much. new highs on wall street, the dow industrials setting 100th record close since election day yesterday, the s&p 500 also closing in record territory, michael lee, hey, good morning. >> good morning. cheryl: what a day? the dow up 7.8%, s&p 9.6%, normally when we get into the fall even with the political situation with the midterms, seems to me that markets will continue to head higher. >> yeah, i tend to agree, all the economic data that comes out continues to get better and better, at will nota fed is tracking at 4.4gdp for fourth quarter on top and you see new indicators in the manufacturing index above 60. above 50 is expanding and below 60 is contracting, we have been above 60, longest run since the 70's, jobless claims at lowest

levels since 1960's. cheryl: 49-year low for jobless claims. a lot of the companies, michael, are benefiting from the tax overall. we have seen this kick in especially the second quarter as we look, though, to the third quarter, are we still going to get positive momentum when earnings start to report? >> absolutely, tax cut was only signed into law on december 22nd, things like this takes 2, 18, 24 months for the full effect to be felt in the economy and i think that was more tax reform than a tax cut that you get less of a pop right away and more of a sustained economy growth and you add that to all the offshore cash and deregulation, we are setting for one of the longest economic pull runs in history. cheryl: one of the concerns was deregulation, do you need to break up a google, is facebook

too large, et cetera, seems to me yesterday that investors went back into technology, is that worry in the rear-view mirror for those stocks? >> you know, it's something that will continue to -- they'll be headline risks with some of those single-name stocks that have gotten so big so fast that have taken over industries, there's always a concern when you get a single player that that's power. that's not a barometer of market. cheryl: i want to ask you about trade, one of the arguments that i've heard because corporate tax rate companies are more shielded more so than they would have been in the past, and even if the trade spat with chinese and even with canada continues that americans aren't going to feel the ill effect effects on that. >> i'm sure you're seeing companies feel it in spots.

you could make the argument that maybe the fbi and judge napolitano made this argument on fox business yesterday that the fbi should investigate, in fact, look at the cover of time magazine and shows you the political fire storm that we are in right now. if you look at the new cover of time magazine, there's clarence thomas, basically we are going back with anita hill days, what happened with anita she was investigated by the fbi, she gave a statement and when she gave public testimony she contradicted her statement. this is different times. >> but this is getting to the theater of the absurd, cheryl, i mean, i've been through an fbi background check, thighed get top secret security clearance, these are deeply thorough investigations, they are literally sending fbi agents 5 hours one way, they have having conversations with all kinds of

people from all walks of life, everybody that you've interacted for years and years and to have gone through 6 different fbi background checks and not once did anyone mention any of this. i'm highly questioning an unsubstantiated, uncorroborated vague allegation from over 35 years ago but -- let's really talk about what this is all about, the left is trying to delay what is inevitable and they are terrified that originalist like kavanaugh is going the take the court away from them, favorite tool for expanding administrative state. cheryl: they are doing due diligence and they have been talking to witnesses, not only did they talk to judge kavanaugh, on monday they interviewed judge kavanaugh under penalty of felony, democrats were invited and didn't appear.

they contacted a third person allegedly at the party described by dr. ford and got a statement under penaltily of felony, how does that play into all of this from a legal perspective from kavanaugh? >> well, they are either going to help him or hurt him. look, as far as whether it's political or not, sure, there's an aspect of it, that's not why i'm here, speaking as a criminal defense lawyer and former prosecutor, there's a process that has to be respected and in this teenage court system is designed to challenge an accuser, right, the constitution has put in the right to confront your accuser and what's here is that if i were judge kavanaugh, actually he's making statements, the reality is for him he's in a precarious position because how do you disprove a negative, disprove something from 35 years

during strong economy, we don't know what's going to happen, investors are starting to realize, wait, the chinese stocks turned around, they were doing badly because country was going to do stimulus, we have potentially low rates, trump readied some stuff, it doesn't mean it's not going to get worse or spread to china, all the initial hysteria a theory that's so far proving wrong. lauren: initial hysteria, you know, all these companies have the big corporate tax cut that they are still benefiting from, the tariffs are still sort of low, there's a lot of exceptions, we don't really know what's going on and the economy is strong so everything is okay? >> yeah, corporations got a tax cut in excess and could hurt much harder with tariffs. charging 10% isn't as much as the stimulus we are under now with the increased government spending and tax cuts, so plus hot economy in general, so no

one knows what's going to happen is the bottom line and right now people realize it was a little overreacting to begin -- lauren: here is the thing, after we get to october, jonas, which a lot of bad stuff happens in october, you know that, we have the santa claus rally. stocks typically go higher toward the end of the year, how much higher will we go and do you see big analysts and big banks changing year-end price targets. >> it's getting self-fulfilling, at the end of the day the market is hot right now and that makes people not worry about stuff and things must be getting better, the market is hot, that doesn't always end well as you saw in last boom hikes, right now people are getting more optimistic, it's a circular feedback. lauren: yeah. >> bonds are going down. lauren: the dollar is steady, the dollar is actually steady right now, it's amazing, something we are not seeing, whatever the something is, we don't know because we are not seeing it but something has to
