all under the age of 55. and the national left wing media apoplectic over the president's choice without even knowing who it is. and senator mitch mcconnell, the rhino republican majority leader instilling little confidence in putting mr. trump's choice through the confirmation plo says. in fact mcconnell came up with a brilliant idea. he suggests that judges, kethledge and hardiman would have the fewest obstacles in the process. there would be fewer on that kls for a democrat if the president were so moved. and now there are five senate democrats and two republicans turning down and invitation to attend the president's announcement. democrats senators joe donnelly, heidei high camp and john manchin, joe johnson, dianne feinstein and republicans lisa murkowski and susan collins. shaim on them.

court. we all know, we've been inundated with how important this choice is from the left, the right, republicans, democrats, independents, you name it. at the end of the day, the democrats are acting as if they have the right to block his nomination even though he's not made the appointment yet. they've made it clear they're against everyone that they can possibly imagine him choosing. have the dems gone completely and utterly beyond the pale? >> absolutely, lou. this is just more of the same course that we've seen since donald trump became the president. and if you think about it, they're upset because they're not going to have the same advantage that they thought they have had at the u.s. supreme court for the last, what, two generations. and that's really got them going crazy. and so they're unreasonable, they're out there saying, we're going to fight anybody. well that doesn't even make sense. you don't even know the qualifications, the criteria.

and we've walked away from what the supreme court is supposed to be doing by making it so political. lou: the democrats have sort of confined themselves to irrelevance because they have been so preposterous and capricious and i irresponsible,n my judgment. in is a constitutional right of a president this is not some art fies con injurekojjuriedconjured up. this is the fabric of the republic. >> the constitution says he nominates, right, and the nominee is confirmed by the u.s. senate. that's their role. if they don't like it, they cannot confirm. we've seen them do it with robert. that started the whole massive politicization that we see going on. but in my opinion they ought to remain quiet until at least you know who the nominee is going to

be. lou: those are two words that i don't associate in any way, democrat and quiet. and then a stillness fell over the room. i can't even imagine. >> i'm with you on that, lou. lou: let's turn if we may, to the business of jim jordan who wants to be speaker of the house. he's received a lot of support from former coaches with whom ht ohio state. he's got support from colleagues in the house of representatives. but there's one conspicuous absent supporter. and that is the spea speaker ofe house. why in the world would he be so classless as not to stand up for the right of this man who's been so dishonorably atakdz b attacke left? >> i can't explain that. i'm not sure i understand. i mean he said he's going to

wait until a new investigation happens and all of the information gets in before he makes a statement. lou: why don't you just -- why doesn't the republican caucus understand -- you say you can't explain the speaker of the house. that means to me you can't explain why he's speaker of the house. why is he the leader of your conference? why is he in that position of power when he's already resigned the job? i mean, the republicans, if they ever wanted to look absolutely lifeless, or as the president would refer low energy, they couldn't have done better than paul ryan who sold out to every major donor, to every major business group, particularly u.s. multinational groups, the business round table, the chamber of commerce, the koch brothers, the list goes on. did i mention wall street? why are you putting up with him? >> well, lou, unfortunately i'm only one vote. but let me just tell you, i

let's turn the business at hand, the president's announcement of his nominee to the supreme court seat vie kateed at the end of the month by anthony kennedy. >> there are four or five finalists, you could put any one in a hat and pick any one of them and republicans and conservatives and the president come out a winner. all three, four or five satisfy the three main requirements. a, they're conservatives, originalistists, b, they're 45 o 53 which means they would be on the court for a very long time. lou: whipper snappers i would call them. >> and c, they're all confirmable given the composition of the u.s. senate although the caveat is some are more easily con firearmable than others. the gentleman on the far right-hand side, hardiman, he was voted a decade ago on the court of appeals 96-0 by the u.s. senate.

the composition of the senate has changed somewhat but it would be a hard argument for democrats to now say we oppose him even though not long ago without dissent they approved of him. lou: and he has the advantage of being recommended by the president's sister. >> you were right to point that out. if the president's relationship with his older sister is anything like my with my older sister, you'd take your marching orders. lou: well, he's a hard man to, as you may have noticed -- but i would guess his sister holds about as much influence as one could imagine over this president. >> i think so. lou: i've actually been in her courtroom when she was a judge and she is a remarkable talent herself. >> she really is. a highly respected judge. lou: as she should be. i find it interesting that mcconnell, the speaker, has come out with his view that there are certain people here

amongst them, the gentleman you just mentioned, who would be easier nominated. you know, that just seems like the recommendation that a majority leader could make to the president of the united states. i think that the president has demonstrated his intellectual superiority to the leadership of the party on capitol hill in both houses. so why would mcconnell state the obvious which is effect lively, mr. president, if you would just nominate is damn demeanor, this would be a breeze. >> i think mcconnell wants to do whatever is easiest for mitch mcconnell which is a sad commentary. lou: hence the name turtle. >> yes. lou: i don't know what that means, but. >> i think i do. lou: slow moving. >> yeah. the fact is that if mitch mcconnell puts his mind to it, he could get one one of those people on your screen confirmed.

they're all, you know, noted scholars and jurists. kavanaugh would be an excellent choice, barrett would be a wonderful choice although she's only been on the bench for eight months. kavanaugh would be wonderful although, there are a couple of things that democrats would seize upon -- lou: the hell with them. it's this president's nomination. >> exactly. lou: what i find interesting are the number of people that have been so presumptuous, they advise the president. but this is a president's right, it's his choice. >> sure. lou: if there is anything about this that is critically important, that it be his man or woman on that bench. >> and the president has experience in this because he guided gorsuch through the process. lou: that's right. >> knows how to do it successfully. and they've had the better part of 18 month to properly vet all of the people on the list. lou: let me ask you this. he's had the help of the

>> thank you. i want to say one thing about the president's sister who people talk about her recommending hardiman. i was on the you dicialg selection panel in 1983 in the white house when she was chosen. she as an outstanding jurist. she not only serve tond federal court from 1983 to 1989, she was appointed to the circuit court by president bill clinton. so in his older sister was an outstanding jurist. so he grew up sort of with law as parted of his background and i don't want people to think that she was just someone who made a recommendation. her recommendation i'm sure weighed very heavily. lou: as the president has said, he comes with a pretty good gene pool. >> absolutely. lou: think about the strength that is required to be the president of the united states, if your name happens to be donald trump. i've never seen such ignorance. forget the vitriol and

joining me now, andrew mccarty, former assistant u.s. attorney for the southern district of new york, long time prosecutor, national review contributing editor, fox business contributor and it is great to have you with us. >> great to be here. lou: let's start with strzok and page on capitol hill again. and i just don't see these hearings producing much. i worry that the intelligence -- well the intelligence committee of the senate is a joke. the house has done some important things, so i want to leave them out of this equation. but then to look at oversight and the judiciary committees, this is -- in both the senate and the house, is to me just, it's stunning how little is accomplished by all of these hearings. >> here's what i worry about, lou. if you were in a courtroom setting and you had a judge, if you tried to give your version of events and then evade

cross-examination, the judge would not let that happen. the jowm judge would say no, no, you've waved your privilege of self incrimination by telling your story. now you have to answer the hard questions. what apparently is happening in these interviews is they give the testimony or the information that they're comfortable discussing and then when they get asked things that are of immense importance to the investigation, there's fbi counsel there and justice department counsel, as i understand it, who intervene and tell the witnesses don't answer this, don't answer that, whether it's over classified information or investigative integrity or what have you. but the bottom line becomes, they get the version of events that they want to have out there out there. now we of course we haven't seen any of this yit. yet. but they don't get cross-examined on the things that we need to know. lou: you remember the number of times that people have -- officials have stood up in front of a committee and offered testimony and then taken the

fifth. >> right. lou: particularly during the irs conservative targeting scandal. it is mind-boggling that nothing happened. in other words these witnesses for a long time, the past -- throughout the obama administration and now, as you ught under thsuggest under the p administration, they're basically not held accountable. you're saying bring in a federal prosecutor who know what is he or she is doing. >> if you remember, we had hearings during the clinton investigation -- lou: this raisings a big question about trey gowdy. >> i think it's not just gowdy. i'll say this much for gowdy. gowdy at least, he knows how to examine a witness and he can get from a to b to c. but i don't see anybody -- the best cross-examiner needs some time to develop a line of questioning. lou: man, we've had time. >> but we don't have time in a hearing where there's 30 guys asking questions and they get five minutes a piece.

lou: they think they're going to be a big star on local television for five minutes. >> if that's the point. but if the point is to get to the bottom of what happened, what they ought to do is the committee ought to retain a former prosecutor, not necessarily this one, please. this is not -- i'm not harping for a job here. lou: we don't want you taking time away. >> but they have to get somebody who knows how to do this and also can exploit the entire time rather than this truncated five minutes this, five munlts that that get you nowhere. lou: you would think this would occur to a group of adults in on the hill. >> if they want to get to it. lou: exactly. do you have a favorite for the president. >> my favorite is barrett, if i had to make a wager. lou: amy coney barrett? >> yes. but whoever said that you could throw a dart at this list and come up with an excellent judge i think is right.

lou: that's remarkable to have this list. again, credit as well to the president, his attorneys and advisers and of course the federalist society and the heritage foundation. >> they've done great. they've done great work. it's an excellent list. they don't get enough credit. there's so much politics involved in this. the craftsmanship of the judges, the sheer excellence of the judges as lawyers is really not appreciated enough. lou: very quickly. you wrote a column on roe v. wade and the democrats are fund-raising on the idea that a conservative will be added to the supreme court no matter what. you pointed out in your column that roe v. wade is basically irrelevant. >> i think the chance of the core holding of roe v. wade being teed up for decision is highly unlikely. we've been under planned parenthood versus casey for 27 years now. lou: and the left hasn't figured out that the law is a living

lou: on wall street today, stocks closed higher. really higher. the dow jones industrial gained 320 points. are you listening out there, business journalists, so-called. it's amazing. how are they explaining the rally today when last friday they were talking about a trade war apparently incited by donald trump and it was raging around the cloab even though it amount to less than 1% of gdp in any one of the countries.
