area. not a huge surprise from the people who support the president. but this does show with governor rick scott and ron desantis claiming victory in their primary that possibly the president's agenda at least in florida is taking traction. that's something republicans at the establishment level are watching to see if the president's message holds through through these primaries. this is a mid-term election year. they are seeing if the president has traction when he goes down there. some of his comments have been taken out of context. president trump backing both rick scott and ron desantis, both winners there on the republican side. the democratic side, that's not a surprise at all. gwen graham has been polling very well, at least 7 points

steele funneling information through steel to the doj after steele effectively had been fired by the fbi for lying and breaking protocol. and secondly, bruce ohr failed to disclose on financial documents that his wife was in the employ of fusion gps. i'm wondering how the serious you think this situation is. >> i think the thing that will determine how serious it is is what the fbi and justice department precisely were telling the fisa court. if you have a situation where you are representing to the court that you have excluded a former informant from the investigation and the fact of the matter is as a practical matter, as a fact you'll matter you haven't excluded the informant because he's funneling information to the fbi, that's a problem. what i think would be a bigger
12:07 am
misrepresentation, and we don't have enough information about this at this point. remember that a lot of the information in the fisa warrants that we have seen that have been declassified is redacted, is blacked out. what i would want to know is whether the information that steele was funneling to bruce ohr off october of 2016 made its way into the fisa applications in some form or covered by saying this is some other source of information. so essentially the question is, do they tell the court we have this informant, he's now excluded for the information yet they are folding in information they are getting from him through ohr representing ohr as another source who they don't identify. that would be problematic. few * how unusual is this?
12:08 am
you have christopher teal work on behalf of fusion gps which was funded by the democrats coming up with that dossier against president trump. he was axed by the fbi because they knew he was leaking to the press. then he went on the record so they had to get rid of him. and bruce ohr is still the go-between, the conduit for this information. is that deeply improper unto itself? >> it's highly unusual. i wouldn't go so far as to say improper. my attitude is as long as you are straight with the court and as long as you disclose, you can justify all kind of arrangements in these kinds of national security applications. and remember fisa now is not building a criminal case. so you don't have the same due process concerns you would have in say a search warrant or

criminal wiretap. here what we are trying to do is collect intelligence on foreign powers that might be threatening to the united states. so you have a little bit more latitude in what might be expected in the way of how the executive branch would go about the business it has to conduct. but what is very important is when you make representations to the court, they have to be true. and it's particularly so in the fisa context. the only due process an american citizen who gets a warrant on him is ever going to get is whether the fbi and the justice department play it straight with the fisa court when they make that application. it's not like a criminal warrant where this will all be disclosed, you will have a defense lawyer, he'll get to pick it apart. in terms of do you process, this is it, what they say to the fisa court. >> we don't know what exactly what was said behind closed
