emerging. the president wants to testify, the lawyer don't want him to testify. so the lawyers will set up a series of conditions. they will make mueller an offer he can't accept and mueller will say i can't accept this offer so we'll subpoena you. the president will say i wanted to testify, it was mule more turned me down. kennedy: rudy giuliani acknowledging mueller could subpoena the president. but what happens after that is anyone's guess. it never happened before. this could go all the way to the supreme court. let's go to edward lawrence in washington, d.c. with the latest. reporter: that could be uncharted territory. the answer to the question and whether the president would do an interview with mueller was heck no. the special counsel robert ruler

inquiries without further delay. the president's legal team will not allow robert mueller to ask about obstruction of justice charges. as you said, the special counsel could use the subpoena power and subpoena the president but that opens up another can of worms. kennedy: so what happens if robert mueller does subpoena the president? will we see this investigation wrap up by september of 2025? maybe. joining me to discuss, ben shapiro. welcome back to the show. what happens if robert mueller subpoenas the president. if these negotiations fall apart because it seems we are at a bit of an impasse.

special counsel feels like he has no choice but to subpoena the president. where does it go? >> this is a serious constitutional question in has been some legal precedent with regard to the subpoenaing of the richard nixon tapes. but that's a subpoena of evidence not test moanist president of the united states. whether mueller has the power to compel the president to step forward and testify. i think the president would be foolish to go along with the subpoena given the fact mr. trump is not particularly fond of stick together narrow interpretation of verbiage. if you are trump's lawyer, the last thing you want is him under penalty of perjury talking to the fbi. if he keeps silent and states out of the way, that's trump's best solution considering he can barely do that now with twitter. kennedy: it's so contrary to his

are you surprised you are now the mayor-elect? >> no, i'm not. after the election a lot of politicos told me nobody thought i stood a chance. i thought it was going to win all along. why would i do this if i didn't think i was going to win. we worked very hard. in the end when you are campaigning that's what you have to do. we did have a message that resonated as well. kennedy: there are pro liberty candidates running. there are primaries to come and a lot of libertarian party members on the ballot in various states. what do you tell them about your overall message and philosophy, take it to local issues? >> the great thing about local issues is a lot of the wedge issues that divide us at the federal level, and sometimes the state level, they are not applicable to local politic.

so you can get out there and talk with people. that's the most of important thing. electoral politics is all about division. generally it works like party a says the people in party b want to harm you, i'm going protect you, and the other cad says the same thing and that's way it's all about. i did try to have a message of unity. i'm not going to agree with a lot of things my democratic opponent says. it's a matter of the solutions that we choose to pursue. that's way it's all about. it's being solution based. let's quit yelling at each other and start talking about. the die flog this country is about screaming and yelling. instead of listen together other side. >> that's the other thing when you run for mayor.
