saying we need to keep the investigation tight and congress wanting documents. at the heart of it, this august 2017 memorandum came after mueller was appointed and it limited the scope to what mueller was to investigate. it came out in the manafort case in was a motion filed. manafort challenged the scope of the investigation. and the doj redacted the document. that would be critical to know, especially in light of these questions we talked about last night about what trump could potentially be asked. what is this special counsel investigating? kennedy: i don't understand why they what with hold this -- why they would with hold this information. if you show people the scope of the investigation. supporters of the president would have an easier time

letting mueller finish the investigation which i think it's easy to -- i think it's important to do. with hold * information whether it's this or on the email server investigation. >> the first memorandum was released publicly. that was in may. this is a subsequent memorandum expanding what the scope was. if you are going to release the first one, why not show us what the investigation is about now? kennedy: it almost seems like rod rosenstein, once he knew jeff sessions reduced himself was working with james comey to get comey fired so they could launch the special counsel in order to take down the president. am i being too conspiracy theoretical? >> he wrote the memo that went to sessions, and that is one of

the bases for the firing of comey. he's also a witness in the obstruction of justice because of that memo. how can he be at the top of mueller directing him about the investigation when he's a critical witness in the obstruction of justice. kennedy: the whole thing is so strange. i hate the idea that wee continually appoint special counsel for this. i think congress has to do its job. the inspector general has to be allowed to finish. the inspector general has been very fruitful. >> we just got a report about mccabe. that was a report that got him fired. if heed finds something about rod rosenstein, that would be a reason to fire him as well. now there is other investigations with respect to the doj. i think the president should take a step back.

ty cobb had a different approach that was more conciliatory. it seems as though this legal team will be acting more like defense lawyers. what do you think? >> you made me think about something about the mustache. only one mustache is allowed at the time. but i think that it is a good sign that he's getting fighters in here. the president is going to fight anyway. you want your lawyer to be fighting moyer than you. you want to have your lawyers be just as tough or tougher than you. you need michael avenatti. he probably watching the monday shows and says that's what i need. an obnoxious guy who is a pain in the butt.

he wants his people to be the pain and maybe he won't have to. kennedy: was that approach not working? is it a sign the president is not going to sit down? >> they need to be more aggressive. up until now cobb's attitude has been we know there has been no collusion we have nothing to hide. but this investigation is not about collusion. this is a bloodless coup organized bipartisan hacks under mueller to take down the president. how many tens of millions of dollars do we have to dumb into this. kennedy: i understand people want to engineer the outcome to do the opposite of what's going on with the mueller investigation. but that could go side waist. -- could go sideways.

we used opioids. previously used only for end of life care. and recovering from inpatient surgery. after the 90s and after a lot of fraudulent practices details in the our complaints. the medical thinking changed as at result of lies these companies told doctors and their patients. that led to the spike in opioid prescriptions. kennedy: what if you have doctors say it's not fraud, it's not lies, this is the data we had. and this how we were forced to deal with pain management because we face lawsuits from the other side if we didn't deal with pain appropriately. >> understandably the students we filed today are not filed against doctors. they are filed against the opioid manufacturers and distriwithoutors for having created out of whole cloth the

data you are describing. the way a lot of doctors were educated in the 90s and early 2000s were from groups who claim to be independent. kennedy: i understand there is a lot of p.r. that goes into public education, but it doesn't mean you goat sue entire industries and jack up insurance -- malpractice insurance fees so doctors can't afford to stay in business. at some point we have to have personal responsibility. you pointed out one person every 16 minutes dies from an opioid overdose. one person every six minutes dies from alcohol poisoning. one person every 7 minutes dies from complications from diabetes. because people are eating and

drink and putting things their bodies and not taking personal responsibility. >> there is a clear distinction. the vast majority of opioid deaths we see even when they are from street drugs are in patients who initially started with prescriptions prescribed by doctors. kennedy: a majority of drug overdose deaths have to do with people putting more than one drug into their body like heath ledger. >> in the opioid context the stats don't bear that out. but also from patients taking opioids and haven't turned to any other illicit substances. the real difference is we are filing these lawsuits to recover on behalf of consumers the costs
