president's current legal team are not allowing him to talk one-on-one with robert mueller. sources are telling fox news they are leaning no on the interview. there is concern legal experts say that the president's legal team may be worried there will be word game traps the president could fall into with the special counsel. talks are ongoing about special parameters for the interview with the president. giuliani is talking about the recordings michael cohen made their conversations. >> there are more recordings of other people having nothing to do with the trump organization which will give you an idea what a scaw scoundrel he was. two months ago i said pretty

nice things about him. reporter: giuliani said hearing at a personal attorney would record conversations without notifying the client changed his opinion of him. he said the possible payment being discussed on one of those recordings, regarding that specific payment he says collusion is not a crime. kennedy: michael cohen has recordings of the president, at least one recording, but are they legitimate? according to giuliani, the answer is no. >> there is no doubt one is cut off. it goes something like this. there's got to be financing. he said what do you mean, financing. cohen said we have got to pay. he said not by cash, cone says

no, no, no, but. >> and trump says check. immediately it's cut off. next thing you hear don juneor. but that's erased also. kennedy: who do you believe? it's not like a lawyer who secretly recorded his clients would lie to anyone. let me ask the host of "justice with judge jeanine." she is the author of "liars, leakers and liberals." let's talk about this a little bit. what stand out most of to you in this whole cohen i fiasco. the fact that he recorded the conversations? the fact that he seems to have edited them? or that they have been leaked in the middle of an ongoing

investigation? judge jeanine: we could spend 10 minutes on each one of those possibilities. as a judge i would rule on the authenticity of the tape and whether a foundation was laid for the admissibility of the tape. you would need a forensic expert look at them to make sure they weren't tampered with, you would have to have someone saying this is the original tape. is it a tape of a tape? and that's the kind of thing you bring in forensic experts for. rudy giuliani came on my show saturday night in breaking news, the first time he mentioned it. this type of thing is onlied a miss fibl they lay a proper foundation. they need the original or else you have to explain why there is a cutoff that is beneficial to the president. you have a guy recording a client. you can be disbarred for doing

that in some states. in new york it's a one-party state, but as a lawyer he did not. kennedy: what about attorney-client privilege? we hear about that in terms of the cohen raids on his home and office where he was poised as the victim. what about attorney-client privilege in regards to the tapes the fbi may have seized? judge jeanine: they had a master. judge kimball wood appointed judge barbara jones to look at the tapes and decide whether anything should be seen or which should be seen by the prosecutor. she made that decision. we have this tape that's been leaked to cnn. what does that tell you? it's not about the admissibility of the tape in a court of law. it's about the idea of impeaching the president and getting out there anything negative. maggie haberman said the

out of the cross-hairs of the federal prosecutor. kennedy: loyalty is obviously very important to the president. here is a person he worked with for many many years and he thought this was his most of loyal and trusted. >> when somebody is in the cross-hairs of a federal prosecutor. when you are in their cross-hairs you will say anything. the fact that michael cohen has hadn't been charged with anything isn't the point. the feds say we have all these files, we know what you did. you give us something we won't charge or we'll charge you far far less. the only way to squeeze him is not to charge him saying we have got this on you. you have got kids. you don't want to go to prison for the rest of your life. kennedy: the president famously said i could southeast shoot someone on fifth avenue and my

supporters wouldn't turn on me. you seat michael avenattis and the michael cohens put something into the publi -- into the publc sphere to damage the president. and this continuing ongoing saga of investigations and personal turmoil, the president has not been impacted as far as approval ratings. judge jeanine: there isn't one metric that is worse off under this president. every metric is better off. you know business, you are on the business channel. you know we have more jobs than people to fill them. the president is more popular than he was before he met with putin. judge jeanine: with the electorate. kennedy: the people who hate him continue to hate him. what about those in the middle?

is giuliani. >> are you now yes or no on a sit-down between the president and robert mueller? >> first i'm no on a sit-down until we get ironed out exactly what they want to do. then the process is, we have five co-counsel, senior people, we'll advise the president. he's always fleeng favor of doing it. >> what are you telling him? >> right now i'm telling him no way. kennedy: will the president ever sit down for a one-on-one with mueller? let me ask andy mccarthy. there are two side to this. there is the legal side obviously and the president's legal team connelled him to not sit down with special counsel. americans are growing more dubious of the investigation but

they still want to hear what the president has to say because he's so adamant about his innocence. >> i don't think politically it will hurt him that much to say no. maybe i'm leaning on it this way because i'm a lawyer. the way i look at it, there is no downside to say no within there is lots of peril to say yes. he should not be put to this choice, kennedy. the justice department should step in here and make sure that before mueller even asks for this, and i guess we are past that point, he ought to be made to show that he's got a serious crime the president is implicated in and the president has information that he can't get from any other source. kennedy: you say those are the two special conditions the president's lawyer should meet? >> i would say so.

if they actually had a serious crime you would have fifth amendment privilege concerns. i don't think that's going on. to put it in a different context. imagine the president was a journalist. i think everybody would understand if a prosecutor tried to subpoena a journalist at a minimum you would have to show there is a serious crime and the journalist is the only repository or source of the information the prosecutor needed to make the case. it's hard for me to see why people can see that with a journalist but not with the president of the united states whose responsibility are obviously a lot more important. kennedy: we haven't heard a lot from special counsel. the american public doesn't really know what the parameters are of the investigation. do you get the sense that this investigator is looking for a crime? >> i think as long as the investigation is continuing they

are continuing to look for a crime. but we always have to remember two things with mueller. first, the fact that you are not hearing anything other than when he returns charges is a good thing. that's being responsible. and secondly, what i would say is with respect to the charges that have been filed, there is no indication that the original rationale for the investigation which is collusion with russia in which americans connected to the trump campaign conspire, it doesn't look like that will materialize. but mueller was given a counter-intelligence investigation to get to the bottom of what russia did. so as the investigation continues he's pursuing multiple angles. one is are there criminal cases against these people. but he does have this mandate to get to the bottom of russia's

donald trump being donald trump. don't test the man. but he's prepared to test congress. it's clear from the reaction by the gop, they are not serious. the wall and immigration reform was the first significant policy platform of his candidacy and he's serious about it. he says there is no red lines in terms of negotiating at that press conference with the italian head of state. but there is one red line. that's the wall. he'll never back down on the wall. and he'll get it sooner or later. the question is whether it's sooner or later. kennedy: how do democrats factor into this. obviously they want a deal for the dreamers. democrats said they would offer funding for the border wall if there was some sort of immigration fix for dreamers specifically. but both sides need to figure out what we are doing with

alex smith is back on the show. i'll tal talk with you about th. the right of a free press is the right of the first amendment and the bill of rights. the president knows his base is distrustful of media organizations that seem to relentlessly attack the president. but there has to be a separation here and there has to be some value in allowing a free press to challenge this in every administration. >> you do support the press. it's their job to do this. i don't think you should bar journalists from the white house. i didn't like the when they did to it fox news and when they do it to conservative outlets. but the press have gone the themselves in a pickle because they have become activists. they can't get upset when the press attacks back at them when they throw blame bombs.

kennedy: senate any north leader chuck schumer has been urging red state democrats to oppose kavanaugh's nomination. kavanaugh met with senator joe manchin and while it was his first meeting with a democrat it won't his last. indiana senator joe donnelly will meet with kavanaugh. at this point opposing him could cost red state democrats dearly in november. is chuck schumer running a fool's end? carley shimkus, lawrence jones and alex smith.

alex, this is a curious position. there are three democrats who voted to confirm neil gorsuch, and that wasn't even right before the mid-terms. now you have senators in north dakota * and west virginia will kavanaugh is a popular choice. you have chuck schumer trying to get them to shut down the nomination. >> they think this akin of analyzing the politics of a middle cool schoolyard. joe manchin bragged about hoist was suppose to be a half-hour meeting and turned into a two hour meeting. but he said that as he was on the way to chuck schumer's office. the democrats at this point in the cycle could afford to lose more than just the three they did on justice gorsuch's

nomination. someone like claire mccaskill, they are going back to their constituents empty handed opposing the president on healthcare and tax reform and gorsuch. kennedy: you have also got people like jon tester and others -- and manchin said chuck, don't tell me what to do. i have to make up my mind, i have to talk to this guy. we have to talk about his opinions he has written about. it seems like kavanaugh will be confirmed. >> there is a lot of stuff i don't agree with him. he seems a little soft on the 4th amendment. and he deserves pushback. but man chins worried about his political career and he'll vote for him. because it's suicide.
