channel. good night from new york. kennedy: the president calls the "new york times" gutless and questions whether it's treason after the times publishes an explosive anonymous op-ed reportedly written by a senior trump official. author or authoress says he and other white house officials are working behind the scenes to top the president's misguided impulses. he says i'm part of the resistance inside the trump administration and says he and other officials considered invoking the 25th amendment.
8:01 pm
the root of the problem is the president's amorality. anyone who works with him knows. don't get me wrong. there are bright spots that the near-ceaseless negative coverage of the administration fails to capture. not surprisingly the president came out swing after his latest anonymous opponent. president trump: if the failing "new york times" has an anonymous editorial meaning gutless. we are doing a great job. the poll numbers are through the roof, and nobody is going to come close to beating me in 2020. kennedy: the president tweeting
8:02 pm
does this senior administration official really exist or is it just the "new york times" with another phoney story. if this anonymous person does indeed exist, the "times" must for national security purposes turn him/her over at once. author of let trump be trump. corey lewandowski. there is some stuff in here that is a little different than some of the other anonymous accounts we have seen. some of it is unsurprising and a string of adjectives to describe the president unfavorably. that's become a pretty common narrative. who do i think it is? >> i don't know who it is. but whoever wrote this, if this is a member of the trump administration is not only doing

themselves, but the country a disservice it's an amazing privilege to go in the white house and serve the american people. this is the second time the "new york times" has published an anonymous op-ed. their tax are reduced, they are safer and more secure. kennedy: that's what this person is saying were there are successes and it is those successes that will drive the president to a second term if he can curb his own impulses. i don't know if we need adults in the room. because that's the world view of the resistant left, that they are the adults in the room, and they know better than voters, and they will tell you, and this person is claiming to guide the
8:04 pm
president and shape his nature. >> if you read the woodward book which has very little credibility. there were people who said they took papers off the president's desk and doing anything they could to stop the president from doing things. this president is fulfilling the campaign promises he outlined which is to make our military strong enough. what part of that is not the job of the president? this is the president fulfilling his campaign promises. those people in the administration before or in there now are doing a disservice to this country and they should leave immediately. kennedy: we are not talking about the woodward book at all. if you are prone to conspiracy theories, i don't usually buy into them, you might see we are not talking about woodward, we
8:05 pm
are talking about something that allows the president to be outraged not only at a traitor, but also one of his favorite targets, the "new york times," but at the same time gives him and the administration credit where it is due. >> it's interesting the "new york times" has broken protocol. an amman plus op-ed is a made up fabrication. if you are going to write something you should put your name tocchet to it so there can be a rebuttal. this person could have had the chance to resign their position and then pen that op-ed. they chose not to do that. this is a disgusting thing for the "new york times" to do. they didn't alert the white house from what i know of, of this pending op-ed. the administration and the

president should have been given the opportunity to respond. kennedy: i would like to see some of these sources go on the record. i think that's the bold and right thing to do. if it's so important to these people to put in word the horrible acts and personality of this president, i think they should put their own names on these descriptions. but you have to admit there is a disconnect between the president's personality and some of his policies. sometimes the things he does are so distracting and weird, it takes away from his success. >> i agree with you, i think this person if they exist should put their name on it. but this president is fulfilling the campaign promises he made. we are renegotiating nafta, and
8:07 pm
i am going to make the economy grow and that's what he's doing. he said i'll make sure unemployment in hispanic and african-american communities are the lowest in history and that's what he has done. if you don't have an america first agenda, then quit the administration, do something else. go flip burgers. to hide behind the anonymous sources is the reason the media has the lowest approval in history. kennedy: there are common threads. the president does have a glitch. >> we knew what we were getting when we voted for donald trump. kennedy: but you are basically saying the same thing the author is saying, there are some great things on the horizon and great things that materialized and the potential for an historic presidency, but at the same time
8:08 pm
he's kind of weird and gets in his own way. >> i don't believe that. this is a guy to came to washington, d.c. as a disrupter. kennedy: i want the country and the president to be successful, but every once in a while's his own worst enemy. >> i have a book coming out called county enemies within." kennedy: you want more than 60 million people to vote next time. >> the economy do keeps going this way, he's going to win. kennedy: an ideological showdown. republicans and democrats fighting over president trump's nominee for the supreme court. but today that nominee got his chance to push back. here is a live look inside the hearing that has been going on since this morning.
8:09 pm
a bunch of energizer bunnies inside that hearing room. kavanaugh holds his ground. >> i'm an independent judge. for 1 years i have been deciding cases based on the law and precedent. >> what sort of loyalty will you owe to the president. >> i owe my loyalty to the constitution. >> what would you say your position today is on a woman's right to choose. >> as a judge, it's an important resident of the supreme court. by it, i mean roe versus wade and planned parenthood versus casey. casey is precedent on precedent. and i understand the significance of the issue. i always try to see the real world effects of that decision.
8:10 pm
kennedy: the democrats doing everything they can to paint kavanaugh unfit for the country's highest court. they were doing everything they could to gum up the works. but at the end of the date on thing that mattered, will judge kavanaugh be a fair and competent jurist. joining me now, former speech writer for george w. bush and bill mcgurn. there were a lot of questions about self-pardoning. >> i think he comported himself very well. he explained his judicial philosophy. his judicial philosophy is available for anyone who wants to read his 300-something opinions.
8:11 pm
i don't know why the love lefts costumes so much. so there is a lot of sound and fury signifying one thing, they don't have the votes. we heard about all these republicans who might go south, none of them are abandoning mitch mcconnell, keeping the caucus together. so none of this matters. i believe not only will brett kavanaugh will win nomination, he'll get a few democratic votes. kennedy: i wouldn't be surprised if some of those republicans knew his nomination was safe and go back to their con si constit. this obviously more contentious than the gorsuch nomination.
8:12 pm
>> last week for the week-long john mccain burial we had all these lectures on civility, and this week we have disruption of the process and interruptions. there are a lot of interesting questions you could ask brett kavanaugh. and he's probably the one candidate on that list donald trump has who is probably most of suited to deal with this. he was through the alito and roberts confirmation as a white house staffer when i was there and probably asked some of the questions. they are not going to trip him up. he's a very capable and smart individual. they are trying to portray him as a misogynist and he shows up with his beautiful wife and two beautiful daughters. kennedy: if that's the way they are going to paint him into a corner, they are not going by the the right way. if anyone has watched the confirmation process you know
8:13 pm
the judges always know how to get around that. >> if you watched confirmation hearings before, i am particularly thinking about justice scalia. he was forthright discussing his philosophy. but most of clam up and endure the moment. they mastered the lesson. you sure got bourkeed out of the high court. all right. do democrats have a prayer in stopping this nominee? charlie hurt has something to say about it. and jehmu greene. welcome to both of you. jehmu, you are coming to us live from austin, texas.
8:14 pm
obviously chuck schumer wanted to gum up the proceedings by invoking the two hour rule so the entire thing would have to end by 2:00 because the senate was in session. mitch mcconnell called his bluff and pulled the senate out of session. did chuck schumer fail? >> schumer has a huge mountain to claim he may not able to. but democrats are probably judging him on a different standard. he's been steam rolled by senator grassley and mitch mcconnell over the last 2 1/2 years. they cheated. they blocked a confirmation hearing for merrick garland. they changed the rules to get kneel gorsuch in. and they are not seeing hundreds of thousands of documents before this confirmation process is
8:15 pm
completed. this is how democratic activists are looking at this. where are you, chuck schumer? kennedy: the left is upset because chuck schumer told some of those red state democrats in the senatorial fight of their lives to keep their powder dry. >> to be sure, i think a lot of the base of the democratic party, i don't think they grasp how all this works and they are confused about why the senate blocked the merrick garland nomination. the reason is voters put republicans in charge of the senate and the senate is schmoesed to be the one to confirm the nominee. kennedy: like democrats will
8:16 pm
have that power. >> and they will one day again have that power. it's why republicans have the power to confirm kavanaugh to the courts. but i think it's amusing watching these people in the senate judiciary committee doing their best to make it look like they are trying to stop them. at one point they had somebody asking brett kavanaugh himself to take himself out of contention until some documents are released. that's the most of ludicrous thing the world. the senate judiciary committee is in charge of making this decision, not the nominee himself. kennedy: i love protests. i love chaos. i think all of this is good fun. but i know that if this were a democratic president with his or her nominee and you had
8:17 pm
right-wing groups screaming and shouting the whole thing down, elizabeth warren would birth kittens in the chamber. >> it happened certainly on both sides. people fight for the issues they believe in. but there is a reason bret calf now is the most of unpopular supreme court nominee. kennedy: the balance of the court now rests in his confirmation. it wouldn't matter -- >> if he were not answering questions and not being straightforward. kennedy: elena kagan, sam alito, they all do the same thing in the same way. >> ruth bader ginsburg answered clearly her commitment to legal

abortion. kennedy: it was a different time. >> it's something that should concern an overwhelming majority of women and the families they care about. kennedy: i don't know what's going to happen here. but the next person nominated. if this president gets another chance, it's going to be, this is child's play. this is nothing. there will be pyrotechnics. >> it will be truly astonishing. that's part of the reason why they are fighting as hard as they are in this particular case. going back to the poll that shows kavanaugh is the most of unpopular? of course he is. because all these people
8:19 pm
saying -- >> it's a reality, he's not popular. >> the bottom line is the reason he might be unpopular because all these lunatic democrats keep talking about how he's going to kill all these women and take everything away from babies. kennedy: why would you do that, brett? >> actually when you sit there and listen to the hearings -- kennedy: it could have been any of the judges on that list. it could have been any one of them and it would have been the sky is falling. but you have to stop saying that because next time no one is going to believe you, and it could be the most of irresponsible hard-core mike pencian jurist we have seen in this land. coming up, the heads of twitter and facebook were on capitol hill today. you might have missed that.
