shows. but added he believes there will be hell to pay if he pardons himself. >> he has no intention of pardoning himself. i think it would get answered by that's what the constitution says. if you want to change it, change the. i think the political ramifications of that would be tough. >> you can't interfere with him either from a point of view of indictment tore question. you can't interfere with the president's time. kennedy: white house press secretary sarah huckabee sanders defended the president when reporters bombarded her with questions about power to self-pardon. >> the president said i have an absolute right to pardon myself. why does he think that. dose also agree with rudy giuliani, his lawyer, that a

pardon would be unthinkable. >> thankfully the president hasn't done anything wrong and wouldn't have any need for a pardon. >> does the president think he's above the law? >> the president h done anything wrong. kennedy: innocent people are found guilty every day. they would love a pardon. over the weekend fox news obtained a 20-page letter that the trump legal team sent to mueller in january. it claims trump dictated don, jr.'s letter. legal experts say the mueller team is looking deeply into that. there are a lot of moving parts here. but is it evidence of impeachable wrongdoing? here to break it down. judge andrew napolitano. first up, mike lee. he's not only a lawyer.

he's a member of the senate judiciary committee and the author of the book written out of history. that is available in paperback and a perfect summer read. welcome back to the show, senator. so you have worked in the supreme court. your name has been floated as a possible nominee to become an associate justice. you tell me. does the president have the absolute power to pardon himself? >> i'm not aware of anything in the constitution that says he doesn't have that power. just because he could doesn't mean he should. it's clear he shouldn't and it would and big mistake politically to do so. kennedy: everyone on his team echoed what you said, it would be a bad idea. i think the president knows that, so why brit up in the first place? >> they like to talk about it.

i think it's a moot point because i don't think he's ever going to do that. it would and bad political move for him and he knows that. kennedy: it's one of those issues that hasn't been pushed to its limit we don't know the full scope of something like that were it to happen. the president could conceivably pardon himself and be impeached. we don't know that yet and i don't think anyone wants to answer those questions. >> the impeachment is different from a criminal consequence. an impeachment is a political. a pardon deems with criminal court. kennedy: one seems to precede the other. people on the president's team say if he did self-pardon that would lead to impeachment.

that's what rudy giuliani said. >> they love to talk about this issue.i think it's apparent why. nonetheless, we have a lot of other issues to talk about. issues they don't want to talk about. that's why they keep returning to this one. kennedy: i think it's a big distraction. is the president using it to his advantage? >> i don't know. only time will tell whether he's using it his advantage. but it's important to remember we do have a constitutional system. the system works well. ey they talkbout this, they speak of it as if it's a separation of powers issue. the tension between the special counsel and the presidency creates a separation of powers issue. the executive branch of government is in fact answerable to him. kennedy: that was part of basis

of the 20-page memo that fox news got ahold of that leaked over the weekend. we talk about the constitutional crises and the rule of law and checks and balances. we speak of the constitution as though it's something that's very static. whose conclusion were reached quite easily. but as you point out in your book, that's not necessarily the case. the way you talk about the forgotten members of thing conversation regarding the constitution almost remind me of the scientific method and how that came to be. >> that's exactly right. i appreciate you raising that issue. we have provisions of the constitution we have forgotten about. at the same time for i am there are reasons about the lost founders, forgotten found horse had been fighting big government

>> no, this came up over the weekend. i was critical of rudy giuliani for raising it, but he didn't raise, chuck todd raised it. the manner in which he answered it ginned up his own client. the mayor said he could have had comey shot and not be prosecuted for it. the imagery is horrific and i don't know why mayor giuliani would that imagery. kennedy: we talk about the constitution. and you talk about the federalist papers. it was never designed protect the president from any accountability at all. >> the president is not a king. he, the president of the

executive branch of government. he would be arrested, charged and prosecuted. the president can't be put on trial while he's president. but he would be rye -- would be rearrested the minute he left ce. can he pardon himself? the supreme court said the pardoning power is plenary and there is no check on it. the other argument is we have a rule of law in this country. the supreme court expressly embodies it. no one can be the prosecutor and judge in his own case. pardoning himself would make him the prosecutor and judge in his own case. i can't imagine the framers contemplated the pardon power could be used to pardon one's

self. kennedy: we don't wants to know the answer. that means we elected someone so horrible. >> one of the best ways to interpret the constitution is to avoid as many clashes as you can and denied things narrowly rather than broadly. i don't know if we ever get there. we won't get there unless he does pardon himself. can he obstruct justice? of course he can. if he orders somebody fired for a corrupt purpose, that makes the use of his power obstruction and that makes it a potential crime and a potential impeachable offense. one of the arguments against richard nixon was the use of the pardoning power to interfere with prosecutions as an impeachable offense. kennedy: that's why get

so nervous when the president talks about pardoning somebody like martha stewart tore rob blagojevich. he doesn't done it yet. >> he tamped down that talk today by throwing under the bus paul manafort. he said if i had known paul manafort had these connections with the ukrainians, i wouldn't have hired him in the first place. ering with the constitution is a dangerous business. i like the president, and i know the president. even if i didn't, he's the valid, lawful, elected president of the united states. the people want him to do his job as president. but he must do it lawfully and constitutionally. i love this show, but i can't wait for that panel. that is a hot panel.
