kennedy: president trump and former cia cheech john brennan on a legal collision course. brennan says he might sue over his revoked security clearance and the president says, brit, boy. the president took away his precious clearance. this weekend brennan swung back calling the president's behavior treasonous. he since walked that back a little bit. but also told chuck todd he's exploring his leg options. >> i have been contacted by a number of lawyers and they have

8:03 pm
>> once you lost clapper, are you a little bit worried about it? once that happens i don't know on that side of the team. there is nothing that ever happened presidentially in the course that would exactly what we think would happen here. but i am not sure how it would work. i talked to a number of attorneys who work in national security and say it sounds like it would be something the justice department would handle. it wouldn't be personal attorneys for the president or giuliani or sekulow. this would be an action against the government or the executive branch and you would have to see the doj jump in. but he could go after him for defamation. kennedy: the president could countersue for defamation for some of the things john brennan said about him. >> if you sue at all, the

president alluded to this. it's up discovery -- it opens up discovery. they start the lawsuit, great, that means you get to get into everything that has to do with the lawsuit. we'll go back to emails, the things brennan has said, what he's getting paid by different networks. all that will be there for the digging up. a lot of people think brennan is all bluster. he sounded like a martyr saying i am being dragged through the mud but if i can stop this for the intel community, i'm willing to go through it. but are you willing to go through disrofer are you. kennedy: that's what rudy giuliani is banking on. i think brennan has done himself a great disservice. i think giuliani is right in calling him a blowhard. this whole thing is a huge distraction. what he's doing on is dismantling his own flimsy
8:05 pm
legacy. >> if he's going to talk a big game, and he has been on any number of networks saying i will do whatever it takes. it will come to a point of put up or shut up legally where he'll have to decide whether he wants to file this complaints. talk about this security clearance being taken away from him. it's something you can monetize, you can go in as contributors and write best-selling books. when you lose your access you lose some your cache to gain access. kennedy: i think people like john brennan were banking on a hillary clinton presidency. their own legacies and the gift bag they take to various administrations stay intact. but why is someone entitled to security clearance?
8:06 pm
>> they are not, really. kennedy: it's not like the president went into john brennan's house and took his microwave. >> the other thing you will hear him and other former intel officers say it's taking away his right to free speech. that's not the same thing as taking a security clearance away. he can say any negative or positive thing you want to say. take away your clearance is not the same thing as taking away your free speech. brennan was involved in a number of things. steve hayes has a good piece on this talking about the things brennan did to should downter people's speech. survivors of benghazi came back to the u.s. for the memorial services for the people who were lost. they were pulled aside by the cia and were asked to sign nds,

8:08 pm
>> i'm not going to be rushed to having him testify so he gets trapped into perjury. when you tell me he should testify that he's going to tell the truth and shouldn't worry. that's so silly. it's somebody's version of the truth, not the truth. >> truth is truth. >> no, truth isn't truth. >> come on, chuck todd. just an hour ago. giuliani tried to explain what he went to martha maccallum on fox news channel. >> i'm talking about in this particular situation, one person says the flynn conversation took place. another person says the flins conversation didn't take place. what's the truth. you you tell me how you figure out the truth. >> iter it did or it didn't. >> it's like the tree falling in the forest. did anybody hear it? how do we know what the truth

is? kennedy: will that get rudy out of his latest jam? let's go to tonight's panel. mark lauder is here. and michael malice, and from reason.com, robby soave. welcome. so let's talk about this. is this the latest version of alternative facts? is this an unforced error that eclipses some of the more pressing elements of the story? >> i think what rudy was trying to explain, is two different views of the same story, is that perjury? i think we have seen so many times where people will string together a set of facts to create their own conclusion which may or may not be right. it's like a dan brown novel, it doesn't mean the conclusion is
8:10 pm
right just because the facts are. kennedy: obviously robert mueller is going to believe someone whom he mentored, meaning james comey. james comey and the president have completely different versions of the same events. i think what giuliani is saying. it's also a failure if people have to reexplain what you mint. >> most of people think rudy giuliani as the [inaudible] he spent a lot of time being a prosecutor. let's say you and i went downtears to make a phone call. if i say yes, were nut same room with her, so there is questions like that what he means is truth is not truth in a legal sense. a prosecutor's job is to nab the biggist fish he can and it's only one fish bigger than the

kennedy: i know people mad at the president for the way he delivers some of these questions. at times the delivery is distracting. but at the heart of it, i think there are, especially for fans of limited government, i think there are valid questions here. i also don't think it should be a political tool necessarily. if you get rid of these clearances across the board and someone needs to be read in and granted some sort of temporary clearance in order to help the transition team or answer a question where they have deep expertise. i think that's valid. but what of hillary clinton's claims that a lot of stuff is overclassified. i think a lot of people are overcleared. >> that's true. but this is not political. clapper lied under oath. sally yates was fired because she wouldn't do what the president be wanted her to do.
