manager for the trump campaign. that's it for for us. join us here tomorrow michelle malkin among our guests. good night from new york. kennedy: president trump wrapping up a major rally in west virginia. we'll have full coverage on that in moments but let's get back to washington d.c. end here new york explosive developments in the mueller investigation. first president comes aamer campaign chief paul manafort today found guilty on eight charges of bank and tax fraud. he will be sentenced later this month. he's looking at decades in prison potential and in new york the presence former personal attorney michael cohen pleading guilty to campaign finance violations claiming he helped the president arranged us money -- hush money payments to stormy daniels. the present legal team said these two things have nothing to

do with russian collision. earlier today the president echoed that. watch. >> i must tell you paul manafort is a good man. he was with ronald reagan and a lot of different people over the years. i feel very sad about that. it doesn't involve me but i still feel, it's a very sad thing that happened. this had nothing to do with russian collision. this has absolutely nothing to do with it. so witchhunt and it's a disgrace. this has nothing to do with what they started out looking for russians involved in our campaign. there were none. i feel very badly for paul manafort. kennedy: not everybody agrees that these cases have nothing to the present. legal experts say the cohen issue could be the most problematic but first let's talk about paul manafort. fox news corresponding garrett tenney is live in washington with more.

>> sources close to paul manafort suggested to us that they were not expecting him to be found guilty on eight of these 10 or rather 18 counts that he was facing particularly because it took four days for this jury to reach a verdict and as each day passed by the team was feeling increasingly optimistic about their chances. said the former trump campaign manager or chairman could now be spending the rest of his life behind bars. a federal jury in virginia found him guilty on five counts of tax fraud one count of hiding foreign bank accounts and two counts of bank fraud. in total to the 69-year-old is facing a maximum sentence of 80 years in prison essentially a life sentence. this afternoon the jury told the judge they could not reach a unanimous verdict on the other 10 counts of bank and tax fraud. the judge ruled a mistrial on those counts and prosecutors cannot decide if they want to have another trial for those charges. manafort was stone taste as the

verdict was read and afterwards his attorney said they will need to reevaluate things going forward. >> mr. manafort is disappointed about getting acquittals all the way through or a complete hung jury on all counts however you would like to thank judge ellis for granting him a fair trial, thank the jury for their very long and hard-fought deliberations. he is evaluating all of his options at this point. manafort sentencing hearing will be august 29th at of an opportunity to address the court if he chooses to but a few weeks after that he scheduled to be back in court for a second trial on different charges including failing to register as a foreign agent, money laundering, witness tampering and making false statements to prosecutors in a case of introduced more than a thousand pieces of evidence compared to the 300 introduced

in this last trial. paul manafort's legal troubles are a long ways from being over. kennedy: i can even count that high. meanwhile the presence former - lawyer michael cohen after his surprise guilty plea. he appeared to implicate the president in a federal crime claiming hush money patients with -- were in court nation and under the direction of the same candidate but as we know it's unclear that the sitting president can be indicted. so now what happens quick starting a criminal defense attorney david rinault. all right so let's look and talk about cohen first. where do we go from here because this was a surprise guilty plea on an explosive newsday and it doesn't seem like there's any good will left between these two men so does the pill there's a pardon in michael cohen's future. has he flipped? >> not necessarily. there is no corporation.

we have seen plea dream of my papadopoulos and flynn but the paragraph is not in his. he could be sentenced. yes today he testified that it was that the direction of the president however. kennedy: what does that mean because rudy giuliani said this is the best-case scenario for the president. >> i can't see that. he did not develop it and he didn't articulate it. he didn't explain it. the information itself when somebody pleads guilty the federal government presents to the court information and it has facts and allegations. says it was for the purpose of influencing the election and their multiple meetings between one or more campaign officials, phonecalls and meetings. it may not just be president trump. there may be others. one has to think if there's anyone else because donald trump is the only one that has the protection that is sitting

president can't be charged so others don't have the same protection. kennedy: obviously there's a big difference legally to which the president could potentially be charged even after he leaves office and the political damage because you know if you are trump voter and you look at this and say yes we figured that he was screwing around at some point that was a known quantity but we went and voted for the guy. so if we separate the legal from the political it seems as though the political may not be that bad but could there be considerable legal fallout? >> listen this is a very technical law. this is not a straight of campaign donation. this is in kind. there are many attorneys that actually dispute whether this is a campaign donation are not. kennedy: we have seen mixed reaction from legal scholars about the potential developments and how close they can get to the president and how much they

are legal. >> the fact that cohen has agreed to a crime doesn't mean there are no more arguments that this is not a campaign contribution. that could still be made by any defendant that is brought into that court. so we shall see if there can be any others. if not he's going to be sentenced and then will they be part of? kennedy: let's talk about paul manafort because the jury had a tough time in deliberations. the deliberation went on for four days more than most people watching the trial five they would pay a lot of questions for the judge had obviously they found him guilty on eight counts but a mistrial was declared on the 10 other charges. what does that mean for him? >> will he has significant amount of exposure. just the maximum. this defendant does not have a criminal history. the federal system that happens is the category goes into the

crime. kennedy: are there mandatory limits for this? >> i'm not sure. i'm sorry for that. i think in all likelihood the federal government will not prosecute the 10 other counts. kennedy: you don't think they are going to go back? >> i would not. personally, why? they have the sentence that they need. they also have another case. why in the world go back to court on these? kennedy: that's my next question. how does this affect the next trial coming up very quickly for paul manafort? >> special counsel has to make a decision. they going to continue to go after paul manafort? they have a substantial sentence based on these counts but if they are going to proceed then they could tack on years. what are his options? he could potentially provide information. i don't know what that information could be paid if it's valuable they could engage

in a negotiation. kennedy: he is a do a cost-benefit analysis. he has remained loyal to the president. it seems like he's the last person facing legal harrell who have it. he feels his reward will be exoneration in the form of a pardon whereas even if he flips and makes a deal with mueller he was still will spend time in prison. >> it's a personal decision that he estimate. i don't know if there has been discussion on the pardon. i hope not but yes it's a federal crime. these can be pardoned and it could be possible. kennedy: promises made, promises kept. thank you very much. as we showed you at the top the president claims the manafort case has nothing to do with him. the president's attorney giuliani says he doesn't think it means the thing saying quote i don't think this could be better for the president's case

mueller. they convicted him on eight counts. kennedy: but this trial was on 10 suthers at differentiation on whether he was found guilty and where they were hung and i'm wondering if that changes the perception that mueller is going after him for other reasons not before -- because paul manafort is a bad guy but because mueller ultimately wants the president. and if that's a persuasive. the other side of the argument he would have brought gates. he's the guy that turns. you are ruling people towards trump's direction and he was only half persuasive is the argument that trump and giuliani have been making. it's only half persuasion in the court of law and it's really in persuasive to everyone who is not tom shillue. the people who are going to vote in november when they see witch hunt and uranium one and every stupid conspiracy theory by people they don't vote for them.

iowa with the latest on mollie tibbetts. >> police say 20 four-year old christian rivera's been charged with first-degree murder in the death of 20-year-old mollie tibbetts. rivera was in the country illegally for four to seven years would i.c.e. singh rivera's from mexico and they are placed -- police say on july july 18 mollie tibbetts went missing. he was following her while she was out on a jog. he approached her and alarmed her. he said she got out her cell phone and said get away from me i'm going to call police. he continued to pursue her and he said he blacked out. police say this morning rivera led them back to the rural area break they discovered what they believed was the body of mollie tibbetts hidden in a cornfield. authorities have not identified the cause of death in mollie tibbetts' alleged homicide. authorities say a surveillance

stay on message. do you think that he was rattled by some of the news today with michael cohen and paul manafort? >> there sort of a parallel here about the wishful thinking that a lot of trump supporter seem to be engaging in as it relates to paul manafort and as it relates to cohen. we also by the way have the second number of congress who endorsed the donald trump duncan hunter was indicted on corruption charges following chris collins. you know it is coming hard and it's coming heavy now. there was some wishful thinking that i think a lot of the president engagement about the investigation and criminal charges and corruption allegations and all of those things that somehow this would be made to go away and somehow was fake and manafort didn't do these things in cohen west into he was. i think there's a similar thing

fight against nancy pelosi and maxine waters he talks about them a lot and talked about joe manchin essentially being a puppet of charles schumer and he talked about energy. he talked about the future of coal. how important is this race patrick morrisey versus joe manchin in november and how important is west virginia in the grand scheme of things? >> west virginia is quite important here. republicans are starting to write off manchin a little bit and they are focusing elsewhere particularly looking at missouri, north dakota and indiana as their three best bets he agrees with the president on a lot of stuff. he agrees with him about coal and in all likelihood will vote for brett kavanaugh. he's a little more difficult than some of these democrats but also for congressional district there's a self-described trump democrat named ricky o. jab at trump democrat who is an iraq

and host of the buck sexton show, buck is here. is molar closer or further away from establishing a trump russia connection? >> i think it has nothing to do with trump russia. everything we have seen today has been a complete shift away from why all this is happening. i remember when they were talking about this was all supposed to be about the sanctity of our democracy and our institutions and the threat to the republic from russia and its collusion efforts and now you have cohen yellow cab taxi and not paying his taxes buying ostrich coats. i think a lot of people are saying okay these guys are shady and by the way you and i have had the discussion before on your show. and manafort is shady and we have known that for a long time and cohen is -- but why did they have these federal prosecutors

going after them in this why? it's obviously political so what are we supposed to do with this? it doesn't donning pink for the mueller probe specifically. kennedy they don't really care how they get trump. they just want to get him. kennedy: so are these eight guilty counts today is that a win for mueller? >> look he has gotten, it's obviously a loss for manafort you can say that. he's gotten a lot of guilty pleas already from people that there is a reason why over 90% of federal cases are tweeted out because the risks are too high. manafort fought it. he felt like maybe he had a shot and clearly he made a miscalculation but because the chargers is so specific bank fraud, tax evasion. these are things that have nothing to do with the election of any kind. and so we look at this and say this is essentially an extension of papadopoulos lying and random

that lawyer. it has nothing to do with russia kennedy: let's talk about some of the other political troubles the president might be in because of potential campaign finance violations. and i know we talked about it at the top of the show but democrats and lanny davis is a democratic operative from years back who actually defended president clinton during his impeachment troubles. he is saying it's a crime for michael cohen it's a crime for the president. >> not a lot of guys are lifting weights telling tales about the campaign finance violations and how they got there. this is generally treated as a pretty minimal thing if no one it's quite clear that something could happen. usually people pay a fine to campaign finance law is incredibly often up to

interpretation. in this instance whether or not it would be a campaign contribution it would be fought openly by the trump team that would be up against them. they are going to try to make something of this but all this feels very -- if you hate trump and think he's getting then all this stuff is great. if you are somebody who looks at the justice system and says i really don't want this to be the way the people are settling their political disputes, you don't want the criminalization of policy differences that's what's happening here. i think we should be honest about that. kennedy: everyone is either on your team or the other team and even if you look at potential judges who might decide the fate of these two gentlemen going forward, are they republican appointed judges are democrat appointed judges? it should be blind but her eyes are wide open issues watching a political strip show and waving

the inter -- and term elections. after her latest authoritarian bill proposal does anybody really buy that? joining me now managing editor and one of the world's foremost obamacare health care experts is back in action. this looks like a great case of individualism versus statism and she really wants the state to be the moral arbiter of everything. >> elizabeth warren just as uncomfortable with corporations deciding what they want to do. instead she wants the federal government to do it. the point that you mentioned that came out yesterday is a follow-up to a plan that came out last week that was really a reinvention in which he proposes reinventing corporate governance and in particular billion-dollar companies would have to get a federal charter rather than the

state charter so she would be moving the locus of control from the state government to the federal government. that is a big deal. i think what you really see with both of these plans and when you put them together is elizabeth warren and justice and comfortable with market mechanisms with leaving corporations to figure out how they want to run their business. instead what she wants is for lawmakers, for the federal government to be doing that. kennedy she also ascended to the -- comfortable with individuals taking ownership which is weird because she has worth up to $10 million. that is her net worth. that puts her in the 1%. she is. heavily invested in mutual funds >> like a lot of lawmakers she's worth a lot of money and to be fair i think there's something, there's a good intention that i agree with at the heart of parts

of this plan which is to say the people who are making the rules shouldn't be profiting off of them direct way. that's the argument she is going to make for this and okay fair enough but what she is trying to do here -- kennedy: yap at insider trading there are regarding laws against seven punishments for that. >> although legislators are exempted from some of those rules. what is really telling the approach she is going after here which is she is going to give more power to lawmakers. the same time she's going to remove them from actually owning things themselves. kennedy: that's just fine. >> from the federal government instead. kennedy: the problem is the major co-op or -- corporations and federal lawmakers are in charge of their fate so what is said to? that creates a stronger bond between corporations and government and that makes

cronyism in this country that much worse. >> you know what she would say is that's why we are preventing people from becoming lobbyists after they have been in congress for a couple of years. we are trying to close down the revolving door. this is not a serious plan that she is actually going to try to get past. this is an attack on the president a set-up or run and 2018. kennedy: she doesn't want to run and she doesn't want to do that for work. she wants to be drafted. she wants to be the progressive hero of the universe and beg for her to get into the race because she's assuming biden and bernie and every other white cadre is going to fail. >> the signature part of his plan is it would force the irs to release tax returns for her presidential candidate. this is really an op-ed about how she doesn't like president trump.
