lou: tomorrow sidney powell and byron york among our guests. i join tucker carlson in a few ments over at the fox news channel. kennedy: an epic showdown on capitol hill. supreme court nominee brett kavanaugh and the woman accusing him of sexual assault set to testify. judge kavanaugh denies all accusations. she is a college proness fessor from california. she claims he globed herb at a party and held her down against her well. kavanaugh said this is a completely false allegation. i have never done anything like what the accuser describes to
12:01 am
her or anyone. president trump this is something that should have been brought up long before this. they had the information in july. that's a long time ago. nobody mentioned it until the other day. i'm sure it will work out very well. you are talking about an individual who is as high a quality individual as you will ever see. kennedy: even in the best circumstances the path to confirmation is very tight. the republicans have a razor thin majority. >> i said in order for me to assess the credibility of these allegations that i want to have both individuals come before the senate judiciary committee and testify under oath.
12:02 am
obviously if judge kavanaugh has lied about what happened, that would be disqualifying. kennedy: the testimony on sexual assault looming next week. what will this mean? joining us, judge andrew napolitano. some serious claims here. it seems they can't both be telling the truth. >> it's a dangerous situation judge kavanaugh is in now and it's dangerous for the senate judiciary committee as well. suppose at the end of the date's a he said, she said, is that enough to acquit him and cause wavering senators, is that enough to give them cover to oppose him? who has the burden here? professor dr. ford or does judge kavanaugh have the burden of
12:03 am
disproving it. kennedy: it defend legally versus politically. in a highly charged's that we are in, it's who makes the most of emotional connection with those who are watching. >> i think you are right. this is not a court of law. there is no jury and almost anything goes. when anita hill made comparable charges against then judge clarence thomas. one of the late senators demolished her with a cross-examination so classic and brilliant, it's been studied in law school. i don't know if any republican senator can do that these days, a male aggressively pursuing a female under oath, a person month claims to be aggrieved, who claims to be innocent, thought she was going to be
12:04 am
raped. i'm not sure the senate and the public would tolerate it. if this is not true, judge kavanaugh must do everything reasonable to defend himself and distance himself from these allegations. kennedy: let's assume it isn't true. how does one defend themselves in an environment like this. >> i'm going to use this phrase for the next 8 days. emotional connection. he has to emotionally connect with the senators and with the public. he has to express outrage with such a degree of credibility you cringe for what happened to him. justice thomas was a friend of mine and is to this day. even if he's confirmed, 20 years from now this paint is still on his skin and this tarnish will still be remembered. he may be totally innocent and
12:05 am
this will stick. kennedy: it's not disprovable. >> it's who will connect emotionally. you have senators looking for ways for a variety of reasons, corker, senator murkowski, senator collins, to vote against judge kavanaugh. kennedy: you have red state democrats look for a reason to vote no. >> now they have their reason. brit hume said if so much as one republican votes no, not a single democrat will vote yes. if one republican votes no the democrats will vote no and it's a tie. but if two republicans vote no,
12:06 am
the republicans have lost. a catastrophic loss for this brilliant judge and the way we select judges in this country, that it should be determined by something like this. kennedy: it has to give anyone who might seek public office and seek the federal bench pause. >> i don't know where this is going to go, and i'm sorry to say, i hope i'm wrong. my gut is not a good feeling on this. kennedy: you don't think kavanaugh survivors this. >> i'm worried a tie does not go to him and that a simple believable denial is not enough to put an end to this. kennedy: it's going to go on for at least one more week.
12:07 am
moments ago martha maccallum who dated him back in the 80s quickly came to his defense. >> i was absolutely shocked. i couldn't believe it. it's just so polar opposite of the brett kavanaugh i have known for over 35 years. i was confused, surprised, shocked, and i still can't believe it. >> what was your reaction? >> the very same. i couldn't believe this allegations had come out. when i had been at the hearing for a couple days and we watched woman after woman come forward praising brett and his respect for women and his professionalism. kennedy: tonight's panel is here, bre peyton along with robby soave and the host of the tom shillue show, tom shillue. let's talk a little bit about this.
12:08 am
this could be difficult for both sides. those on the senate judiciary committee would have liked to have this information a little bit sooner. is this a dirty political play by democrats or in the #metoo era is this legitimate. >> what's the trepidation on the other side in noise down side. kennedy: if you have independent voters and they think democrats are playing dirty politics and not work on substance or in good faith, that could create the kind of outrage that doesn't affect the mid terms.
12:09 am
>> it's 30 years later. i think it's absolutely ridiculous. kennedy: it isn't ridiculous to victims of sexual assault. to someone who has been dealing with trauma for decades, it's not a trivial matter. but to the judge's point, how do you prove that before the senate judiciary committee and prove his serious charge. >> despite the fact i generally don't want to revisit everything a person did in high school, if this is true, it will be disqualifying. it will be hard for him to demonstrate he didn't because it was so long ago. i counsel not always believing victims because there are such things as false accusations. but i don't say we should
12:10 am
automatically disbelieve them. kennedy: it's very serious. but you realize, god forbid this whole thing is fake and made up. how easy that is to do to someone. in an environment when you have protesters and people staking their futures on bringing down this president. it's way to important to for some people to pass up and too easy to bring about something like this. >> dianne feinstein sat on these allegations for two months. this is sending a message to victims of sexual assault that your story only matters if it
12:11 am
helps in politics. and dianne feinstein supposedly was quote-unquote having her staffers say her office was blind sided by the fact that grassley arranged for this interview with the accuser as well. i think all of her behavior raises questions about the legitimacy of the claim and raises a lot of questions about her. i think personally her feminist card should be revoked and we should be castigating dem drats kratz for how they used sexual assault as a political pawn. >> dianne feinstein has made this so political. kennedy: if this is such a horrific act, we should have been speaking to it weeks ago. how do you get that back?
