a special counsel who involves additional motions and all arguments because were talking about the special counsel mueller, russia and this is a text case where apparently they looked at it appears back and did not think it was worth bringing but now ellis knows he's been used as leverage to convict paul manafort so they can squeeze him to go after the president. lou: but not doing nothing about it. after all his statements in the upset seeding the trial he declared basically what, to me, seems to be the reality. using leverage in going after manafort to get to the president of the united states and summing up in one sentence what the judge did. precisely what special counsel is about and what these attorneys as members of special counsel represent and it's a shame. what he has done here is absolutely nothing to create equity in the courtroom. judge jeanine: there is no equity in the courtroom and

everyone knows that this is nothing to do with russia, the president or anyone else. why are we wasting time in this courtroom with all of these - i call it super due process. we have a case with the national media is involved and there's super due process and it takes more time. our justice is so backlogged and it's ridiculous. this judge is frustrated and angry and i don't blame them. lou: with all that frustration and anger one would expect there to be some sort of intercession here on his part with those attorneys because he's talked to them about them rolling their eyes and about putting their heads down. he's even put up with backtalk from an attorney who i think should've been lifted out of the court by the nape of his neck. judge jeanine: any tough judge who wants his order in the courtroom and if someone rolled their eyes at me and the jury caught wind of that that means i

lost control of the courtroom. this judge cannot be pushed back by the prosecutors who are pushing back and criticizing him. you got to put his stake in the ground and make sure they understand you don't cross this line. that's the only way to be respected by the jury as well as these prosecutors. lou: when the judge said, as he did yesterday, perhaps he'd been too tough about skaters. is that the point of which he lost control with this proceeding? judge jeanine: anyone with common sense says i wonder what happened in the back room and was only what and very unusual because here's the thing. if there's a conviction the prosecution cannot appeal. maybe the judge is trying to be fair just to get out there and i don't take position but all he had to do was tell the jury i take the position and you go into that deliberation and you decide the facts based on the law and evidence you hurt.

cuz, um, i thought that was what i needed to do. we got our orders to go overseas and i went to baghdad, iraq. we were transporting a bomb sniffing dog to the polling stations. we rolled over two anti-tank mines, it blew my humvee up, killed my sergeant. after the explosion, i suffered a closed head injury, um, traumatic brain injury, loss of a limb, burns to 60% of my body. when the doctors told me i reached my plateau, i did not want to hear that because i do not believe i have a plateau. so, i had to prove 'em wrong, which i am doing to this day and i will still do until the end of my days. i've gotten to where i am at because of my family.

likely is it that that subpoena will win out? >> well, better late than never. i'm glad he's doing it. i think it's a critical piece of information that the public has got to have access to. we're already suing -- in fact we sued to get ahold of the orr, gps, steele communications. we filed those requests literally months ago to exhaust the administrative process so so it was ripe for litigation. he was issue a subpoena and act quickly which is great. he should. we were ahead of him in hopes that we could get it through the legal process. as long as the information gets out, that's the important thing. lou: it's nice you have the confidence that that's going to succeed. do you really have that kind of confidence and if you have confidence, high, medium, low krfd. >confidence. >> i think it's quite high based
