expected to vote tomorrow and the lawmakers will not have enough time to read the bill. lou: mike emanuel reporting our first guest tonight blasting republican leaders for not giving the members time to read the spending legislation text and he says the time is now to get funding for the border wall which by the way won't happen in what we tbhoa is contained in this legislation. congressman matt gates who serves on a number of key committees, including judiciary. i've heard mark meadows complain, you complain and a

number of other members. it is squarely on speaker ryan and mitch mcconnell on the way this is going on. they are leading the house and the senate, as you well know, and they bring in pelosi and schumer and the four of them make these decisions. what's the point of being in control of the house and the senate? >> well, lou, this is bipartisanship at its worst. and unfortunately definite spending is the glue holding together the republican leadership and democrats here in congress. it is absurd that under republican control of the government we would see the biggest increase in spending since the obama stimulus package. that's not what we promised people. we promised border security. we said conservative principles like pro-life principles and prosecond amendment principles . i fear that this will hollow out this country from the inside. lou: congressman, you're a conservative, first and foremost on so many issues.

and last night talking with congressman ron desantis who like you is a stalwart in the house and i asked simply, why do you put up with paul ryan. why does the president put up with paul ryan. he's sold out to everyone he can sell out to, the chamber of commerce, the business round table, to the establishment in every way he does hi master's building and says the hell with the republican party every chance he gets and conservatives be damned. >> well i wish that speaker ryan would form a government coalition with conservatives and i wish that conservatives would be more willing to work with the speaker on those matters. unfortunately this bill that we're about to built on was built on ooh conservative that did not include conservatives. i'm sure that chuck schumer is popping the champagne in his office right now with a number of democratic priorities maintained. lou: he would be a damn fool if he weren't. we're looking at $4 billion in

spending headed his way, an easy pass down the northeast corridor for the tunnel project, the gateway project. we're looking at the president accepting a 5% down payment on the border wall which is basically a large statement to the president that i would think normal circumstances he might find it a reason to fight. but not now. >> well, you're right. we promised the american people a wall, not a tunnel. and i'm not sure if the gateway tunnel is going to be in the bill or not and frankly it's going to take many hours and for most people it would take days to read this bill. we chastise democrats when they put legislation on the floor without the opportunity to reveal it. these are highly con flex issues. there is language in this legislation that will impact people's second amendment rights. how am i supposed t suppose to t if we only have a few hours to read it before a vote. that is no way to run anything,

much less the most powerful government in the world. lou: $1.3 million, most of it, much of it democratic spending and they couldn't have written it up better from what we know of what its contents are. secondly, this is a president who is being mocked by chuck schumer and nancy pelosi and the democrats and paul ryan and mitch mcconnell. he's being mocked. 5% on the border wall and he has to eat that? what is the point of being a and how many of you think that you will have a majority after this bill passes and you head into the midterms. i they you're waiting for a slaughter. >> if this is the last bill that we pass of significance before going into the midterms, it will and should leave a sour taste in the mouth of voters. i'm hopeful after this we'll be able to tackle critical priorities of the president like

tax cuts -- lou: it's not going to matter, congressman. what you're putting forward here right now and so signing your names to will be gun control legislation. you'll be funding the democratic agenda. you'll be telling the president to go to hell with us. this is just not acceptable to his base and whoever is advising the president, whoever is advising the republican conference in the house is crazy as hell. you're going to pay a huge huge price. >> the people who advocate for this bill would say that the military is december nately in need of support. my problem is that i'm not willing to fund the military in exchange for hollowing out the country that they're fighting to save here at home. if we allow this country to be destroyed by debt, driven into economic despair, it would matter what our military is around the world. we need to take care of the priorities and promises we made

and it's putting west wing leakers on notice again, calling leaks about the president's calls to vladimir putin illegal and likely a fireable offense. chief of staff john kelly reportedly outraged but what he's doing to stop the leaking. it shouldn't be that hard, should it, to find the leakers? the president prepped for his putin car by the national security team led by h.r. mcmaster who is said to be close to losing his job for fighting with the president. you know, that's pretty strong. joining me now, charlie hurt. have you ever seen the like, charlie. you got the chief of staff running around stamping his feet but he's the guy who is supposed to be assuring the president that the people around him have integrity, discretion and judgment and are loyal to the president and to the country. >> it is truly incredible, lou. i've never seen anything like

it. the idea that something that sensitive, that close to national security information, that immediately would be leaked from the president's desk to the "washington post" is beyond astonishing. and i really don't understand how it is that the white house hasn't figured out how to control these leaks. because these people are not serving the president. if they don't like the president, quit, leave. they're not doing anybody any good. but honestly i think the real problem is that we have a lot of people and they despise the president and they despise the president's agenda that got him aelected that the people want and they think it's their duty to remain in the white house or in the administration to protect america from what we voters want. and that includes doing things that -- i don't see how it's not illegal. nobody -- lou: the white house even raised the question as to whether it was illegal. they don't know at this date, 14

today where in any evidence obtained unlawfully or throughout any sort of illegal act on behalf of law enforcement or prosecutors can't be used. and anything derived from that can't be used as evidence. this is criminal law matters -- lou: is there anything that mueller has done that wouldn't be contaminated, tainted as you put it? >> no. what we have is mueller acknowledging that he had a huge problem with strzok being on his staff because strzok, he's got his fingers in everything. he was in the hill clinton e-mail server case, the russia case with the steele dossier. the fact that mueller realized strzok is a problem anakined him is an admission that th knows tt anything that comes out of all of those investigations is the fruit of the poisonous tree. you can't take bad evidence and pretend you got it some other

u.s. employers are prevented from paying an extra fee to have their petitions processed within two weeks. incredible. illegal immigrants who avoided capture after the oakland mayor tipped them off about i.c.e. raids last month have committed new crimes already. authorities have just apprehended three illegal immigrants who avoided arrests for offenses that include robbery and spousal abuse. acting i.c.e. director blames the mayor's actions for the escape of as many as 800 illegal immigrants. our next guest is fight against president trump's daca order in arizona. he petitioned the supreme court to take up the case to challenges to give driver's licenses to illegal immigrants, specifically daca recipients. joining us is the state of arizona's top law officer, attorney general mark brnovich.

good to have you with us. let's go to first the trump justice department basically saying they're not going to side with you and urge the supreme court not to take up the case. >> yeah. very very disappointing, lou, on so many levels because frankly our case was about more than driver's license. it was about the separation of powers, the rule of law and maybe more importantly, going back to that fundamental question of whether the president can unilaterally change a federal statute, which is what we've alleged all along president obama did and what he did with his original action dealing with daca. lou: it's been called illegal what president obama did, it was an executive action without any foundation. is that not correct? >> yes. and part of this is really -- there's some really fundamental questions i think we need to go back to. look, i'm a first generation american and you know my family fled communism in eastern

europe. lou: how far back are we going to go, mr. attorney general? we got limited time. >> i'm sorry. no, no, no. what i want to get to is the fundamental principle about the rule of law is that one person cannot unilaterally change the law. what makes the united states such a great country is the fact that no matter who you are, you have to follow the rules, no person is above the law and the law will be applied consistently and fairly to everyone. lou: did you not pay attention to the obama administration for eight years? they violated that almost daily. >> right. and that's why there were so many lawsuits against the federal government during those years. and that's my point. you cannot have the president of the united states unilaterally deciding -- lou: how does the supreme court leave in place an executive action that was illegal and call that adequate aban adequate response to your action before the supreme court? i mean, it's outrageous. >> that's the problem.

that's what i i wanted to get back to the first principles of the rule of law, the separation of powers. we've lost sight of this on both the right and the left about what the rule of law really means and what federalism really means. the federal government should not be telling zon arizona who y can and can't issue drivers' listens to. it's not up to the federal government to make those determinations. lou: are you going to appeal? >> we tried to appeal to the united states supreme court. lou: so you have no further action available to you? >> and that's the great disappointment, is the federal government, the united states department of justice basically undercut us and cut our knees out. we were hoping with the new administration that e would get some support from the federal department of justice and they would weigh in saying yes, supreme court you should hear this case. they took the step of asking the federal government to weigh in whether our case should be heard at the supreme court. and the united states department of justice said no, it shouldn't. and too me this case is so
