[♪] kennedy: the trump administration possibly on the verge of a huge immigration win. the supreme court reportedly leaning towards one of the president's signature campaign promise, a travel ban from several muslim majority countries. justice samuel alito led the liberal charge. >> i think there are 50 predominantly muslim countries in the world. five predominantly muslim countries are on this list. the population of the predominantly muslim countries

on this list make up 8% of the world's muslim population. if you look at the 10 country with the the most of muslims, exactly one, iran would be on that list of the top 10. would a reasonable observer think this was a muslim ban? kennedy: justice sotomayor questioned whether they were targeted based on their religious beliefs and does the president have the power to make such a rule. >> i see the president saying i'm going to add more to the limits congress said and to what congress said was enough. where does the president get the authority to do more than congress has already decided is adequate? kennedy: what happens next?

and who will tip the balance? joining me now, fox news' anchor shannon bream. from what you have seen and the arguments that you have witnessed, how did this play out for the president and the issues at hand? >> i would say it went pretty much as expected. there is it appears an ideological split saying the president has authority when it comes to national security. the statute says that the president can decide if people are detrimental to be admitted to the united states. he can put a block, a temporary hold on them. he has a lot of power. that answers justice sotomayor's question. justice kennedy brought up this issue of the president and the statements he made in the past about a muslim ban and blocking

muslims from coming into this country. whether those things should be factors in when you are looking at the text of the travel ban, this is the third version of it. kennedy: where are they leaning in their questions with the idea of the travel ban versus the particulars in that hawaii lawsuit? >> it's not surprising that you have folks like justice ali tee saying if this is a muslim paint's not very good because it only impacts 8% of the world's muslim population. but they did give a carve-out to the president. congress won't know six months from now we get a threat from a country and the president needs the power to block people from that country. what if he has intel from the intelligence community. for the most of part, there were

three critical comments we view as being on the left side of the bench. justice kagan who is the left side of the bench had to tough questions and had a genuine interest in whether the president could actually do these things and why it would make sense to allow him to have some of these powers. kennedy: you can't always tell how the decision will come down based on the argument before the court and the interaction between the lawyers representing each side and the justices. what is their next step in this process. walk us through that deliberation. >> this was the last case they will hear argued for the entire term. they weren't it withing a bang today. friday they will have a private conference behind closed doors. they take an initial vote about how they feel about the case. is it 5-4, 6-3, and that's where

the deliberations begin. the chief justice can in most of cases decide who writes more the minority and who writes for the majority. people start writing those opinions and say if i tweet this for you can we get your vote to come over to the side. the vote they will take friday is step number one. there is a lot of debating back and forth. as they exchange those ideas you may end up with a different vote and we get it sometime the end of june. kennedy: in that deliberation there are special relationships and things week only speculate upon and they don't have their clerks there. how could this play out when a decision is finally reached? >> i think what we have seen from this court under the leadership of justice john roberts, he likes to go as

narrow as possible. so i think they will try to make this as narrow as possible. they have put parts of the ban on hold and aloud other parts to -- and allowed other parts to proceed. the two bad decisions they got from the slower courts came from courts that are considered to be pretty liberal. people want to judge shop and forum shop where they think they will win. justice gorsuch said, i have got this problem with the single district judges, the first level of the federal court who can put out an injunction and stop an entire nationwide law. that's something we have to think about. all it takes is one judge to shut something down. that may be something justices want to address for further cases as well. kennedy: we are learning that president trump met with va

secretary nominee dr. randy jackson amid growing calls for him to step aside. jackson says he'll not withdraw his nomination to lead the va and is strongly denying the wave of misconduct allegations. some democrats, including senator jon tester say the allegations are too serious to ignore. >> the 20-some people who got ahold us and said this doctor has a problem. he hands out prescriptions like candy. in the white house they call him the candyman. kennedy: the white house says they are standing by ronny jackson. >> dr. jackson's record as a white house physician has been impeccable. because he has worked within arm's reach of three presidents,

of ronyy jackson's life that maybe should have come out much sooner. one of the biggest questions is can someone like this handle the va? >> how has someone like this with such a history apparently allegedly of drinking and crashing cars and handing out ambien and all these terrible things, how did he serve as doctor of the president of the united states for three administrations? don't you think these things would have come out? he went through four background checks. wins an fbi back ground check. we are being diewched. we don't have the right to hear what this man's policies are. we are supposed to talk about whether he has a drinking problem. it seems to me cliche'. it seems set up. this is the veterans affairs nomination. we have a bureau that needs our

help, it needs reform. i would like to hear what this man's ideas are on reform. kennedy: there are plenty of institutions within washington that could crumble and disappear overnight and you would not miss them, like the commerce department or education department. this is when the va does require. michael cohen, president trump's personal attorney will plead the fifth in the defamation case filed by storagey daniels. sources telling fox news rudy giuliani has taken oversteps with robert mueller and they are reportedly discussing a possible sit-down with president trump. should trump talk to mueller or keep his beautiful lips zipped?

>> this is complicated for the president. they have been back and forth on this issue for a while. we never heard directly from president trump other than the notion he is innocent and he wants to proclaim his innocence. i think at this point in time it's a big question about whether a new precedent is being set and the requirements are met for him to meet with the special counsel. we don't know fully what they want to ask about. so there are two sides to this one as well. i hate to say it. kennedy: giuliani is loyal to the president, he knows politics, and he knows the law. and he also knows mueller. so he can talk to him in a different way than some of the president's other personal attorneys. >> if you are talking to

somebody who has to deliver. you can talk your way into an arrest and not talk your way out of it. i don't see how this will help trump in any way. kennedy: is giuliani the savior here? >> i don't know there will be a savior other than the elections. >> i think it's good news he's on the team. he's a credible politician. he's a credible lawyer. he says he holds him in high regard. he has the possibility to be the mediator. but the intentions in the meeting were to find out why trump had the meetings he had. and it's necessary. if you are going to get rid of the charges of collusion, collusion is not a crime. you want to show what your intent was when you had those meetings. and do they under lie different
