closed 85 billion-dollar deal with time warner earlier in the afternoon justice department backed down and decided not to seek a delay in the deal. however, still reserved the right to appeal merger after deal is completed and as part of agreeing to not seek to stay on merger, doj got at&t to agree to operate time warner essentially as separate entity or possible appeal is decided. cheryl: all right, well, you have a new report about cyber-attacks, what do we know? tracee: this one is interestingly and timely, tech companies says singapore became the number one top target of cyber-attacks in the world earlier this week while president trump and kim jong un met in the country. singapore battled more than 40,000 attacks but the company does not know if hackers gained any access to information and according to data 88% of the

cyber-attacks were deployed by russian ip addresses. >> and a story about fit pit, some employees are being charged with theft. cheryl: i got rid of mine. tracee: prosecutors have charged six current and former fitbit employees from stealing secrets. the employees received the stolen trade secrets after leaving job bone and knew they were not supposed to have them. this isn't the first time the two companies have been in court today. there's issues over patents previously, so we will see what happens with this one. cheryl: fit bit has been struggling so much. with apple watch and all the other devices. >> everybody has gotten into the wearable technology so it's tough to compete. cheryl: tracee, thank you.

in judgment and that's what's happening now. i tell you it's friday. cheryl: we will pick up on what exactly you're talking about. he's responding. a lot of response to ig report yesterday. let's start with this, fbi chief james comey is defending himself against inspector general report calling him insubordinate in e-mail investigation. comey said he did what was best for the fbi and justice department. here is what he tweeted, quote, the conclusions are reasonable, even though i disagree with some, people of good faith can now see unprecedented situation differently. i pray no director faces it again. the report says comey's action damaged bureau reputation and it wasn't only comey, the report laying out a long list of mistakes made by over people involved in the investigation. for more let's bring emily in seattle with us this morning and former prosecutor, welcome to

both of you. >> good morning. >> good morning. cheryl: emily, let's start with james comey. he has written a book, far removed now and really this report is just an overview and doesn't make any criminal referrals to comey or anybody else except andrew mccabe. from a legal perspective what do you think the report can do moving forward. any other prosecutions coming? >> likely no. to focus on comey for a second, they are being stern for disciplinary measures, we are referring to opr, opr is bound by precedence and a table of penalties that really sets out very clearly and precisely what levels of discipline could happen. that's a preponderance of the evidence, but at the same time the most we expect for comey is a slap on the wrist especially because he was already fired.

now he's was the most damming in terms of the language, especially in contrast to as you said, mccabe where they said, look, his failure to recuse himself, that was within policy even though we recommend changing that policy, note, however, it's a lot of congressmen that are saying, this isn't enough and the ig is set to testify on monday, so i do think that they'll be a lot more questions raised and those in the report subject to possibly more harsh consideration come monday. cheryl: so maybe more discipline within the fbi or -- but not necessarily any more criminal matters again except for andrew mccabe. i want to ask you about something that she just brought up and the fact that obviously this is politicized since the ig report was fully published. listen to christopher wray talking about his take on the ig report and they -- trey gowdy's

response. chris wray, i'm sorry, you're wrong. consequences is that your fellow citizens questioned whether or not they can have confidence in world's premier agency. cheryl: consequences, what does that mean? >> i think it has to do with public trust. this report is like solomon splitting the baby, no side is happy. you have for the republicans, you know, sort of vindication that comey was reirresponsible and incredibly insubordinate, for the democrats you have vindication that the hillary clinton e-mail probe was handled -- wasn't affected by comey's ego and problems. but this really speaks really more badly of comey because it shows that comey's ego, he placed his ego above that of protocols and policies. -comey who felt that he alone just when then candidate trump

at the republican national convention, that only he could fix america. only james comey could fix doj. the problem was that he wasn't a probation -- prosecutor, no reasonable prosecutor, should have referred to loretta lynch at that point. cheryl: fbi agent that is received improper gifts to reporters, they leaked information about the investigation to reporters from phone, their fbi phones, ig -- that's something new that i did not know was happening. a couple of bombshells. >> i agree. they are outliers, we are dealing with them accordingly. he did refer to the fact that internal personnel matters so we couldn't talk about it with specifics but got enough specificity in the report and for the referral for discipline, for those agents that remain with the agency right now, they

are facing more likely adverse actions which means suspension possibly termination over, for example, again, comey that was already fired. so i do see there that likely the discipline measures will be huge for them. cheryl: almost out of time but do i want to give you final word real quick, these five unnamed fbi employees, there was a lot of bias, a lot of messages, text messages from the employees, is that anything that you can prosecute. it's unlikely because these people are human beings, are entitled to own opinion and didn't affect the ultimate conclusions. again, it makes it look bad as law enforcement official you are supposed to avoid appearance of inappropriately, when you act in a certain way, that's not consistent with thousand department should be viewed. well, then, it should be disciplined. cheryl: emily, appreciate it, a

too fast too fibbing question. it remains to be seen. we don't know the fox will accept bid or not. i'm sure disney will come back with manager. >> that's a change of strategy because they are known to be quite conservative in their finances and now going forward with this amount of debt, that's quite a bit and stock has been depressed for a while. >> it has been. the problem is that everybody is so worried now about competing, these companies are worried that they're not going to be able to compete with netflix. everybody is consolidating, i'm not saying that's good, in fact, for the consumer i don't think it's that good. it's bad, less companies, less choice, less creativity in the market-producing content. the companies want to control continue tent. they want to produce content. they want to charge for it and think they have to do this to survive long term. they are not looking at the next year, next 10 years or 20 years.

>> inevitabel. makes sense for me to go after fox's asset. i feel like it's going to cost for more consumers, i agree with that. isn't that long term, 5 years, 10 years from now and possibly the landscape is change from here? >> it's already been changing. everybody is afraid of netflix. people are watching more content streaming because if you're on the phone walking around, you watch your phone when you're watching television. you only have to be sitting in your apartment or home to watch tv. also cost of getting something like netflix or streaming either free or cheap. like the hulu, that's another big reason why everybody is going after fox. whoever ends up buying fox will end up owning 60% of hulu, that's big time, that's one of the reasons that disney we wanted to buy fox, that's huge. i don't know what disney wants to do.

releasing draft immigration bill that would allow legal protections for dream erstwhile providing $23 billion for border wall, it's unclear if the legislation has enough votes to pass. brad blakeman. >> good morning. cheryl: i'm going to gu you what nancy pelosi has to say. let's get right to the critics of the plan. >> nothing more than than a cruel-codification of president trump's antiimmigrant theagd abandons or nation's heritage as beacon of hope and opportunity. needless to say democrats will not be supported whatsoever. >> under eight years of obama democrats promise, they ran obama ran on first term as first thing he was going to do is solve immigration, they never did yet they had to power to do it. republicans also ran on solving immigration starting with our border and promises made, promises must be kept. we have white house and congress. by the way, we have a

very important midterm election coming up and the american people are going to stake stock of the promise that is were made and kept. so this is not a nice to do, this is a must do for our country. cheryl: one of the biggest, if you will, outcries that we have seen about how the administration is handling the border and illegal immigrants is the separation of participants and children and paul ryan respond today that criticism. listen to what he said. >> this is because of court ruling, this i do think ought to be addressed. we believe should be addressed in immigration legislation, so what's happening at the border and separation of parents and children is because of court ruling, that's why i think legislation is necessary. cheryl: look, we will address this, that's why all the criticism is being launched at republicans and the administration. we will address this, we will figure out a way to not have children and their parents separated. >> absolutely. this is a job of a legislation of congress, when the court rules,

you know, that contrary to public opinion, then it's the obligation of coequal branch of government to fix it. we also need to fix the lottery system, we need to fix family immigration, we need to fix our border first and foremost and we have to deal with dreamers, those are the four pillars the president ran on, those are the four pillars that republicans ran on and we now need to do that which we promised to do and by the way, the problem necessarily isn't with the house, the house could pass the greatest bill in the world, the problem is the bills die in the senate, we really need to focus on the senate because we need 60 votes in order to get bill to the floor and we need the president's involvement. >> and because it's the border wall funding, that's where the biggest sticking point was the last time around. you mentioned the dreamers. i want to dive into that specifically. the wall street journal saw a draft tax of what the republicans are proposing, basically for the dreamers it would

allow the dreamers to apply for protections for six years, right, they would have to meet certain educational age requirements but would protect them. do you think is something that could maybe get bipartisan support in all of this? >> well, it should, as a country we have complicit in a lot illegal immigration that we are now faced with and we have to deal with. porous borders, work for these people and we turned a blind eye, we have an obligation now to fix that which we were complicit in breaking and we need to fix it once and for all, we can't revisit this every 20 or 30 years with 12 million people who come here basically because we have unsecured borders and we are providing work unchecked work and we also need to fix it with e-verify system to require employers to make sure that the people they are hiring are legal. cheryl: we still have to deal with ms-13, something that's clear from president trump on that issue. brad blakeman, thanks for all the perspective this morning, appreciate

stock market futures, a lot of concern about a brewing, it was on, it was off trade war with the chinese. the president approving 50 billion in tariffs on chinese goods. investors are watching watching that today. s&p down 10 and a quarter, nasdaq down 15 and a quarter. lawsuit filed by the new york attorney general is accusing president trump of using the trump foundation charity to further his 2016 campaign. the suit alleging that trump and his family used the founds promote the family businesses and pay off legal settlements. donald trump, jr., responded on tucker carlson last night. >> there were no salaries paid, there is no expense travel, there are no, you know, paid members of this thing, we are sitting there on essentially a board to see that the money that he's putting in there is going out to other charitable causes. that's all it is. i've never taken a cent from it, no. neither did my brother,
