>> for more, let's bring in macy's. good morning to you. >> good morning. thank you for having me. cheryl: there's been a debate about invading a sitting president. how does this differ from a subpoena? >> absolutely. twice now the justice department has issued an opinion in the context of nixon and clinton that a sitting president cannot be prosecuted for a crime. that means a sitting president is not going to be indicted and prosecuted for some criminal at committee. that is different from a subpoena seeking some sort of document or witness testimony not necessarily leading to a criminal indictment of that person but it could be regarding another individual or another situation. that's the difference between the two. cheryl: today is the one-year anniversary of the mueller

investigation. i want you to listen to a rudy giuliani said about how long this has been going on for. >> it is than a year. it's got 1.4 million documents and he has nothing, which is why he wants to bring the interview and we demand from him, tell us what you have to get to you don't already have. he has all the facts to make a decision. >> he's got all the facts and he could make the decision. in past probes of this nature they've gone on for over a year. >> can't believe it's been a year, but the issue is the legal system does take time but it is particular. it is very clear mueller is not going to be able to indict trump. the question becomes is he going to begin to testify. if that happens, the trump team is absolutely going to challenge

the subpoena. guess what, there's no supreme court decision on point to that niche issue of whether or not a sitting president can be compelled to sit down and testify. in the past we saw clinton subpoenaed, but he ended up coming to an agreement to get his testimony. track challenges this, you can see this go to the supreme court. it just depends which write because how hard to push testimony. cheryl: so clear here, smaller sistrunk broke along the president can be indicted, what does mueller have at that point? >> write a report that indicates what laws were broken, what may be at may be an issue as far as breaking the law and you can submit the report to congress. congress can take the opportunity whether or not to say that would qualify as a misdemeanor for the purposes of impeachment. that's really if anything where

steve, i'll start with you. a big news for the russell at 5% for the year. while the dow was up two tenths of a percent. what does this tell you about the economy and isn't this just a response to the fact that big cab drivers are under pressure because of these trade worries? >> more than an economic story taking place. the domestic economy is running on this same trend we've been seeing for years from two and a quarter to 2.5%. accelerating lasher is starting to dip back down in the three of the big performance of large-cap relative to small cap last year. he gave us a little reversal this year. gerri: right, of course i've got to tell you small-cap now outperforming the overseas market. if you want to play this trend is an individual investor, how do you do it? analyzing the small companies

under one by one basis because the analyst coverage is spotty and after all their 7000 of these companies in the index. >> small caps were ripe for a rebound. the action had been in large caps. when you look at the small-cap index, sectors are benefiting from the domestic economy. you've got higher demand growth for loans and lower reserves at the banks. you couple that with interest rates they can charge more for the loans. the tax cut a huge slingshot effect for small-cap names which are a big part in the rational that you mentioned. gerri: that's a very good point. write it down by sector. back to you in the economy. small-cap companies move the economy to higher levels. gdp week in the first quarter,

the small business optimism sells in april. why do you think? >> the fact that there's an individual large-cap and small-cap environment. was more important is the negative impact of the tax cut and statewide level of gdp and a lot of these are dependent on transfers. what they see as basically 40% of gdp for the overall economy are being negatively impacted by the tax adjustment. typically what happens is you begin to see info for the longer-term positive come through in terms of the economy and that's the reason you see that adjustment takes place. gerri: interesting stuff. bar, which you unwind the tech

stocks because of this trend. the four or five stocks just crowding out all of their trade, is ultimately the small-cap trends sustainable? >> small caps have a long way to run on a relative basis and it wouldn't exit was been working. too risky on the wrong side of things if you've been betting against tak in the science and future of tomorrow. the same stocks are up for reason. the individual components have strong support. he saw warren buffett was saying about apple. amazon is the beast in the retail space. i don't see how you bet against what's been working and feeling the economic growth. i think you put think you put your money in a broad range of stocks if you're going to be in the stock market and it's time investors were rewarded being in small-cap sector right now. gerri: the small-cap funds or reason at this point is people
