let's get to breaking news and that is the weather. goal states are bracing for impact with tropical storm gordon excepted to strip into a hurricane. we have the latest. reporter: a labor day washout in south florida ruining many people's plans for the unofficial last day of summer. >> rain falling and we were like this is not what we expected. reporter: court informed monday over the upper keys, but by mid afternoon areas like west palm beach-- palm beach were drenched with some parts of the state getting 8 inches of rain. >> heavy rain and a lot of water. reporter: what should have been at packed beach was a ghost town , not just fighting the sun that fell victim, the severe weather impacting shopping with local businesses same foot traffic was almost nonexistent. it's expected to hit mississippi and louisiana where preparations are underway. >> statewide emergency

declaration. enforcement is primarily southeast louisiana. >> our team in the operations center is activated and has been activated over the past couple of days. reporter: cruz did not have noticed as they rush to fill sandbags keeping up with demand for plenty of homeowners grabbed shovels to do it themselves. >> blocking off around the doorways into such a. reporter: 5-foot storm surges are expected prompting workers to suspend their labor day tying up boats. if gordon stays on track the entire gulf coast will deal with significant rainfall. fox news. cheryl: looking at oil prices as they had higher as oil platforms in the gulf are closed ahead of gordon's approach. lauren: the gulf of mexico is responsible for about 17% of crude oil production. to a political storm, if you will, judge brett kavanaugh hearings are set to begin today.

senator lindsey graham, a key republican on the judiciary committee was on fox news sunday saying brett kavanaugh is expected to get enough support to be confirmed to. >> i think there are a handful of democrats that will vote for judge kavanagh and maybe even more. a lot of people should vote for him. if you are looking to a republican president to pick a qualified conservative he would be on the top of anyone's list. cheryl: senator dick durbin disagrees with that. >> he's the most unpopular supreme court nominee in the last 40 years. kennedy reached that point so quickly? a number of reasons and you look at first and foremost the fact that this president said i'm not going to put a man on the supreme court unless he overturns roe versus wade and a portable care act. cheryl: the lawyer for former president george w. bush turned over 42000 pages of documents from judge kavanagh's service in the white house, but minority

leader chuck schumer tweeted not a single senator will have time to review these records with the late date dump, but hours later the judiciary committee said the commodity staff has completed its review of each and every one of these pages. lauren: trade talks with canada are set to resume tomorrow. four days of talks last week ended with differences remaining. cheryl: president trump tweeting there's no political necessity to keep canada in the nafta deal if we don't make a fair deal for the us after decades of abuse canada will be out and congress should not interfere or it will simply terminate nafta entirely and we will be far better off. some of the sticking points include canada's policy to protect its dairy market and patent protection for us-based pharmaceutical companies lauren: nike certainly feeling the heat this morning after they named a colin kaepenick the face of their just do it at campaign.

nba lebron james, both are outspoken supporters of colin kaepenick. back to you. cheryl: thank you. we should look at shares of nike now as they are lower in premarket trading, down more than half a percent. lauren, radiant spread nfl games have been under pressure sunday after sunday. nike ignoring that. lauren: ignore the larger picture and yes. i looked earlier and shares were down more than that, so we have to watch this stock for sure today at work. cheryl: executives are headed to capitol hill tomorrow where they are expected to face tough questions. lauren: now to headlines. reporter: tomorrow's hearing before the senate intelligence committee are expected to include facebook co zero sheryl sandberg, twitter co zero and representative from google. topping the agenda and lawmakers want to know what tech companies have been doing to stop for an election interference

lauren: stranded on a greek island sounds pretty nice at the same time. sticking with the weather, gulf coast states on high alert as tropical storm gordon is expected to strengthen putting millions under hurricane warnings. cheryl: janice dean has been tracking the storm and is here with the latest or do we need to go to greece to escape the weather? >> depends on where you live, are all-- on the gulf coast they are preparing for a potential hurricane making landfall later this evening and overnight. this is gordon. we have been watching gordon over the last will days. it became a tropical storm yesterday, brought a lot of rainfall to south florida as well as the west coast florida, gulf coast area. we expect to make landfall sometime this evening. we have hurricane warnings in effect from the perl river, louisiana, mississippi, alabama and parts of the florida panhandle as we expected to become a

hurricane. the good news is that it will be a quick mover as it makes landfall and then it will quickly dissipate bringing rainfall to the gulf coast region, so we will keep an i on that. here's tropical storm gordon and we expected to become a minimal hurricane as it approaches the gulf coast. there is that one of uncertainty stretching from parts of coastal louisiana, mississippi, alabama and the florida panhandle. quick, ladies, also tropical storm florence with several waves coming off the coast of africa. i expect a busy september in terms of tropical activity. it's been pretty quiet. we make a whole bunch in the next couple weeks. lauren: september is a volatile month. thank you. cheryl: september is also volatile for the stock market. we have had a record run especially month of august, so what's ahead for you? there is a dire prediction about volatility. and more reaction

historically volatile. how do investors prepare and it? we asked michael. good morning. >> how're you doing? lauren: do you expect volatility to spike and had we prepare? >> i don't see anything coming along those lines we just hit all-time highs night expect to continue going that direction. earlier this year we saw some headwind from stocks, but that itself has subsided and every one of those shocks created buying opportunities for us. the economy is doing well and it will continue to improve. lauren: do you think trade or potential trade war-- i say that because if you look at annual performance of stocks in the us we are up eight, 9%, but china is down almost 20% and a lot of the global indices are down on the year, so have american investors priced trade into the market yet? >> look, i don't think any of these trade wards

-- wars will deteriorate to anything significant over the long run and i think when investors look at the s&p 500 say this might create short-term uncertainty, but over the long run it's in everyone's best interest to figure these issues out. lauren: if you look evaluations of these stocks, i mean, they are expensive. by some estimate if you look at the forward price earning multiple it's about 10% above normal. what is that say to you? should we buy when we see a pullback? >> it's important to remember we are about 10% above the height like 16 and a half, 17 multiple in the long-term averages 15, but yet extended periods where you are way below the 15 number or way above and the periods above the 15 ordering multiple are a cause of economic expansion and you tend to stay there for long periods of time and to put this in perspective the last

time we got an all-time high the s&p to about 24, 25 earnings which is almost 50% higher than where we would be. lauren: i like that perspective, so you are not worried about september at all. what worries you, michael? >> the difference between short-term interest rates and long-term interest rates is very small. as the expands you could create a lot of volatility, but i would see those as buying opportunities because interest rates are going higher for the economy. as things get better stocks go higher. lauren: gdp 4.2%, 18 year hyper consumer confidence. thank you for joining us cheryl: we have more coming up this morning. supreme court showdown. president trump's nominee, brett kavanaugh, faces his first day of hearings on capital hill. will his pro-business past hurt him? carnival launching the biggest cruise ship ever in the big prize tag will shock you.

looking at futures with the dow jones up four and the s&p up with nasdaq up 11 and a half. you are watching "fbn:am" the digital divide is splitting this country. we have parents who are trying to get their kids off of too much social media and computers, and then we have parents who would only hope their children have access. middle school is a really key transition point, right. the stakes start changing. students begin to really start thinking about their futures. what i like about verizon's approach is that it's not limited to just giving kids new tools, it's really about empowering educators to teach in different ways, and exposing kids to more active forms of learning.

5:30 a.m. in new york. tuesday, september 4. lauren: good morning. i'm lauren simonetti. cheryl: brett kavanaugh begins his hearing for the supreme court this morning kicking off what is expected to be a bitterly partisan slugfest with controversy already beginning. a lawyer for pot-- former president george w. bush turned over more than 42000 pages of documents. it came in late so charles schumer criticized saying that they could not analyze them in time for the hearing. at spring in a law professor and former clerk for judge brett kavanaugh and justice kennedy. good morning. >> think you. cheryl: before we get to brett kavanaugh and his record and went asking about this document dump. do you think there is validity and what chuck schumer had to say say not a singer settable will be able to review these records before tomorrow.

grassley's committee says we are in good shape. when you make of that controversy? >> my goodness. well, chuck schumer is local about this. chuck schumer's vocal about everything. the truth is brett kavanaugh has already produced 80 times more documents than justice so to mayor produce. he produced four times more documents than any nominee in history and the most important documents have been public all along. those are the 300 opinions he's authored from the second most important court in the country over the past 12 years and 13 of those opinions have been vindicated by the supreme court and unparalleled record of endorsement for lower court judge. cheryl: senate judiciary said the majority of staff has not completed their review of each and every one of these pages, but i want to listen to what senator richard durbin had to say on fox news sunday about the idea maybe they are trying to protect capital-- cavanaugh. >> the assertion of

executive privilege by the white house to take 100,000 documents obtained the american people will not get a chance to see them as they reflect on brett kavanaugh's background is the first time in history this denial of access to documents filed its a rule we thought was the tradition of the senate under senator sessions and the senator leahy time and again when he to nominees. they are suppressing these documents. cheryl: what you make of them suppressing documents? >> there is no suppression of documents the truth is, again, more documents have been produced for judge brett kavanaugh than any nominee in history and there's really less need for the documents than any nominee in recent history because unlike justices by chief justice roberts or justice taken not a judge before her nomination, we don't have to guess about what kind of judge brett kavanaugh will be by going back and looking at his high school yearbook or reading the

tea leaves. cheryl: we have his records. >> exactly. cheryl: we have his records on the bench. i'm curious if his pro-business slant which you can kind of see and whether he went against the epa saying the regulatory overreach was hurting business and consumers. he's been mixed on employment, but also went after the fda saying it overreached in shutting down a medical device maker. he does seem to support the business community and less regulation. is that a problem for him in these hearings? >> i have to disagree with the premise of the question. i don't see a pro-business slant. i worked with him every day for a year as his clerk and in every case he seemed to go where the log reads without prejudice for one side or the other tricks sometimes big business one and sometimes a small plaintiff one. every time the law was on the side of the plaintiff, the plaintiff one and he would say every case is a

separation of powers case because every case requires the judge to remember it's the rule of the judiciary to apply the law, not the role of the judiciary to make the law. cheryl: you probably have learned great lessons from him and we would love to have you back as the process continues. thank you for getting up with us. >> thank you. lauren: moving on to another hotseat this morning. silicon valley executives from facebook, twitter and google on capitol hill tomorrow facing questions about their efforts to stop foreign interference on their sites out of the midterms and also how to police content on their site. melissa joins us now. good morning, melissa. >> good morning. how are you? lauren: on the albright. do you expect these hearings to be productive when i can i don't expect these hearings to be productive mainly because congress has a difficult time understanding what the social media sites-- you can tell from previously in the year when facebook testified, so

as far as what will come out of this, it's difficult for any of these sites to really police contact. you have interference in the last election and now the midterms coming up in a few months and who knows. i think it's difficult for them to police the content and it goes back to the conversation about censorship and should they be policing certain things are not? lauren: their speech platforms i think everyone can agree social media sites are platforms for which different points of view are shared, so we have to understand that in a different way these days and it's going to be difficult for the executive of twitter and facebook and google is not sending their ceo, but it will be difficult for them to prove that they are innocent or a political. they are not. >> they are definitely not, i mean, they do police contact, but that's it i'm saying. i don't think there's any way to stop that and i don't think congress can stop that.

they can have the hearings, but remember one of the reasons facebook stock did so well up until this year-- i don't wait-- like the way the stock looks now, but people put ads on their and make money this way through advertising and they've done a good job. twitter has not done that great of a job. google has because of youtube. they have been able to collect and that's why those two stocks google and facebook have done better than twitter. lauren: the tech stocks are big reason the market is up and the nasdaq for the month of august was up almost 6%, but you say they are outside of technology tech stocks and stocks in general you like. what are they? >> we are up to 40 and i'm not surprised because it was so strong on friday and it could be a bullish week in the market. we will have to see. there are other reasons why the market looks higher it looks higher because retail is performing. target, walmart had great earnings in the last month and that was

unexpected. usually those stocks don't performance of the last quarter of the year with holiday shopping. also, the banks are starting to turn around. j.p. morgan chase looks good. once you get all the financial participating backup info on uptrends breaking new highs you will see a strong close until the end of 2018 for the overall market. lauren: melissa, thank you. cheryl: nbc news chairman andy lack is defending his network's decision not to run the bombshell report on harvey weinstein. lauren: tracy picks up that story and the other headlines making news. reporter: good morning. issue date 10-- memo and 11 page report yesterday defending the network's decision not to pursue a story by journalist ronan farrow about harvey weinstein's allegation of sexual harassment. farrell also make-- old boy took it to the new yorker.

according to the memo he said the story did not have a single victim or witness willing to go on record, so we had nothing. the memo also claims pharaohs new yorker police quote had little risen when students reporting that the network. farrow says the memo is full of false or misleading statements. cheryl: some tech companies are changing the way they hire? >> according to job searching site class store google, apple, ibm and other big companies no longer require applicants to have a college degree work according to the site ibm looking at candidates with experience in nontraditional education like coding classes or industry related vocational classes, so it is something we see a shift away from a lot of these jobs previously requiring college educations. cheryl: a shift for them and now to a big ship your carnival cruise has outdone itself.

we will show you how the market is reacting. dow jones down 11 at the nasdaq up 11. billionaire ceo is denying a sexual misconduct allegations that prompted his arrest friday in minneapolis. details of the allegations have not been released. he has returned to his-- to china and his attorney says it is likely he won't face charges. its primary day in massachusetts with voters heading to the polls hours from now to decide between incumbent governor charlie baker and attorney scott lively in the republic gubernatorial primary. on the left j gonzalez and bob mackie will battle for the democratic nomination. a trio of republicans are set to compete for a chance to unseat democratic senator elizabeth warren in the midterm election. former white house adviser steve bannon has been disinvited from the annual new yorker festival after several celebrities said they would boycott the magazine's event if steve bannon attended. jim carrey was among

about finding justice, calling out criminals and prosecuting crimes and building cases. do you think it's fair the president when after sessions on the timing of these indictments? >> no. i don't know what he's doing because the role of the attorney general is not to pick sides, not to pick teams. 's role is to enforce the rule of law, so i'm confused as to why the president has it really understood this, i mean, we have got to make sure we are not looking like we are people trying to get favors and trying to pressure decisions are coming that the purpose of the rule of law and i can disagree with jeff sessions of when it comes to some of his positions, but it's crazy-- the guy is trying to be a referee and have a level playing field. cheryl: howard, even some in his own party have criticized him. republican said these two men have been charged with crimes because of evidence, not because of who the president was when the

investigation began instead of commenting on ongoing investigations the job of the president of the us is to defend the constitution and protect the impartial justice. >> pretty strong words from a republican and leader of his own party. i see the president looking to level set and looking to scapegoat jeff sessions to her two weeks ago we heard from the podium talking about a red way than continuing the congress and u.s. senate and now it looks like he may see writing on the wall and wants to level set not take the blame for the disarray he has left his party and. cheryl: i went to move on to the midterms. cliff, we keep hearing about a potential blue wave come november but the "wall street journal" the big good deep dig into different congressional districts that may be art getting the effects of the tax cut, maybe in particular negative effects.

let's talk about state and local taxes. used to be able to obviously that was a deduction on your returns and that is no more. whether it's new jersey or illinois or california or minnesota all of the seats are currently gop held. journalists saying they are competitive and in danger because of the president's policies. how were each of the republican speak about this? >> i think the problem right now is the republican messaging is that they are not focused on the benefits they have delivered to the american people. look at president trump talking about jeff sessions and that's a distraction. should focus on tax cuts like a writ of the regulations that have allowed so many jobs to be created, i mean, the economy is booming. cheryl: not in every district, cliff. i mean, what the journalists saying the midterms won't be a national referendum. it will be locally based and not everyone is doing the same depending on where they live.
