god bless you and your family and the survivors. here's lou. lou: good evening, everybody. our top story, republican lawmakers clamoring for the full release of fbi and department of justice documents detailing obama administration surveillance of the trump campaign, but there's an apparent effort within the white house to stop president trump from revealing those documents and the truth to the american people, an effort reportedly led by some of the president's attorneys. congressman matt gates has been one of the leading voices calling for declassification of the fisa application documents and joins us tonight. the 17th anniversary of

already told to evacuate. the category 4 hurricane is tearing its way through the atlantic as you see on the screen before you. expected to hit the east coast by friday morning. we'll have the very latest on the strength and the track of the category 4 storm straight ahead. our top story tonight. president trump pushing to declassify fisa documents related to the surveillance of his campaign, but meeting resistance from his own attorneys, apparently, in the white house. the daily caller today reporting imminent flood of the white house counsel's office opposing declassification of the document requested by a dozen republican lawmakers just last week. flood is apparently concerned the public release of the classified information could have unintended consequences. what could flood and his band of wary attorneys possibly be concerned about? that the public would realize the fbi and justice department

failed to disclose important information to the fisa court when seeking to spy on former trump adviser carter page? could that be it? or are they concerned that the american people can't handle the extent of the corruption of the deep state that worked to delegitimize and subvert the trump presidency from the outset. there is no time for the reluctance of the white house counsel's office the american people deserve to see those documents and the president needs to roll back the special counsel that shows no sign of acknowledging even that the president has absolutely demonstrated no wrongdoing whatsoever and that the special counsel has no evidence of any wrongdoing. in other words, it's time to end this witch-hunt. joining us tonight, congressman matt gates, member of the house judiciary committee, one of the 12 republican lawmakers who called on the president to declassify both the fisa and bruce orr documents, and

congressman, great to have you with us. let me start with this first report that emmet flood, reportedly, has been leading the effort on the part of some attorneys within the white house to stop the release of the fisa documents. your thoughts. >> well, i've not met mr. flood, not spoken with him. only transparency is going to expose the extent of the corruption and really the connectivity of the cabal that is out to disrupt this presidency. we have caught the orr's red-handed, not disclosing information, and i think what's really important is the information wasn't given to the secret court, to the fisa judge. here is our commonsense argument, lou, we can't show the american people what was hidden from the secret fisa court until we show the american people what was presented to the hidden fisa court. that's going to show where you didn't see the dnc paying for this information. you didn't see the bias in creating it and didn't see the

department of justice's own spousal relationships impacting what was presented as intelligence document. lou: well, as you say, common sense, and it makes perfect sense. there is also the issue here, this is a president who said, and he has acted upon it, he wants his to be the most transparent administration in history. a claim made by his predecessor but honored only in the breach by the former president. this president has a unique opportunity and that is to take control of this witch-hunt that has frustrated him throughout his presidency. he has received no support from mitch mcconnell, from speaker ryan, from you and a number of your colleagues. he has received immense support, but from the leadership, nothing, at a time when mcconnell and ryan, in any other circumstance would have expected to stand shoulder to shoulder with this president and simply decry the

appointment of the special counsel and demand its end. >> well, lou, i think that what you've highlighted is the frustration with the status quo, but imagine how worse things will get if the democrats take over in the mid terms. i think bob mueller purposely doesn't want to give his report to a republican congress. i think they're hoping that the democrats take over that. mueller can issue a report and democrats in the house can have a snap impeachment to take us away from the results we've been delivering for the american people. you look at energy in the democratic party, it's about resistance, not results. we've been critical at times on the show, lou, a heck of a lot better than having the democrats do everything they can to create chaos when we've got a president doing so much on trade, on the economy, on jobs to make sure that american people live better lives. lou: i couldn't agree with you more, and personally, i believe that the american people agree with what you're saying, and i

can't imagine that republicans won't turn out in massive order. i don't know whether such a thing -- >> they've got to know what's at stake. if you don't show up at the midterms, you are dooming the president to impeachment. we've got to get up and be active and encourage people to exercise the right to vote. madison said citizen was the highest role in the democracy, and we've got to rise to that challenge in the mid terms as conservatives. lou: you know, the american people and particularly those who voted for president trump did rise to the occasion in 2016. they been frustrated. this president has not delivered on the wall. he's been frustrated in that desire by mcconnell and ryan there. has to be, it seems to be a new bargain between this president and the people he would have vote for and you for your colleagues in the house and in the senate.

seems there needs to be a new trump contract with specificity and dates about when does the wall get funded and what is going to happen, in because it can't be another one-way deal. it was a shot, if you will, heard around the world in 2016, but now there's got to be careful aim and careful, careful targeting in that contract, don't you think? >> you're right. i'm new to the congress. this is my first term. we making a member of congress a lot harder than it needs to be. if we wanted to fund the wall, we could do it this week. put funding to the wall on the appropriations package, send it over to the senate and that wall funding could be on president trump's desk before florence makes landfall in the carolinas. but we won't do that because we're so afraid if we do bold things that will upset the applecart for the mid terms. as republicans we need to be a lot bolder and i stand with jim

jordan who propose what i described. fund the wall do, it right now and let's go into the midterms with momentum doing what we said and keeping our word to the american people. lou: i couldn't agree with you more, congressman. i think you've got the right man for the job. i think you are making absolutely perfect sense but at the same time, as we're talking about turnout, the republicans listening saying why do i need any more of these feckless fools who will not demonstrate the principle and the courage to do precisely what and you jim jordan have said? move on. let's get this thing done, and i just don't know -- i just don't know how that affects the american voter right now. >> we'll demoralize our base if we don't do what we said. we didn't repeal obamacare to the fullest extent, and if we don't build this wall and ask people to show up and vote, they're going to ask what we've done for them. the economy is rolling,

regulatory environment is right, we're resetting trade. this last election in 2018 was about immigration and we need to do what we said. lou: without question, and this president he has more than delivered on his promises. i can't wait to see what the contract is that the republicans will make with the american people in order to assure strong turnout that will keep this president, this congress, and this senate in control of our government because it's critical to see what the democrats are talking about. my gosh. your head could explode listening to some of the litanies of free stuff that they're pushing across the table irrespective of their own performance record or lack of such a record. it gets kind of exciting to think about what would happen on november 6 because i can't imagine anyone rational voting democratically, i suspect it's a bit of a leap for you as well, congressman. >> well, yeah, and look, their

agenda will be chaos. every day, there won't be policies put forward to upon help the american people, the middle class, to make sure we've got safe streets and good schools, they will manifest trump derangement syndrome in crazy hearings that will distract us from the important work we've got to do for the american economy, the american worker and the american family. look, i get there are elements that are a bumpy road, but we're doing better as a country because the president is showing bold leadership. you're right, the congress can do more but the congress has to be a partner, not an impediment and if the democrats take control, all they'll be selling for two straight years is chaos and disruption rather than the american results people deserve, and we have to keep our promises. >> just have to keep your promises, and the president, again, i love how you used the expression the trump derangement syndrome. the left is overwhelmed by

trump derangement syndrome and i love the woodward book coming out with the nonsense about this is a chaotic white house. this is bob woodward who has not had the best relationship with accuracy in his reporting before and bernstein, his former partner, i mean these two guys look like -- they're laughingstocks, what they're trying to do to this president and trying to do two months before the election, and then they walk around holding their nose high like they're some sort of clever lads. they look to me like abject fools and the book looks rife with, well, misrepresentation. >> well, what concerns me about the book, it really demonstrates everything that trump has to fight against in a washington where the bureaucrats, the democrats and even some of the republicans are working to thwart his progress. lou: absolutely.

. lou: states of emergency are now in effect across much of the mid-atlantic tonight. hurricane florence, a category 4 storm making its way slowly toward the east coast. more than a million and a half people have been ordered to evacuate coastal areas ahead of the storm, which is now packing as i said category 4-force winds, over 130 miles an hour, threatening to dump as much as 30" of rain when it does make landfall. president trump says his administration is more than ready for the storm. >> the safety of american people is my absolute highest

priority. we are sparing no expense. we are totally prepared, we're ready. we're as ready as anybody's ever been. lou: and florence, look at this, this is an extraordinary picture. three hurricanes in the atlantic ocean, helene is expected to turn north. isaac, you see there, could affect a recovering puerto rico, too early to tell, but one thing is certain, florence is a massive storm headed straight for the east coast. joining us tonight, jason chaffetz, former republican congressman from utah. fox business contributor, author of the soon-to-be released book the deep state, how an army of bureaucrats protected barack obama and is working to destroy the trump agenda. jason, good to have you with us. let's start with the decision before the president now, and that is whether or not to

release the fisa documents and to be as open and transparent as he possibly could be about what is frustrating everyone who wants to see this witch-hunt end. >> yeah, i hope the president does it. you know, we air on the side of openness and transparency, we are self-critical. that's how we get better. if you don't hold people accountable and let the bureaucrats run amok, you get people in powerful positions with police powers that abuse the powers. it's a closed case, this has come and gone and the american people, members of congress ought to debate it but the american people ought to see this and expose it for what it is. i also think we need to take another critical look at the fisa court in how it operates because evidently they were snookered on this thing. that's the allegation, and ought to look what the judge is doing and how they make the

decisions. lou: the two judges in question, there is also the less, full, generous interpretation of the conduct, which was as passive rubber stamps for an all-too-aggressive and let's say indifferent fbi, an fbi indifferent to the law, to regulations and just plain decency. your thoughts on that prospect? >> well, remember, there are text messages that we've seen between strzok and page. two people at the fbi, it would appear to be at least conspiring to figure out how to manipulate a judge that was sitting on that court. i know the inspector general, i think a whole lot of him. michael horwitz at the department of justice, looking at this fisa abuse, that includes not only the manipulation potentially at the fbi, the generation of the documents and where they came from and how that all happened,

but i do also help, and under the chief justice roberts is in charge of that court, and i hope he feels some of the heat as well because they cannot allow these types of things to happen. >> you know, you say, i think we would all agree with you, they can't let this sort of thing happen. they shouldn't, but now we know they did, and they did let it happen at least four times. that's what we know right now. we know that the department of justice and the fbi, their leadership and the instrumental officials including peter strzok and lisa page, took active roles in defrauding those courts and absolutely setting up the president, unmasking members of the trump campaign at the orders of some of the obama intelligence officials. we don't know how far it goes in the obama administration,

but it doesn't look good on any level in any quarter of that administration. >> well, that's why you need to have the full exposure of the documents so that you're not hiding behind this idea of classification. i think president trump will do this. i think he takes bold positions. i think he's building the case for that. i'm sure he wants to hear out his attorneys, so he'll make a case not to do it. that's the reporting. there are the cautious ones saying hey, don't do it. donald trump that's not his style. he'll want this out there and let the chips fall where they may, but we have to have people held accountable, that's why oversight is so imperative. lou: and leading the house oversight committee for a number of years, you know exactly what you're talking about when it comes to oversight. this has been a congress that has been pushed back by the department of justice, but the fbi, and told to go to hell rather effectively, if it were

not for devin nunes. there would be very little that we know about what's going on here, and michael horowitz, the inspector general, as you say as well. white house those two, we would be watching basically the constitution at an impasse because of a politically corrupt fbi and department of justice. >> and you know, it's sad, lou, but i really saw no difference between sort of the eric holder-loretta lynch department of justice and the attorney general sessions-rod rosenstein department of justice. they have equally been as obstructionist as you could possibly be. i used to issue a unilateral subpoena when i was chairman of the oversight committee. they would laugh at it, ignore it and, of course, congress won't stand behind it and do anything behind it, that's why i'm critical of the republican leadership because if you're not -- it's only worth a piece

polls via the leftist organization voto latino. murillo expressed shock at latino support for president trump. new numbers tonight show 39 million social security numbers have been stolen and many used by illegal immigrants to work in the united states. immigration reform law institute says the issue stems from an obama-era decision to stop the notification of employers if one of their workers and entities doesn't match up with the social security number they used on a w-2 tax form. that change came after the president, president obama, gave amnesty to some 700,000 illegal immigrant children. joining us former federal prosecutor, author of the book licensed to lie, sidney powell. sidney. great to have you with us. >> thank you, lou, welcome

back. lou: thank you. let me start with this decision not to notify employers of a mismatch on w-2's and social security numbers and accounts, which is fundamentally a clue that you've got a problem with either a book keeping problem or you've got a fraud problem, one or the other, right? >> exactly, and it's a problem that affected 39 million american citizens whether they knew it or not. so it's an absolute outrage that the obama administration stopped the practice of notification. that's something that should be done automatically any, time that issue arises, and this department of justice could start making a difference by cracking down on those violations and prosecuting them right now. lou: and he made that change through an executive order. can this president simply reverse it? >> yes, he can. he can instruct the department

of justice to start prosecuting those and issue the notices of conflict on those numbers. lou: of course, you and i both know that some idiot judge appointed by obama will simply order the trump administration to not notify employers of that breach and mismatch. what do you think the odds are? >> well, they might, i would encourage this administration, if that happens, to just stop the practice in that particular district and contest the ability of any sort of district judge to issue any kind of nationwide injunction. justice thomas laid grounds for that in his dissent in a case that came out a few months ago. lou: and there's really, this going to be a decision here at some point, whether it's in the high court or the public opinion, that either the president of the united states is going to be in charge in this country, or is going to be district court judges telling the president what to do. the latter now seems to me to

be absolutely overwhelmingly infuriating. >> it's gone way too far, but that's another reason why this year's midterms are the most important in the history of the country. we don't just need a red wave, we need a red tsunami to send the message loud and clear to washington everybody there, which direction we want this country to go. lou: and the president making a decision right now on releasing the fisa documents and perhaps the bruce ohr documents as well. your counsel to the president? >> definitely release them. lawyers tend to be a problem, particularly with things like that, they want to complicate everything beyond measure, but this president has always been more transparent than his predecessor and this is one area unprecedented in the nature of the evil he is combating right now, so unprecedented results are required. they should be disclosed. lou: absolutely, and i've got

to say that one of the problems that's starting to me to demonstrate itself is clearly, we've got too damn many lawyers in this country. no offense, sidney. no offense. >> yes, i know what you mean. lou: thank goodness we don't have one sitting in the oval office. thank you so much. appreciate it. and delighted to have you with us. >> thank you. lou: no matter how annoyed i am with lawyers. up next, u.s. intelligence officials say they found the culprit behind the mysterious sonic attacks at u.s. embassies in cuba. and in beijing. so why haven't they done anything about it? we'll tell you who they think it is. take up the national security implications. dr. sebastian gorka joins me right after these words.

. lou: a new intelligence report says russia is behind sonic attacks that led to brain injuries of u.s. embassy personnel in both cuba and china. u.s. officials using communication intercepts signals intelligence and spy talk to find evidence of russian involvement, they decline to give any more specifics because -- are you ready for this? -- the usual claptrap is because their investigation is ongoing. national security is at risk, et cetera, et cetera, blah, blah, blah. one question the report doesn't answer, why haven't we gone after cuba and china for attacking our personnel in

of operations, it wasn't targeting human beings but used incredible high levels of microwaves to literally fry ukrainian uav's out of the sky, and remember, they've used cuba as their test bed before. let's not forget the cuban missile crisis, turned that island basically into a giant lily pad for russian tactical nukes. somebody did something. lou: so stipulated, but dr. gorka, let's look at the facts. the facts are these, we've had a dozen of our personnel injured and seriously, some of them, very seriously. we have not seen the united states respond in one of these little silly statements that we think that the russians are behind it. this is asinine. this isn't intelligence. this is stupidity. and the united states government is supposed to act with a higher degree if i may

use the word intelligence than this. how is it that the russians were able to carry out these attacks in beijing, first question. second question, why hasn't there been a respond by the united states government in retaliation? because this is not the way forward for a rational superpower to behave. >> well, to the first part, how is it possible it occurred in these countries? lou: no, no, no, how is it that russia could carry out this attack in beijing specifically and -- >> with acquiescence. lou: and guessing at this, and secondly, why would we not have our own defenses against such an attack? >> number one, this is a brand-new form of technology. using sound waves or microwaves against human targets to create a physiological damage, that's a new kind of irregular warfare. why is it so hard to determine

who did it? because it's not a bullet, it's not a bomb. it has really very little fingerprints on it, but i think that our people will work out who's behind it, as for the response -- lou: my god, it's been a year, man. this is not something for rationalization. we have an intelligence community that couldn't stop meddling in our elections in 2016. now they haven't a clue who is carrying out the microwave attacks, if indeed that's what it was. that's a high level of supposition seems to me, still, and there are other explanations as well, and other parties that could very well be the actors here. i'm just getting a little tired of an intelligence community frankly, dr. gorka, that doesn't seem to have intelligence and when they

carry that on our shoulders as a trade style. i'd like to see them do better, wouldn't you? >> i would, there's a problem with that lou. a guy called john brennan ran the cia and turned it into his little fiefdom. created centers where analysts were quasi operatives. he almost created the culture of the cia for failing the farm. he failed out of the school of the cia to become a case officer. so, lou, damage has been done, and it's not going to be fixed overnight. lou: we can't be in the business of rationalizing failure two years into this administration. it is time now for somebody to take charge of the dad gum agencies and, by the way, talking about the dni, the head of the cia, this is all great sport. it's politics. it's nonsense. this is a president who pledged smart government, and we've got really dumb government working
