[♪] kennedy: some in the media are pushing hard for impeachment since democrats are calling it the beginning of the end. but as we all know, president trump is a counter puncher who thrives in this kind of chaos. the question is, can he day one step ahead of robert mueller and his enemies in the democratic party. his former campaign chief paul manafort will stay in jail for a while. and michael cohen bled guilty. insiders say it's like i cone is going to tell all and sing like a canary.

on top of all that. a fox news poll shows more people support the mueller investigation compared to last month. but white house press secretary sarah sanders says the president has nothing to worry about. >> he did nothing wrong and there are no charges against him. just because michael cohen made a plea deal, it doesn't mean that implicates the president on anything. kennedy: most of legal scholars say the president cannot be indicted. the hush money for affairs probably doesn't rise to high crimes. but the ultimate threat is political. congress will decide ways an impeachable offense. if democrats retake the house in

november, they will decide what is high crimes and misdemeanors. joining me now, the senior editor of the federalist, mollie hemingway. there are gleeful leftists, one writer at nbc news called it the darkest day since watergate. i think some of those are an exaggeration. but i think there could be legal trouble for the president. where does the truth lie? >> it remains to be seen. people who oppose trump think michael cohen's guilty plea for campaign violations will be the means by which president trump gets take' down. impeachment is a political issue. any democratic congress can decide whatever trump has done is worthy of impeachment, regardless of what the underlying facts are.

but campaign finance laws are murky. there is a of reason to think there isn't a reason for trump's implication. john edwards was indicted to campaign violations for payments to his mistress. but that money didn't come from him, it came from a donor. the government was unable to make the case that was an illegal campaign donation. kennedy: i don't know that we are quite there yet, but what you pointed out is now with special counsels. all they do because they do have an endless budget, they don't have fixed time lines. they just have to justify their existence. and for a lot of people on the left it would seem carefully choreographed between paul

manafort's guilty verdict and the michael cohen plea deal, that this was cord nateed and ordered to do as much damage to the president as possible. >> the timing is interesting but it's impossible to say at this point. by the many worth looking at how this special counsel was set up to look at treasonous collusion with russia to set up an election. the manafort case had nothing to do with trump or russia. and when they were squeezing cohen to plead guilty he didn't plead guilty to a meeting in drawing or hacked emails. he said he made an illegal campaign donation when set up the payments. a lot of people don't like trump. they will do waste takes to get rid of him. if this is the means by which it has to happen, they will try for it. i don't know if they understand

it requires the consent of the people as well. when you were promised treasonous collusion with putin and it's a campaign violation at best which would normally be handled by a fine, that's a big step down. kennedy: you are dealing with people who haven't been in politics and they are used to operating this way in the business world. politicians who resign tend to do so to save face so they can run for office again. or somehow regather their political capital. richard nixon resigned because he had no more political capital. he was at the end of a costly and bloody war that expand five administrations. and he had no goodwill from his own party on capitol hill. the president is in a vastly didn't place, isn't he? >> people are fed up with a

the same thing they find so sickening right now. and it does undermine trust in government and these institutions when people try foul because they don't get their way in the outcome of these elections. where do we go from here and how do we get to the point where justice is metered out equally? >> people keep saying yesterday was the day that put trump on the path to impeachment. the truth is he has been on the path to impeachment the moment he won an election he wasn't supposed to win. people have decided it's an untenable situation. i think it's better for people to have confidence in our institutions and government and a desire to let the people choose who their president is and not fight against that for the entirety of his 4 to 8 year term.
