among our guest tomorrow. we hope you'll join us and we thank you for being with us throughout the past two hours. thanks so much. good night from new york. breaking news now after an absolutely stunning day on capitol hill i am sure you are watching senate majority leader mitch mcconnell months ago saying the judiciary committee will vote tomorrow after today's dramatic grilling of supreme court nominee brett kavanaugh and the woman who has accused him of sexual assault. several gop lawmakers are calling one of the greatest shams in political history. all started this morning at 10:00 a.m. eastern time when lawmakers began questioning dr. christine blasey ford. she claims judge brett kavanaugh drunkenly attacked her at a high school party in 1982. watch. >> dr. ford with what degree of certainty do you believe brett

kavanaugh assaulted you? >> 100%. kennedy: blasey ford went on to say she suffered from anxiety and panic attacks ever sent, so much so that she claims that she remodeled her house she wanted to have an extra front door so she could easily escape if she was ever attacked again. watch again. >> and explaining why i wanted a second front door i began to describe the assault in detail. i recall saying that the boys who assaulted me could someday the own the u.s. supreme court and spoke a bit about his background as an elitist all boys school in maryland. my husband recalls that i named my attacker is brett kavanaugh. kennedy: democrats called her a courageous hero for coming forward and testify against republicans treated her with respect with fear of appearing

too heavy-handed. and it was judge kavanaugh stern and that's when the tone in the room change. an app fighting for his professional life gave a firing rebuke to democrats calling their investigation embarrassment to the country. >> i wanted the hearing as soon as possible to clear my name. i demanded a hearing for the very next day. unfortunately it took the committee 10 days to get to this hearing. in those 10 long days as was predictable and as i predicted my family and my name have been totally and permanently destroyed by vicious and false accusations. the 10 day delay has been harmful to me and my family, to the supreme court and to the country. kennedy: democrats badgered him for several hours predictably demanding the fbi investigate

on. it was the tip of the iceberg. fox news's on capitol hill with the latest. >> the ways we have had two latebreaking developments here kennedy and just about the past 20 minutes. i'm going to start with bob karp -- bob corker who has announced his support for brett kavanaugh. i'm going to read part of the statement quote i believe judge kavanaugh has conducted himself as well as anyone could expect that this process of my plan to vote to confirm him. what that means is there are three republican wildcards. it's all about the math kennedy. it's about the math comments about the math, it's about the math. they have to get 60 votes and they are only 51. i would look at jeff flake from arizona lisa murkowski of alaska and susan collins from maine but i caught up with jeff flake a couple moments ago and asked what he was thinking an iffy and made his decision and he said to me quote it's tough. he said i'm still processing things. asked senator flake what he needs in the next few hours in

the next coming days. does he need paperwork or does he need to pray and he was not willing to say what he needs. we also asked him if he was willing to greenlight chuck grassley two of the committee votes properly keep in mind the committee which is scheduled to vote tomorrow according to majority leader mitch mcconnell 11 republicans and 10 democrats say you need flake to vote yes but i should point out a committee vote is not binding. they move the nomination of clarence thomas to the senate floor in 1991 with an unfavorable, no rating at all from the committee. robert work in 1987 got no rating at all, got an unfavorable rating from the committee. he was defeated in thomas was confirmed. the committing vote doesn't mean that much but it sets in motion what will we'll see in the next 34 days on capitol hill. respectively a committee vote tomorrow procedural votes over the weekend a big procedural vote on monday with a potential filibuster with the democrats and perspective a confirmation

vote on monday, tuesday. kennedy: i have two questions for you. corcoran flake seemed to have been voting and speaking in a blog particularly since both of them announced they were retiring from the senate. it seems as though senators murkowski and collins tend to vote and block. is corker's yes vote a signal to flake and you think that has any influence on him and will that in turn influence moderate female republican senators? >> sometimes it does because senator sometimes i am going to be the deciding vote on that. bob corker was somebody who was initially a no on tax reform last year and then he switched to yea at the last minute. he's somebody who is also against the omnibus spending bill. bob corker can be an predictable had another development at the capitol tonight for senator starting with late murkowski collins and democrat joe manchin

of west virginia. they all huddled after the confirmation hearing with kavanaugh and ford can i ask flake what did you discuss and he said i don't want to characterize any of that. that coalition of flake collins murkowski in possibly democrat joe manchin as the operative group right now. that's the operative huddle. kennedy: they certainly do hold the cards here. that seems to be the power this critical vote and it makes you think perhaps they are leaning towards it and it might be difficult because the senator flake said he felt both participants were very credible and they both made emotional pleas which resonated in ways we expected with democrats and republicans but for those on the fence it will be millimeters that pushed him to the other side. >> millimeters is a good word to use. you could tell physically when i spoke with senator flake said he

was sweating this. there was a lot of anguish as he tried to make his decision and something else he said when i spoke with him that resonated. he said you are making an allegation and there has to be cooperation so where is the cooperation in this? this is back to the he said she said and that's why senator flake is really struggling with this decision. kennedy: i think he was pained by dr. ford's testimony. thank you so much. as we have seen judge kavanaugh's testimony. we didn't see that coming especially when he detailed how the allegations were heard. >> i intend no ill will to dock or ford and her family. the other night ashley my daughter and liza said their prayers and liza all of 10 years old said to ashley we should pray for the woman.

that's a lot of wisdom from a 10 year old. we mean no ill will. kennedy: joining me to discuss this emotional day on capitol hill as "fox news" night costanza. in court extraordinaire shana brain. welcome back. >> thank you kennedy. great to be with you. kennedy: when he talked about emotional resonance which is something that is critical for both participants here today i didn't assume we were going to get the more emotional moments from judge kavanaugh. explain what you saw. >> dr. ford comer boy cisterns and there were times she said i'm terrified rage she seemed a little bit choked up and she seemed. at having to talk to it for a couple of hours this morning. you could see judge kavanaugh's interview was very measured and controlled to demand and controlled. amanda we saw show up in the afternoon was loaded.

he came in and he was angry. he was upset and acting like somebody who had been wrongfully accused and had his family taken through the sewer. he was very emotional and at times people thought okay we get it. you need to put together a bit here because talking about calendars and his parents his mother very emotional and teary at eyes. the afternoon was way more emotional than we thought we'd get. kennedy: watching dr. ford watching this whole thing start were republicans regretting having that outside prosecutor from arizona asked those questions? >> you know was tricky because obviously a prosecutor takes hours to go through an examination or cross-examination and it's tough to do in five minute chunks when you are trying to a predicate with all the narratives that i talk to folks about this and the aftermath and one senator said we think it was the right thing

to do. otherwise it was us questioning dr. ford. they seem to think that she truly believed whatever happened happened and she was delicate and is not a good look for them to be going after her. a lot of people think rachel mitchell is good she may be this was an effective format. they felt it was a lose lose situation that i talk to them about possibly an afternoon would they take the time back or in one senator told me if i think brett kavanaugh needs a little help or a chance to tee him up we will question him instead of rachel mitchell and you can see the as it happened afternoon peggy did start out questioning him that quickly the gop senators decided to take back the reins. kennedy: i think she provided a really prayerful thing here. if you're a republican senator and you are a democrat senator and you have your mind made up especially ones on the committee but if you are susan collins or lisa murkowski and you need a little bit of doubt and you need

reminding about the corroboration were some of the fuzzy details and how those in a strictly legal and rational sense can be very problematic. i think it was helpful for that but also the most important role she played was providing the contrast for lindsey graham. that was the most dramatic moment from the questioners. that's when you felt the gop snap. he was like a field general who had had enough and was no longer in the mood to agree. i don't think if we had seen grandstanding from republicans all day long i don't think senator graham would have that much energy and i also don't think it would have been as effective. >> i think you're exactly right. they held their power all morning and waking to the afternoon several of them felt like this. we now judge kavanaugh felt like this. there was this explosion of emotion and you will notice

senator graham when he is turning in pointing and looking down the dais he is looking at jeff flake. he is one of the people is so critical and he's on his way out. he is not running for re-election. doesn't like the president so he has been one of those ones that has been wavering. obviously it's more important would be votes on the full floor. graham essentially is lecturing him looking at him eye-to-eye during that speech. if you vote for -- if you are voting for the character assassination and they still want to run for some kind of political officer be appointed to accord if you believe they are innocent and that's a tough judgment to make and you have to look for corroborating evidence if you support any of the nominee because they will succumb under the same nomination charges. who knows if the republicans do

it on the other side one day. he did say karmazin a tough thing in washington. kennedy: right i made the same point that this could very easily happen to anyone else and that's where you have to be really careful. that's why politicos when they watched harry reid pulled the nuclear option they were signaling to democrats this is going to be very problematic for you in the future. i think it's the same thing here i'm going to talk to david from the federalist society a little later about whether or not this whole process the judge kavanaugh has said whether that will affect how it they put their lives together potential conservative supreme court nominees. where do we go from here? chad was saying the confab between the four senators is incredibly critical. how much do think we'll know tomorrow? >> they are going to vote for morning.

that is what mitch mcconnell telling us and that is what we are hearing from committee members and lindsey graham is told us as well. they'll will vote at 9:30. when you watch jeff flake and see how he votes he could be the reason the committee does or doesn't report itself a probe. -- favorably. even if judge cabinet would lose the vote it's a recommendation for a favorable or unfavorable but you have to watch jeff flake and that will tell you a lot about where it goes. kennedy: as goes corker so may go flake to thank you for your perspective shannon. president trump seem pleased with judge kavanaugh's performance today and in fact reportedly watched part of the hearings on air force one. kristin fisher is live. >> k kennedy president trump said he was riveted by the hearing. he watched the almost all of it from the white house and he waited until was over to weigh in. minutes after the committee adjourned he tweeted out of support for the nominee and his

disdain for the way the democrats on the judiciary committee treated him. quote judge kavanaugh showed exactly why nominate him. his testimony was powerful honest and riveting to democrats were disgraceful in this process has been a total sham and an effort to delay obstruct and resist. the senate must, must bow. there was a lot of concern in the west wing that judge kavanaugh perhaps wasn't forceful enough in his interview on fox earlier this week. clearly he did not have that problem. also the white house very pleased with senator lindsey graham's performance. kellyanne conway and sara sanders tweeted about it during the hearing. white house press secretary said quote lindsey graham had more decency encouraged in any democrat member combined to god bless him. that was a turning point and so is kavanaugh's opening statement that after many the west wing considered it to be a shaky start because even they can see that dr. ford and a lot of the

testimony was credible. overall kennedy president trump very pleased with judge kavanaugh today. kennedy: her credibility and herb poise is what makes it so tough for some of those senators who are on the fence. i talked to shannon and chat about at moments ago. it's the moderate republicans who feel they are confident enough to vote for judge kavanaugh i think the red state democrats do the same thing to do what is interesting is the diametric turn we have had from this point from yesterday morning when the third accuser came forward. it was heard much from her today? >> haven't heard much from her and a fourth and a fifth accuser one of those accusers remains totally anonymous. the fifth accuser allegedly came out last night in essentially said he apologized and recanted his statement.

a.. rob you are one of the first reporters to publicly question "the rolling stone" uva folks. got a lot of heat for that and it turned out you were right. >> a lot of meant particular young men on campuses who have been falsely accused of sexual assault and it's horrible for them. they told me they wouldn't wish this process on their worst enemy and you could hear the pain in the suffering in their voices. i saw some of that in brett kavanaugh. he was defiant and he was angry the way you would be if you were in that position. kennedy: i think that's what a lot of people said. if i were falsely accused and fighting for my professional life these are the things i would say. this is how i would react and when he talked about his daughter he choked up that something you can't fake. >> on the other hand they think she was very sympathetic and credible and convincing as well.

it's a very tough situation frankly. kennedy: i don't know what it comes down to but i will say this, as i was watching i thought to myself here's a person who has no incentive to just make something up out of nowhere. she's got a very bright or personal career and she has a family and a reputation. no wonder she didn't want to be named and she wanted to remain anonymous. given all of that i think she did come off credibly. >> i agree with you kennedy. she had spoken about her kurds are being annihilated. annihilated was the word she used and she uses in her testimony today. she has no motivation. the idea that she remember something very clearly and other details not so clearly is not so unusual and sexual assault. i think both of these folks had their lives destroyed in some way and this is terrifying and

politics. kennedy: i think that's important it's also why judge kavanaugh said we have no ill will for you. my family has no ill will for you but it does boil down to some very important legal facts. with any of that cleared up today? >> no and as it was repeated over and over this was a trial. the only word that comes to me is heartbreaking. i think we have two people who are victims here. both have been victimized by a process. everyone a new in their gut this was not right. as an accuser and accused and serious allegations being put on trial on live television in front of millions of people with no due process. the point was to figure out the voracity. we know nothing now that we knew before. two witnesses who are credible

when corroborated and one did not corroborate. we learned about the high school yearbook. kennedy: that's when judge kavanaugh became very defiant. he wants to talk about when i was 15 years old and in my yearbook. go ahead. >> it's relative to his idea when he's a teenager surrounded the time. the problem here is that we only have -- we don't have an investigation at the huge disservice to both of those people. >> we are never going to get a process when they had to stop every five minutes. kennedy: i don't think they anticipated that. you are given essentially days. >> that didn't work at all. >> i love her. i respected what she did and i

kennedy: the democratic race casting them before the hearing you miss her. the california senator kamala harris purchased over 3000 facebook as leading up to the hearing and concluded with a link to donate money. here's a the story by fellow democrats wide senator mazie hirono. she said the fund-raiser e-mail to supporters 30 minutes into the hearing probably with the list. senator hirono has since apologized after being called up for the shameless money grab but of course senator harris has yet to respond to similar criticism. democrats have been screaming for weeks that republicans don't care about the alleged victim in this case but should they use some of that fund-raising money to buy a mirror? >> hey kennedy some residents in palo alto where dr. ford lives now rally just outside of stanford university in support of her this weekend before hearing her testify today before the senate judiciary committee. hundreds of residents attended a candlelight vigil supporting her but ford was not the only one facing questions today. california senator dianne feinstein was under scrutiny to ford first approached with a written letter counting the alleged assault. feinstein facing questions from senate colleagues about how ford's name in a confidential letter leaked in the first place. >> i believe what you just said. can you tell us that your staff did not leak it? >> i don't believe my staff would leak it. i have not asked that question directly. >> do you know back? how in the world that give the hands of the press? >> the answer is no. >> have you asked your staff?

spending a lot of time talking about the allegations. kennedy: we are and i take fault with republicans and democrats are made up their mind before they saw both of these people testify. the problem with that is if you abari made up your mind you are totally closed and something that might be incredibly relevant and important information. the voters here in new york realize that sometimes gillibrand aspirations don't necessarily serve them. >> i think they are certainly discovering that. after all she was known as annie oakley when she was a member of the house she was a blue dog democrat. an a rating from the nra but two years later she ended up with an f rating from the nra. how did that happen in someone who's middle-aged? my issue is she hasn't done anything for new york. her 12 years she has passed one bill all while hemorrhaging

the fbi is a political job at some point that people need to vote on it. kennedy: let's say susan collins and lisa murkowski do in fact vote yes and jeff flake and bob corker said he's going to vote yes for judge kavanagh. if joe manchin and john tester and heidi heitkamp, if they all vote yes what happens to their political careers? >> i think the democratic base wanted an investigation and i don't think they thought to the hearing. they are if they did and if they didn't. there will be payment for that. 40% of the electorate may be voting against them. kennedy: maybe it's not the worst in the world for democrats if judge kavanagh's conference. >> he will be on the supreme

court which democrats certainly don't want. kennedy: short-term for democrats is good and long term is bad because these young jurists could shape the supreme court for decades. here is one of the problems that i have. democrats are saying they want an fbi investigation. they want the fbi to investigate they want the fbi. we heard from the fbi but also by the same token what they are saying is the fbi has done such a bad job for the last 26 years that they have missed all of these potential red flags in judge kavanagh's past. can you have it both ways? >> no you can't have an fbi investigation now when you had confidential investigations and the democrats refuse to participate which i think was a huge disservice to ford. one of the things i find particularly insulting and how people are saying what an

empowering thing for women. everything that happened today would turn someone off from coming forward. you had a woman with very serious accusations who was betrayed by one democratic office. we don't know which one it was. she felt victimized by the media. the democrats did not show up to the investigations that were happening and now she has to appear on national television and she's getting death threats. nothing about this is empowering. >> the sentiment that lindsey graham made his absolute certainty that this is wrong but that this has been such a low and despicable moment for us as a nation politically i think is true. i'm not sure anyone is going to benefit politically in the short term or the long term. i think this makes everyone know --

on the list aside from amy -- amy coney-barrett. you think she still remains at the top? >> she certainly does for me and for all those who are considering she is very, very good, very intelligent, very presentable and would make an excellent justice. if the president could avoid this particular slur by appointing a woman like amy sadly i think they would decide to make something else up. kennedy: they absolutely well and they have already started and democrats have to be careful what they wish for. obviously this has been an emotional day. there are senators on the fence. do you think judge kavanagh will be confirmed? >> i do think you'll be confirmed because in the end republicans senators will look at that and say they are both compelling but we believe judge kavanagh. no republicans senator has said
