controversy of his own making. it seems to be building by the week. is this purposeful or has he lost all political touch? >> he does seem to be out of touch right now. he seems to be out of touch with some of the currents in the democratic party. i think what we are seeing in this debate between him and cynthia nixon and in this race in general is that the old hillary-bernie fight is continuing with a different cast of characters now. the fight between the progressive wing and the old fashioned liberal establishment wing of the democratic party is going on. cuomo seemed loaded for bear but having trouble aiming last night. the idea that the candidate would say, "i'll stop lying when you do" is mindboggling. that is what came out of his mouth. >> lou: that came out of his mouth, insulting immigration and customs enforcement. by the way, they are a

standard for law enforcement in this country and then to unsult them as thugs? are you kidding me? does it play so well in new york it's just a statement he has no future national ambitions? >> it's hard to believe that could really play in a statewide race. maybe in alexandria ocasio-cortez's district in bronx and parts of brooklyn. it doesn't seem like it would work in a statewide race. but on the other hand, you see that conventional liberal establishment politicians like him trying to catch up with the progressive wing. does he want to abolish i.c.e.? yeah. let's call them a bunch of thugs. what about medicare for all? well, can't go there yet but who knows? there is still time. >> lou: well, mayor gillum did go there. he wants medicare for all. >> he did.

can't be paid for so he needs to create at least a regional syndicate of state where he could pull that off. and destroy the budget of the state of florida, which has enjoyed, well, immense prosperity under president trump's presidency. this is getting to be a wild race in florida as it begins now with gillum basically under investigation, federal investigation. three years of extraordinary crime rates in the city of tallahassee that he has mayored. this is looking like a clash between the left, the far left and the democratic party itself before we even get to the republican trump era. >> well, a lot of us were paying perhaps more attention to the republican race where we really did see the power of

donald trump with the republican voters. his endorsement of ron desantis really turned that race. turned it in a big way. it wasn't close. >> lou: adam putnam had i think a 25-point lead at one point. >> yeah. >> lou: the president stepped in and turned it all upside down for the establishment g.o.p. and the koch brothers and wall street and the business round table and the chamber of commerce. there is no doubt. which is stronger? establishment g.o.p., represented by those entities or donald trump? right now the answer is convincingly donald trump. >> absolutely. putnam had been elected statewide and desantis had not. when they had the debate, i believe it was bret baier and martha maccallum on it. desantis did an excellent job. he got exposure across the state and then he had the president come in and it really flipped the race. while all that was happening

there was a multi-candidate race going on in the democratic party. remember andrew gillum i think won with 34% of the vote. >> lou: right. >> and so -- >> lou: he was up against five other candidates. all basically establishment democrats. >> one of whom named graham. the daughter of a senator and former governor bob graham. you had an establish. thing going again. and everybody was really surprised when gillum came out on top. >> lou: we look at what is happening in the democratic party and arizona, arizona, oklahoma with the gubernatorial runoff. this is starting to be one of the most interesting if not the most interesting already midterm elections that we have seen since certainly 2010. >> absolutely. arizona being a really, really critical race because if democrats were to capture the

house, that is a rain possibility. for the republicans, the senate becomes everything. everything. and they have got good pickup opportunities like north dakota. but arizona is the one where democrats think they mate be able to pick up one and -- might be able to pick up one. >> lou: i don't believe either party anymore when it comes to this. this is going to be, it seems to me right now, very clearly, the democrats have very little to run on. they will be as nasty and brutal as they can. it looks like a scorched earth campaign led by the far left elements. and we have seen what happens when there is no bridge across the center for the democrats or the republicans. and the democrats certainly don't have that bridge. it's certainly not represented by any major candidate in any state that i have been following. >> no, they have been having a hard time coming up with an actual strategy because the entire race is anti-trump.

that is just it. and i do think that this year, this whole all politics is local and each one of these 435 house races going on across the country is really about local issues. i think we have not seen a year in which a president sort of has cast a shadow across every single political event. >> lou: i would frame that somewhat differently. the president casting a bright light across all of that. >> bright light. that is what i meant to say. >> lou: that is what i thought you meant. we look at the republicans, though, the choice seems to be very clear now because republicans are acknowledging that if the democrats win, they are going to work as hard as they can to begin impeachment proceedings against the president of the united states. the democrats tried to play coy for a while. but now that is clearly their unifying message. we will impeach president trump. that is charge him. although, so many democrats acknowledge there is no crime

with which to charge him. they simply want him out of office. this is an entire party lurching left and announcing publicly that they intend to overthrow a presidency. >> this is becoming extremely difficult for democratic leaders. you have seen in the past, they have tried to be cool about impeachment. or at least let's not talk about impeachment. august 21 was a big day. a was the day of the michael cohen plea. it's also the paul manafort guilty verdict. with the michael cohen plea, the democrats got so excited about the presidenting implicated in a felony of campaign finance violations. i think the democratic desire to see, the base desire to see impeachment went up more. there has been a poll by axios recently that showed 79% of the democratic voters favor impeachment. the leaders cannot really put

a lid on that. >> lou: especially leaders who have, by the way, been out leading that very strategum talking about the impeachment of the president. they have said so much falsehood and ignorance and so much vitriol in to their party that i don't know if they can escape what they have brought. >> they have come one a new poll tested phrase, not a new phrase but a new phrase they tested in the polls they want to serve as a check and a balance on president trump. or to counter the culture of corruption. so the one thing they are absolutely coming out and saying is if they take control of the house there will be an avalanche of subpoenas heading toward the white house. adam schiff will be the chairman. naylol will be the chairman of

>> lou: the trump justice department cited with a group of asian american students suing harvard university over its race-based admission policy. the department of justice alleging harvard uses a personal rating that discriminates against asian-american applicants. the case goes to trial in october. 22% of ad mitted 2021 harvard class is asian-american. joining us tonight is dillon, the attorney, r.n.c. committee woman for the great state of california. it's great to have you with us. >> thank you, lou. >> lou: start with the case with the department of justice. race-based admissions of any kind should be -- i would think in this day and age -- a real red flag for admissions

officers, for university administrations. >> absolutely. it's illegal to put it bluntly. unfortunately in today's america, discrimination against asian-americans is the last frontier. and the justification is that because asian-americans on average, their students overperform, if you allowed people based solely on merit you would have more than 50% of the harvard community being asian-american so we can't have that because of course, the left believes in racial gerrymandering and manipulation of society this way. so what they do is assign low personality scores to asian candidates and use that as a proxy for elimination of those students. even without actually meeting the students. so, that is obviously illegal. the federal government stepped in because the federal government gives substantial funds to harvard. so harvard has to comply with title xi and federal civil rights regulations. they have a great place and i look forward to it playing out in court in october, lou. >> lou: it's fascinating. by the way, it's not just

asian-americans. i love the expression "over-performed." in a merit based, in a meritocracy, a capitalist economy, free enterprise, we should be celebrating, quote/unquote, "overperformance" in every fashion. it makes it sounds redundant or superfluous. i don't know how anyone could get to the level that it's overperformance. >> we can't have people out of their place. >> lou: you want overperformers. >> yeah. >> lou: and to deny them, denies the country. >> absolutely. >> lou: and to your point, you know, when you -- i don't know that everyone has thought this through to its logical extension. it is saying that we are going to put race before merit. we are going to put race before talent. and that there is some sort of magical potion that only elite universities know the formula

that somehow should be superseding merit, talent and demonstrated intellect and the great potential future for themselves and the country. >> yeah. >> lou: it denies us. >> bad news. i mean, it's un-american. it's like a brave new world. it's telling that they have to know their place and stay in their place. it's not right. >> lou: you know the other part of it is a quarter to a third of the students admitted are international students rather than american students. and some of those obviously losing their -- some of the people losing their seats, asian american, jewish students who also out-perform. i love that word. "outperform." i have never been accused of that. i would like to do that some day. anyway. >> you are an overperformer, too, but harvard doesn't have control over you, luckily?

polls. despite the pummeling he takes every day. >> i'm a codirector of the harvard katz harris poll and chairman of the harris poll. i was surprised as anybody else that he held up at 46% job approval after the pummeling he clearly got in the media. but i polled for president clinton in a same situation. the economy was good and he got hit with monica lewinsky and we kept the ratings above 50%. the sate thing. the public saying this is not about the issues that affect me. >> lou: there is not even so much as a blanch. they don't even blush, the dems, go off on all sort of salacious nonsense that is irrelevant as you say to nearly all americans. it's pure speculation. it has nothing to do with the

counsel, the targets of the special con sell to this point -- counsel to this point. she was given a free pass. give the president counsel here tonight. >> well, look, the president has got to defeat the mueller investigation. i think he is doing basically the right things. i think his people have to be and his tweets oftentimes go over the top. but i think when you go back is this investigation biased? yes, it is. was the foundation corrupt? it really was. the more you look at what happened with the f.b.i. has this now somehow transmuted back to 1998 all over again? we are looking at the private lives of our president and trying to create crimes there? yes, it has. any fair person now sees that. which is why we have to remove these kind of investigations from the politics and let elections decide things. >> lou: in "the hill" you

had written a piece talking about fusion g.p.s. and writing there is no question that hiring spies to do opposition research in russia would qualify as a campaign expenditure. and yet, no prosecution. it's staring everyone associated in the justice department, the f.b.i., they are looking at it and think have been looking at it. yet, they don't want to take that on for some strange and i'm sure corrupt reason. >> well, what i was trying to contrast was they have stretched everything imaginable to try to implicate trump related to these non-disclosure payments related to things from a decade ago. at the same time, clearly, the expenditures that were made to fusion g.p.s. and christopher steele by current election law had to be reported for what they were and not use a law firm as a cutout for that. that is clear. i'm not suggesting by the way that hillary and her campaign
