his public service. just kavanaugh made it clear to them in the nation that no matter what he will not be intimidated, no matter the pain to him and to his family. the judge vowed to never quit. >> this confirmation prices has become a national disgrace. the constitution is the senate an important role in the confirmation process but you have replaced advice and consent with search and destroy. since my nomination in july, there has been a friendly on the left to come up with something, anything, to block my confirmation. shortly after i was nominated, the democratic senate leaders that he would quote, oppose me with everything he has got. a democratic senator on this committee publicly referred to me as evil. evil.

think about that word. he said those that supported me were quote, complicit in evil. another democratic senator on this committee said quote, judge kavanaugh is your worst nightmare. you sowed the wind for decades to come. i fear the whole country will reap the whirlwind. lou: judge kavanaugh starch defense comes after nearly two weeks of being smeared by the radical immigrants and their allies in the left-wing national media where unsubstantiated, uncorroborated and refuted allegations of sexual assault have run rampant. one senator who was set up with the democrats attempts to tarnish this command, senator lindsey graham. >> did you meet with senator dianne feinstein on august 20.

both who are members of the house judiciary committee and the house freedom caucus. gentlemen, good to have you with us. we witnessed the most extra ordinary senate judiciary hearing sense that of clarence thomas in 1991. i have to say that unlike those moments, senators stood up for the president's nominee, lindsey graham - congressman, i will start with you, if i may. senator graham. i am almost speechless because i am not a person who is easily impressed by rhetoric but this man impressed. i suspect, he reminded the republican members of the u.s. senate of their consciences. >> yeah, lindsey and i have had a lot of disagreements but i'm telling you what - lindsay reached down into his soul and

he was righteous and he was right and he was defensive of a process. lou, i was having to handle former late dinner with a former czech republic and he had hearings and things that were going on here and he said we always look to america as that light on the hill. we do not always agree but we knew were trying to do is write and be fair. we are not seeing the light so much. lindsay got some of that light in up today. lou: the idea that - >> go ahead. lou: this business that they started with, first of all, if not all light in the senate judiciary committee. after watching this i can't even imagine what senator chuck grassley was thinking about when he had this woman doing five-minute intervals and for

all the world came out much harsher in her line of questioning, congressman biggs that she did when interviewing christine ford. it was a remarkable thing. finally, they change that but this after the delay as judge kavanaugh said ten days from the moment he asked to accelerate the hearing. it was an awful spectacle of managing the committee. >> i was bewildered. i don't know how anyone who is sad trial experience can say you will get five minutes to ask questions and try to go down a train of thought and then lose it after another five minutes - the whole setup was meant for failure. quite frankly, on the part of poor republican questioner. how do you get train of thought?

i was shocked that was the process that they decided to undertake. it did not make sense to me. it goes to the subprocess which has been disgraceful. what the democrats did - lindsay graham brought it out perfectly when he said dianne feinstein had this for 20 days and you are sitting there, judge kavanaugh, interviewing you and guess what? she is setting you up at the same time. doctor ford had a lawyer that was recommended by senator feinstein and you look at the whole thing and when i see spartacus asking the type of questions he's asking on the committee i am outraged that they went after judge kavanaugh without any degree of respect or decorum. this was designed to delay and to destroy this man's character, his name and actually, lindsey graham was right. i've said this before but this is a war. they view this as a war.

we view this as a process. lou: there is any confusion in your conference about what you have done by permitting paul ryan to remain a speaker, what you have done in the senate by permitting chuck grassley to manage that like a - i don't know, society it is, i would hope, been a revelatory day. the terrible thing it seems to me and all of this is the family of judge kavanaugh, along with the judge himself. he's been dragged through the mud with extraordinary accusations. doctor ford, as she was entirely credible, as judge kavanaugh himself said, she has gone through pain but it's not an experience that he was in any way associated with. >> we may disagree on the immensely credible.

you can't talk . lou: let me finish. if i may. the fact that the democrats kept asking for an fbi investigation when the only four people who have been named by doctor ford have refuted her story as to time, place, event, they say they had no knowledge of either judge kavanaugh or and being of proximity to her or that event which none of them could they ever happened. they know nothing about it. >> well, i'm sorry i was jumping in but . lou: i'm going straight back to who you are. >> well, look, there were so many inconsistencies in her story, yet she presented it credibly just as anybody in her situation would after she'd been coached repeatedly, prepared as a witness. they asked for these extra days so they could keep her

rehearsing and get her ready. she was and she burst as well as she rehearsed. she presented. but there were still these incredible discrepancies and how you can say it had wanted you and you will never get the details and in one sentence and in that accident say you don't remember the details but the details will remain with you forever. she did not even call the name when she first told the shrink and then she said the shrink said four people and now she said to end the testimony says four. bottom line is i hope that republicans will learn a lesson. it wasn't a trial. it was a charade. lou, all the trials that i had as a felony judge as a litigat litigator, not once did i ever hear both sides rest. we finished oral argument and i

said okay, now will come back in a couple weeks and vote then. when you finish the evidence it is time to vote. don't allow these charades to go in and this intermittent garbage that is developed here. shut it down. you have a vote at the time after evidence. lou: judge kavanaugh - congressman biggs, does he - does he win the support of all the republicans and perhaps a few democrats? what is your outlook on how that vote will go? >> if there is fairness then he will win all the republicans and a few democrats. i think grandma was right. this is not the town of fairness. he wins the nomination. i think the fact that the discrepancies were big enough with the witnesses that you allow some of the republicans who were women to vote for judge kavanaugh. i hope he gets confirmed.

which the radical dems on the committee use, exploited doctor ford. she was credible. she was obviously in immense pain. she has lived with, it seems looking at her biography, immense pain for much of her life. you can't help but have your heart go out to her but this m man, this distinguished judge, to be whatever she thinks happened - for him to stand before the committee and call them out, all of the evidence, all the testimony, other reputation of all the charges and everything that doctor ford had said by the very people she named to support her view is the end of the story until there is some basis to move forward. each of these democrats kept

talking about an investigation. the judiciary committee to support and cooperate her charges so they knew nothing about what she was talking abo about. >> no fax or collaborative evidence. lou: it was refuted. >> you. lou: it was just not just simply cooperated but this one started against his nominee and the people she named refuted her charges. >> the outrage was this man and his family has so suffered over the last couple weeks been charged with this bs, total bs, and no one should have to put up with that. it's not what the sprinklers justice is . lou: to word response. first and foremost, senator dianne feinstein who had pledged confidentiality and that was betrayed.

as judge kavanaugh said, the family he and his family have been through hell and more. as i'm sure doctor ford. your point is exact and its point that seem to me to be elusive on the part of both republicans and democrats. there is no evidence. it's not a matter of as judge kevin himself had to point out to them, the matter of no cooperation. there is reputation and the names that she is the forward to support her story could all have refuted the existence of the event and knowledge of judge kavanaugh and had no memory of being anywhere near a place that looked or sounded like what she described. >> well, the one person who did make the case out in the hallway in a break during the hearing was senator lindsey graham. that was prior to his big

statement and said it again this is not about credibility but about whether or not there are corroborating evidence to show this. he had another point correct as well, lou, that's been missed. he gave that impassioned statement when he was essentially saying was this has become about much more than just one man and a job on the court. this is now going to be a judgment on the antics we have seen waged on the other side of ambush, allegations, anonymous allegations, and hiding them from people, on sending coat hangers and rape threats to susan collins office. if you vote no on this man you are legitimizing that. also, by the way, if you are a republican senator saying that a sitting federal judge on the appeals court in dc lied to the senate and is committed perjury and potentially open to impeachment. those are serious things. lou: by the way, part of what you said graham was amazing.

political correspondent for the washington examiner. he's an attorney and national republican committee for the great state of california. good to have you here. let me start with you. your sense of the committee and the reasons we are here. judge kavanaugh said pointblank, the radical dems have created a national disgrace. he was not that succinct but i am. your thoughts? >> it was a roller coaster of a day, lou. most republicans watching the hearing fell for doctor ford and felt like she could be believed but that's different than whether it is true or not. you see how respectively the republicans treated her compared to way the democrats treated judge kavanaugh. that was revealing. at the end of the day have a lot of friends brought the political spectrum on the republic inside and not a one of them thinks at the end of the day just

talking about the job she was selected to do, that job was invented by chuck grassley. the committee is run by chuck grassley. he nearly ran around the party into the ditch. it was an abysmal performance, don't you think? >> look, from the point of view from the prosecutor will it's unsatisfactory to be interrupted every five minutes by campaign speeches from the democrats. lou: what about every ten days for the hearing and said having an expeditious - the back of course, just kavanaugh drove the point home that he wanted hearing right away and i think mitchell did expose without looking harsh the plainness and she got out who paid for the polygraph issues and a lot of the point that she scored points and weight without losing marks on the witness. that's a type of questioning role but i can say is lawyers, we were scratching her head saying that was not a great follow-up. lou: do you avoid the question like what you think of the job chuck grassley that? >> i would not have chosen that methodology that was chosen. in hindsight, that is not the

best choice. there are many great lawyers among the public and senators on the committee and they were too quick to cave to the criticism that is a bunch of white men. so what? we should not be caving to that reasoning. lou: right now the republican party and this is breaking news is in the senate and meeting and conference. all the republicans are talking right now about what to do about the vote tomorrow. usually it's been mike's parents and i don't know about yours but when they go to conference to talk about a decision by the leadership that means it could change. i guess that's the subject of this. whether or not they will go ahead and vote. what is your insight and what is your judgment? >> it could change. we had reports that senators collins, murkowski, flake and mansion, the democrats were meeting in a room immediately after the hearing and before this republican meeting that you

just mentioned that we don't know where they are on this. because all begins have 51 votes they are in the driver seat here. unclear but the brief amount that senator flake said today was absolutely inscrutable in the hearing. we don't know where collins and murkowski are. lou: at about as substantive as the other gets. >> very much not so. [laughter] it is still there but of course the reason charles grassley scheduled a meeting for 9:30 is not that he would have a vote but that they could have a vote. they do not want to come to a situation where they had to wa wait. lou: on that judiciary committee, now it's the time to get things done and no more retracted - >> lindsey graham speech was spot on and this is a charade and has been badly played. frankly, even for doctor ford,

charlie, this was a magnificent day, i thought, for the american people. they got to see what the judiciary committee has become, what its failed leadership is doing to the process and what the radical dimms are willing to do to a great american, a great jurist and to his family. unconscionable. >> absolutely. credit needs to be given to chairman grassley. when you are in the united states senate you don't get called out very often to your face on television. when brett kavanaugh unleashed that ferocious broadside defending his family, his good name, his wife and daughters, saying you will not scare me out of this. i will not quit. you might kill me, but you won't make me quit.

that was powerful stuff. lou: for just a moment, i actually thought i saw some dimms holding their heads. >> i think without a doubt. the line of questioning changed dramatically. that's why we ended up talking about flatulence. lou: that was one of the most of ignorant performances i have seen from a senator. >> since his last performance. lou: the judge acquitted himself brilliantly. and he did so with an amazing acumen. and sensitivity. he also incorporated dr. ford into his defense by saying how much he i am a thieds with her and how much he understood her

pain, and recognized she has been hurt somewhat, but not hurt by judge kavanaugh. >> the most of important sentence uttered today was uttered by brett kavanaugh. he said i do not question that dr. ford was sexually assaulted at someplace at some time, but it was not me. when two people tell different conflicting stories, the benefit of the doubt must go to the accused. that's not just a guiding principle in a court of law and democracy. it's a guiding principle for life. it's the presumption of the innocence. we should abide by that inside and outside the courtroom. lou: do you buy the idea this was a trial? i know our attorney friend wants it to be a trial. but was it a trial? >> the reason you are innocent

until proven guilty and the burden of price of on the prosecution, it's a way of fairness and probably the best way to get to the truth. which is what x all wanted -- which is what we all wanted to come out of this. so many people said we won't get to the truth. it will be a contest with which there is no resolution. i believe without any question that we got to the truth today. it may be a more complicated truth than many people wanted to contemplate. >> the absence of corroborating witnesses who in fact say just the opposite. it didn't happen. i didn't see it. wasn't even at the party. the other was, it was quite remarkable. the 1982 meticulous calendars that he kept. he could account for his

whereabouts just about every day on all weekend except for two he wasn't even in town. and those two he can account for by weekdays, every single day is accounted for. lou: how many old fellas like me snickered at the idea of a high schooler with a calendar. after hearing the story, it turns out this nerdy guy who played football and basketball and was, you know, a terrific young man, first in his class, he turned that into a wonderful story by telling us his father kept a journal. and it was a wonderful, wonderful story. we understand more about judge kavanaugh as a result. >> i thought it was the most of poignant moment of his testimony today. what that revealed that was so powerful, not on are these people trying to destroy a man.

they were trying to destroy the boy he once was. the number of people texting and emailing and calling, people that were watching it who are not in politics, people just balling when he got to that point. they realized this is a man standing up for his family, his children and his wife, and he's fighting. if you are out there and not in this business, you can relate to that. lou: he apologized to amy klobuchar for contesting her ever so slightly. she was going after him decidedly partisan appointed, and frankly ugly. and she apologized. in that moment between those two, there is the potential to restore the republic's civility. it's not much of a window, by the was a wonderful moment. the judge deserves great credit

as well. because he acted pretty well as a trial lawyer, i think. he point out, it was not simply a lack of corroborati the names she put forward to support her story, her claim, they were not corroborated, they were reputed. gregg: he used the word refuted. lou: that's why i used it. gregg: i'm not a soft touch but i pulled out a kleenex especially when he talked about his 10-year-old saying her prayers and wanted to say a prayer for dr. ford. that really speaks volumes about what kind of a man and father he is. and probably the very kind of guy we want on the united states supreme court because he's also happens to be a brilliant jurist. lou:
