"the evening edit" starts now. john: the dow dropping nearly 100 points to 26,062 as president trump announcing his latest chinese tariffs plan just moments ago. more on your money in just a second. first, edward lawrence is live in d.c. with the latest on the tariffs. reporter: president trump could any minute announce anywhere from 10% to 25% tariff on $200 billion worth of chinese imports. as of right now, we don't know

what that final list will look like. in this hour sources are saying the president will make his announcement. the threat of those tariffs has chinese foreign minister saying they will take countermeasures, unspecified countermeasures, but still countermeasures. china said they are willing to put everything that the u.s. imports under tariff, although that is considerably smaller number than what they export to the united states. also, talk of the tariffs has the chinese minister of commerce delegation talking about skipping the next round of talks in washington. according to the chinese, they were supposed to meet treasury department officials to talk trade. larry kudlow saying he has advice for china, saying just say yes to something. still, the chinese have not taken steps to protect u.s. intellectual property or lowered their trade barriers even though the u.s. has been very specific about what it wants. u.s. negotiators have been trying for quite some time to get the chinese to sit down to talk. so far, they have just been

talking and the talks have been complaints and retaliation tariffs. john: thank you, edward. with me is mike lee and "wall street journal" editorial page assistant editor james freeman. mike, i want to start with you about the tariffs. the market does not seem to be reacting. this is not in the grand scheme of things, if you are a farmer having to have a $12 billion government bail-out or you work for a newspaper in tampa bay where you are being laid off, i'm not diminishing that, but talking about the trillions of dollars you are bringing into the country, you are only talking about $200 billion, less than 10%. is the market not reacting to this because they think there won't be an escalation and because the numbers in the grand scheme of things are small? >> yeah, i think you just hit the nail on the head there. this is a much bigger deal for china than it is for the u.s. we are an 800 pound gorilla in terms of trade due to our trade

deficit, so we have the ability to push people around whan and we are trying to do here is not punish our trading partners. it's to get them to open up their markets. if china would do a better job on opening up their markets and reducing the i.p. theft, they would ultimately benefit in the long run. john: what if they just say no? china is a very proud nation, as any nation should be. president xi can't be seen backing down to president trump. they seem to also think the u.s. is in a bind as well because we have a very positilarized electorate. they may be underestimating us as well. >> this is a question. the dictatorship doesn't have to face voters in november the way our members of congress do so they may have a long timeline here. we heard about larry kudlow saying they have really not engaged at all on the intellectual property issues, forcing our companies to share

their technology when they want to do business joint venture so i think that is a concern. i also, just to underline the potentially more short-term political pressure in the united states, this new round of tariffs when we learn about it, is very likely to have -- impact a lot more consumer goods than the last round. that was kind of indirect, it was hitting a lot of manufacturing sort of industrial parts. this is more consumer products from food, fish, luggage, bicycles. consumers may feel this in the united states and not like it. john: when you talk about the short-term thoughts of the united states electorate, the politician, we have midterms coming up, it seems to me with china, they are playing chess, we are playing golf. doesn't seem we are playing the same game. doesn't mean we don't have valid concerns. they have i.p. theft and trade barriers but they are thinking long-term. they really want to replace the dollar at the reserve currency. they are starting to price a lot of future oil contracts, they

got it march 26th was the first day they had that, 18,000 contract, very small, they are up to 150,000. they are trying to do that long-term, looking for 25 years. is that chinese policy, does that bear focusing on right now? >> there is certainly a long-term view they want to have the world's reserve currency, they want to be the world's technology center, they want to be the tech champion of the world, they want to be the world's number one economy. obviously they made great progress toward that goal. i think as we go forward here, though, i think they also recognize there is a lot of down side for them here that's not getting resolved. i think while it would cost us a lot, the president does have the ability to make chinese manufacturing much less competitive. i think what's encouraging about the president's recent remarks on twitter is that he sees this as a negotiation and not a permanent effort to raise prices on trade.

let's hope it gets resolved. john: when you talk about this being a negotiation, that's what nearly everybody is saying, this is a negotiation. however, a trade war quits being a potential trade war once tariffs start going on. we are starting to see that right now. does this concern you as -- because you are talking about apple products that could be hurt with the tariffs, you talk about other products, a tax upon the u.s. consumer. does this concern you, this tariffs round right now, as to what it could lead to? >> yeah, not whatsoever. all of a sudden, it's armageddon, we are putting tariffs on chinese goods, considering all the things they are doing to harm our economy and harm our interests worldwide, yet somehow, obama was praised when he raised taxes by $600 billion. look, these tariffs aren't good but the notion that this could cause a recession or slowdown in the economy are a bit of a joke. china would like to be all these things. i would like to be michael

jordan and dunk basketballs like him. it's just not going to happen. they are a communist dictatorship. their economy is held together with essentially duct tape and bubblegum, building cities to nowhere, all sorts of excess products, state-run entities. they will never catch us or never get anywhere close unless they open up their economy and coincidentally that's what we are trying to get them to do. in the long run, it will benefit them to reduce the barriers of entry, open up their economy and make it easier for the rest of the world to do business with them. john: here's republican representative devin nunes on why tariffs are needed. >> if the chinese don't come to the table and number one, stop stealing our intellectual property, number two, stop dumping products on the market, i don't think we have a choice because if we really wait too long, our military is not going to be able to go up against the

chinese in parts of the globe. john: that's exactly what mike was saying as well with that, that they have to do this. is tariffs the way to get them to deal with the intellectual property theft and is the toothpaste out of the tube? most of the intellectual property theft has been stolen for the last 15 years. there's not that much -- >> but we are creating new stuff all the time for them to steal. i think that issue is not been resolved. yeah, if you are looking for a prediction on when the chinese will decide this is in their interest to start having a different approach on intellectual property, there's been no indication to this point in their negotiations with the administration, as you mentioned with larry kudlow. they are not really engaging on this issue. will it work, we don't know. we do know it's in china's interest to allow basically to respect property rights because that's what will allow them to develop technology. no one is going to develop

technology in china when they don't believe they can profit from that invention. a lot of these reforms would actually benefit them. getting the old line communist who runs china to buy into that is a challenge. john: thank you very much for joining me. let's take tou tyou to the mark. three major indices ended the day on the red. susan li is at the new york stock exchange with the latest. reporter: the dow snapping a for-day winning streak, the s&p finishing off a five-day winning streak. today is all about technology. the nasdaq seeing its worst day since the end of july. amazon, apple, the two big tech heavyweights being the main drag, having their worst sessions since april of this year. we started off with news on amazon and really, amazon employees are being accused of leaking user data in return for bribes. most of this, they say, taking place in china. apple being impacted by a 10% tariff on $200 billion worth of

strongly denies a decades old allegation of sexual assault. here's the president. watch. >> judge kavanaugh is one of the finest people that i've ever known. he's an outstanding intellect, an outstanding judge, respected by everybody. never had even a little blemish on his record. the fbi has i think gone through a process six times with him over the years where he went to higher and higher positions. he is somebody very special. at the same time, we want to go through a process, we want to make sure everything is perfect, everything is just right. i wish the democrats could have done this a lot sooner, because they had this information for many months, and they shouldn't have waited until literally the last days. they should have done it a lot sooner. but with all of that being said, we want to go through the process. john: the accuser's lawyer saying her client is willing to testify before the senate judiciary committee. >> my client will do whatever is

necessary to make sure that the senate judiciary committee has the full story and the full set of allegations to allow them to make a fully informed decision. >> but testifying in public under oath in front of the senate judiciary committee with the american people watching, that's an enormous amount of pressure. is she willing to go that far? >> she's willing to do what she needs to do. john: joining me is fox news senior judicial analyst, judge andrew napolitano. judge, dr. ford, who made these allegations 36 years ago, seemed they had these allegations for some time, they came out after the hearing. they had the judge there for 32 hours in congress. now it looks like they will have to reconvene. not talking about the veracity of these comments, that's almost impossible to tell. why did they wait so long? >> who knows. one argument is senator feinstein, a fierce opponent of

judge kavanaugh's confirmation, kept this to herself as sort of a hail mary pass. she had known about it since july and that argument says she should have told the chair of the committee, senator grassley, and should have told the white house so they could discuss it with the nominee. the other argument is the letter that she got said do not tell anybody, do not reveal my name, i'm not prepared to go public on this and she was honoring that person's, we now know who it is, dr. ford's wishes, until some website got ahold of this and revealed the existence of the letter. we will probably never know which is the truthful answer, but i do think we are going to see another anita hill/clarence thomas type hearing, but this time, in the #metoo era where the republicans will have to tread very lightly when they challenge the credibility of the accuser, unlike when senator spector cross-examined anita hill and basically demolished

her. john: the fbi looked six different times into judge kavanaugh's past and senator feinstein said she gave this to the fbi. did the fbi have this? have they already looked into this? >> i don't know the answer to that. she gave it to the fbi last week. here's what the democrats want. the democrats want the fbi to interview dr. ford, her husband, the therapist in whose presence she emoted this repressed memory, and anybody else along the way who learned about this and then the democrats want the fbi to interview judge kavanaugh, the so-called lookout who was there at the time these alleged events occurred. it was denied that the events occurred. and anybody else whose names come out of the fbi investigation. this will take weeks. then the democrats want to be able to call whoever they want to testify to buttress dr. ford's testimony. i don't know if we are going to get that deep into it. my guess is dr. ford will

testify, judge kavanaugh will testify, maybe one witness on either side to bolster each of them. the american public will have to decide who they believe. this isn't a trial. there isn't a case to be proven. it's an allegation that's probably going to be neutralized by his denials. john: it's going to be all based upon what people feel are the credibility of the people talking, right? >> you know what? if you want judge kavanaugh to be confirmed, you will believe him. if you don't, you are probably going to believe his accuser. john: you think he gets confirmed? >> yes, i do. but again, it's going to depend upon how the republicans deal with this. they need to undermine her credibility without undermining her as a person, because this is an era in which, unlike the anita hill allegation, these allegations have to be taken seriously and addressed compassionately. john: as a judge, do you take into account the political ramifications of what can happen? you have mueller's investigation coming out, mr. comey released

some details about miss clinton right before the election, she claims swung the election. not sure if that's true or not. you got mueller now with manafort, you have this with judge kavanaugh. does this stuff all get resolved? are they going to take this into account? >> i think we are at a dangerous intersection of the law and politics. the democrats believe they will succeed in taking one or both houses of congress in the midterms, they want to wait. the republicans who fear they may lose one or both houses want to do this now. republicans also want a full panoply of justices on the supreme court. i can't say how this is going to go until the hearings occur and we can assess everybody's credibility. i will tell you this. there's no indication whatsoever in brett kavanaugh's lifestyle or background of behavior consistent with what she has alleged. on the other hand, we haven't heard a peep out of her mouth yet and we need to hear from her before coming to conclusions. john: always great to talk to you. thank you. >> pleasure to be with you.

flood waters are still raging across parts of our state, and the risk to life is rising with the angry waters. this storm has never been more dangerous than it is right now for areas from fayetteville and lumberton across the sand hills and southern piedmont to our mountains. john: north carolina governor roy cooper says epic storm florence is still an immediate danger as rivers reach major flood levels. now at least 18 dead and more than half a million still without power after florence pummeled the carolinas. tens of thousands of homes damaged by the storm.

scores of residents and pets rescued from flood waters. we are in lumberton, north carolina with the latest. reporter: the power in this entire area is still out and as you can see, the damage is evident. i'm standing in front of a days inn, a hotel just off i-95 which is literally the longest highway going from maine all the way to miami. i-95 and 211. you can see the water has receded. there is blockages so you can't really come this way but we wanted to show you how deep it is. you have rescue boats that have traveled throughout this area to get to some people, bring supplies. overall, i spoke to a police officer earlier and he's off camera, you can't see him now, but he pretty much told me luckily, there hasn't been any major accidents or calls the past few hours which is very, very good news. obviously this is not good news, because people cannot get around. there's no power. all the hotels in this area are completely either packed with people that have evacuated their

homes or are just filled with water and that's the situation you are seeing right now over here. it's just a dire situation because the water is expected to rise even more, the sewage system [ inaudible ] so it seems to be an ongoing story. it's not the first time this entire city has been hit. that's the sad story. it always seems to be the same towns that are hit by these massive hurricanes, tropical storms, you name it. that seems to be the consensus from a lot of people i have spoken to. john: are people still being evacuated? reporter: just within the past few hours it seems more people just need supplies. they are opting to stay in their homes. there's a little area, community just off maybe about three miles from here, and they said they just need some extra water but so far, people prefer to stay in their homes with no power as opposed to being evacuated, because they believe the water will recede. but that's been the concern by a lot of officials is that you should evacuate because the water could potentially rise.

they are hoping for some good weather which is expected further on in the week. john: thank you very much. stay safe down there. to atlantic beach, north carolina, which was in the direct path of the storm. joining me, atlantic beach mayor trace cooper. mayor, want to ask you about what is going on on the ground right now. how are things in atlantic beach? >> things got a lot better. we had a break in the weather, it finally stopped raining. that allowed us to get out, clean up the streets, get some emergency pumps to remove some water so the town is passable, things are safe. we don't have any power but we are on the road to recovery. john: is the worst part over? >> i believe so. the worst part of these storms is really, is not knowing how bad they are going to be. at this point it looked like a category 4 early, which obviously would be devastating,

then as it came in, we were going to catch the edge of a category 2 but it turned out to be one of the most damaging storms in the past decades for us. just waiting out is the harm part. after-storm recovery. john: talking about after the storm, when are residents going to be able to return to their homes and businesses being able to start back up? is there a time frame that you have? >> yes, for the past two days, we have allowed property owners and business owners back into town. there's a [ inaudible ] we have been doing the past couple days to get back to their properties. starting tomorrow morning at 8:00, the general public, mainly contractors and aid groups, will get in and help as well. just during the daytime. since we don't have any power, we will have a curfew from 8:00 p.m. to 8:00 a.m. john: real quick, what is the

great this is seeing the light of day. john: switching gears, secretary of state mike pompeo doubling down on criticism of former secretary of state john kerry for staying in the iranian nuclear deal. listen to this. >> what secretary kerry has done is unseemly and unprecedented. this is a former secretary of state engaged with the world's largest state sponsor of terror, he was telling them to wait out this administration. you can't find precedent for this in u.s. history. john: former arkansas governor mike huckabee weighing in as well, saying this. >> john kerry's the only guy i know that wants to bring back the edsel, myspace and other failed enterprises. this is why john kerry really is a joke, but the sad thing is what he's doing is not funny. what he's doing, i believe, is both a violation of the logan act under which, by the way, nobody has ever been successfully prosecuted and only two people charged, but i think he makes the case for actually

getting convicted of it. john: christian, the logan act, last time it was actually used was 1852. they claim that richard nixon violated that when he quote, threw a monkey wrench in the paris peace accords in 1968 but then got elected president so was never prosecuted. people have threatened this logan act many times. it seems what senator kerry has done, certainly inappropriate at best, but is this something that is in violation of something like the logan act? >> i think it's in violation, i think it would be a good idea to pull together a grand jury and possibly indict him for the same reason, you know, this law can't just be used against republicans. sally yates, the disgraced obama pointee who was dismissed from the justice department, used the threat of the logan act to basically entrap michael flynn, saying because he was only the incoming national security adviser, because he wasn't actually in office, that his discussions with the russians were illegal somehow. that led to the fbi meeting with michael flynn where he allegedly lied. i don't think he actually did.

so what's good for the goose is good for the gander. if this law is going to apply to republicans, it ought to apply to john kerry. it will be hard because it's unlikely you will get iranians to testify which will be necessary to get conviction but i think we should look into it. john: you mention you think he should be indicted. people have questioned whether the logan act is even constitutional. that aside, what he did was certainly inappropriate. do you think this is worthy of indictment, what senator kerry did? >> i think so, if not just to air this thing out. this is a guy who started off his political career slandering, bad-mouthing his fellow soldiers that he had just come back from vietnam and bad-mouthed them before the foreign relations committee, now he's ending his career talking not just once but several times with iran's foreign minister. it would be one thing if he disagrees with trump administration policy, to privately or even publicly here in the united states say i disagree with it, here's what i want, but to go and collude with iran's foreign minister, chief sponsor of terrorism, is beyond the pale.

john: edward lawrence is back with us live in d.c. with the latest on the president declassifying fisa warrants related to the fbi probe. edward? reporter: this happened a few minutes ago, the president saying he's going to declassify. we don't have an exact time schedule as to when that declassification will result in public documents coming out but the president is announcing he is declassifying the fisa warrant used to start the russia probe that was against carter page and also, any interaction carter page had with bruce ohr, one of the doj's prosecutors there. he also says in this release from the white house, the president is ordering the fbi to release any text messages in relation or leading to the

russia investigation, including those from james comey, andrew mccabe and peter strzok and lisa page, also bruce ohr. we soon should see a flow of information from this. exactly what is in these documents remains to be seen. we don't also have the timeline as to when they will be released, but they will eventually be released as presidential order. back to you. john: back with me is mike lee and christian wyten. christian, we started with russia collusion and ended up with manafort being indicted for a 2005-2007 bank fraud alleged crime which certainly had nothing to do with 2016, but we had porn star payments, payments to playmates. how did we get so far off track with russia collusion? >> this investigation should have been shut down rapidly when it was very clear there was no collusion between the trump administration and russia which incidentally isn't a crime. didn't happen. instead you had basically this wide-ranging witch hunt that's gone on, endless resources, no deadline, no timeline and of

course, a very weak leader at the justice department who is unwilling and unable to rein in a rogue investigator. these things tend to go on until they find enough people guilty to justify their existence. but it's really a disservice to the republic. john: mike, what worries you the most? i have talked to a lot of democratic strategists who think that impeaching the president if they do win the house is a terrible idea. the republicans did it back in '98 to president clinton, it came back to haunt them. they think the same thing would happen. that being said, every one of those democratic operatives said it could certainly happen. what worries you more as an investor? does it worry you more an impeachment of the president or that the house loses control, the republicans, and you lose tax cuts 2.0 now get killed? >> it's definitely impeachment because you see what's going on right now. the strategy is resist, resist, resist. so what has brought such confidence, such a pickup to the economy and shockingly, the people that have benefited the

most, the high school dropouts, the unemployment rate going from 8% to 5%, wages up 7%, 7.5% over the last year for those at the bottom level. you wonder if confidence will get shaken or if we will just keep soldiering along. i think the economy is in such good shape right now, partially because of the cash buildup that would happen in the last years of the obama administration that the deregulation and tax cuts took over. i think that's what's really accelerated us right now and i think it would be almost impossible for anybody to repeal the corporate tax rate. you need veto-proof legislation even if the deshms take both houses but if you impeach the president and throw him out of office, that can't be good for the economy. john: certainly not good for the economy or the country. that was something the democrats are going to have to deal with and learn from history and make a judgment themselves. this just in from cnn host jake

plan is crazy, you aren't coming up with $38 trillion, it's not a great sign. john: i was talking to christian earlier about the embargo and sanctions on iran. iran, the sanctions supposed to go on in november, 1.5 million barrels of oil a day is coming off the market. you have a bottleneck in west texas right now because of lack of pipeline capacity so you have a ceiling on how much capacity you can have in the oil market. does it worry you about oil prices going forward this winter? >> well, what i do with the price of oil is not something that's dictated by supply and demand, something that's decided by a cartel. it's no coincidence the price of oil went from $120 to $20 as iran just went off -- came on to the market with the saudis playing against the iranians. the iranians go off, i expect the saudis to run the price of oil up. there has to be some sort of back room deal with the united states to keep it at some reasonable level, but this will slow our economy but not to

dramatic effect. then you have to look at the other side of it so if prices tick up even higher, what's that going to do to excess drilling. the u.s. is now the largest producer of oil in the world so maybe oil prices will have a mixed bag of effects from the u.s. economy. john: mike and christian, thank you very much. florence leaving a trail of damage in the carolinas and hundreds of thousands without power. cities like myrtle beach and new bern are starting their cleanup. another update after this.

john: florence is now a tropical depression with sustained winds of 30 miles per hour. the storm causing at least 18 deaths confirmed in the carolinas. our chief correspondent is live on the ground in charlotte, north carolina with the latest.

jonathan? reporter: the city of charlotte itself escaped pretty lightly, given the dire predictions, but south of here, there have been intense flash floods and there has been tragedy, too. earlier today, we were on the scene of one of those tragedies. caden lee welsh, a 1-year-old little boy swept from his mother's arms. she was driving along the road you can see here in rural north carolina. she tried to cross a creek, its raging waters swept her car aside, ended it in some woods. she managed to get out of the vehicle, was trying to get 1-year-old caden out of his car seat, managed to unbuckle him but then lost her grip and he was swept away by those waters. we were there earlier today when officers had the grim task of finding 1-year-old caden's body, and there remain many flood warnings across the state of north carolina tonight. officials are asking people in

the affected areas please do not let your guard down, please listen to official advice and if we tell you to evacuate, do so. the danger from florence, while it is a beautiful day here in north carolina right now, is clearly not over yet. john: such terrible news. thank you very much. florence leaving behind a trail of damage in the carolinas. hu hundreds of thousands without power. as the storm moves out, removing debris and solid waste. joining me, congressman tom rice. please tell me about the recovery efforts that are just now starting to get under way. >> well, you know, on the coast we were very blessed. we didn't take the hit that north carolina did. i think we will be open and ready for tourism in the next week or two. in the counties on the border, unfortunately they got an awful lot of rain and there's a lot of people displaced.

all the rain that dropped in north carolina, all the water is coming out of north carolina through the upper part of south carolina, all the riverside towns are experiencing record flooding and people are getting forced out of their houses. one thing that really impresses me, so little loss of life for the amount of damage that's been done. our hat goes off to all the law enforcement folks and all the military folks that are out here, people running shelters, people at the red cross, all over the country, every time i shake somebody's hands, i shook the hand of two people from california, one from maine, here volunteering to help displaced people. and people are generally upbeat. an 80-year-old lady i was just talking to in the shelter, she said the good lord only gives us

what we can handle. it is quite an experience. i'm out here thanking law enforcement, thanking the military, telling the folks we're here to help them with fema claims and that we care about them and that we will do everything we can to make it as less disruptive as we possibly can. john: how has the coordination been? you mentioned fema, you mentioned the military. the dod has a huge presence down there. you also mentioned the shelter. is this a state-run shelter, is it fema? how has the coordination been between those three? >> each county sets up shelters and fema comes through the shelters to offer people assistance and the red cross actually runs all the shelters. i have been through shelters in several counties, and the red cross is very present and have very strict rules about how people are fed and making sure they are properly taken care of.

there's a mass of humanity brought together by very unfortunate circumstances and their positive outlook is so heartwarming and so impressive. john: congressman, the storm is moving north, into the watershed of the river so it will add to the flooding. is the main part of the flooding going to go down from here or is there more flooding still to come? >> well, the runoff water, the standing water that came up and ran a lot of people out of their houses, that is receding but all that run-off ends up in the rivers. as i've said, all that water in north carolina and upper south carolina flows right through the northern part of my district and right on down into georgetown, south carolina, and there is a very large volume of water going through creeks that just can't handle it. one problem people are having is trying to get supplies into
