email server and the tarmac meeting. andrew mccabe, we are told the report chastises him for the late discovery and mishandling of evidence related to the clinton investigation. mccabe's attorney sent a letter to the senate judiciary committee claiming he'll testify in exchange for immunity. should any of these amigos be worried about their freedom? reporter: the answer is maybe. we are all waiting for this inspector general's report, including the president, who has been tweeting about it. the abc report uses the word insubordinate. the report says he defied the

attorney general especially when he sent the letter saying they are reopening the hillary clinton investigation. the president of judicial watch says this is like a russian nesting doll when you pull one out than is something else inside. >> you know, this spy gate is getting worse and worse. and i don't understand the lackadaisical approach the congress has to bringing in, hauling in rosenstein. reporter: lawyers for the former deputy director andrew mccabe says he is willing to testify. but there is a catch. they said quote we request the judiciary committee use a grant of use immunity.

consequences will be? >> we all see he's the narcissist we always thought he was. but we need to see the i.g. report. if there was criminal conduct associated with that insubordination which i suspect there may be, then we should get the attorney general's office prosecuting the case. i suspect he was misusing his position to let hillary clinton off and manipulate the system on donald trump which we know he did. he admitted this. we see the contradictions that should lead to conviction. kennedy: i know he probably thinks it's a bang-up idea to write a book because he wants to tell the world his special story. he says he's often fallen in love with his own ideas. but within that book tour there have been a series of contradictions. could those be legally

problematic for sometime in. >> he can say whatever he wants in a book tour. there is no law against that. but where it might provide problems is where he testified under oath to congress and given affidavits and testimony under oath if he contradicted himself somewhere else, then we get to bring him in and opinion him down and see if there is a chance for a criminal prosecution. kennedy: andrew mccabe was fired because the inspector general found he had lied to investigators potentially about leaks to the "wall street journal" and other things. he said comey knew about those leaks and authorized them. comey denied that. should andrew mccabe be given immunity to testify before the senate judiciary committee? >> i don't.

he wants use immunity for whatever he may testify at the hearing. i think we need to let him come forward. take the fifth amendment which ways' threatening to do. but we are never going to get to the bottom of this on mr. comey and loretta lynch, the strzok and page and this whole cast of characters if we give him immunity. unless he's got a massive bombshell, and we won't know that. then i don't think you give him immunity. kennedy: look at the people that were given immunity during the hillary clinton investigation. so i agree with you. i think they should with hold there fan he's done something bad, there has to be accountability. what does accountability look like for these three people.

>> one of the great things that makes america stand out in the world ostensibly is we hold everybody accountable and everybody has to obey the same laws. if you grant immunity here to somebody who may have known about corruption, but corruption for political purposes. think about that. you undermine the very foundation of our constitutional republic. it's hard for me to say let's get to the somebody who has done that immunity. kennedy: you bring up a good point about strzok and page. telling each other to go easy on her. that's just plain wrong. that's a different type of politicization that's equally problematic. we know president obama rolled out the red carpet for iran. but did he also roll out the green carpet?

the labor participation rate. everybody eligible to work, it's like at 62%. almost 40% of the country who can work is not work. where are the jobs? do you have to move to the city? they are not in the rural parts. do we have to become immigrants within our own country? i don't see the magical recovery. a lot of lives don't seem better. kennedy: but there are jobs like in banging and accounting and things like that where you need some specialty training. there are also a lot of jobs in service industry like retail and food service which oftentimes are part-time jobs. but for people entering the job market, those are starter jobs, and hopefully they lead to

bigger things as they do for a lot of people. that's how a lot of people get their foot in the door in a job market. >> who could complain about there being jobs. available jobs is a good thing. but an advancement to where? you have got to remember, we are not worky about the future of this country. namely, our children. what do you advance to? these are good-paying american jobs. these are hotel jobs and wiping old people's back end. there are less men working now than there was 10 years ago. neighbor people don't want them or don't have access to them. i am not saying the sky is falling, but the sky is overcast. kennedy: you were doing a

offenses. when there is a conspiracy, they look at the aggregate amount. the first-time offender. it's non-violent and that went into his decision making. kennedy: the judge who sentenced her knew all of those issues. was that judge obligated to put her away for life? >> not necessarily. there is discretion even in the federal system. we have guidelines so if someone is convicted of a crime that falls within a certain range, the judge has to consider that. he probably did have some discretion mott to give that life sentence. kennedy: i know in the 90s there was a big push for law and order and three strikes you are out. this is a person who didn't commit a trike.

we could be spreading our dna to other planets as well. kennedy: will they send rovers here? >> remember this is still speculation. nasa is keeping a tight lid on this whole thing. but apparently it will be a big announcement. another possibility, they found minerals worth mining on mars and that could set off a gold rush. perhaps rare earth or new platinum materials. so that may give us mining, ores and rocks capable of sustaining colonies on mars. kennedy: that's why he on muks and branson and others are all in the space race.
