issues for his written opinion in the supreme court and those opinions by the supreme court have been written by the likes of justice or i are on one the ideological position and justices on the other. gerri: he is a favorite of the republican legal establishment for sure. david keogh, i want to turn to his taste rate really guess somebody who closely questions regulators in this country with some 40 opinions in which he found an agency action to be unlawful. talk to me about his record when it comes to the epa, the consumer financial protection bureau. what you see there? >> that is a big issue. he's holding the government accountable. the house has a judge. just listening to the coverage already, his record is being misrepresented. especially in the conversation. last year he issued a dissent

and in the while he did say that the legal woman who wanted an abortion didn't need it immediately and that she can be transferred to sponsor. they have a right to a constitutional right to an abortion. again, misrepresented over and over again. >> get to roe v. wade in just a second. i want to look at the cfpb for this judge really wanted to put a knife in the heart of the bureau mainly because he thought the bureau himself, this agency, this consumer finance agency was illegal because it had no restraint, no checks on the president. this was an idea of the republican party picked up and ran with. just a fascinating idea. on the epa and i gave this to you on the epa the judge seemed like, they never look at the

cost of their decisions. tell us about his attitude towards regulators. >> you know, the epa decision they're talking about is one where judge kavanaugh didn't say the epa regulation was definitely illegal, unauthorized by congress. he said congress requires epa to act in a reasonable way. they have to take a look at the benefits and regulation as well as the cost of regulation. after the supreme court took up the issue, that is one of the 11 times judge kavanaugh house but nonissues. that just the right of center just dislikes cochlea or thomas or alito, but some of the justices like chief justice roberts and justice kennedy who don't always factor the justices. >> the real stories of democratic opposition and you mentioned roe v. wade and concerns about that decision

standing. is the idea that this is a bush lawyer for many, many years been critical in writing the starr report that resulted in the impeachment of bill clinton. he was an important part of the bush administration. do you think this is the real source of democratic opposition, his relationship with the party? >> know because i don't think it matters who i was. this goes back to the merrick garland appointment and mitch mcconnell not giving him a hearing and a vote. it didn't matter whether or not this was judge kavanaugh or judge barrett. they are going to attack it and it didn't matter who it was. gerri: justin walker and david bruno. thanks for joining us today and eliminating just exactly who judge kavanaugh is. thank you. >> talking lots of politics at
