"the evening edit" starts right now. >> today's supreme court ruling just coming out a tremendous, is a tremendous victory for the american people and for our constitution. this is a great victory for our constitution. >> a big win, a big victory for president trump, the supreme court ruling 5-4 in favor of the president's travel ban on seven countries, including venezuela and north korea. and california democratic representative maxine waters is trickling down make no apologies for her calls to confront team trump, instead pinning the blame on him. also in the show tonight, a

"the evening edit" starts right now. . >> the dow closing up 34 points, this after yesterday's big loss, but you know concerns about trade policies still linger. we're going to have more on that in just a moment. first, to the supreme court upholding the president's travel ban. very big news today. kristina partsinevelos was front and center at all of it. the supreme court when the decision came down earlier today. kristina, over to you. reporter: thank you, trish, a huge win for the trump

administration, but i'd like to preface that this was the third version of the travel ban. originally president trump put forth a first version that included five muslim majority countries, now the latest one has the five countries along with two others. what are the countries? iran, syria, libya, yemen, somalia as well as north korea and venezuela. so those are the difference between the previous versions, shot down in lower courts. the lower courts arguing that the president's executive order was prejudiced against muslims but the supreme court said today in their statement, their opinion that that's not the case, that the president has it within his authority to make such a decision to create a travel ban and limit the entrance of certain people into the united states. they also said that this has to do with legitimate reasons and nothing to do with religion. of course, you've got lawmakers on capitol hill weighing in and reacting along partisan lines. listen to republican lindsey

graham's reaction. >> i thought it was a sound decision. this is not a religious ban. the first order was poorly written. the third iteration made a lot of sense to me, picking out countries with high threat levels with poor vetting process. makes sense. this ruling makes us safer. reporter: and it's -- 5 versus 4. 4 of the liberal justices voting against it. a democratic voice, too. senate democratic leader chuck schumer who is weighing in. listen. >> this ruling did not make us any safer, and i believe that the court was wrong. it's un-american to do what has been done. reporter: the white house is essentially said that countries can be removed from the travel ban, liz, all they have to do is change vetting process. chad is an example of a country that has done so. what does it mean for

travelers? they can challenge the bhanot -- ban on the ground. this was brought forward by the state of hawaii, the court and the trials will continue but the supreme court says their decision has to be based on the outcome today, which was upholding the travel ban, trish? >> democrats responding, slamming the decision. take a listen. >> we are a nation that this is moral vandalism about our values, what's going on, separating families to religious-based travel ban. >> this is a dark day for anybody in our country, the president can pretty much do whatever he wants to discriminate against groups of people and say it's for national security. >> categorically ban people because of religion or background or country they're from is not the way we should

do things in america. >> dnc chair exploding over the decision attacking supreme court justice neil gorsuch. watch him here. >> as long as he puts a very thin veneer of national security on top of all that discrimination and racism, they will buy it. if you steal and rip off a supreme court justice, then you can try to jam any kind of nasty racist, ugly policy you can down the throats of the american people. the supreme court in the 1850s said it was okay to own a black person. that was judge scott's decision, so did plessy versus ferguson and core mautsu and this will, too. >> is that fair to be comparing this decision to dread scott? joining me is harvard law professor, author of the upcoming new book, the case against impeaching trump. mr. alan dershowitz. professor, good to see you

again. twice in one day! >> twice in one day, a day for americans. >> it is an important day. and what a historic day in many ways. let me get your reaction to what we heard from mr. ellison there. is this comparable to the dread scott ruling? >> it's not comparable to any of the decisions he mentioned. those all involved american citizens, people who lived in america, born in america. 100,000 japanese-americans, americans put in detention centers, plessy v. ferguson said americans can be segregated. this is about people who want to come into the country and have no rights under the american constitution. so the opinion itself is found as a matter of law. if you pick countries, mostly picked by president obama are the right countries. i much prefer to do it by individuals rather than countries because there are good people in every one of

those countries who make great visitors to america. great students and ultimately great americans. i'm opposed to the policy as a matter of principle but the decision is right to the constitution. >> you don't like the policy, you like to look at them as individuals as opposed to saying we don't know who's in yemen or iran, so as a result, and by the way, iran doesn't know who's in iran and syria doesn't know who's in syria. consequently we're saying when it comes to people from those countries, we're going to say nope, you're not allowed in. i know you don't like that. however, let's talk about the actual legal aspect of this and the constitution itself and the 1952 law that said the president does have the right to make these decision. let me also ask you, are people more concerned about this because it's president trump as

to, say, opposed to president obama or president carter, obama did the same thing with north koreans, sir. >> there's no question that this involves democrats attacking president trump the way president trump attacks democrats. we've become a very divided country. anything that trump does, whether it be recognizing jerusalem as israel's capital or negotiating with north korea, that can do no right when it comes to extremists on partisan grounds and for some extremists on the other side, president trump could do no wrong. i think it's important for americans to look at every policy and decide every policy on the merits and look at every constitutional issue. and separate out constitutionality from policy, you can propose a policy and support the supreme court's decision on constitutionality. people want to come into the country have no rights. so the only issue is whether or not the band could constitute an establishment of religion or disestablishment of islam.

problem is the vast, vast, vast majority of muslims don't live in the seven countries constituted in the ban, and ishia is the largest muslim country in the world, turkey largely muslim. they don't vet people and have long history of terrorism, whether you agree or disagree, i disagree with the policy, it's very hard to find a strong constitutional objection to it. >> wow, you're always fair, and for that we thank you, professor. let me get to the media for a movement you got all the members of the media trying to discount the supreme court ruling. pretty much immediately after it came out. i want you to see this professor and get your reaction on the other side. here we go. >> i think what the supreme court found is the president and his team were basically able to construct a legal architecture to buttress what he wanted to do. >> just because the court legally found it justified doesn't mean the truth. >> we were able to watch a lawful ban be reversed and

engineered. >> justice breyer is reading the dissent from the bench now which is something we don't necessarily often see happen, pete. is an indication how strongly the justices who did not agree with chief justice roberts feel about this. >> this kind of a term is not unusual for a justice to read a dissent. this is the second dissent justice breyer read from the bench today. >> give the reporter some credit there, making the point this is not as unusual as the anchor was trying to make him think it might be. when you hear the various pundits. when you hear the bias that is really directed so directly at this president, what does it make you think about the statement in which we are in, and the importance of preserving the country that we have all loved for so long, which is based on the constitution. >> no, look, i agree with that. i'm trying to preserve the island they vacation on for the last 40 years, martha's

vineyard, where i'm being shunned, is a professor at a major school that wants to be given a trigger warning every time i'm invited to a party so he can find a safe space and not have to encounter me and listen to my ideas. this is a professor. this is martha's vineyard. it's shocking to me how divided we've become. nobody wants to hear anybody else's point of view. people shun you if you say anything about the constitution. that might be helpful to president trump. and i think we have to end that, and congresswoman waters is doing a terrible disservice, when she encourages people to harass people with whom she disagrees. that's not what america is about, and fortunately many democrats have condemned congresswoman waters. she doesn't speak for me, doesn't speak for liberals, doesn't speak for democrats. she speaks only for radical partisans, some of those

and the most populous arab nation not be included on the executive order? trish: dr. gorka had a point back then and has a point right now. with me right now is rnc spokesperson kayleigh mcenany who received her juris from harvard law school. they're not the same countries that the president has banned. and the reason for that is pretty simple, because the countries that are banned are countries where we have no idea who's there and more importantly the country themselves have no idea. the countries themselves. so kayleigh, for the media to have been so hysterical about this, which they continue to be, what do you make of that, given where we are right now?

>> i was working at cnn when this travel ban came out and the apoplectic outrage and mischaracterization of the ban and dr. gorka went onto question chris cuomo to name the most populous countries which he could do. they demonize the president, mischaracterize the policy. the six of 49 muslim majority nations were affected as you heard alan dershowitz say, not the vast majority of the muslim world. never about faith but cnn and others would use it to demonize the president, and it's unfair. trish: i'll answer that question that chris cuomo couldn't, and i'll tell you the two most populous countries are indonesia and pakistan, and we can go down the list, india, bangladesh, nigeria. you know, people want to make this, right now, given the environment such as what we live in right now. kayleigh, they want to make it about racism. they want to make it about islamophobia.

they want to make the president seem evil, and i guess what i find discouraging about this and you've got a legal background is the lack of intellectual honesty, specifically from the supreme court because to me should have been a decision that was 9-0. >> should have been, yeah, no doubt about it. it wasn't because you have certain justices on the court who the constitution, who statue does not matter to. congress has explicitly said in the united states code that the president has the power to bar any class of aliens that pose a threat to the united states. we know that obama's intel community, james clapper said that isis is trying to infiltrate the refugee program. that was the president's motive, making sure every u.s. citizen is safe from isis terrorists. they will demonize, at the end of the day five justices sided with the president. trish: it's a big win for him count andry, i'm disappointed

that we can't have more of an honest conversation and these justices can't look at something legally, but that i have to look at something emotionally. speaking of emotions, turn to the restaurant owner who kicked out sarah sanders. the media, they really seem to be taking her side on this matter. democrats as well. watch. >> do you make choices in life? you make choices in life. and there is a cost to being an accomplice. >> should come as no surprise to her, no surprise to all of us that administration officials are being yelled at in restaurants. >> an administrator out and b, there is nothing wrong with confronting that person. >> do you see anybody from that cabinet in a restaurant, in a department store, at a gasoline station, you get out and you

create a crowd! >> wow. so maxine waters takes the cake on this one, and i would say she's bordering at this point on inciting violence. she has doubled down on her comments and you heard from other people saying it's perfectly okay for those who work for the administration or anybody that supports president trump to be harassed in public. kayleigh, what kind of world are we living in? and let me by the way say that i stood up for jim acosta today and continue to stand up for him, he should not have been treated as poorly as he was at that rally last night. people should not be yelling at him. he's just trying to do his job, but so is sarah huckabee sanders, and so is kirstjen nielsen. kayleigh, it works both ways, and what has happened to civility in our society?

protests. >> right. trish: peaceful protests? that's what she's encouraging? somehow i don't consider it a peaceful protest when they're attacking kirstjen nielsen when she's out to dinner. that's not peaceful. you know what else is not a peaceful protest, when they deliver a dead animal, the carcass of a dead animal to somebody who works at dhs. that's not peaceful protest. and heckling sarah huckabee sanders and her family after kicking them out of the restaurant and governor huckabee told me this is exactly what happened. that sarah went across the street with her family to another restaurant, where the owner of the little red hen followed them across the street and continued to yell. sarah finally left that restaurant, left her family there. her in-laws who were once again heckled by the owner of little red hen. none of this is a kind of peaceful protest.

democrat california congressman maxine waters is tripling down, making no apologies for her call to confront team trump and ping the blame entirely on him. democrats are denouncing her rhetoric, as they should. listen to what senate minority leader chuck schumer is saying. >> if you disagree with someone or something, stand up, make your voice heard, explain why you think they're wrong and why you're right. make the argument. protest peacefully. if you disagree with the politician, organize your fellow citizens to action and vote them out of office, but no one should call for the harassment of political opponents. that's not right, that's not american. trish: and yet, that is exactly what they're doing. house minority leader nancy pelosi tweeting --

yeah, you think? and yet we just heard a whole bunch of sound from maxine waters, from cory booker, from pundits on television saying somehow it should be expected that if you work for donald trump, you will be harassed. you will be attacked, you will be ashamed or shamed by these other people. take it up with our political power panel. ford o'connell and grace gibson, kelly grace gibson. ford, i don't even know what to say. i understand, by the way, why some democrats like chuck schumer and nancy pelosi want to back away from this one, but there are plenty that have no interest in doing so, and they think that you can actually rule via intimidation. that's not the kind of country we live in, and frankly i don't think it's the kind of party the democrats should ever

aspire to be. >> well, let me say this. political civility needs to be restored in politics on both sides of the aisle. i didn't like it last night when trump hecklers went after cnn's jim acosta and certainly don't like it when sarah sanders and secretary nielsen are driven from restaurants. i think it is ridiculous for democrats to say that the root cause of this is donald trump, when trump wasn't in office when gabby giffords got shot in the face and bull's-eyes put on sarah palin. public shaming and violence has no place in public discourse, this is not the first time maxine waters has done this. she's been doing this since the early 190s, the l.a. riots. >> our president has used shaming in public. he tweeted today by calling crooked hillary. secretary clinton is how she should be referred, we are no

longer campaigning. >> if trump does it then maxine waters can do it too? >> i wasn't finished. there is a climate here with the president who shames people in public on twitter every single day. maxine waters should not have stooped to his level, and i think that many parts of this, my party, are saying it's not okay. she's going to take it to trump and this is the way she's done it. trish: trying to create a platform for herself. it's not going to help you come midterms. it's not going to help you a couple years from now. >> you don't think there's a problem with how the president treats people on twitter? >> i'm not wild about it and i said it many times. i also say two wrongs cannot make a right. you cannot say he's not as civil as you want him to be, you go the same direction, it's important to lead right now and lead by example and maxine waters is not doing that. >> neither is the president. trish: nor are many of the

first lady melania trump plan to visiting additional facilities this week. no details yet when or where. all of this as occupy i.c.e. protesters, you just saw them there, shutting down a portland headquarters, protesting the men and women across america who are trying to keep the country safe. they are just out there doing their jobs. now this movement spreading to other cities as agents face increasing numbers of threats, warning from dhs that safety is at stake. now we've got reports of burned animal carcass left on a staffer's porch in d.c. kamala harris now going as far as to say we should just start over. we don't need i.c.e., start over from scratch. here's this. >> i think there's no question that we've got to critically reexamine i.c.e. and its role and the way that it is being administered and the work it is doing. and think about starting from

that's causing millions of people to cross the border illegally and live in the shadows. i grew up in a town of dalton, georgia, 78% hispanic inside the city limits. since i was a teenager, the numbers have gone up. let's assume everyone who crosses the border has their heart in the right place. it's inherently to live in this country illegally and in the shadows than it is being in an i.c.e. detention center, getting meals and cared for. i know two i.c.e. agents, who spent time searching for online crimes against children and sex trafficking or human trafficking. those two people are the first moment of compassion anyone crossing the border either legally or illegally will encounter, and someone is going to offer them a bottle of water when they've been in 120-degree heat, it's an i.c.e. agent, border patrol agent to.

become increasingly problematic, even violent because they're dehumanizing anybody who doesn't agree with their point of view. >> well, it's become an american way that when you're so passionate about something, and you can't find a legal way to fight it, then you have become inflamed, incited and do stupid things. right now it's the left. hopefully doesn't become the right. at this time, we have to understand we hold the power as people and can do this by changing those in office rather than fighting each other, calling each other names and torturing animals as a sign of political discourse. >> you know, i hope we get there, and i hope that everybody starts to realign and recenter themselves, and really recognize that we should be able to have civility in our society. we always have.
